IR-1 / CR-1 Spouse Visa Process & ProceduresK3/Cr1
QUOTE (anish and lijy @ Jan 21 2008, 08:17 PM) <{POST_SNAPBACK}>
CR-1 is not much different that K-3; with K-3 you mainly deal with USCSI and a week or to in NVC(national visa center) and off the Indian Embassy; once you hus/wife comes here then you file an AOS9Adjustment of status) and go through NVC to get a green card and SS#,

Basically with K-3 your hu/wife can’t work right-away when they arrive U.S. have to file for an AOS .. that AOS application is taking longer to process now a days.

With CR-1 your hus/wife get green card within days of arrival in the mail. the passport with act as a green card until the original one arrives.

With the recent delay I don’t know how different k-3 and CR-1 is …

According to the recent press release 1-485 (the form for AOS) is on the backburner

http://www.uscis.gov...ETG_17jan08.pdf

A big difference, K3 is way way way faster But if you are not wealthy enough to pay adjustment of status and if you have a son (child) go with CR1.

it seems many october filers finally received their NOA 1!! congrats.. this is a big relief....

mine was sent to texas, then went to CA, then off to chicago and my receipt came from Vermont.. anyways, mine was sent oct 12. USCIS received it OCT 16 07, and my notice date is JAN 11. check was cashed on JAN 15, got the NOA1 in the mail JAN 16.... I did apply for K3... I guess my best bet is which ever comes first.. we will go on that.. CR1 or K3... God knows..

what happens, if they reject K3 and stick you with the immigrant visa.. I don't understand the steps for a immigrant visa (for my husband) .. I understand how K3 works completely.. but not the i-130 deal.. can anyone break it down for me? thank you I am new to all this..
any help is appreciated!!

God Bless

A little taba at the top of every page here reads "Guides". Please start there and then come back with any question. The current policy is to approve both petitions together and then hold the I-130 until Adjustment of Status, so the chances of sticking you with a CR1 are pretty low. As you read more, though you may wish you weren't getting stuck with the K3.

I don't see how hard is the CR1 visa, infact it's a better visa. You don't have to pay for Adjustment Of Status.....which is cost $1010......ect. ect. But K3 is lesss paperworks for one reason......and get your loveones close to you ASAP. I don't believe on people saying they were HOLDING I-130 when you file I-129F. I called USCIS 3 days ago they said they don't hold any. and today I receive my I-864 bill and DS-3032.

To answer your question, pick which visa you want..........follow the guidelines what they sent to you.

Does anyone know if the NVC is back Logged, similar to what USCIS has been? We received are NOA2 on 12/21/07 but haven't received anything from the NVC.

Just curious, I am tired of waiting already. crying.gif

I receive our NOA2 12/08/07 notice date 12/04/07, I Just got AOS fee bill and DS-3032 choice of address and agent yesterday.
does it make you feel a little better. Don't worry you'll get it soon. I thought I read a thread here before that USCIS send all approve applications once a month to NVC. Goodluck!

IR-1 / CR-1 Spouse Visa Process & ProceduresFee Check
QUOTE (christinejohn @ Feb 23 2008, 01:23 PM) <{POST_SNAPBACK}>
Hello,

Well USCIS deposited the check to be cashed out on the 22nd and it got denied for insufficient funds... then the pay was deposited on the 23rd...
Now that the check has been denied, will they try it again or cancel the petition?
Is there anything I can do about it like resending money another way?
There was the case's number on the back of the check, should I send money using that number?

Any advice would be of great help. Thank you.

Base upon my personal experience, They will send you a letter from USCIS and invoice after......they won't accept personal check from you. Money order or credit card only. They will start the process as soon as they receive the payment.

Looking at your timeline your petitions is not yet approve. How did you get a case number? ....maybe a case number of bank returning your check? I don't know..........but anyway here's the letter..........unfortunately I can't find the invoice copy.

We have stoped processing the above applications or petition or because the check or money order submitted as payment was returned by bank.

you, or the person who wrote the check, will receive an invoice from INS Debt Management Center. The invoice will show why the payment was returned, what you owe, including penalties, and where to send your payment.

We will take no further action on your application or petition until the filing fee, plus all penalties are paid, in full within 14 days, then:
1.............
2.......
3......

If the invoice is not receive in 14 days, or if you have questions about the payment, call 802-288-7600. Wriitten inquiries about the returned payment can be submitted to the address shown below.

Question number 3 asks for current individual annual income. Are they referring to what I've made so far this year? or what I'm expecting to make for the entire year? Please help!!!

I will be making 12 to 15K more than last year (2007) W-2's, because of promotion and salary increase last Jan. 2008. I wrote down my current income right now. How do I figure it out? I look at YTD of my last pay stub plus a number of pay stub I'm going to get this year......

I hope I'm right on this one too.

Plus .......I did have my employeers make a letter......saying how much I make, how long I've been working in the company..and whats my position........

Are you paid an actual salary or paid hourly? If you are paid a salary, how often are you paid, if you are paid hourly, how many hours a week do you on average?

When your employer made up the letter, what figure did they use, an annual figure or hourly?

Are you paid an actual salary or paid hourly? > I got paid hourly.........
how many hours a week do you work on average?> 40 hours a week.............
how often are you paidwork > I got paid Bi-weekly..........means every other friday
My employer use HOURLY

Base on my last pay stub Year To Date, and I counted how many more pay stub until the end of 2008. which is 23 more ........

One more thing, to make it clear ......on my last pay stub year to date. it includes $2000 bonus. EXample: instead of making only $6k my paystub says $8k ...am I right on this? ........

Hey guys,

After waiting about 5 months for a receipt alone from August to December, I can't believe this just happened... I've been APPROVED!!! Being bored and frustrated, I decided to try entering my receipt number into the USCIS website and not only did it work this time, but I just found out that they approved us on February 8th. I can't believe this and I'm in serious shock right. After these people told me it could take 9-10 months because of the delay, I've been approved. Now its time to move on to the next step, which I'm sure I'll have questions on. For everybody still waiting, just hang tough. God works in mysterious ways. He gave us something so wonderful without even expecting it on this Valentine's Day.

IR-1 / CR-1 Spouse Visa Process & ProceduresI am confused CR1 and K3
QUOTE (CaNdiD wiTcH @ Jul 3 2008, 02:51 AM) <{POST_SNAPBACK}>
We filed for both CR1 and K3. The thing is my husband would want to stick in K3 because the process is shorter. I know it is faster than CR1 but I just do not want to have a headache in filing for AOS, EAD, and SSN.

What is the time difference of K3 and CR1?
How long is the AOS process if I will come in US by K3?

Your input would really be a big help..

My timeline for (I-129-F) K3 is

07/20/07 - Mailed to chicago lockbox via USPS mail
07/22/07 - Item was delivered at 10:19am in chicago
07/30/07 - Check in cashed
07/30/07 - NOA1 hard copy received (dated 07/26/07) case at NBC
08/13/07 - Touched (This case is now pending at the office to which it was transferred)
08/20/07 - Receive Hardcopy mail Transferred from MSC to CSC Notice Date: 08/14/07
12/05/07 - Approval Notice Sent (Website and CRIS E-mail)
12/10/07 - Receive NOA2 in the mail
12/26/07 - Receive MNL2007XXXXXX (Assign) case sent to US Embassy Manila.
03/03/08 - Medical at St. Lukes Hospital.
03/10/08 - Iterview at US Embassy Manila
03/05/08 - (called & fax embassy) for cancellation of K3 non immigrant visa.
The time diff. between K3 and CR1 is ......the K3 4 to 5 months faster.
We choose CR1 route coz' we don't want to pay $1010 for AOS, more hassle ...But according to VJ timelines ...it takes 6 months..for the green card to come and She wanted to look for work right away.
Not much diff..... other than for k3 ...you will be with your husband arms 5 months sooner.

WOW this got me confused as well... I re-read the entire form and we're supposed to answer:
- ALL questions on PART 1 and sign PART 1.
- ALL questions except #45 on PART 2.
- DO NOT sign PART 2.

Part2 is pretty clear, it says this at the bottom:
"DO NOT WRITE BELOW THE FOLLOWING LINE
The consular officer will assist you in answering item 45.
DO NOT SIGN this form until instructed to do so by the consular officer"

Just wanted to put my situation here if it helps someone:
We got married Dec 10th 2009. I inquired with our benefits dept and they said that you can add your wife when she moves to the US, since relocation is a "qualifying event". I'm thinking that companies have differing "qualifying events" based on their contracts with the health insurance companies. I'm lucky that was considered b/c I was outside the 30 day window when I inquired! :)

It is very surprising that relocation is NOT considered a "qualifying event" by ALL insurance companies. WHAT's the point if the dependent is not even in the US???

Thanks aussie. always there, huh? :D

Jennieh - don't worry, I'm not going to send things before they're requested... I just want to have the paperwork ready to go so I can have a same-day turnaround when I do get the request. I'm not a patient sort of person! haha.

Tagging on, if I may... Given that for the residences, all it wants is city/town, etc... My wife lived at two different residences in the same city in a row. This seems silly to ask, but should I put two consecutive lines with the same info except for from/to dates (so it's clear they were two separate residences), or should they just all be combined into one line (in the case this is just a checklist for the police reports, it would be easier for them)? I can kinda see it bending both ways and I'm generally lucky enough to pick the wrong one ;) Thanks!
