We're still at the USCIS stage, but even at this stage we're hoping to beat some speed records going through NVC. We're currently gathering all the info and documents for the NVC stage, but I have a question.

In people's profiles, I see some use regular mail, while others seem to only be using email and electronic filing. Can all filing with the NVC be done electronically or through email? And if so, how/when do we opt for this? Are these specific countries only for which this is an option?


Electronic processing is only available to certain countries. China and Canada are one of them.

Hello all,

I'm getting ready to mail out our I-130 pack to the Chicago lock box. Please let me know if I'm missing anything.

To give you some background, I am a US citizen living in Japan. I married my husband, a Japanese citizen, nearly two years ago. He flew in for our wedding in America and I flew back to Japan with him in 2010 to live.

Please tell me if this is complete.

a. Cover letter
b. Form I-130
c. US citizen G-325 form
d. Immigrant G-325 form
e. Copy of US citizen passport (ID page only)
f. Copy of immigrant passport (ID page only) with second paper attached for English translation
g. Copy of US citizen birth certificate
h. Copy US citizen residence card in Japan
i. Check for $420 made out to U.S. Department of Homeland Security
j. US citizen photo
k. Immigrant photo
l. Copy of marriage certificate
m. Proof of relationship, all included in one big binder and with a table of contents:
- A written history of how we met and how our relationship developed (1.5 pages)
- A huge amount of emails showing contact between us from 2007-now (probably 200 emails in there)
- 10 pictures, including from our wedding and both of us with our families
- Copies of flight confirmation emails
- Copy of recent bank statements with both of our names on them
- Copy of money transfers from my husband's Japanese account to our account in America
- Cards congratulating us on our engagement


Questions:
1. Do I need to include the I-864 Affidavit of Support form at this time?
2. Our emails generally don't include our real names; we do a lot of nickname calling. Does this matter?

You dont need the I-864 at this time, you will send the I-864 to NVC after USCIS approves the petition.

Hi all!

We are almost ready to start the process for the IR1/CR1 visa (what does that stand for anyways?). I've done a lot of research on both CR1 and K3 visas and chose to go for the CR1 because my husband will be a permanent resident as soon as he gets here.

I wanted to know whether or not you used a lawyer and how did it go. Did it make a difference if you had one? Did you feel you needed one if you didn't? Was it enough that you had done your research and gotten help from this website?

You dont need a lawyer, just read the instructions very carefully, most of the questions on the form is self explanatory, most questions are about your personal information. Just make sure to double check the checklist before you send out the packet and make sure you sign where you need to sign, one missed signature can cause a delay (RFE) on your case. Heads up, USCIS CSC is currently processing filers from July 2011. So this means you should get NOA 2 in 5-6 months or some people get it sooner (the lucky ones), it depends on the volume of applicants for the month.

Hi!
First off, I'm so happy for you and your husbands. It gives me hope to see you guys reunited and I can't wait until I get to feel that happy.

My husband and I have been married for six month and we have a 2 month old baby boy.

He was not able to be at the birth of his son and it makes us both so sad that he is missing this special part of his life.

We are almost (financially) ready to file and we want to do it the best possible way so my hubby does not have to miss anymore of our son's life and so we can be together again.

We want to be completely financially ready. I was wondering if you could tell me, other than the initial $420 for the I-130, how much did you spent in total from the time you started the process to the moment he landed on US soil.

We just want to be ready for every step of this process and want nothing to delay it.

Also how did you mail things to him or him to you, like the G-325A for him??? Haiti's post is not exactly famous for its speed or effectiveness....

I'd appreciate any help you could give us.

it seems that everybody and there brother/sister says to place each passport photo in a plastic bag and to attach each photo to a seperate blank page with a staple going through the bag only or to use a paperclip. (and to write your name on the back of each photo)

Do you really think the best location for these photos is behind each 325a form?

I was thinking that BOTH passport photos would be best atached to a single blank page behind the cover page?

so the I-130 packet would go like this:

cover page
one blank page with passport photos attached
1145 with the payment attached
I-130 pages
325a pages
petitioners passport - complete copy for proof of being a USA citizen.
Marraige Certificate with a translation
Photos of us together - wedding photos plus photos of us spending time togeter.
The Passport Pages of all the stamps and visas.(from both of us with the dates of travel printed at the top of each page)

I attached the photo to each G-325 form but I placed it in front of the form. I dont think its a big deal where you put the photos, as long as you send them you should be good, im pretty sure those guys can figure out who owns it, thats why they make you write your name at the back. :thumbs:

I am having three ceremonies as well. The date USCIS is concerned with is the date your marriage is registered which will show on your marriage certificate. Most likely this will be the court marriage.


I agree with this, I had 2 ceremonies, court and church, I used the date we got married in Court and I was approved by USCIS. :thumbs:

As stated by my title my wife had been denied a tourist visa (B2) two times in the past once in 2005 and another one in 2008. I was wondering if this would affect our CR1 process now. At the time she was denied we were not married. I had been living in Dominican Republic since 2000 and actually returned in 2008. That is the last time she attempted the tourist visa attempt in order to come see me. If anyone has any input with this please let me know. In the i130 app I actually forgot about this and answered question #16 which states "Has your relative ever been under immigration proceedings?" We answered no being that the process was never commenced since she didn't meet the requirements. Please let me know what you think I should do regarding our answer to that question if anything or if her two previous apps for a tourist visa will affect her CR1 now. Thanks in advance

Yes you need to get a co-sponsor and you can also use your assets to support the I-864. NVC will not send the documents to the embassy for interview until you provide the affidavit of support.

Hello to all my fellow VJ members,
I do hope all is well as we await our responses from the various agencies.
I have a quick question or three that may be on someone elses mind also.
Is it advisable or recommended to submit new evidences to the Consul through
the NVC when you submit your AOS and other requested documents?
e.g. Additional evidence of ongoing financial support, co-mingling of finances,
correspondence of any kind, receipts from online flower purchases, receipts from
mailing birthday gifts etc.......
Can, or will this delay the NVC process?
Do you think it is worthwhile to do this so that the Consul has this additional information in
your file, in his/her hand, reviewing this evidence before you are in front of them at the interview?
I know others here have done this, and would the case number need to be printed on every document in upper
right corner to maintain consistency and accuracy of file?
Give me your take on this.......pros and cons.

If NVC does not ask for it then just hold on to those documents and bring it on the interview and wait if the CO asks for it.

1) It appears that I can petition with just a copy of the naturalization certificate, which I think should be given to me at the oath ceremony (fingers crossed), and do not need to have a US passport. Please confirm.

2) Please advice what document(s) I should submit that may evidence the bona fides of our marriage ?

1. Yes you can send only the copy of naturalization certificate.

2. Marriage Certificate, Pictures from the wedding and there are many more documents to support the case e.g Document from insurance company showing your spouse as the beneficiary.

What kind of help? You just have to wait, NVC will send you the packet with the interview date and the checklist of what kind of documents you still need to provide. You can call NVC and speak to one of the operators and see if they can look up the interview date. Goodluck on your interview! :thumbs:

You can also request a tax transcript from the IRS anyway its free, so if NVC asks for it you are already prepared most people get a checklist from them requesting for the transcript even if you provide the W2 and 1040 besides that everything is looking good, goodluck! :thumbs:

This may be a stupid question but I'm not sure how to fill in the i864 affidavit of support form. Firstly, my grandmother is going to be a financial sponsor for my wife and I (I am an American citizen and my wife is Vietnamese). It is my understanding that I am the petitioner but I'm confused about how we both fill out our forms.

In part 1. do we both fill in letter e. "I am the first or second of two joint sponsors."? Or do I just fill in a. "I am the petitioner" and my grandma fills in d. "I am the only joint sponsor" on her form? Additionally, as the petitioner but not the sponsor am I correct in assuming that I do not need to fill in parts 4 and 5 (information about the sponsor and the sponsor's household)or as the petitioner am I automatically a sponsor even if my grandma is the one backing us financially on paper for the visa?

Any guidance here would be much appreciated.

Yes you should get a response in 2-3 business days, if you don't hear anything from them, give them a call and speak to one of the operators. :thumbs:

I finally get the NVC number...log in to pay and find this error message:

"This case is in the process of termination. Fee payments and online forms can no longer be accepted. If you believe you have received this message in error, or to resume processing of the case, please contact the NVC immediately."

This process is unreal. Has anyone else seen this error message?

I called and they said a supervisor would look at it, and it "may be resolved" in a week.


It happened to me, it means NVC have not loaded the receipt number in the system yet, give it 2-3 working days. :thumbs:

I'm just wondering at which point my wife's interview date at US Embassy in Tokyo will be assigned. Is it when our case is completed at NVC and sent to Japan?

Also is there enough time between 'case complete' to interview? She wants to travel for 3 weeks.

Once the case is complete in NVC then they will schedule the appointment date, usually its 1-3 months waiting time.

Hello friends,

I am the petitioner for my wife, but the I-130 has not yet been approved. I'm considering moving to a new apartment before my wifey gets here. I obviously know there is a protocol in place to inform USCIS of an address change.

My questions are:

1. Will this further delay our processing?

2. Is it acceptable to just forward all mail to the new address and then make the change later?

3. What if the I-130 gets approved before I potentially move out, do I still need to inform them of the change?

It wont delay the processing, I also moved to a new address while the petition is still at USCIS stage. Just make sure you go to USCIS website and update the address.

After one month of nothing, there are some news, the petition came back because of one mossing doc..
We are not discouraged, just feel sad that it seems taking much longer than we expected. We will send the petition again next week, but here is a question:

The petition itself with all the docs was dated late November 2011, now with this situation, we just want to add the doc missing and send it back..do we need to fill all over again and put the fresh dates?


This doesnt make sense, they dont have to reject and send you back the entire packet. They could have just given you a RFE. If you dont mind me asking, did they charge you with the application fee? If yes, then you will have to pay again.

Has anyone ever heard of getting an extension?

I would like to have more than 90 days before we HAVE TO get married, is that possible? Maybe a waiver or loophole somewhere?

Getting married within the 90 will be OK, but I would like to have more time if possible.


No extensions, for the simple reason that the 90 days isn't supposed to be a trial period.

When you filed the I-129F, you filed a letter of intent, you stated that the purpose for obtaining the visa was to get married, not to get to know someone better...

Our NOA2 has an expiry date of March 15th. What does this date mean? We may not be able to have the interview by then, because the interview date was scheduled less than 2 weeks after we received Packet 4, and my fiancee still needs to go get the medical, which will take another week to process.

I'm guessing it's not a problem, since we have Packet 4, but anyone have any other info? (And I know that some people wait longer than 6-monts after Packet 4 to get interview...)

Using my fiance's login, I received packet 4 on the same day (17 Feb 06) but came home late to see it in the mailbox.

However, the interview date is 28 Feb 06 and I have no idea how I am going to get the translation of my birth certificate notarized, pay for the visa (at RHB) and go for my medical examination (and get the report sent to the embassy before my interview date) whilst having to work crazy 12 hour days (Mon to Fri!).

I'm in the last stage of getting my Malaysian fiancee a K-1 visa (interview date was sched for 2-28, but had to reschedule and now it's 3-28).

You can look at my timeline for some estimate of times, although the time to get NOA2 seems much shorter these days.

You might want to consider doing a DCF, but I believe you will have to spend a minimum of 21 days in Malaysia to get the marriage license, possibly more. That is likely the fastest method, but if NOA2 takes weeks instead of months, then it would change the timeline a bunch too.

Best bet is to file I-129F now, as you have already meet in person. Then go thru the painful process waiting for all the steps.

Other things to note is that it took almost 3 months for her to get her Police Certificate there, and I think you will have to do that no matter which kind of visa you go for.

So, in summary, DCF is potentially fastest, but if they dont let you do that, or are too busy (seems they are busy right now), then you are hosed at that point and have to file a K-3, which takes much longer than a K-1. There are benefits to a K-3, such as getting a work permit upon entry. Read the guides here.

K-1 is likely your safest and best bet. It's a bit painful going thru all the steps, but I think it's the best plan.

I've been to KL 4 times since filing for the K-1, and she came here once at christmas (with lots of proof that she's going back). At least hotels there are cheap. I've stayed at all sorts of 4 and 5 star hotels (staying at the KL Hilton was really nice).

I have been twice to the US in 2005. The first time in June for three weeks and again in September for just under the 90 days coming back at the end of November.

I don't really see this as abusing the VWP but i suppose it depends on the immigration officer.

I would hate to get so close to my fiance in LA and get turned back.


I visitede US in June 05 and went back another time in Dec 05 whilst awaiting for Packet 3.

They just asked me the standard, "How long do you plan to stay?" "What's your job in Kuala Lumpur?" which I went through during my first visit there. Oh, one extra question (went through immigration before collecting my bag), "how many bags do you have with you now?"

I am from Malaysia. Get it from travel agents. Cost of KUL-SFO tickets (Cathay Pac) is RM2140 (without airport taxes), on the website it's like more than RM8k.

Read my post on the interview. That guy was much nicer than the document guy. Yes, the social visit pass interview was much more pleasant than this. For that, my interview was over in less than a couple of minutes and they only looked at my salary slips and letter from my employer. They didn't want to look at the rest of my documents! Moreover, you can get back your passport the next day for the B1/B2 visa. For this k-1, they are keeping my passport for 3 days!

Just wanted to document my experience at the KL Consular in Malaysia this morning. Today is my interview date and I had to hand in my documents for checking at 9am for my 1.30pm interview.

Reached the consular at 8.15 am and was told to wait till 8.45 am before I could enter. However, as I had to use the washroom, the guards let me in earlier to wait inside. The guards were really friendly and asked me to leave my cellphone and car keys with them. However, I was allowed to keep my documents, books, some reading material from work, house keys, purse, brush and lipstick and the two bags that i had with me.

Took at number at around 8.20am and waited till 9am before my number was called. The consular was filled with people applying for either social visit or business visit pass. As far as I could tell, there were only 3 other people who were there for "immigrant" visas (the classification I fell under for my number taking purposes). 2 were there for green cards and 1 unknown.

Handed my documents at around 9 am. The guy was pretty rude and was quite unlike the other consular staff that I observed during my wait there. I shrugged it off and tried to be friendly. He asked me to take out all the documents from the nicely prepared folder that I did up and I passed him stuffs piece by piece. Towards the end, I asked, "evidence of relationship?" He said, "Just pass a couple of photos"

Since the first piece of paper I got was Miwa's letter of intent (latest) to marry me, I asked if he wanted it. He rudely replied, "No! Just 2-3 photos" I passed him the photos (I had 6 of them) and jokingly asked him to take his pick out of them. He went, "Any other documents?" in the rude tone of his and I handed him my forgotten medical report which was inserted in my x-ray envelope. I was instructed by the doctor to hand the x-ray and medical report (inside in another small envelope) to the consular. But the guy went, "Take it out!" I was surprised and for the first time, opened the x-ray envelope and pass the smaller envelope to him and politely asked him if he wanted the x-ray too. He rudely replied no and told me to wait for them to call my number again. When I asked him if there's anything missing, he asked, "What else do you want to give?" I asked, "Our travel documents, phone bills..." before i could finish, he instructed me to wait for them to call me again.

So I waited.

At 9.30am, I was once again summoned to the window. I was shown the latest forms and was asked, have i seen them? Having seen them online, I said I did (I was confused then). Then he rudely asked, "Then why didn't you give it to us?" I was like, "er... but I didn't get them and was asked to fill in the old ds-156" Then he shoved the entire "packet-3" to me and rudely instructed me to turn the page, "Read it!"

I read it and it was an instruction to download the latest forms from the website (can't remember the url) and I told him that I have never seen that and in my packet 3, I did not receive it. I was confused what he wanted me to do it and handed him back the packet 3. He walked away for a while leaving me at the window and came back with 3 more forms to fill in. 2 of the forms were forms that I filled in when I applied for my social visit pass. He went, "Go away and filled it in and pass it back to me when you are done".

Did that, almost in tears by then as I was already really nervous for my interview day and having been treated quite badly by the guy. I filled in the forms as quickly as I could. One of the questions on the form were like, "do you intend to work in US? If so, fill in the name of your employer" I was like of course i intend to work, so i said yes and not applicable to the second part of the question. Another question was, "How long do you intend to stay in USA?" I ignored the question because I have no idea how long will I be there!

Some of the questions includes info in my passport which by then have been passed on to him. I asked him for it and he was quite rude and gave a long suffering sigh when he passed it to me. I forgot to fill in the back of one of the forms and he went, "You didn't fill this in!" So I quietly went and fill it in.

When all was done, I passed the forms to him. He said, "Come back for your interview at 1.30pm" For clarification sake, I asked if I have to leave the consular office. He went, "Yes! You have to exit here completely!" again in his rude tone.

Gah... for an emotional day, I really don't need to face a person who woke up on the wrong side of the bed!

I am worried about my interview now... It's 11am now and it'll be in a couple of hours time!
