Hi, I am Miwa's fiancee, using his login.

Just wanted to document my experience at the KL Consular in Malaysia this morning. Today is my interview date and I had to hand in my documents for checking at 9am for my 1.30pm interview.

Reached the consular at 8.15 am and was told to wait till 8.45 am before I could enter. However, as I had to use the washroom, the guards let me in earlier to wait inside. The guards were really friendly and asked me to leave my cellphone and car keys with them. However, I was allowed to keep my documents, books, some reading material from work, house keys, purse, brush and lipstick and the two bags that i had with me.

Took at number at around 8.20am and waited till 9am before my number was called. The consular was filled with people applying for either social visit or business visit pass. As far as I could tell, there were only 3 other people who were there for "immigrant" visas (the classification I fell under for my number taking purposes). 2 were there for green cards and 1 unknown.

Handed my documents at around 9 am. The guy was pretty rude and was quite unlike the other consular staff that I observed during my wait there. I shrugged it off and tried to be friendly. He asked me to take out all the documents from the nicely prepared folder that I did up and I passed him stuffs piece by piece. Towards the end, I asked, "evidence of relationship?" He said, "Just pass a couple of photos"

Since the first piece of paper I got was Miwa's letter of intent (latest) to marry me, I asked if he wanted it. He rudely replied, "No! Just 2-3 photos" I passed him the photos (I had 6 of them) and jokingly asked him to take his pick out of them. He went, "Any other documents?" in the rude tone of his and I handed him my forgotten medical report which was inserted in my x-ray envelope. I was instructed by the doctor to hand the x-ray and medical report (inside in another small envelope) to the consular. But the guy went, "Take it out!" I was surprised and for the first time, opened the x-ray envelope and pass the smaller envelope to him and politely asked him if he wanted the x-ray too. He rudely replied no and told me to wait for them to call my number again. When I asked him if there's anything missing, he asked, "What else do you want to give?" I asked, "Our travel documents, phone bills..." before i could finish, he instructed me to wait for them to call me again.

So I waited.

At 9.30am, I was once again summoned to the window. I was shown the latest forms and was asked, have i seen them? Having seen them online, I said I did (I was confused then). Then he rudely asked, "Then why didn't you give it to us?" I was like, "er... but I didn't get them and was asked to fill in the old ds-156" Then he shoved the entire "packet-3" to me and rudely instructed me to turn the page, "Read it!"

I read it and it was an instruction to download the latest forms from the website (can't remember the url) and I told him that I have never seen that and in my packet 3, I did not receive it. I was confused what he wanted me to do it and handed him back the packet 3. He walked away for a while leaving me at the window and came back with 3 more forms to fill in. 2 of the forms were forms that I filled in when I applied for my social visit pass. He went, "Go away and filled it in and pass it back to me when you are done".

Did that, almost in tears by then as I was already really nervous for my interview day and having been treated quite badly by the guy. I filled in the forms as quickly as I could. One of the questions on the form were like, "do you intend to work in US? If so, fill in the name of your employer" I was like of course i intend to work, so i said yes and not applicable to the second part of the question. Another question was, "How long do you intend to stay in USA?" I ignored the question because I have no idea how long will I be there!

Some of the questions includes info in my passport which by then have been passed on to him. I asked him for it and he was quite rude and gave a long suffering sigh when he passed it to me. I forgot to fill in the back of one of the forms and he went, "You didn't fill this in!" So I quietly went and fill it in.

When all was done, I passed the forms to him. He said, "Come back for your interview at 1.30pm" For clarification sake, I asked if I have to leave the consular office. He went, "Yes! You have to exit here completely!" again in his rude tone.

Gah... for an emotional day, I really don't need to face a person who woke up on the wrong side of the bed!

I am worried about my interview now... It's 11am now and it'll be in a couple of hours time!

Need advice on the following:
1. How to translate the birth certificate? in what format?

2. As for the police report, do you refer to Letter of Good Conduct apply from Ministry of Foreign Affairs Malaysia? For the (2) recent passport size photographs would it be an issue if I have cut the photo align to the FORM alignment?

3. How long would it took for the medical report? Where do you go?

1. I made a direct translation from the birth certificate myself into MS Word. I was born in late 70s and therefore had the notice for small pox immunisation at the back of it. I translated that too but the consular guys didn't even look at it. After it is translated, I got it certified by a commissioner of oaths near my house (they are like everywhere!) by paying RM4 per copy. Good to have extra copies as you may need it later.

2. Safer to get the passport sized photos from any photoshops. Just tell them you need passport sized photos and they will get it done for you. Should not cost more than RM16 for 6 copies.

3. There's only 2 clinics you can go to for the medical report. One in KL and the other in penang. My experience was that with the KL clinic. Scheduled my appointment (they are quite busy and would only be able to fit you with a week in advance notice) and was able to get my report in 3 days. However, the clinic wanted at least a week buffer (from medical appt date to interview date) for cases where they have to send your medical report to the consular. Btw, this is not a good sign as if you have no problems with the medical report, you get to collect it yourself.


The forms for the medical appointment are only provided with Packet 4. Btw, based on my experience with the consular for my interview, it is important for you to download the latest forms, regardless what they say.

I am from Malaysia too. The thing that took the longest (and delayed the sending back stuffs from Packet 3 to the embassy) was the police certificate. It took slightly more than 2 months for us to get it because of the year end holidays.

Btw, your birth certificate would need to be translated (since it's not in English). What I did was to translate it myself and got some commissioner of oaths (paid RM4 per certified copy) to certify it as a true translation. The person at the embassy (i emailed them) said that this was ok.

My interview will be in a week plus time. Wish me luck! Good luck on your visa journey too

Yup, that's what I though too. But Miwa is pretty nervous about the entire thing. I am not able to collect my passport tomorrow (Friday) and he's pretty antsy about it :lol:

oh yeah. I left out the part where the Consular Officer got all serious and asked, " Do you realise what this visa entails? This is a life long thing where you intend to stay in US after moving there and getting married there. It is a permanent thing. Are you aware of the implications. It is FOREVER."

I was like "d-oh, why would I have gone through all the trouble to get a k-1 when I already have my other visitor's visa that's valid for 10 years if I don't intend to stay in the states?" Of course, being the good girl I was, I smiled and said, "Yes."

He warned me further, "This means you are going to US and get married and stay there. This is not for the case whereby you get married there and come back here."

That part was cute!

Hi guys!

I passed and I should be able to get my passport back together with my visa on Friday (assuming that I can get time off from work for that).

My experience for the interview was way more positive than the documents check stage. Anyway, for the benefit of those who will be undergoing the interview process in Malaysia, I shall post what I can remember of my experience there.

Since my interview was at 1.30pm, I reached the consular at 1.10pm and promptly got myself in. The guards, as in the morning, were very friendly and this time round, I already know that I must hand in my cellphone and car key which I did.

Went in to the processing area and was told to wait. No getting of numbers this time as you would have your earlier number with you. The same people who are undergoing the same visa process (2 with husbands in US, 1 couple for green card) were there waiting too.

However, at 2pm, when they started work, they processed some other applicants stuffs but of what, I don't know. There were some US citizens at the consular getting their things done too.

Finally, at 2.30pm, they called my number (I was first because I went really early in the morning). I was pleasantly surprised to get the same consular officer that I did when I went for my social visit pass. He is much friendlier compared to the earlier guy and asked how am I. I replied that i was nervous. He laughed and said, "I don't bite. In fact, none of us bite".

Well, anyway, I was quite nervous by then. Can't remember the exact sequence of questions asked. However, the following questions were asked:
- How did you meet your fiance?
- How long have you known your fiance?
- Tell me about your relationship with him
- What does he do for a living? Describe what exactly he does
- Has he gone to college? Which college?
- Tell me more about where he's from (from birth till now)
- (I told them I was there for Christmas) How are his parents like? Do they like you?
- (showed them a picture taken during Christmas) Identify the people in this picture
- (My FSIL is a Japanese who went there on the same k-1 visa) Who is she? How long has she been there?
- What do you plan to do when you get there? (I am an investment banker, replied that i will like do the same, he said, "I am not worried about you, bankers can get jobs any where!")

He returned my pictures to me (the only thing I submitted as evidence of relationship), kept all the forms, police certificatte, copy of birth certificate and translation, fiance's affidavit of support which came with his letter from employer, 3 salary slips and 1 year tax return. By the way, they scrutinised the evidence for his affidavit of support quite a bit (took some time).

They cancelled my social visit pass (ouch!) and told me that everything looks fine and they will have to keep my passport for a while. I asked till when, and they asked me to return on friday to collect the passport. They did not officially said that I obtained my visa but from the "everything looks fine" statement and that they are keeping my passport for the next few days and did not asked for any more documents, I assume that I passed.

The entire interview took about 15 mins.

But I won't be moving till end May... have loads of things to do in the meanwhile.

Hello,

I am Miwa's fiancee. I obtained my social visit pass (B1/B2) in May 2005 and my fiance, Miwa, applied for the k-1 visa in August 2005. I travelled once to US in Dec 05 and faced no problems when I entered US. However, they asked to see my return ticket and my occupation at the POE. This are standard questions that I faced even before the k-1 application during June 05 visit.

When I went for my k-1 visa interview, they did ask about my B1/B2 visa and asked about the guy I was staying with during my June visit. Other than that (and that they cancelled that visa when they granted me the K-1 visa), nothing really happened.

Thanks for all the great advice and re-assurance. I would like to say, that I tried to be honest without being too detailed, so there's a lot more to the story than just meeting one guy, changing my mind, then meeting another. In my own defense I've been happily single ( no dating, boyfriends, fiance's or anything else) for over 8 years. But the Philippine Country had a way of softening my heart, and I made some poor choices becuz of my love for the Country. I would also like to add that I haven't been asked to marry him yet...I'm just asking if the timeline would be a problem. We met in January online. But face to face in April.
Thanks again to all of you for your great input. The fact that this website is here, to support and lift each other up is really encouraging to me!


Hi, I am from Malaysia, so not sure if your case would be judge the same way as mine since yours would be in a different consulate.

Anyway, although we have known each other for an extremely long time, my husband and I meet in person only in June 05 and we filed for our k-1 in August 05. To make things less complicated, our story to both USCIS and Malaysia consulate is that we meet through friends in June 05. I went for my interview end March 06 and I am now going for my AOS interview in September 06! They did not question the timeline of our relationship and merely requested for photos as evidence when I went for the interview in Malaysia and asked me things about him.

I live in the UK and my fiancee lives in the US and we have just had our K1 approved :D. I have received my forms, checklist etc from the US Embassy and am in the process of completing them.

However I am planning on visiting my fiancee for thanksgiving and I am concerned that I may not be allowed to enter the Us. Is there anything people could suggest that I bring with me to help prove that i plan on returning home and that it is just a holiday. I live with my parents which means no lease or utility bills. Any help would be greatly appreciated as my fiancee is extremely nervous that I wont be allowed to enter.

Just fyi, I visited US after obtaining my Packet 3 (before returning said Packet 3 to the embassy in Malaysia) on my B1/B2 visa. The POE officer just asked to see my return ticket and my occupation, questions which were asked when I entered US earlier (before the K-1 process).

Aqui contesto tus preguntas

1. Al leer en la página del Consulado de Cd. Juárez, solo mencionan un "Paquete 3". ¿En Cd. Juárez no hay que entregar un Paquete 4?

Solo hay un paquete, el paquete de FIANCE (FIANCE PACKET) o paquete 3, ese es el unico paquete que llevaras a Juarez y que te van a regresar si es que te dan la VISA K1

2. Leí también, que no es necestario tener una cita para ir a la entrevista de visas K-1. ¿Es esto cierto? Si es cierto, ¿cuándo se puede ir a la entrevista?

No necesitas cita, puedes ir tan pronto recibas tu carta que incluye las formas del paquete fiance.
Esas formas se enviaran tanto a Estados Unidos como a México, no es necesario recibir las dos, con que uno las reciba, llenenlas y eso es lo que llevaran a Juarez.
Esas mismas formas las puedes descargar por internet en el sitio del consulado de Juarez, las formas no son exactamente iguales, pero no esta de mas que las bajes, para que te des una idea de las cosas que tienes que llenar, asi que te recomiendo que las bajes, pero que esperes a que te lleguen por correo para llenarlas y estes segura de que llevas todo lo que te van a pedir.


3. ¿Que hay en relación a las vacunas? ¿Las aplican en el examen médico? si es así ¿cuánto cuestan?

Las vacunas no son necesarias para fiances, pero te las van a pedir ya que te mudes a estados unidos, para poder hacer tu adjustment of status (oses ya que te cases y apliques para la residencia)
Puedes vacunarte en Juarez, pero en mi caso yo no me las aplique y llegando aca lo hice y solo me pusieron las de MMR (measles, mumps and ruvella), Varicela y Tetanos, pero si tienes records de que ya te las pusieron, llevalos y asi veran que no las necesitas.
Creo que para las mujeres algunas de las vacunas no siempre se pueden aplicar, depende del ciclo menstrual, porque si estas embarazada sin saberlo, eso podria afectar al bebé.
La verdad desconozco el precio de las vacunas

4. ¿Cuánto mas hay que gastar en el examen médico aparte de los 135 USD?

Nada mas 135 dlls, excepto que te pongas las vacunas

5. En algunas partes he leído algo acerca del "Affidavit", pero en la página del Consulado de Cd. Juárez no lo mencionan, ¿necesitamos llenar ese formulario de todas maneras y anexar mas documentos?

Eso lo tiene que hacer el residente de Estados Unidos y lo tiene que llevar a un notario para hacerlo oficial, y lo debes de anexar a tus papeles antes de que vayas a Juarez


6. ¿Hay que llevar traducciones de los documentos que piden?
No, todo puede ser en español o en ingles, te aceptan los documentos ya sea en español o en inglés

7. ¿El Paquete 3 se envía a Cd. Juárez antes de la entrevista ó se entrega el día de la entrevista?

El paquete 3 se lleva a la entrevista y lo entregas ahi.




Otros tips que te voy a dar, que te pueden ser utiles.


Si pueden ir los dos juntos haganlo, no es necesario que tu novio este ahi, pero te ayudara mucho sentir el apoyo. Aunque puede ser dificil para el ya que no puede entrar al consulado el dia de la entrevista, lo que pueden hacer es que te acompañe en la mañana a hacer la fila y que regrese al hotel donde se hospeden, ya que no tiene caso que se quede afuera.
En nuestro caso, yo estuve en la embajada por 11 hrs, y la pobre de Kate se quedo afuera esperando en la calle. Te puedo dar mas tips si es que tu novio decide esperar afuera, para que se puedan "comunicar" ya que no permiten celulares dentro del consulado y la espera es muy larga.

Ve lo mas temprano que puedas a hacer fila al examen medico, mientras mas temprano te formes, mas rapido vas a salir, nosotros nos formamos a las 5 de la mañana, entre a las 6 de la mañana y a las 7:45 ya habia salido.
Otro tip, ese mejor si haces tu examen medico en martes y vas al consulado en miercoles, ya que hay menos gente que si lo hicieras lunes y martes.
Hay dos clinicas, asegurate de ir a la que esta a un lado del consulado, ya que al parecer el trato es mejor y es mucho mas rapido.

No se si esta info te vaya a servir pero por si acaso mejor te digo, si haz probado drogas, asi haya sido una sola vez en tu vida o varias, NO DIGAS QUE LO HICISTE, ya que a menos de que lo hayas hecho algunas semanas antes de tus examenes, no las pueden detectar, pero ya hubo un caso de alguien que por querer ser muy honesto y aceptar que habia probado drogas, le negaron la visa, asi que mejor ni mencionarlo.

Formate aun mas temprano para la entrevista, yo me forme a las 4 de la mañana, y aun asi tardo 11 horas, vas a necesitar mucha paciencia, porque no puedes entrar con nada, no celulares, no ipods, solo tus papeles y dinero, lleva un poco de dinero extra para comer algo ahi dentro. Trata de identificar quienes van a hacer el tramite de la K1, eso puede ser muy bueno porque al menos tendras compañia. Si puedes contactar a alguna otra pareja que este tramitando mas o menos en los mismos dias que tu, seria bueno que vayan juntos, de verdad no sabes como vas a agradecer el no estar sola ahi.

Cuidado con los Taxis, van a preguntarte en que hotel te hospedas y te ofreceran llevarte a otro hotel diciendote que es lo mas conveniente, NO LES CREAS, ellos tienen tratos con los hoteles y no siempre te van a ofrecer la mejor opcion.
Nosotros nos hospedamos en el Holiday inn Lincoln, y la verdad fue la mejor decision, el hotel es sencillo pero bonito y te permite dejar de pensar en el proceso, el stress te puede afectar.
El holiday inn esta solo a una cuadra y media del consulado asi que bien vale la pena la caminada. Ademas de que no esta tan caro y puedes hacer la reservacion on line.



Hmmm creo que es todo lo que se me ocurre al momento, pero de verdad, si quieres mas tips o tienes dudas o simplemente quieres platicar con alguien que te pueda ayudar, contactanos. Este proceso puede ser mas facil si tienes alguien que te pueda echar la mano.

Hi...here is information regarding travel clearance of a minor in the Philippines:

"A travel clearance from the DSWD is not required by a minor traveling to a foreign country with both or either parents or with his/her solo parent or legal guardian. ". So, your fiance can bring her son without a travel clearance since her son is traveling with her..as amended

that requirement shows what the government of the Philippines requires for minor children to travel abroad. It is not what the US consulate will require to give a visa. You will need either consent of the father or a court order.


Doesn't the OP's fiancee have full custody of her son as stated in her Declaration of Finality of Absolute Nullity of Marriage? Wouldn't this suffice? In my case, I do have full custody of my minor daughter as stated in the Court Decision (Annulment). I also have a Permanent Protection Order relative to R.A. 9262 (Violence Against Women and Their Children Act of 2004) granting me full custody of my daughter; my ex is not allowed by the court to come near us (including my 2 other children) within 200 meters nor even communicate to us directly or indirectly. Would the Consulate still require me to ask the consent of my daughter's father?

Yes, my fiance does have full custody of her son. When her son was born, they weren't married yet. So on the BC, it doesn't state that she's married, however, she told me that on the back of the BC, the father did sign it... My fiance will be calling the consulate in manila today and will be asking about the requierments for her son to be able to come with her.

...And things just keep getting more complicated for me. First is what I've already mentioned, which is her mother being here, the non-legal way. Now the other is regarding her son. Since they recently went through a "Decleration of Anulity of Marriage," I had thought that she has full custody of her son. Well she does, but the biological father can still fight for custody if he chooses to. Now, since we don't want to leave her son back in P.I, and want to bring him here, we would need his biological father to sign a consent for his son to travel with his mother, my fiance. I myself want everything to be done legally, but it would appear that the biological father is unwilling to sign the consent (more headaches for me). Our plan, after we get married, is for me to adopt her son. I've read in other forums that I can later use the K4 visa to bring him here with us.

This would be my question(s).

1. In the I-129F, it asks for the name of children that my fiance has, and I presume that I would put it there?

2. In the actual interview of my fiance (at the embassy in manila), would they still need the travel consent even if we plan to take her son with us at a later point? (hopefully the adoption goes through before the K2 visa expires).

I hope that I made this as clear as possible.

They allow cosponsors for IR1/CR1 but not for K1/K3

The best thing to do is to get verification from the immigration visa section at the consulate in Manila. It would be better to know now than to be told at the interview.

Assuming he finds it, won't the OP's gainful employment be more important than his 2005 tax return? This is the I-134 we are talking about here - not the I-864.


You are correct. They generally do not accept cosponsors at the consulate in Manila. I know of no K visas that successfully used a cosponsor in Manila.




I haven't asked the embassy in manila, but when reading other visa/immigration forums regarding the K1 and co-sponsors, co-sponsors were sucessfully used.

Who are the co-sponsors? Certainly, you have made it clear that you do not qualify with respect to the minimum poverty line of income. You will need some co-sponsor help on this. Your choice, but you should have the job for more than a day, prior to filing the I-129F. Your choice though, if you have good co-sponsors.

I have 3 co-sponsors, one is a Single nurse (no kids). The other 2 are nursing assistans. One is single with no kids, and the other is a single mother. I hope they can qualify because I alone do not.

For question 3 about needing permission from your fiance's son's father. Were you talking about needing permision for the son to come here or the ex to come here? If it was refering to your son then my answer is correct. If you were talking about her ex coming here then Williams answer is the right one.




Sorry of my question being a little confusing. I was talking about persmission from the father, for their son to come here with his mother, my fiance.

Thank you for the answers guys. It's helped me to decide about getting a lawyer. I wasn't thinking of getting one first, but seeing as some issues are possible red flags, I dont want the risk of denial from the embassy. Thanks guys.

Hello Everyone,

I've been reading a lot of the threads here but I couldn't find an answer to my own question.

This is my situation. My fiance, who's in the Philippines, just recently got her anulment finished. But I guess it wasn't just any type of anulment. They called it "Anulity of Marriage" (which i think is the same thing as anulment), but her explaination is that it means that the marriage never happened. This is what happened with her marriage. About 7 years ago, her and her ex-husband got married. When they filed for the anulment, they needed a real good reason why they were going to file one (The Philippines is not a place to easily get an anulment or divorce). And when they dug up their past, they found out that the whole marriage wasn't even suppose to happen. The person conducting the ceremony was not the same person as was stated in the marriage contract because the person who performed the ceremony had an expired license (to marry people). Basicly, he fooled them into thinking he was a legit person. So on those grounds, the court recently, August of 2006, declared the anulity of marriage.
Upon reading the I129F, it doesn't ask for a documentain of anulity of marriage. And all it ask is for a Divorce Decree, or legal documents that the marriage was properly terminated.

How should I answer this question? Should I even answer it all? Or just put that she's single (which she is) and just provide the anulity of marriage certificate if asked?

Another question: Her mother is here in the states, and coicidencially, in the same town as I am. However, she arrived here through a visitors visa, but never went back home. So she's been here for around 5 years.

Will her mothers situation of being here illegaly cause a red flag on us?

Evidence of the relationship : While in the Philippines, I wasn't searching for anyone, but now it just happens that I've found someone that I want to marry and be with for the rest of my life. Now that I'm back here in California, I find out that we needed lots of pictures, taken at well known landmarks, with dates on them. And even traveling tickets, and things like that. I was in the Philippines because of school, so we didn't get to do any traveling. The pictures that we did take were taken on a cell phone, and maybe a few, less than 5. The way we communicate now is through txt messages, via Chikka.com, yahoo chat, and calling her (using phone cards all the time). Will this be enough to show our for our relationship? I will be going back to the Philippines when she gets interviewed for her visa.

About her son: Do I need to have/prove that I've met her son (pictures)? I have met her son, and spent time with him, but never took pictures with him.

I disagree about calling the congressman just yet, my noa was recieved dec 16 and arrived to manila jan 11. i would say give it 2 more weeks before involving a congressman, I am very sure it will turn up by then



ok thank you ryecatcher, but I want to add that NVC sent petition on Feb 1st. I did call Washington DC, one up on NVC and the lady there told me that my case number shows Manila recieved on Feb 17th... but still makes me wonder why Manila Emabssy dont recognize my case number . I will call manila a few times a week and see what materializes in next two weeks.

I have been calling the embassy in Manila with my case number, but each time they tell me they have received nothing yet. And call back again.

I called NVC 3 times and they tell me petition was sent Febuary 1st, same as date on my letter from them.

NVC stated they shipped DHL and also electronically filed.

As I look at other time lines (Philippines only), I see 10 days being long and 4 days fast for this petition to arrive to Us Embassy in Manila.

Manila says we dont have your file, please call back.

NVC says they need something in writing from Embassy stating petition never arrived.

I cant seem to get help from either side. I do in fact have a case number MNL2006******.

Any comments on what I can do about this, or what maybe happened with petition would be greatly appreciated.

I'd say it's time to call your congressman and ask for help in tracking it down.


I did call another phone number in Washington DC and they, with my case number, state that Manila received petition Feb 17th. Wow!, I hope so. I will give a little more time for Manila to recognize it. Thanks John and Marlene

Hi everyone, I would like to know how to fill up the EMPLOYMENT question portion regarding the forms G-325 (Question in Employment last five years) & I-134 (Question #7), if I have TWO jobs (One is a full-time job and the other is a part-time job) available as of now. What is the correct procedure when filling up the Employment Question part about having 2 jobs?


For instance:

~ In G-325, column part of "Applicant's employment last five year," should I mark Present Times in the Month/Year column boxes, as I put the second job title in the 2nd bottom-row listings?

~ In I-134, "Question #7," should I mention or answer all the blanks by listing the 2 job info's about my work?

You're positive it was that they couldn't prove the relationship? Perhaps I'm misunderstanding what I've bolded above but were pictures included of a wedding ceremony between them? Was there an assumption they were already married at all? It wouldn't be the first time that we've seen a "non-legal" ceremony cause problems at the Embassy.

Pictures of a wedding ceremony prove that a marriage exists (already proved by the marriage certificate), they do not prove that the marriage is bonafide.

Nor do phone calls prove that a marriage is bonafide - they only show that someone may be willing to talk a lot if it will help get them into the USA.

What's next is consult with an immigration attorney to discuss the details of the case and get advice on what additional evidence the couple may have that would be useful given their circumstances.

the fiance petiton has been sent back to NVC per delhi embassy but no one knows, including NVC where the petition is. it has been more than a month

Make sure that they still continue to track the old petition as well. I have heard cases where an old petition ignored can cause problems.

we contacted the congresswoman zoe lofgran. her office advised us to file another petition. the embassy says that your petiotion has been returned to usa. thats why they can't answer any thing.
the old petition can take several months or longer, to be looked at by California service center.the petitoner just visited his fiancee in india and stayed there for a month. the new petition has been filed by an attorney. she also advised to file new petition.
