This is only my second post on the VJ forum, as I try to not talk about things I don't know, and as such, I am not always sure I can be of much help.
But I can talk about our experience, namely about the "continue making return trips" thing.
You do not mention what type of visa you're using when you're making these trips, so I'll make an assumption and guess VWP (Visa Waiver Program).
Our experience with using the VWP to do repeated trips to the US is that it works... for a while. That is until an officer decides that "enough is enough!".
Of course, depending on the officer, the entry denial can happen sooner rather than later. And trust me, since my fiancee went through this, it is not a pleasant experience.
My fiancee was denied entry last year (2007) for her third trip under VWP in a year, which followed two trips in 2006 and one in 2005. I think in general the officers are pretty lenient in allowing multiple returns over the years under the VWP, but again it's a matter of luck. Angela never had any problem in the Dallas POE (Port-Of-Entry) - the last entry there, the officer allowed both of us to be together and was extremely nice - but the first time going through Washington POE did it. I could go at lengths on why I think she was denied in October and not before. Note that she had two VWP overstays in her file, so again, I think the officers are usually VERY lenient.

Now in term of the VWP rules, one is very clear - and I quote from the CBP.org web site: "If you are admitted to the United States under the VWP, you may not change or extend your non-immigrant status."
I know for a fact that there are exceptions regarding the "extending" part and one of these exceptions actually covered one of Angela's overstays. She had to have an emergency surgery following an accident and had to stay in the US for longer than her 90-days allowance in order to recover.
Note that that there is no official way of extending or changing the VWP status. I called the CBP office and they told me there are no forms to submit a request of VWP extension while in the US and that on her next trip to the US she would have to have all paperworks necessary to justify that the overstay was warranted. Again, it's up to the officer at the POE to decide.
Which brings me to the point that under VWP, you CANNOT apply for another visa and stay in the country. You are automatically becoming an illegal immigrant. Don't do it!

I did it so fast, because mine was only a passport photo from my fiance, he had an extra one at home, so he sent over night. But they only approved more then a week later!!

I am confused... We are getting the documents ready for Angela's K-1 interview (in Rio) and nowhere does it say that the US citizen has to provide copies of his/her entire passport. They only ask for the foreign fiance(e) information.

If this is for proof of relationship, copies of the pages with the stamps should be enough, along with the original boarding passes for the flights.

It is also my understanding that they actually don't ask for proof of relationship at the interview. This is what the I-129F was for. If your I-129F was approved, then they have enough proof. Of course, it doesn't hurt to bring a few more photos, letters, boarding passes, etc...

Well, except for the interview letter! I am not sure security will let her in without that letter.

As to the mail, my fiancee who lives in a small town in Minas received the interview letter/packet 3/packet 4 (there's just one packet) 5 days after it was mailed by the Consulate.

You can email the Consulate at ImmigrationRio@state.gov for questions, they have always replied within 24 hours (or less)... unlike the NVC!

So here I've been fretting for over a week since my application was recieved. I still had no NOA1. I've been hounding my sister (address back in the States). I've been pestering people (and whining a little) about NOA1 wait times and I've been filling in the blanks and decided that there MUST have been a problem.
Well, I guess the problem is that they didn't see the need to send a NOA1 since it would be sent out almost at the same time as the NOA2! Our package was accepted via express mail on the 23rd and it was approved on the 28th! I can't believe how fast that was. Really?!?!?! 3 days?!?!?!?!. I wish everyone gets to cross that staffers desk!
I am thrilled, so is my fiance. We hope the rest of the process goes as smooth. We are keeping our fingers crossed.

What about updates on line? Is it also being updated ones a day?


This is a computer batch work. what happens is that cases are being approved during the day, but computer system will send out emails at 5PM to all the applicants who's cases are approved during that day.

Just a general observation, but I notice that most people seem to get a their NOA2's towards the end of the business day... (5pm ET)

However, is this just because this is the time people come back from work or is this when USCIS posts the actual change? I know touches are updated there and then... but not neccessarily any change to the case.

I can't remember anyone getting notice during the day... Can anyone correct me?

I would not send CD. I doubt the adjudicator will bother with viewing it. Easiest way is to attach your pictures to a piece of paper and write a date when it was taken and where. Other documents: flight itinerary, boarding pass, etc. will be a proof of your visit.

There are a lot fancier ways to print pictures with dates out there.

I have a question about photos which we will need to send as part of the proof of relationship for the I-129F form. We certainly have plenty of digital pictures taken over our 3 year relationship as a couple and wth other peoople in them. My question is, can we send a CD form of the pictures which will show the dates that the pictures were taken??? If we can't do this then how do we go about printing out pictures that will show the dates- or do we just print out our pictures on our printer and put the dates on the back with our signatures? I would appreciate advice on this

San Diego has a relatively large Russian community. Besides, I am almost sure, she will not be missing home anytime soon. San Diego is a great plase to be. Well, Kiev is not to shuby either, espesially in a few weeks when chesnuts trees begin to bloom. I would also recoment AiroSwit - very good service.

It took my fiancee (now wife) about a week to get her visa and she lived in Kyiv. So, make your plans accordingly. I found that if they book the flight (always get a round trip with 90 day return) and you pay for it with a credit card, then you can probably save money. The costs generally are cheaper for them than for us. Americans pay the highest for everything.

If you can manage for her to fly directly into your area (San Diego) I always thought that was best for their point of entry. That way if there is a problem, you are in the airport already. Although problems are rare, why take the chance.

Also, give her three weeks to a month to begin to adjust her body clock. She is going to be exhausted from the trip but the change is really hard on their bodies. Let her get plenty of rest. She will likely get a little homesick about a month after arriving so find some stores with Russian/Ukrainian goods for a little taste of home for her.

Congratulations and best of luck. You are going to have a great adventure together.

P.S. Don't forget to notify your credit card company first before giving authorization on the flight.

Based on other people's timelines it seems that it would take anywhere from 2-4 months to get an NOA2. Fifteen days seems like a really short time in between NOAs.

Good Luck with the next step- for me- it will be challenging. He has an enormous amount of work to do for the Ankara Embassy, and unfortunately, the downside of this early approval, is that I can not be with him for the interview. My understanding is that the NOA2 expires in three months (June 15), and I do not arrive in Turkey until the 20th.


Will you be able to be present for the interview?

Yes, you right, I have NO idea if my approval yesterday was the cause of my visit to INFOPASS. I am almost sure that it was a coincidence.

I am not telling everybody to make an appointment with INFOPASS. Like I am not telling everybody to pray god, kill a goat, or burn incense. I am not telling anybody that they “shouldn’t start stressing out until the end of the month” or “just be glad you're in the loop and not starting out. I just sent mine in today.” Then again, if any or all above-mentioned activities make you feel better, by all means knock yourself out.

All I did is share my ideas and observations with the board. I think this is a great place to help each other, exchange experiences, discuss theories, etc. There are people here who spend a lot of time collecting, organizing, and preparing data, researching government publications, etc. I, personally, appreciate all of that, even if I disagree with some of the data and/or ideas. Let’s try to help each other more and criticize less.

I know one thing for sure; the only way to expedite your approval is to move to Vermont.

How I read it is that there commitment is to process I-129F's in 6 mos. or less and that the date shown on the status page will reflect a date of 6 mos. in arrears as long as they are meeting there commitment. If and only if the processing regresses to a date beyond the commitment date will the date reflect reality.....

Most of applications are done in about 3 months or so. At least that is what we see here on VJ.

Or maybe it just an excuse: "We are still working on August applicants - don't bother us."

How difficult would it be for them to publish information like this?????:

It's worth noting that official government publications list the avg I-129F processing time as 2.9 months. Google up on the USCIS site the document that is the request for public comment for the proposed fee increase for visas - it has a ton of interesting data.

Including the 2.9 month time that contradicts their CYA numbers posted on the website.

You are right. I am still within a relatively average waiting time as far as California goes. We do read however, that sometimes USCIS computer/phone does not have up to date information. All I wanted to find out, is maybe there is any kind of delay, RFI, etc.

I just came back from my appointment. At 10 am, I made an appointment on line for 12:45 p.m. on the same day!!! How about that for government efficiency?! There was no line at the office. I waited maybe 10 min. Sure enough, almost no new information: “It takes 6 months to process. Come back in 3 months.” There was one record that I didn't know about - some small change in address. My zip code covers 2 towns, so either one works. Anyway, not a problem, but they did have a little more information.

As I came back and check USCIS case status, I do have a touch dated today. I guess, this is a result of an agent accessing my file during my appointment. Or maybe, just maybe, some one in a dark office did actually open my application folder, but was interapted by latte brake :whistle:

I am not quite ready to contact congress/senate yet. If a few weeks I might. Yes, it might be selfish, but if Vermont can process their application 10 times faster then California I believe we should complain.

As you can tell from my writing, English is not my first language. I've dealt with Immigration Naturalization Service (INS) over 15 years ago. It is way more efficient and organized then it used to be. Nothing could be done on the phone (don't even mention Internet). People had to be at the office before 6 am if you ever want to talk to anyone in the office, etc.

Anyway, I do believe that we all have a voice and we can improve the process.

They did suggested to make an appointment a local office (San Francisco in my case) using INFOPASS.

What do you hope to accomplish with an InfoPass appointment?

You are by no means outside what is now "normal" processing times for CSC. It is taking on average 90 days +/-, which means that 50 % of the cases were approved in less than that time and 50% of the cases in more than that time. My recent experience was 99 days.
