K-1 Fiance(e) Visa Process & ProceduresAbout notorization
Hello. Both the G-325A and the "letter of intent" are NOT needed to be notarized. However, you will need to have the I-134 notarized.

I agree. With the Guides provided here and VJ members ready to answer any questions you may have there's no need to hire an attorney to submit your petition. Unless your case is complex. Otherwise, read through the Guides and follow along. Good luck!

K-1 Fiance(e) Visa Process & ProceduresCo-sponsor not allowed
QUOTE (Seattle2Cebu @ Nov 9 2007, 01:57 AM) <{POST_SNAPBACK}>
looks like it might be country specific...

I found this on the net

2) Q: I do not meet the minimum income requirements. Are there any options available to me?
A: Yes, if you can find a qualified co-sponsor, in most cases you can get around the income requirement. However, some U.S. Consulates such as Manila, Philippines will not accept a co-sponsor. The co-sponsor must be able to meet all the government's requirements just as though he or she were the sole sponsor. You must submit all your financial documents as well, even if they do show a low level of income.

Aloha everyone,

Thanks in advance for any help anyone can provide to solve my dilemma. On October 24th, 2007 I went to the interview with my fiancée in Bangkok. I dragged the children (2) on a 5 hour bus ride to Bangkok and Jit's sister as babysitter. I felt I had everything in order but they found a few problems.

I knew my I-134 was deplorable and stressed over it for a month. Then I came across information about using a co-sponsor. Well my father has enough assets for ten fiancées and I felt I had a strong case. I included a letter from an officer of the bank explaining my father's accounts and included how much he had in the bank. His I-134 was signed and notarized just like mine. However, the consular told me I cannot use a co-sponsor for a K-1 visa. I argued I could not find anything that excluded a co-sponsor and that it was within the jurisdiction of the consular approving the visa. Well, they did not buy that and when she went and talked to a senior consular he told her there is no basis in the law to let them accept co-sponsorship. I was completely blown away as I was sure everything was in order. I did not record the webpage where I found out about co-sponsorships and that was a mistake on my part as I would now advise using the mother of all paper trails, Keep every paper associated with this process.

This is where I am and now need to find out if this is true or not. If anyone has info about using a co-sponsor on a K-1 visa please let me know how it is done.

Thanks, AlohaBob

Great find Seattle2Cebu. Yes, I believe that this is country specific as I've also read that the consulate in HCM, Vietnam do accept co-sponsors, BUT with special conditions and that it is rarely approved (less than a 10% chance of approval). It's getting tougher nowadays and they will look into your income more closely.

alohabob, I hope you will find a solution for this and have it resolved. Best of luck!

I haven't had any touches either, since June 27th when they sent NOA1. I just hope that my NOA2 is in the mail, even if the computer email never comes I just want to be approved.

That was exactly how I found out I was approved. No touches, but received snail mail. So it does happen. Good Luck!

I know it's frustrating, but there's not really much you can do but wait. Even when you call them, they will tell you it can "take up to 180 days". In any case, I do hope you will have your NOA2 soon. Good Luck! good.gif

K-1 Fiance(e) Visa Process & ProceduresNOA2 approved - NVC has no info - what is wrong with CSC ??
QUOTE (afterforever @ Nov 14 2007, 08:54 PM) <{POST_SNAPBACK}>
I wonder why they said it take 2-3 weeks to ship your file to HCM. We all know they use DHL and that it only takes 2-3 days to get there. Hopefully it will be sooner rather than later. Good luck Mr2Nice!

Does anyone know if they send out the packet 3 after the embassy receives the electronic file, or do they wait for the actual hardcopy before sending paperwork?

Thanks afterforever, I also thought NVC use DHL from what I've read. Well, nothing surprises me anymore. Just our luck I tell you. One delay after another. I thought getting out of NVC is a good thing, now I find out it takes 2-3 weeks from NVC sent date for them to receive it. Let's see if we catch any breaks when they do receive it.

my K1 was approved 3 weeks ago, after a very long wait. NVC has no info yet. first of all CSC takes too long to process it. it is absurd that they take too long to send it to NVC !!! how long does it take for NVC to get these papers ? i am talking about CSC here. i know they on that "slow path" ? what are my options ?
thanks,

sam

Our case took 5 weeks to get to NVC. NVC forwarded our case to the Consulate on 11/6. I just called the Consulate in HCM and they have not received our physical file yet. They said they received an electronic file on 11/8 and that the physical file will take 2-3 weeks to arrive. wacko.gif

K-1 Fiance(e) Visa Process & ProceduresDo you think USCIS looks at this website?
I would like to believe that they do, but I would have to agree that the adjudicators would less likely to put anymore of their time into this. They would either have to get pay or be at a Manager level to help improve the quality of their system. But I do hope that they do check us out so they can get an idea of what's going on in "our world."

Thanks for the heads up!

I didn't get one either until I emailed them to let them know. They sent me a Replacement Receipt Notice. What's important is the NOA2 because you will need that for the AOS. Good Luck with the process. good.gif

K-1 Fiance(e) Visa Process & Proceduresreceipt and noa 1
Yes, that is your NOA1, also known as the I-797, Notice Of Action. If you look at that notice, you should see your Receipt Number. It should start out with WACxxxxxxxxxx, where x is a 10 digit number. You will need to visit the USCIS Online Website to register and then enter your receipt number into a Portfolio and you will be able to follow-up on your case. Here is the URL:

https://egov.uscis.g.../jsps/login.jsp

Good Luck!

There's no minimum length requiremnt as long as you can describe a timeline of how the two of you met. Try to stay under a page.
