The operators at NVC are more knowledgeable than those at the USCIS misinformation line but Gabrielle is misspeculating and is simply wrong.  Still, no harm filing the I-864.

My AOS with 864ez was reviewed and accepted by the NVC.

 

I had, 

Interest income

Dividend income

State and Local taxes refund income

Capital gain income

 

besides my w-2 income which was used to qualify for the AOS.

No it's true.  The NVC does not okay the end result, merely checks your paperwork for correctness to make the consular officer's job easier.  If the Consular officer decides you should have submitted an I-864 instead of the I-864EZ they'll issue a 221g and say that, even if the NVC has okay'd he document.  

 

It truly is not over until the beneficiary is in the USA with an approved visa.  Even then there's the issue of getting the green card... There may be the issue of removal of conditions (something my husband is not taking seriously either.) 

I don't disagree. It's not even over at the consulate as you mentioned, the POE officer has the final say and even after that...

 

My concern with the post was, someone had an "ok" from the NVC in this scenario. Now based on the posters reading of the instructions this was wrong; in that case have something to back it up (previous example or anyting). Other then well maybe the consular officer will find that you didn't fully disclose (by filling the wrong form!). 

 

Anyways, the reason for my post is that people on this forum take you senior posters (with all those hearts under you picture) words very seriously. We all really appreciate your dedication and willingness to help strangers. It's truly a great thing you guys do. People make decisions based on the input they receive, and in this scenario I didn't see the need to scare someone into thinking they did something wrong. Or for someone who could have qualified for i-864ez to fill out a more complicated i864 that could lead to mistakes and additional delays for their loved ones.

 I864-EZ worked for my case.
 
However after reading all instructions I think that "Darnel" is correct.  I suppose different NVC employers may have different opinions on this and it sending I864 is more safe. I864-EZ worked for me, but doesn't mean that it works for everyone in similar circumstances.

When is it over ? On interview day. The Vice Consul actually adjudicates that I-864, does some math, usually right prior to the interview.

I wish it goes well for you and they not ding you about not having a full disclosure on docs and amounts from the income tax return.







What are you basing your claim on here? No full disclosure, please...

 

Sending copies of 1040s or transcripts, required by 864 or 864ez form, you by definition can't be hiding any income, or not fully disclosing. If you qualify and meet the requirements with your W-2 income alone, having other income doesn't disqualify you. Are you suggesting that if you have any income in the 'Income section' of 1040 other than  line 7, you don't qualify?

 

Plus the comment about the NVC approving a AOS and it being overruled. I am not saying it doesn't happen, but you think the guys whose job is to look at AOS all day and do nothing but approve them at the NVC don't know the rules?! 

 

Making statements like "eh - it ain't over till it's over."  you should have more to back it up.

Still not understanding of i864ez and i864.

Single person being sponsored on the I-130?

Are you filling alone? w/o any joint sponsors

Are your incomes salary based? No self-employment / business / rental income / other types of income being used to meet the poverty requirement. (W-2 has to be primary source of income being used to qualify)

You are not using any assets to qualify

 

If all the above are true you qualify to file a 864ez.

called NVC; having 1099s do not disqualify you from the i-864ez.  the only condition is that these 1099s are not used to help you qualify and instead you are using income from W2's. 

 

If you send a copy of your 1040 instead of a tax transcript, they do request copies of the W2's+1099s.  This is listed in the instructions,

 

"If you provide a photocopy of your tax return(s), you must

include a copy of each and every Form W-2 and Form 1099
that relates to your return(s). Do not include copies of these
Forms if you provide an IRS transcript of your return(s) rather
than a photocopy."

 

I agree with you dirk_diggler. The requirement clearly states the income you are "using to qualify" MUST come from W-2s. Heck most people have 1099s from their state refund from the year earlier, requiring that NO INCOME other than W-2 shall be present on the tax return would be pointless. Nobody would qualify!!

 

We'll have another data point, I filed 864-ez and I had Interest, Dividend, and capital gains income on my 2013 1040.

No they are not the same.

 

Use the number on the tax return that was filled, not the w-2 form that an employer provides.

I just receive a checklist from Nvc it says

__________ income indicated on the I-864EZ Part 19 does not correspond to that shown on the most recent tax return and W-2(s).

I just copied what's on my W2?? am I doing something wrong?? does it have to be what's on my 1040? I gave my w2's for 2010,2011 & 2012.

They advised me that since my case is complete I have to send a new copy of filled out I864EZ to my husband for his interview. Has anyone have this issue before?





You need to report the 1040 income on that item:

 

if you filed a 1040 (or 1040A), then use total income, and if you filed a 1040EZ, then use adjusted gross income.

If you didn't make any income in the last 3 years, how will you support your beneficiary? It's about time you start thinking of another sponsor to assist you in filling I-864A.

1 - You should complete the I-864 with your letter stating you didn't file any ITR.
2 - Include an I-864A that you and the person with income will both sign. Make sure this person includes their last 3 years tax returns.

Don't take a chance of Visa denial by simply submitting your I-864 and letter. Submit 1 and 2 above.

Im kinda confused here.. Fist I file the I-864 along with the letter of attachment that the IRS didn't require me any ITR because I did not have a job for the past 3 years.. so what will my cousin (sponsor) fill out now? is it I-864 or I-864A? Thanks in advance!

No, we did not file a separate petition because my husband asked a lawyer before sending the i 130. The lawyer said that our petition serves as one since we put my child's name on the form for question, name of person who will accompany you to the us now.

All immigrant visa applicants are required to submit a police certificate for the country of nationality; they must also submit a police certificate for their current country of their residence, if they have resided there (country of nationality and country of their residence) for six months or more after the age of 16. Finally, they are required to submit a police certificate for any other country in which they have resided for one year or more after the age of 16.

Is it strict at Taiwan consulate?
One question: these document would be reviewed at taiwan's consulate, rather than NVC?

So if taiwan's consulate is not strict on this, I could still file it before extension deadline.
I just worried if this approach would incur some concern and request 2012 tax return. it will delay my wife's green card application.

We got married at 12/30 of 2012. She is Taiwan citizen and has income in Taiwan for the whole 2012. She didn't have SSN or taxID.
I will double check with my CPA for married filled jointly or married filled separately as Atm suggested.

I already paid the estimated tax to IRS for 2012 return as single, since i am nor sure if my wife could get the SSN before extension deadline. Will need to double check if married file separately will affect my tax.
My annual income would be much higher than poverty lines bases on 2009 to 2011 tax return. Annual income would be higher for 2013 if they calculate from my pay stub. The poverty line for a household of 2 is about 20k per year. so this would not be problem.

Hello, I am USC and recently get the NOA2 notice(Notice date: 4/4/2013). Currently, I am trying to get the NVC case number and invoice number in order to submit the I-864 before April 15.
As time approaching, I think I would need to submit I-864 after 4/15. But I am not sure what is the best way to take care the 2012 tax return.

I already extended my 2012 tax return since I want to wait until my wife comes to US and get the SSN so that I can file MFJ to get back some money(several thousand dollars).

My question is following:

Which way is better to submit last three year tax return?
1. Submit 2012(with extension), 2011, 2010, (probably include 2009)
2. Submit 2012(single), 2011, 2010
Amend the 2012 tax return when my wife comes to US.

My CPA told me it may be not good to amend the 2012 tax return especially I change the martial status from Single to Married.
I think her opinion is based on the tax point of view.

For the solution #1, some other VJ member said it is ok to submit the extension.
But I am not sure if my reason of extension is strong enough: want to file MFJ and get some money back.

Which way is better for me, or is there better way for me?
