If you have futher evidence I would keep the western union out. phone records, letters, stuff she send you and also stuff you send her, you can take those envelopes and make copies of them if you can blow them up to actually show her Country Stamp and also the Dates, that will link the communication between both of you, yahoo chat messenger transcrip of your chats, (hmmm keep the juciest stuff out) lol, just kidding, but mostly anything that link both of you together. For places with High fraud showing western union payment may or may not raise eyebrow as the the nature of your relationship, so I would play it safe but of course this is just my 2 cents(disclaimer : based on my personal experience only)

You don't get much problem going through POE. It's nothing more than your Point of Arrival, meaning the 1st place that process your passport, i think a few folks from Dublin get check there as it's treated like a POE. but let assume you are coming to San francisco, SFO will be your POE. if NY then maybe JFK is your POE. Once you arrive at custom, you give the officer the brown envelop he officer will ask you to follow him/her to this room where they will process the papers and issue you the I-94 card, normally they will just staple it to the passport, nothing to worry, Wish you a safe journey.

That process will take too long. IF she doesn't have the records, she can have a couple of the required shots when she goes for the medical, then when she gets here she can takes whatever that's need at the Local civil Surgeon. for form 693 medical supplement when filing AOS.

One little secret I would say, Once your wife gets here, add her to your medical, and find out what's the required shot, then make an appointment at your doctor on your insurance, gets the required vaccination they will ask for, so when you go the the civil surgeon all you have to do is show proof she had those shots already. IT's been awhile but you can IM me if you need more info i can dig for the I693 from India.

I would go with a Cosponsor and also another advantage since he got laid off 3 months ago, if he made more than is required OVER The proverty line, He can send the 2006 tax return to show he made more than the proverty line, along with his assets. Even if everything goes well Still line up a cosponsor as AOS would be around the corner when you move here.

It was kinda the weirdest interview,

Basic questions

how did you guys meet, what work does his fiancee do in the states, they had sent photocopies of his sons birth certificates, they requested to see the original. He mentioned some of the interviewers were very rude to other folks going for their visas, but he had a nice interview and the guy was very gentleman and very professional.

The CO came back a few minutes later and gave him this form saying his purpose for this immigration is for Visa purpose only not Love/Marriage.

Weird they didn't ask him to bring futher documentation, and they kept the original birth certificates of the kids that they had asked to bring at the interview, now the main Question is how to get those documents back.

The CO doesn't even said anything as to why he came up with that decision, they had lots of chats, visit, and the MAIN PROBLEM is the unknown factor WHY

Without the WHY, He had no chance to even explain what kind of misunderstanding, or confusion that brought them to this devastated decision.

Anybody here got a 212a(5)(A) Refusal on their K1

One of my friend's fiance had his interview yesterday and the consulate wrote on the paper, the doesn't beleive their relationship is geniune beside all the evidence and poof submitted.

The consulate asked him only 1 question, how did they meet and that was it, He told them the truth they met at a party at a friend's house.


So she wrote a letter to the consulate and that was their replies.

Thank you for your inquiry regarding the fiancé visa petition filed on behalf of Mr. X.



During the interview, Mr. X failed to submit strong evidence demonstrating that the relationship was entered into for reasons other than to acquire immigration benefits. The consular officer was not convinced that Mr. X and you have a qualifying fiancé relationship. The beneficiary was refused under section 212a(5)(A) of the Immigration and Nationality Act (INA) and the petition will be returned to USCIS. If you would like to pursue this case, you will have to contact the USCIS District Office where the petition was originally accepted.



We regret that we cannot offer a more favorable reply to your inquiry.

Here's the exact reply "WORD FOR WORD" from the consulate.

The principal applicant refers to the petitioner as his girlfriend( Even though it's a made up story, he never mentioned that she was his girlfriend, he told them his fiancee is the petitioner) COMBINED WITH THE STRONG FACIAL RESEMBLANCE BETWEEEN THE PETITION AND THE APPLICANT, The consulate officer beleives that this relationship was formed for immigration purposes.

I've heard of so many reason for the consulate denial, but I have a friend of mine whose K1 got denied at the Haitian Consulate, they sent the paperwork back to NVC, The couple wrote NVC from here and submitted futher proof of their relationship, and this time around without even giving a Second interview

The consulate wrote back to the couple and to NVC, they don't beleive the relationship is geniune and they can see a strong ressemblence even though they don't look like siblings, maybe racist from the consulate part, i guess thinking all black people lookalike, really upseting.
They even accusing the relationship is fraudulent only to obain a visa to migrate to the US.

My friend tried the congressman office but so far no help, they are willing to take a DNA test to establish there's no blood relation between them, from far cousin, uncle or any previous generation relationship.

It took a lot of courage for this man to speak what he had to say for the world to hear. You are eligible to apply for US citizenship 2 years 9 months before your 3 year anniversary of your AOS approval. That date is the date that will show up on your Green Card, even though you may not have received your Green Card, as you long as your AOS interview was approved that's your TIMING SET.

CAUTION

Let say you divorce your US Spouse that Gave you the Green card, (hopefully it's married happily ever after)

You have to wait 4 years and 9 months from the time of your green card approval.

Speeding ticket is not a felony, unless you were under DUI, or some other offences attached to it, Like driving to cone zone, speeding on a school zone that kinda thing, mostly you can pay for the ticket and don't have to go to court. IF YOU WANT TO FIGHT THE CHARGES then you go to cour to plead your case, normally it's the best options as the cops sometimes are too busy and don't even show up, IF YOU ARE LUCKY and the cop don't show up it's an AUTOMATIC dismissal of the ticket. It's the same in NEW YORK< same in California, I don't know about the law in Colorado, But if you have already paid the ticket and go to court and your case is Dimiss then you are even entitled to a Refund.

Don't worry, there's a Huge backlog for passport to the point that the govt have decided to suspend the requirement for us citizen traveling to Mexico and Canada, Now once you have the receipt that you have applied for the passport it's enough to travel to canada and mexico with just your driver's license or something like that.

If you are not a USC it will take much longer. She would have to go back to her country in order for you to file for her
2) she would need to get a waiver for that overstay because she might get a 10 year ban

3) It takes much longer for green card petition compare to USC, if she goes back you can petition for her, than upgrade your petition after you become a USC but it's very risky since she's already into trouble with immigration with the visa overstayed.

Sorry to hear things didn't work out, Just be Honest, like the earlier post mentioned, the worst thing that can happen, they will tell you wait 5 years until you can fill out another N-400 citizenship, times fly, you have already completed 3 years, so basically you are less than 1year 9 months away from filing again if things doesn't work out.

Based from what you wrote, since your wife is going for Biometric for N400 that means she's here, don't worry about the baby info, she can mentioned it at the Oatch Ceremony, when they send you the Oath of Ceremony later, there's some update info being asked but you give it to them at the time of the ceremony so it's nothing that will stop you.

IMPORTANT FACTOR

At the time of the Oath of ceremony, the baby will not be around yet, so there's nothing to update, even if the baby is born here in the US before that, there's nothing to worry because the will automatically be an american.
