I know right! Lol so I call back today as I am 1 day outside the processing frame and they tell me that I am still within normal processing times and they cannot submit a service request at this time. Are you going to call USCIS since the california service center is listing 5 months as their processing time?

I actually spoke with them yesterday and they told me to call back today since I wasn't outside the processing time frame as of yesterday. However now I am 1 day over the processing time so Im supposed to call today and complain so they can do a service request. Aww this really sucks. Hope to have some good news by the end of this week atleast :-)

Long time reader, first time posting in this topic!  I wanted to let you guys know that you gave me hope since I read that January was being processed several weeks ago.  I wanted to inform anybody who was interested, I am an early January filer, noa on 1/10/2013 and I got approved tonight (5/28/2013)!  I'm very excited because the wait has been extremely stressful hahaha.

Hope the info below help fellow Vietnam filers:

7AM in VN, my fiancee was already waiting with hundreds of people standing on the sidewalk
The consulate opened before 8AM, my fiancee and others turned in paperwork, wait for hours and talk among themselves, while other people get interviewed right in front of her, I'll list a few bad stories below...
9:30AM (7:30PM here in CA) I decided to skip dinner, stop by my church and prayed until I hear anything from her.
11:30AM (9:30PM in CA) she called, my prayers were answered!

The Consulate Officer didn't give her any trouble, and the Vietnamese workers there didn't treat her that bad. I guess u just have to appear like u deserve some respect. Also, she probably had her paperwork together well.

Interview took 5 minutes, nothing about me:
- What's jor job? Answer: Marketing, event execution
- What exactly do you do? Answer: blah blah lbah
- Any things else do you do in your job? Answer: blah blah blah
- Can u speak english? Answer: A little but she prefers Vietnamese
- How did you meet? Answer: Website chatroom
- How did you find a friend? She answered that you can pick any nickname in the forum, but that did not satisfy the Officer, after a few tries, she finnally understood the question was that how did she get to chat in that website. She said just go to the website, login, join a chatroom and start chatting.
- How many times your fiancee met? Answer: 7 times
- What situation when you met your fiancee parents? Was it during your wedding (careful here)? Engagement party? Answer: No wedding, no engagement party (no problem), she met my parents when they came back to VN back then.
- Congrats, wish you happiness and success! Visa will be available Mar 27

- Officer did carefully looked at my 1040 tax return and W-2 to find my income (I got pretty decent income for the last few years)
- Officer glanced thru the photos that she brought, didn't touch the timeline, phone records, emails, letters, receipts of sending money, diamond ring, credit card statements proving purchase of airline tickets etc...
- It seemed like the decision has already been made before the interview.

- My package submit to USCIS includes (all color copies):
* First emails showing dates
* A dozen photos from 2000 to 2007 (I went back Oct 2008 after submitting I-129F)
* Some personal letters, greeting cards
* Some remittance receipts, package mailing receipts
* Some airplane tickets
* Copies of passport pages
* Hotel receipts in Singapore trip
* Food and drink receipts in Vietnam for every visit (paid by credit cards w/ my signatures & date)
* Yahoo PC-to-phone calls for 6 months before sending in I-129F
* Rent checks for the room I rent

- My I-134 includes:
* 2008 completed tax form + w-2, prev 4 years tax transcripts (Officer looked at this very carefully)
* Employment verification letter from my work
* 12 month statements from my 2 saving accounts

- My fiancee hired a service to help her with organizing paperwork, they did help alot, however I really made sure she can identify which is which, since things should be chaotic in there, there's no time to read anything. A lot of people in there didn't understand what paper work they're bringing in.

Some things she witnessed in front of her that morning:
- Quite a few people got pinks, but not that many
- Some Husband/wife of 4 5 years w/ children get rejected also ===> marriage & babies are no guarantee
- Consulate officer asked one woman w/ kids: How do you prove this baby is his son/daughter?
- Cases w/ big age difference, low income, or 2 meetings or less, get rejected almost certainly
- Huge amounts of evidence (suit cases full of docs) appear to be of little value, people reeling in tons of papers all got white slip
- Long interrogations all got whites and blues, quick interviews meant pink
- If the officers didn't like the case, they seemed to try to fail the interviews by asking questions like what time does he go to sleep, what location does he call you from, birthday of his parents etc...

Posted times by USCIS from NOA1 to NOA2 is 5 months for fiancee petitions (I-129F) and spouse petitions (I-130). It may not take that long, or it may take longer.

To the best of my knowledge, I know of no rule or law that says you cannot file while she is here.



I went to my local USCIS and used the InfoPass. The immigration officer said that once we get married here, I should file the Adjustment of Status and I-130. I asked her if my wife needs to go back to Manila or Dublin to wait for processing she said no. And also asked where the medical exam and interview will be done. she said itwill be done here. Is this something new?

Reggie--

1) Get married immediately
2) File I-130 as soon as you can to get the CR-1 ball rolling--all you have to wait for is the marriage certificate
3) FORGET anything else--you are still mixing up the process--it is simple, simple, simple--read ONLY about the CR-1
4) In 3 - 6 months you will go to step 2--I-864, I-230, etc
5) She can stay as long as her visa is valid--you will likely be done with the I-130 by then
6) Medical is done in her home country (or Ireland)--not here--

It is really, really easy--read the CR-1 instructions, and have her bring the required documents with her or order them immediately if she doesn't have them in Ireland

Thank you! That really boosted my confidence! Regarding #5 is it OK for her to quit her job already in Ireland before she comes here using her Tourist visa to come here? Might it create any problems during the process?

I loved point #1. That's what we want. :D

We talked about her coming here this October, and since we're undecided on which route (k-1 or Cr-1) to take it has been very stressful especially for me.

If you have evidence of meeting sometime in the last 2 years and the other things in the guide you could file today. The only thing stopping that is her signature is required on the biographic forms. She could visit at any time during the process ( as long as she shows stong ties to where she left from) WIth either path the interview will be either in her home country or the place she is legally residing.



Does this mean that she should not quit her job in Ireland?

The medical and interview CANNOT BE DONE HERE. SHE CANNOT ADJUST IN COUNTRY. Both a fiance visa or a spousal visa require that the person go home for medical and interview. Why not file fiance visa today?

Is it OK for her to stay here using her Tourist Visa as long as it does not expire while waiting for the Fiancee Visa process? I know that she can't stay here after her 6 mo. Visa expires. That I understand.


Ftom what I heard it takes 3 mos at least for the whole fiancee proces and based on the processing times on the UCIS it takes 5 mos for the i-130. We're thinking of her going here first and then when she arrives we file the Fiancee visa. And wait. The interview and medical exams can it be done here? From the form it asked if my fiancee is here and if so asked for her 1-94/95 number and the expiry. does that mean we can file it when she's here? It's just that we want to be together as soon as possible and having her wait outside of the U.S. is too much. : (

A recap of our situation. I'm a US citizen and my fiancee who is a Filipino citizen working in Dublin using an Irish workers visa. She has U.S. Visa and is able to come to the U.S. anytime. We want to get married here once she arrives.

I read up more on the Cr-1 section of the USCIS website and came up with the following:

Eligibility: i'm a U.S. Citizen

How to Bring your Spouse to the United States:

You are a U.S. Citizen and You're spuse is: Inside the United States (through lawful admission or parole) In my fiancee's case she is here legally because of her tourist visa.

How to apply:

File Form I-130, Petition for Alien Relative, and Form I-485, Application to Register Permanent Residence or to Adjust Status, at the same time.

Now it said in the website that she can live and work here while waiing for the petition if I file for a I129-F along with the 1-130.

Weill she be able to stay here while she waits for the I-129F. She will still be able use her Tourist visa till it expires? Will there be enough time before the 129F gets approved? Based on the turn around times on the website the 1-130 takes approx 5 mos.

Regarding the medical exams i think it can be done here already.

Also what are your thoughts on this link?

After we get married i'll file the CR-1 together with the AOS. Am i right?

She can get married in the USA (on day 1 or day 60), but she is not allowed to use her tourist visa with the intention of immigrating.

If you decide to go the K1 route, you can file today. If you decide to go the CR-1 (spousal visa, ie I-130) route, you'd need to get married first- be that in the USA, Dublin or the Philipines- and can apply as soon as you have the marriage cert. If she wants to continue working in Dublin that is fine, she can interview at the US embassy there.



Thank you Ryan and Penguin for the prompt response. She will not use her Tourist visa to immigrate here. My question now is which route is better? The K1 or the CR-1? My plan was to get married the next day she gets here, then apply for the 1-130. Since she entered the U.S. legally using her Tourist Visa then she can stay as long as her visa lets her while waiting for her paper work is being processed right?

Also regarding waht lawyer #1 said about not getting married on day and waiti till day 60 have you guys heard anything about this? he said it's the law.

Yes, mail in HCM is also slow as I've analyzed previous VJ Members to determine the approximate timeline for send and receive (2 weeks). I'm trying to do my best to find any ways that I can to make up some of the time lost. good.gif

Thanks afterforever. Like you said, it's a good sign to finally see the case on the move. I actually emailed the HCM Consulate back on 10/30 to inquire if they received our case because one of the CSC operator had told me that our case skipped NVC and sent to HCM directly. I'm surprise to see that they kept my email and replied back yesterday. I hope you will hear good news and I think once you can find out that they have sent out Packet 3, try and see if you can submit it in person. I'm not sure if Thai Embassy allow you to do that, but I do know that HCM Embassy allow us to pick up the packet as well as return it to their office in person. Once we found out that Packet 3 was mailed out to us, we know we can now go ahead and turn in the DS-230 Part 1 form, which my fiancee will do tomorrow.

Good news this morning. I received an email from HCM Embassy (see below). I've already filled out the form ahead of time so she will submit it directly to the Embassy first thing Monday morning. Hopefully this will save a couple of weeks instead of waiting for the snail mail to arrive. Hopefully we'll get the interview date soon.

From what I've seen, if you get lucky when your NOA2 was approved and the crate is close to being filled up they may just include your NOA2 and send it out. If not then you will have to wait for the next batch (usually 4-5 weeks).

Hi friends! Just wanted to share my great news!
It's already more then 2 weeks since Kiev Embassy got our case (hard copy). We called every day since they got it, but were unable to schedule interview. Today finally we got it! It is DECEMBER, 11 !!!! A week from today!!!
I almost fell of my chair, I never expected it so fast. Statistically Kiev is about 20-40 days from scheduling to actual date. Seems it has changed recently.
Anyway I am very happy!!!!
