All of what you have submitted along the way is reviewed. The CO that is conducting the interview reviews the case prior to the actual interview. If there are items that raise question, or need clarification/confirmation they will seek the clarification during the interview through dialog and reviewing the additional items. If their questions aren't answered to their satisfaction - blue slip requesting such. If they have their questions/concerns answered sufficiently - PINK slip.

You can, and should, submit as much as possible beforehand. Bring the originals to the interview along with even more detailed evidence (for example: you submitted 50 e-mails prior out of 200 total, bring all 200 to the interview) to support your case. They can only decide based on the evidence presented during the entire process. The CO's have a lot of cases to review. What type of decisions would they make if they went into each interview blind??

As Chuck & Kim have said: think like a CO (in HCMC a CO where fraud is a BIG problem) and fill in the gaps and drown them in evidence. When in doubt, send it in. That will bring home the PINK and your fiance. It is worth all the time and work!!!!


Thank you AnhMap for your reply. This is really helpful in my situation. I think I'm getting close to NOA2 and would like to prepare for the next step. Now, would it be ok for my fiancee to go ahead and submit all the secondary evidences along with all the forms that she will need to fill out for Packet #3? I think I will ask my fiancee to go to the HCM Embassy to pick up the packet rather than wait for them to send it. I've read on here that a few VJ members have done that. Right now my concern is really the secondary evidences because I did not submit it orignally. I'm stressing out over this big time. unsure.gif Thanks again.

No, not all blue slips are the same. Each specifically states the required document, supportive evidence that petitioner has to submit or provide to HCMC for further review of the case.

Yes, it's already typed up and ready to issue by CO at the point of interview. Note, the CO didn't just see your case on the day of interview for the first time. He/she has studied or the Vietnamese staffer already studies your case prior to the interview date, then recommend for certain decision (Blue/Green/White or PINK). In my opinion, the interview is the tool to confirm the CO's gut check! If your case is a total "diarrhea", run loose, guess what you'll get? If it's a solid case smile.gif (no pund intended smile.gif) Just relax, it's will come out ok (again, no pund intended)

This was the point I was trying to make and asked in the other thread. My question is how can they issue a Blue Slip or Pink for that matter ahead of time without seeing the evidences at the interview? The Guide on the forums say to bring all the secondary evidences such as emails, letters, phone bills, engagement ring receipt, etc. on the day of the interview. So how are they reviewing the case and plan to give the Pink or Blue slip ahead of time? This is where I am confuse. Could somebody kindly help answer this process? Am I suppose to send the secondary evidences to them along with Packet #3? Thanks.

It's sad to know that some of these Blue Slips may have been made prior to the interview. My question is how can they when they have not seen all of the evidences?? I was under the impression that we gather all of our supporting evidences and to have our fiancees bring them on the interview day. Or am I missing something here?? Are we suppose to send them all of the evidences anytime before the interview? Because I only send out the primary evidences as part of my package (no emails, no letters, no phone bills). I only submitted passport stamps, engagement pictures, airline ticket stubs of trips I've made with her to Nha Trang twice, and bank statements of transaction made while I was in Vietnam. I do have all the secondary evidences which I will bring back for my finacee when she has her interview. That's what I don't get about this entire process. Presuming that all of the evidences are to be brought on the interview day, how can they issue a Blue Slip without seeing the evidences??? Very frustrating and disturbing to hear in my opinion.

From what I've read here on this forum, many VJ who have received Blue slips contacted Marc Ellis (American Immigration attorney) and he was able to help them resolved the issues and attained the Visa.

Yes, you will be able to get these on time with maybe the exception with the IRS Transcript as it takes 3-4 weeks to receive in the mail. I was told you don't need the transcript if you can provide a copy of your most recent (2006) Tax returns, including the W-2.

1. Fill out the I-134 and get it notarized.
2. Have copies of your most recent tax year (2006) filed or IRS Transcript
3. Letter from your Employer stating the Date of employment, Salary paid, whether the position is temporary or permanent

For reassurance, you should also bring back all original documents on this trip and leave them with your fiancee so she can take them to the interview. You don't want to leave anything behind and then come back here to mail out those originals. On a side note, you should also bring back your original Birth Certificate (including your parents if possible). I've seen in some cases they actually want to check and see if your parents and your finacee's parents are related in any way. So it's good to prepare those ahead of time to present to the Consulate just incase they ask.

I will also be going back next month and will bring with me all of the above mentioned.

On the back of your check, look for a Receipt Number that starts with WACxxxxxxxxxx, where x is a 10 digit number.

Then visit this URL to register: https://egov.uscis.g.../jsps/login.jsp

After you registered and logged in, add your Receipt Number (WACxxxxxxxxxx) to your portfolio. From there you can monitor your case 24/7. When you see people say "Touched" it means that the case got updated with a new date under the column Last Updated (mm/dd/yyyy).

Individuals born in Vietnam who need new copies of their Vietnamese birth certificates need to contact the office of the People's Committee of the district where they were born: the district where their mother was then resident according to her Ho Khau. The district People's Committee can issue certified copies of a birth certificate (Ban Sao) based on their records of the original birth certificate. Alternatively, the office may provide an Extract (Trich Luc) of the information in the birth record on file in their office.

If you are not able to obtain a birth certificate because records have been destroyed or the government will not issue one, you must obtain a statement to that effect from the civil registrar's office and submit secondary evidence of birth. Secondary evidence of birth can be old family household registrations, school records, or baptismal certificates.


For your second question. No, you do not need to provide an Affidavit of Single Status if you're the Petitioner, filing for the K-1 Fiance(e) Visa. What you've heard from others are for those that got married to their wives abroad. They would need to show the Affidavit of Single Status in order to get marry in the country where their fiance(e) resides. This could also depends on the Country too.

Hello and welcome. To avoid any future RFE (Request for Evidence) you should provide the as much as possible. I submitted my fiancee's Affidavit of Single Status.

1. Only the beneficiary needs to obtain a police certificate. This can be done after you receive the NOA2.

2. Your fiance will need to obtain an Affidavit of Single Status. You can download the form here: http://www.vietnamco...an-tuyenthe.pdf
Also, you will need a "Letter Of Intent" for each of you. You can see an example of the letter here: http://www.visajourn...r_of_Intent.doc

3. With this one, try and see if you can obtain both of your parents birth certificates. They may or may not ask depending on how much evidences they see that you have a bona fide relationship. But it is good to prepare ahead of time just in case that they do ask. In our case, although my parents and her parents do not share the same last names, I've gathered both of our parents birth certificates including ours as well. In our case, I was introduced to my fiancee by her aunt who lives here in the US. I've also obtained her Aunt's birth certificate. There are many uncertainties when we're dealing with the HCM Consulate so the best advice I can give you is to prepare as much as possible.

Hi visao,

My fiancee lives in Saigon. She made the first call to them and a lady told my fiancee that they only received our case via electronic (11/8) and ask her not to call back until 3 weeks later. A week later I decided to give them a call myself. The day that I called (11/16), they said they received our case early that morning and said they will mail packet 3 to my fiancee in 4-6 weeks. 2 days later I received an email from them that packet 3 was sent out on 11/17. From the email, it stated that my fiancee needs to return the DS-230 Part I asap so that an interview date can be issue. The DS-230 form was already filled out in advance so I wanted my fiancee to drop it off. But they wouldn't allow it and told her to mail it in. I know it takes 2 weeks or more just for the mail to travel within Saigon. She hasn't receive the packet 3 that they've mailed, but we've already mailed back what they asked for. Here's the email from them if you like to see how they process:

Well guess what showed up today!!! kicking.gif A notice from NVC!. They have recieved the petition and within a week will be sending it to HCMC!!!!! I read somewhere about the automated system so I assumed it worked for K1 visas too! Oh well, I was going to call and speak to a live operator on Wednesday if it didn't arrive by then. The notice was dated Nov 16th, so that's 3 weeks. Now the wait to see when HCMC sends Thi her packet 3. Ohhhh I better get my I-134, etc together tooo!!! Now I have stuff to do......

You don't have to worry about it as your case will be forwarded to the NVC first, where it will be assigned a case # and then mailed to HCMC.

Yup. It has a couple more forms in it, about vaccines, about the exam, about the vise fees, about the interview and about how to order everything, and of course the letter.

Looking at NeverSeen's timeline it says packet 3 was received on 09/20. You're looking at close to 3 months from the time of packet 3 and the interview date.

I'm sorry you have to go through this trouble. This isn't right. If anything I would think the less nice hotels would question, but a nice hotel? I don't know what they're thinking. I hope that it doesn't have to resort to that when you head back. I'm not really familiar with the city so I really don't know which hotels will give you a hard time. Maybe some members will be able to help answer.

Same here. For days that we are not out of town I stayed with my finacee and her family. The only night we stayed at a hotel in HCM was on Christmas Eve as we just gotten back from Nha Trang that same day.

We stayed at a few places. The first trip to Nha Trang (my home town) we stayed at Dai Duong Ocean and Dong Phuong 2. On the second trip back to Nha Trang, we stayed at Sofitel VinPearl Resort. In HCM City, we stayed at The Sheraton on Christmas Eve of 2006. Right after Christmas we headed out to Mui Ne and stayed at CoCo Beach Resort for the New Year.

As much as I'd like to be there for the interview I can't because of work. From Jan - Macrh of 2008 my company is going through a reorganization and a lot of projects are on the line. Our interview date will most defintely land within those months where I can't afford to leave (unless I quit my job first or will be let go if I decide to take another trip). Either way I'm in a no win situation unless we get the Pink the first try. If not, then it's going to be tough. I was able to only get 1 week off to travel and that I must be back to work by year's end. So I will be going back there next month for the 3rd within a 1 year span. I chose the week of Christmas to be there. Total amount of time spent altogether for the 3 trips will be 6 weeks. I hope the HCMC realize and understand that it's not that easy for us to just put in a request and leave our jobs. If it's within the country then it's much easier.
