US Embassy and Consulate DiscussionManila Embassy Interview
Happy Happy New Year Everyone!!!

Quick question.

We are very curious and wondering about the move to the states. Just wondering about:

How many boxes you brought over?
How did you ship them?
Any problems with customs?
Did they search through it all?
Did they seize anything?
Was there a limit?
If you had done it differently, how would you do it?
Were you able to bring everything?
Did you have to pay twice for extra on plane (International and then Domestic flights)?

We would like to know your experience.

Thank you!!

K-3 Spouse Visa Process & ProceduresSetting Up Joint bank Account
I was unable to add her to my bank accounts at Wells Fargo and Citibank without her being here. I was able to add her to several credit cards though, they are always happy to send more cards.

Since we both have bank accounts in Uganda, I will probably try to merge our accounts next time I visit.

My landlord here won't even add her to the lease without her being here to sign! I'll probably try to get our landlord there to change the lease when it is up, currently its just in my name.

K-3 Spouse Visa Process & Proceduresvisa petition and filing taxes
I'm still a little confused about this, I plan on filing married, filing jointly

am I correct that:

1) My wife (in Uganda) gets a copy of her Ugandan passport notorized at the American Embassy and sends it to me
- can she have a cerified copy made at the Ugandan Immigration office rather than at the American Embassy?

2) I attach the W-7 along with the copy of her passport when I file my taxes, meaning that I leave the space for here ITIN blank.

or can I just bring the W-7 and passport copy to an IRS office and get it on the spot so I have the number when I file my taxes?

K-3 Spouse Visa Process & ProceduresAn Interview Finally!!!
I've been trying to look into this issue this week as our baby is due in June, and if all goes well my wife will have her interview a few months later.

you need to register the foreign birth: http://travel.state..../birth_593.html

while they state that they can require a DNA test, more evidence, my guess is that's pretty rare.

I plan on filing for a passport for the child immediately so that she can travel without hassle whenever my wife is approved. Unfortunately Uganda does not recognize dual citizenship so she will have to give that up.

Does anyone have any experience bringing a baby to the interview, I'm torn between thinking that it would be great as further proof (I'll be there as well) and a miserable experience for the baby if we end up waiting for hours in some room. It also may be distracting.

The baby is a U.S. citizen, you have to file a report of foreign birth and get the baby a U.S. Passport. Nothing needs to be done with regards to the wife's visa application.

What sucks is that my wife is 4 months pregant and if we dont get the approval soon she wont be able to travel (I believe airlines wont let pregnant women travel after their 6th month of pregancy.

Most will let pregnant women fly right up until the last weeks, for US based airlines, here's a good chart:

http://www.babycente...neral/6976.html

I hope things work out for you, we were also hoping my wife would get here before the baby was born, but it looks like we we won't make it so I'm heading over in about two weeks to be there for the birth in Uganda.

K-3 Spouse Visa Process & ProceduresSeeking for advice- EAD card
This is right -- you can work for whatever company you chose as long as it is in the field of the study.

I would also advise to check off a new card, since this will be a family-based application. Otherwise, if you select renewal, USCIS may start looking for an AOS-based EAD already issued and there would be none.

I think there is an area in the petition where you are asked if you had previously applied for employment authorization from USCIS, and that's where you would mention the OPT EAD.

K-3 Spouse Visa Process & ProceduresH1B visa and marriage
In addition to "K1" adjustment package (I-485 etc), your wife need to file I-130 for you. You can file these together. You also need to do a full medical (not just the vaccination supplement).

Since your H1 will expire in in July, I would file for an EAD too, unless you plan to renew the visa. But it does not seem to make sense to do that. It may also be tricky to do so, once you file for AOS.

I would also consult your company's lawyer, so that they can advise you on this subject also. It gets pretty tricky with travel -- I undestand that once you use the EAD for employment, you cannot use H1 to travel.

BTW -- Your better bet is adjustment of status discussion, not K3, since you'll be going through the AOS process, not a visa process.

K-3 Spouse Visa Process & ProceduresWork for hubby
K3 allows one to travel outside of the US and then come back -- it's really the only advantage over K1. Like K1 holder, your husband would need to file for AOS and EAD.

K-3 Spouse Visa Process & ProceduresWorking in the USA
To make it even shorter, you can put:

"US resident with necessary work authorization"

I've seen people put such notation at the bottom of the resume.
kc456Not TellingRussia2006-02-12 17:35:00
K-3 Spouse Visa Process & ProceduresK3 and working

K3 must apply for EAD after arrival to the US with activated K3. Depending on the district office, it may take a few weeks to up to 3 months.

I believe this is outdated info. All EAD applications are files with the Missouri Service Center, not the district office. Furthermore, "a few weeks" is incorrect. It takes at least 60 days, 75-90 is more like it.

About the other angle -- file for AOS -- and go back to Canada to work, I'd consult an immigration attorney before proceeding. I'm not sure, but it may jeorpadize the AOS application.

As far as I know an approved petition does not guarantee a visa approval. I'd get a second opinion. Perhaps others can comment too, or you can try posting on the Waivers forum.
