Thank you, Mike

I too was hoping my fiancee would be here this Christmas. But with all the delays after another that hope is now gone. Did you get an answer from them regarding your case?

No, I don't think I'd automatically think shorter courtships are a fraud. There are alot of people who get married after knowing each other less than a month and stay married for decades.

If you love someone, why would you want to wait for years to be next to them?

I agree. It's hard to put a timeline on love. Some can love at first sight and other can take years to develope the same kind of love. It's one of those things only your heart will know at that moment.

Hi David-Hien,

I wrote an explanation of how I met my fiancee in a letter that was sent along with the I-129F. The evidence of first time contact was from a phone card. After that it was email exchanges, all written in Vietnamese. Then the rest switched back to phone cards and that has been most of our communications ever since. That was the main reason why I posted this topic because everything prior to 08/2006 I do not exactly have credible evidences when it comes to phone logs because they were all from phone cards which I bought from stores and online. There's no way to proof that I called her. The only thing I have are all the receipts for the ones I bought online.

I've known my fiancee for 3 years now. I didn't want to rush into things so I spent the first 1.5 years to get to know her. In 08/2006 when I felt that we're in love and want to spend our life together I applied for my US Citizenship. Just this past April, 2007 I swore in at the Oath Ceremony and got my Certificate for Naturalization. Thus, I sent in the I-129 in May.

She doesn't know much English so I'm sure the interview will be conducted in Vietnamese and from what I've read on here is a negative thing since she'll be at the mercy of the translator.

Thanks for the advice and I'll make sure she'll bring all the necessary evidences to the interview.

Hello Visao,

The minimum income for 125% poverty guideline for 2 people are $17, 113:

http://travel.state..../info_1327.html

I think if you are well above the 125% guideline then you don't really need to provide other items like assets, bank statement, savings, etc. If you barely made the 125% guideline then they may ask for more.

As for letters, yes you will need to send them back to your fiancee so she can bring them to the interview.

Yes, that's right. I asked my attorney (previous case), but you can ask the Bank make 1 for you incase (you will never know). Make sure in letterhead. btw, can you speak a little bit Viets? because they may interview you (I read somewhere on VJ).

oh wait...i just checked your timeline. From what I understood the embassy is interested in the evidence that would prove that you have an ongoing relationship from the moment of the application for the visa until the moment of the interview. That included phone cards, phone statement (if she ever called you from her home she can present that). You can submit anything that is stamped (postcards, letters). That also includes e-mails, instant messengers and pictures.

I actually have the phone logs from calls made since last 08/2006 to present because that was when I signed up with Lunex Telecom. They send me monthly statement showing calls made to my fiancee's house/cell #. It also shows calls made from my cell #. If the embassy is interested in the time frame from the day I filed the petition until the interview date then I'm not too worry. I'm just worried that from 10/2004 to 07/2006 that I do not have credible evidence for phone logs because everything before 08/2006 I was using phone cards. On top of that, my AT&T online bill only let me download the call logs for the past 18 months period. I'm trying to get the rest of the bill from AT&T and they want to charge me $5 for each month to reprint. I still need an extra 20 months to complete the time that I have known my fiancee. Even if I do get those past 20 months bills, I can only highlight all the 1-800 # from the phone cards, which is not really proof. Not sure what to do. Sigh... sad.gif

I also have gifts receipts for all 3 years of her birthdays/valentines gifts that was delivered to her home. Thank you Neverseen. I think I will do just that, by putting the larger stack of Lunex Telecom on top and the rest of it follows. Just like you, I'm already feeling that butterfly and I still probably have 2 months away until the interview date. I just want to prepare as much as possible.

Over the weekend I went to see my fiancee's aunt to gather information from her such as copies of her Passport, driver license, list of addresses she has lived for the past 5 years, date she immigrated to the US and means of immigration. I got this information from a fellow VJ Member that had gotten a blue slip asking the beneficiary to list all of her relatives living in the U.S. Maybe I'm being a bit paranoid, but I just want to prepare for the worst case.

Hello,

Hopefully someone who have gone through this process with HCMC can help answer this question for me. I am trying to gather as much evidence as possible to prepare for the upcoming interview. Here's a quick recap of my situation:

I met my fiancee in the Fall of 2004 from her aunt living here in the US (only relative). At the time I took the introduction as a friend and did not think anything of it. So, from 10/2004 to 10/2005 I purchased Phone Cards from stores locally. Those were physical cards that I trashed them after each used.

From 11/2005 to 7/2006 I started to make purchases for phone cards online. I was able to print out all of the receipts.

From 08/2006 to Present I signed up with Lunex Telecom and so they were able to mailed me a monthly statement that shows all the calls I've made which included my fiancee's house phone number and cellular number.

My question is can I use those Phone Card receipts prior to 08/2006 to provide to the HCMC as part of evidences? My original thought was that there is no way for them to tell if in fact I made those calls to my fiancee since my Phone Bill only showed the 1-888, 1-800, 1-866, etc. numbers and not my fiancee's house number.
I've highlighted all the calls on my phone bills to match up with all of those numbers given from the calling cards. I would say that 90% of our communication is through the phone, where I would call her twice a day and almost everyday.

I'm just not sure if they can be used. It's not enough credible evidence but I'm hoping that when they do see the bill and call logs from Lunex Telecom they can see how much time we spent talking on the phone. Has anyone ever submitted phone cards as evidences and did they believe that you used it to call your SO?

Any input would greatly appreciated. Thanks for reading this.

As above, I think notarized or not notarized is not important. The most important is how your wife would answer to the CO. So, your letter may be a guideline for her to answer only. She must be calm enough to answer exactly each question.

They may not want to read your letter. Which evidence they want to check is up to their idea, not ours.

Hien

Thanks Hien. I will go over the letter with her when I go back.

Why get it notarized? Notarizing it only shows that you signed the document and does not authenticate its validity of the document. Notary Publics only make sure the person who is signing the document, is that person... and thats it. Lots of people mistake them for Lawyers or the County Clerk.

I'm a notary, not a lawyer. So take this with a grain of salt because I'm pulling from memory, not statutes.

The notary should be asking you to acknowledge the contents of the document are accurate to the best of your knowledge, or they should be asking you to swear the contents are true prior to them signing and stamping it. If you read what is in the notary block it will say something along the lines of "This person ____ swore to me this day _____ that the contents of this document are true to the best of their knowledge, etc."

The notary public is a publicly held office. You are just not voted in, the government allows your appointment. If something is falsely notarized the notary or the person can be held accountable. Notaries carry insurance to protect themselves against this. Notaries have the same ability to marry and confirm copies and acknowledge and execute documents just like a clerk of the court. Clerk of courts are notaries. My stamp is as good as his. Notaries have rules they follow as to what they can, and can not, sign.

You are correct the notary is NOT a lawyer, and can not give you advice on the document that you are signing. They can ask that you understand it and they can make sure you are in the correct state of mind to execute that document and they can refuse to notarize. They are not just verifying you are the person signing, they are executing a legal document and ensuring that you acknowledge or swear it is true and correct and are in the correct state of mind to do so.

All that being said... If I were the CO I would still be weary of the notary because I am sure it is easy to fake, or you can just pay off a bad notary to stamp whatever you need.

Thanks Neverseen. Was your letter to the CO notarized?
