As I sort and view the advanced timeline for K1, I am focusing on "I-129F Mail to 1st NOA" and I see that many of these are like 1 or 2 days. Some are more, but most are within a week or so. I overnighted my paperwork to NSC on 8-1-06. USPS says they received it on 8-2-06. Its already 8-11-06 and I have checked my mail today.....A GREAT BIG NOTHING!!!

When you update your timelines are you putting the date of I-129F NOA1 from what is written on what you receive in the mail or the date you actually get something in the mail?

Because I'm checking the mail everyday with expectation and getting killed by the disappointment. How can you send it on one day and then have NOA1 the very next day?

My stack of paperwork was almost 2 inches thick. I have so much proof that it should be a slam dunk. I shouldn't have to ask the freakin govt for permission to love and live with this perfect woman for me. It makes me want to sneak her in through Canada. :angry:

I am looking at the NOA1 that I received in the mail and want to make sure of a couple of things.

1) At the top it says I-797C, Notice of Action. It also says Notice Type: Receipt Notice and has the amount we paid. This is NOA1....correct??

2) On the bottom of this notice is the address for the California Service Center, P.O. Box 30111, Laguna Niguel, CA 92607. My envelope is also postmarked from Laguna Niguel, CA. Does this mean that my case has been transferred to CSC already?? No longer at NSC?? Do I have to adjust my timeline?? When I check my status and other timelines do I have to check CSC???

We have been running some stats too, just to try and ease our minds a little. Not sure that it helped. Even though we are Newbies (Only been in the game 28 days so far), we still want to see how close we are to getting that elusive Visa. BTW...anyone come up with any interesting acronyms for the word VISA?? Okay, back to the averages.

So we took all of the petitions that were sent in 2006 and have already received a visa and worked the number of days it took from I-129F Sent - Visa Received. Here's what it shows:

2006 I-129F Sent - Visa Received Average # of days: 148

2006 I-129F Sent - Visa Received Highest # of days: 233 (This would have been 539 but we noticed that Olya & Randy from Uzbekistan has a Visa Received date of 7-31-2007. They must have received their visa next summer. :lol: Wonder how many other mistakes are messin up the timelines?)

2006 I-129F Sent - Visa Received Lowest # of days: 19 (Is that correct? And it's from TSC even. Not VSC. The second lowest is 50...and that is CSC. Something seems fishy. Quickest VSC is 57.)

Since we care mostly about the Philippines...we did some work with those numbers too (there were only 7 total so far in 2006 that received a Visa):

2006 Philippines I-129F Sent - Visa Received Average # of days:189

2006 Philippines I-129F Sent - Visa Received Highest # of days:233

2006 Philippines I-129F Sent - Visa Received Lowest # of days: 174

Since none of those 7 show any from NSC, probably because of the transfer to CSC, I worked the numbers for 2005 through NSC for the Philippines. Sorry if my focus on one wonderful woman in one country loses some people here.

2005 Philippines NSC I-129F Sent - Visa Received Average # of days:242 (2006 doesn't look so bad na.)

2005 Philippines NSC I-129F Sent - Visa Received Highest # of days:341 (I'm beginning to like 2006 numbers much more)

2005 Philippines NSC I-129F Sent - Visa Received Lowest # of days: 147

So I hope this is somewhat encouraging to some people. Truth is....It doesn't really matter. USCIS is not going to look at these numbers to make sure they stay in line. I really don't think they care. We are just another folder with a stack of papers in it. They try to cut out of the office before 5PM. They probably surf the web at work and waste time like the rest of us. Funny....the movie OFFICE SPACE comes to mind right now. Sorry, scary thought.

Oh don't get me wrong, I think the CSC is totally and completely screwed up in the order of approvals. I realize I am many weeks from my approval. But when I start seeing August approvals....you get some hope. You can't help but wonder if your approval will come sooner than expected.

And tell me how I can possibly control what CSC does and "Get back to the back of the queue"? The more approvals per week makes everyone's approval more imminent.

I wonder how many would pass up their approval to give it to someone who has been waiting longer? I wouldn't. I miss my girl so much. I would pay all the money, time, treasure...anything to get approved the fastest way possible.

...no approvals today? Please tell me the wave of approvals at CSC is not over. I am so close...well at least by the numbers that were being put up recently. I was seeing August approvals and I am August 9th for NOA1. If CSC would keep at the pace of the last few weeks, everyone will get approved quicker.

Whatever was done to speed up the process before....can we do that again?? Well....unless it was because of the money that they had to use. But I thought someone said that ends in November.

We sent an e-mail to the embassy to ask if we could get the interview date changed to the week of July 3-7 so we could be together for my birthday and they called her up today and told her the new interview date....it is on July 7, on my birthday. What a wonderful birthday present this will make.

Hi guys, its been 4months since my fiance Vince and i sent our application for a fiance visa and by God's grace we have finally received the NOA1 last April 24, 2006 then followed by the NOA2 on May 11, 2006. However, my concern is how long does it take for the US embassy to mail the first packet to me. I would gladly appreciate if anyone can tell me regarding this question. You only need to get married once to be legally married -- does not matter where. If your K1 does not come through before September, I doubt you would be able to continue your application, since your fiancee will no longer be a fiancee, but your wife.

I would hold off on the marriage plans.

Blue Cross offers insurance for emergencies only..... meaning that you can't just go to the doctor's office with a cold or a minor injury.... but it would cover you if you had a heart attack, got in a car accident or any other emergency type service.

I got it for one month before we were married and it cost us about $150.00 for the month.


What Raymaga proposed sounds like a good option. This type of insurance is often also called catastrophic coverage. You can deal with a cold without a dr's visit, but in case of a major accident, you don't want to end up in hospital without insurance. Even a simple two-day stay can be $15K.

Or have a civil ceremony right after arrival to get on the spouse's health insurance.

even if the fiance(e) is lucky to find a sponsor for a work visa, they need to go back to home country and await visa processing. If you plan to apply for a work visa, then an overstay is not a good idea as it will come into play when consul makes a decision on the new visa.

You can definitely start responding to job postings and sending in applications.

Regarding filling out applications: Depending on how far along you are with the EAD and what area you are looking for a job in (i.e it takes days/weeks/months to get a job), you can do one or two things in response to the question are you authorized to work:

(1) Say yes -- if you think you'd have the EAD by the time the offer comes through

(2) Say "I'm awaiting employment authorization from USCIS, to be received by [give date equal 90 days from USCIS receipt]"


But I would not care about it much -- the job search process is long, and not every application you fill in will turn into a job offer. The only thing you *must* do is present your EAD within 3 days of starting a job. Presumably you would not accept a job without an EAD since you'd be fired 3 days after.

Anything outside of that is not against the law.

Should the visa be denied (which is not likely if all documents and proofs are in order), you can always marry your fiancee in the home country and apply for K3. Good luck and I hope you won't need it.

That does not quite the solve the problem, since the affidavit would only work if the father marries the child's mother after the birth of the child. Since OP has a fiancee petition, this would not work.

I don't believe the OP gave any reasons for the fiancee to be inadmissible. He was more concerned about his previous marriage. Some people here are concerned about fiancee's age. But we obviously cannot read minds (especially of the consular officers), so I guess the OP will find out when the interview comes. So far (to me, and I'm no expert) the situation does not seem dire. Only time can tell.

She's definitely not a dependent -- she's not even related to you (yet).

Don't file as married! You are obviously NOT married, and you may get yourself in trouble both with IRS (misrepresentation) and USCIS (how do you get a K1 approved, if you've indicated you're married?).

Saving some money on taxes is not worth it in your situation.

I mean, yeah, better if they just don't worry about a few months, but circling it and giving you a letter telling you what to fix is spiffy. :) So it sounds like it will be easier for HumanUnit to amend the form. So Cygnet, did you just correct it right on the form, add another attachment with the amendments, file a second corrected form attached to the first, or just sumbit an altogether new one with all the fixes? I ask 'cause it might be helpful for HumanUnit to know what to expect. In the last couple cases, some work might be done ahead of time to be ready. :) HumanUnit, please let us know what minor details about which they are being picky... if they're looking for nits to pick, then we'll make sure the community is ready for them! Yes, that's what I meant. I neglected to tell them where I was for 8 months after my 16th birthday. I started with 16 years and 9 months instead of from EXACTLY 16 years of age.

What they did was encircle the number in red pencil (in my case question 20) and then wrote in their letter that I need to tell them where I lived since turning 16.

I agree with the sentiment here, but I'm not sure if I'd actually do this (as a matter of fact, we are not). They're asking for specific information on the form. If you start giving them things that they didn't request in an effort to "help" them, you might slow down your own process while they have to dig out the information that they actually need from all the cruft that you added to it. I would get as much accurate information as you can and just use continuation sheets. That is what I had to do with our case. It was a pain to get all the information--but better have the info and have the visa approved than receive a denial for lack of information.

not specific for the embassy at all. as far as i know, there aren't any guidelines/suggestions from my embassy regarding what constitutes "good evidence" or whatever. I just want to make sure that there is ample evidence for the CO so that there is as little reason for doubt as possible. I spose it's more of a reflection of who i am than where our interview will be ;) I'd rather have something be someone else's fault than mine :lol: I'm sure that there won't be enough time to go through this all, but who knows which one will be the most useful or which is the magic silver bullet for the CO. So having my bases covered makes me feel a bit more safe about the process. :thumbs: If you were a CO and you saw all that, how much doubt would you have? ;) I also want to make sure that my wife feels confident when she goes for the interview - especially if i can't be with her. I'm sure that you can get away with less (and I'm sure that people will post that they have). As I said... it's just me. :) Luck favors the prepared, right? ttyl,
