A quick story and some good news... First the story... I know a lot of people ask about I-551 stamp entries. I had a really good experience coming back from an oversees trip last week. Instead of just showing the stamp, I laid it all out -- my expired card, the stamp, the duplicate receipt I got (never received NOA1), and NOA2. I also told the officer that I'm a permanent resident and that I have I-751 pending. She simply swiped my card, stamped the passport and let me in, without having me go to secondary inspection, which is what usually happens. I'm not saying this will work for everyone, but wanted to share the experience hoping it will help someone.

Also........ Got my 10 year card today!!!! Even though I'm done for now, I'll stay on these boards hoping to return the favor, because everyone is really great and helpful here. My deepest thanks!! When I talk about this forum to other people I call it our support group for abused immigrants smile.gif

My I-751 took a long time to get approved. While the case was still pending, I called NSC and they submitted an inquiry. They selected as the topic of the inquiry "Non-Delivery of Permanent Resident Card" for some reason -- they said that was the only option available to them. This was on Nov 5, 2007.

On Nov 15, my case was approved and card production ordered. I received the card a week later, end of story, right?

Well, today (Dec 7)I received a response to that original inquiry I made. It said that since my card has been lost, I have to submit I-90. They obviously didn't look at the date of the inquiry and put 2 and 2 together that my case was approved and card sent after I sent my inquiry.

My question is this -- I want to just ignore this notice, since I have my 10-year card now and everything is good. However, I just wanted to know if they somehow cancel the card they sent out in their system when they send out a notice like this? Or am I safe to just ignore the notice and use my 10-year card happily...

I you're a conditional/permanent resident, you can go through the residents/citizens line with your expired card and the I-797. No need to fill out I-94 -- just the customs form.

I also filed in April and never got NOA1 -- only got the Biometrics appointment after getting my congresswoman involved. It seems there was a big problem with CSC during April.

I agree with the other people here that you should not have to pay $600 to get this done. The problem will be getting through to the right people though. As you know, there are three ways to contact USCIS: (1) the national service center (phone number), (2) the service center where you filed (mail), and (3) your local sub-office (in person). The problem is that communication between those three touch points is absolutely horrible, so even with an Infopass appointment at your local suboffice you can't be sure that the correct info will get to the service center where you filed -- which is where it needs to be.

I would also encourage you to contact your local congressperson. They are really helpful with this kind of stuff. And just from my personal experience (could be different for you though) I wouldn't place a lot of hope in getting this fixed on your own. Good luck! good.gif

As long as you filed in time (which you did) and your case is in the USCIS system (call the 1-800 number to confirm and get a receipt number), your permanent residency is automatically extended for a year while they adjudicate your case, so there's no need to worry about your status and ability to work.

However, you can't travel with an expired green card unless you have NOA1 or an I-551 stamp in your passport (through InfoPass). So if you think you'll travel it's definitely recommended to go in for an appointment.

I also recommend, just from my personal experience, to stay on them through phone calls (and maybe an inquiry from your congressperson) if you don't have NOA1 by the time your card expires. Things have a way of falling through the cracks unless you stay on top of them...

You can actually apply for something that's called "extended leave", or something like that. If you know you're going to be out of the country for more than a year, you can apply for this and you'll stay in status (i.e. you won't lose your permanent residency). Maybe someone else on this forum has more details about that, I'm not very familiar with the process.

Your argument makes a lot of sense though -- it IS a lot of money! I guess we're just encouraging you to look at all your options, because you just seem SO close to being done with this process that you should be very certain if you're going to abandon it this close to the finish line.

On the surface your argument makes sense, but look beneath a layer or two and you'll realize that even by lifting the conditions we will LOSE the permanent residency when we live outside the USA for longer than a year. We would have to re-apply for the ENTIRE immigration process again if we want to live here in the future. So, for a somewhat struggling family of 6..throwing $700 odd dollars away on removing conditions for a period of 40 days in order to stay (in-status) seems ridiculous to say the least. I guess I'd rather fly international pregnant on my own with all the kids while my husband is deployed to avoid the penalty if there were one. We just don't have that kind of money to throw around, considering we've moved all these people over 2 continents 4 times in 2 years. It gets expensive!! The immigration Visa itself to move INTO Australia is going to cost $1300. Plus the cost of moving our entire household goods and flying us all back. ARGGGH!!

I do however appreciate everyone's 2cents smile.gif I think I'll just call USCIS and ask them from the horses mouth. I'd hate to not be able to visit my lovely inlaws because of an overstay! LOL

Most I-751s are approved without an interview, so you're won't necessarily get an interview date. However, if you're extension letter is expiring it means your case has been pending for more than a year. I would call the 1-800 number, give them the receipt number that's on the extension letter, and ask them if they have any updates on your case. It's weird that they couldn't give you more information at the Infopass...

I agree with Jesse. As long as you have your parents for co-sponsors you shouldn't be too concern. I know in some country, like Vietnam they're very strict about accepting co-sponsors. Seeing that you're going through UK Consulate that shouldn't be a problem. You'll be fine.

I see. I suppose marriage counsellors are not experts in immigration.

The only rule that I know that relates to 2 years: if you've been married over 2 years by the time USCIS gives you a greencard, you'll receive a 10-year greencard. If you've been married less than 2 years at that point, you'll receive a 2-year "conditional" greencard and will need to apply to lift conditions.

Hi -- I'm not filing yet... but would like to know what role the passport (from your country of citizenship) play in the process. I looked at the documentation requirement (from the back of the USCIS guide), and do not see a passport on the list of documents -- unless I missed it? Only saw that you are required to provide a copy of your GC with N-400 application.

If passport is required, does it have to be unexpired within a particular timeframe, when you file? I'm also reading that people are asked to bring it to the interview -- does it have to be valid at the time?

My passport expires in 2009 around the time I would be eligible to file N-400, and I'd like to know if i need to renew it ahead of time.

I'm not familiar with this, but it would seem odd if you were eligible for a refugee travel document, not being a refuge.
