Hello. I was unemployed for the years 2007 and 2008, and did not pay taxes in these years. Could I use my tax return from only 2009 in order to file my K1 visa application? Also, what is the required percentage above the poverty level an applicant must earn? In addition, what course of action is available to me if I have insufficient income?


Your income must be 125% above the poverty level. If your income is not this much, you can get a co-sponsor on your affidavit of support. his is to assure the petitioned person (beneficiary) does not become a "public charge."

one's K1 visa or K3 visa (marriage visa) or Relative visa, you must have sufficient income to be a financial sponsor for the person receiving the visa. If not able to meet the requirements, a co-sponsor or joint-sponsor is permitted. This is to assure the petitioned person (beneficiary) does not become a "public charge." You can use form I-864 Affidavit of Support for immigrant visas.

I was thinking of not using a lawyer but one of these companies that assist with the paper work. They charge from $249 to $495. One is called "Filipina Fiancee Visa Service" and they charge $289. I live in San Francisco, CA


My understanding is that these "assist" services don't do anything. They send you one of their forms, you fill it out, and they copy the information over into the actual forms. They probably pay a kid $8/hour to do it. Trust me, you can do it yourself, and the community here is so helpful if you have any questions.

What happens next is your application is sent to the National Visa Center, and from there it will be forwarded to your embassy in Canada.

Packet 3 will tell you about what forms you need for the interview, and Packet 4 will tell you when the interview is.

That information is OLD. About a year ago they rewrote the rules about authorization for work and the K1 and stamp does not qualify. You need an EAD document if you enter on a K1. However one on a K1 cost $340 and take 60 days so at most you get 30 days work for $340. Not worth it. If working is an issue marry quickly and file AOS as the EAD is free then. As far as telling about the filing NEVER lie to an immigration official. They may already know from their computers and lying can cause you trouble for misrespresentation


Just wanted to thank you for this comment, which helped me out also. I didn't know this information was out of date and that work authorization only costs money if not with AOS. AP, apparently, is the same deal.

It won't matter whether your girlfriend is in Thailand or Dublin until her visa interview, which if you apply soon is still about five months away at least. You can go ahead and begin the process by filing a I-129F. She will need to send or give you a couple things, such as her passport-sized photo and letter stating her intention to marry, but presumably this could be done from Dublin or Thailand.

Nope, anyone can make this call. The NVC can tell you if they got the application and if they sent it to the Canadian embassy, but the most important thing about calling the NVC is getting your case number (it'll start with three letters). You'll need this case number to get the status of your application later on.

Just to be clear, there's nothing wrong with your case and you're not delayed. The next thing that happens is that your petition will be sent to the embassy in Canada. The beneficiary (Canadian citizen) will then get a letter called "Packet 3" which will tell him/her what to get ready for the interview. Once you get Packet 3, you can reply to it and then be given an interview date.

Hello everyone, I think I know the answer to this question but I just want no complications...I know that a person coming to US should not really travel to US (not recommended) while the visa is in the process and this question was answered many times on this website...Now, should there be any problems with petitioner or a person in US to travel outside the US and visit his or her fiance(e)? I would like to go for a visit one more time and possibly go back to US with my fiancee when she gets her Visa? Would I have any problems going there? English are pretty strict about these things...thank you and I appreciate your help/hints/advices!

Do not get married before applying for the SSC. That will confuse the heck out of them, and they have a tendency to invent bizarre new regulations off the tops of their heads when they get confused, like saying that getting married cancels your I-94 and makes you not qualified to get a SSC, or some such nonsense. :lol: The process I outlined above is the easiest way to do this, trust me :)


My fiance I and I were planning to get married immediately (maybe a day or two after he gets here) and apply for a SSC a couple weeks later. Is what you've mentioned above based on your experience, or many people's? I believe that it's happened, but it's hard for me to change my plans just based on possibly confusion.. surely this can be explained to them or proven somehow?

Both fill out the form.Both provide income information - though if you have zero income, you should provide a letter of explanation about that. Additionally, the cosponsor will need to provide proof of US permanent residency or citizenship (copy of green card, Nat. cert, birth cert, passport ID page....etc).

Please know that the London embassy can be quirky on the I-134, and the example forms which direct you to check "Do NOT intend to provide specific support" are not always accepted. Be sure that you and especially your cosponsor check that they intend to provide specific contributions. For yours, the same vague-ish statement about marriage and sharing everything etc. is OK, but the cosponsor should put something more definite, like if you were going to live with your parents and your parents were cosponsoring, they might put "room and board"

This means your case has been send back to USCIS for review. Generally, this just means more time in processing...dont lose hope.... if you do not hear anything within 5 months, you can create a service request. And then they will be obligated to reply.

I hope not but if your application gets denied you will receive very specific reason as to why it was denied. Instead of appealing, file a new one while making sure you address the previous denial reason sufficiently.

As an intern are you an employee or a contractor? Do they withhold taxes? Will they send a w-2 or a will they send a 1099?

IF you are a contractor (1099 worker) then state that you are "self employed", this is true actually, and attach your previous three years tax returns and a bank letter showing deposits for the previous 12 months (OR 12 months bank statements) as proof of income

If you are considered an employee, then it is quite likely the consulate will not consider your work permanent and will not sount your income.


I am consider an employee and my employer does withhold taxes and I just received a W-2.

I guess the best solution to this quandary is to get a permanent job or have this internship extended.

In either case, you guys have been wonderful, I really do appreciate all the knowledgeable responses. Just one last request from you all: Please wish and pray that I get a permanent job soon :)

You're not likely to be interviewing until June at the very earliest. Is a co-sponsor a difficult find for you? I'm just thinking that getting one set up will alleviate your stress over having a permanent job in time for interview. If you then don't need one, that's great but it's not panic stations if you're still only interning/ not permanently employed.

Difficult? I think its almost near impossible because as I said I am recent grad and all my friends are looking for jobs also.

My family and my fiance's family don't get along very well [typical Pakistani family bs against love marriage] so I cannot ask my parents to sign it.

Lets see who else? my boss (he is a good friend) ? If I ask him to be my co sponsor that will not look very good. And again, it is a professional friendship so it might end up doing more bad then good if I ask him.

What is the likelihood that your internship will be renewed again come May? And if it will, do you sign any type of contract that stipulates you will hold that position for another year?

I know that a lot of Americans work without employment contracts and so if this is the case, I would see if you can get a written promisory note of this renewal. You will likely know more closer to the time and that's fine as long as you have it in time for the interview.

If you do find a permanent position, don't worry about your employment only being very recent. As long as you can calculate projected gross annual earnings (so you get paid $3,000 a month gross, you'll have a projected annual income of $36,000) coupled with a letter stating the condition of your employment and ideally a couple of wage slips supporting your $3000 monthly income, then you're golden.

Unless you find a permanent position, I would still line up a co-sponsor as there's no such thing as being over-sponsored!


To be honest, I can say nothing for sure about it being renewed or not, it totally depends on their budget; but I have continued to do everything that I can everyday over the past years to give a full 100% to my job and I guess each time they are happy to renew it.

Men I wish the copious amount of interviews that I gave, apart from advancing me to round 2,3,4,5 etc someone would actually hire me. Pray for me people please! I really really need a permanent job!

I am a recent graduate with a Bachelors degree however due to the economy taking the plunge, I cannot seem to find any permenant work. Every employer loves to offer an internship but not a permanent position to me, dont know why, anyhow so currently I have an internship which will be good until May 2009 and I make $17 an hour(and work 40 hrs a week) (i.e. approximately $32640 a year). Now will this be enough to satisfy the income requirements(I have no other dependents so the household size is 2) or will I need to get a permanent job?

I recently asked a question on the forum and stated it was my first post. Obviously that was incorrect. Regarding my first post back in July, my circumstances were that I had to go away and could not take care of all of the details and filing procedures. So YES, I did hire an attourney. Whether it was a mistake or not -- I believe it to be a very good choice for me considering the circumstances. And also that my fiance asks me questions now regarding some of the things their 'man' in Moscow is asking her. So in my situation not getting the help of a third party would have delayed the process by many months. And instead of having an interview in Feb we would be waiting until late in 2010 for the process to be where it is today. That I have studied and understand the process since then I agree that the use of a lawyer is not necessary for the average situation. But mine was an exceptional circumstance which shall remain ours.

Not really. Again as I said before it totally depends on the CBP officer that he gets to deal with, some are easy some are #######.

But again the key is don't offer any more information then asked.

Actually for him to show I-129F will cause more suspicion of his intentions, best thing would be just keep the talk limited

Also, I would like to add it will be much easier and recommended for you to visit him rather then him visiting you because he is already in the system being shown as filed for a K-1. Hence, CBP officers can get really ####### if they wanted to - you can ask him to bring with him documented proof in case he gets grilled. Good examples include car parking receipt from UK along with the car keys (this one is super solid); a letter from the employer on the company letter head stating he will be back (another solid one); Housing/lease agreement.

But again let me tell you one thing about US CBP officers, they have every power in the world to still deny him entry even if he has all those proofs, it just depends on the CBP officer he gets to deal with. Hence, that is why I recommend you visit him instead of him visiting you.

Wow, only one week to receive the hard copy - thats fast (ours took two weeks to receive). What is the date on the hard copy? My assumption is that the touch on 1/27 was when it was actually received into the "system". When they receive in the mail is one thing, one they actually log it into the "system" is another.

My fiance (USC) thought he had a certified copy of his divorce decree, but it turns out that what he obtained from the court house is just pages from the court order. Can someone give me a description of what his divorce decree will look like, so I can tell him? Even a picture of one would be helpful. :thumbs: I've explained to him that it needs to have an official seal, and a date that the divorce became effective.

You don't need a visitor's visa to enter the U.S. as a Canadian. It's visa-free.
I was told that I could enter the u.s. without activating it. She even said "for example, if you are going there next week, you just have to tell them that you have a valid fiancee visa, but you are not activating it at this time"

ok I dinged into this issue further - it appears there have been instances where certain Canadian citizens with K1 in their passport were allowed to cross to US without activating their K1 but they showed "strong" ties to Canada. Also there were instances when a vast majority of Canadian citizens were forced to activate their K1 visa or denied entry because they were unable to show strong ties.

It totally depends on the CBP officer and you can expect secondary screening for sure and be prepared to answer very specifically with documented proof as to why you do not want to use the K 1 right now

I just got my fiancee visa at the end of Jan. this year. This visa expires in July. However, I want to enter the U.S. and visit my friends/fiancee prior to my visa expires. I was told that I could enter the U.S. without activating my fiancee visa during that day when I picked it up. I talked to my other friend who also got hers, she said that she wasn't told that. I wrote an e-mail to the U.S. Consulate, they said that if I was told at that time, then it must be true. However if I was still deny entry or have to activate my visa upon entry then they "have nothing to do with it" (i know, so rude). They didn't give me any written proof or documents of all the instructions they told me that day when I picked up my visa..

Sooo.. I was just wondering If you guys know for sure that I could enter the U.S. prior to my visa expires WITHOUT activating my fiancee visa? (meaning enter as a visitor and leave)

you cannot enter on any other type of visitor visa once you have the fiance visa - think about it - when you were issued the visa it was put in your passport - the moment your passport is scanned your fiance visa will automatically get activated. Secondly, you should be carrying the sealed envelope otherwise there is very good chance you will be denied entry.

We haven't filed for K1, but this issue concerns my Pakistani fiance if/when we do. Does anyone know if there's a way he can get by with not having all the towns' that he's resided in, police clearances (he said hes lived in many towns)? If not, can anyone please give us advice?


My fiance is discouraged (to say the very least) that the visa process will not work for us. He is deathly afraid and it's killing our relationship. I'm trying to convince him that we can do this, other people in similar situations have done it, that it's worth it in the end and he's just convinced we'll never be able to be together.

Also, he doesn't want to meet in a couple months (like he agreed to a week ago) because now he said that he'll never want to let me go and it will be too hard to go through all that again. (It's damn worth it to me, especially if we file for the K1 in the meantime)

Ok first of all - step 1 - go and see him, I know he is like dont come and blah blah blah but he will be really happy to see you...it will be difficult when you are heading back however, you seem to have a much stronger character then him so its about time you take control of the situation and tell him "mein abhi sirf is liye ja rahi ho takey ap ko wapis leney k liye asako".

To be honest, I cant believe a pakistani guy being such a cry baby, no offense though. My fiance is like that too but she is a girl; however, there seems to exist a certain breed of lover who need just one thing to keep them happy i.e. reassurances. It can be tough sometimes but if you really love each other, you will stand by in each others corner no matter how hard things get.

And dude in Pakistan I know it is a pain to deal with the police but COMMMON! its not like its something impossible.

On G-325A, there is a question which asks "Have you ever lived outside the United states for more then a year"

I answered it assuming the fact that this question had no date boundaries. So I said from birth to xx/xx/1999 (the date that I immigrated to US). I have lived in the US since xx/xx/1999 to present continuously.

After Immigrating to US I have never lived outside anywhere.

But now I am wondering, was this the right way to answer? or were they interested in only after I came to US?

My interview is scheduled for May 17 in Moscow.  We want to go ahead and buy our plane tickets now to save money. We want to allow enough time for the visa to arrive after the interview, but we also want me to come to the U.S. as soon as possible. How much time should we allow after the interview to receive the visa? 


How about getting first or business class tickets? they permit change at no fees :)

The way I read that - if he provided more information, they may of accepted it, but then again, they didn't even mention the benificary.

The petitioner would have to prove the benificiary cannot come to visit in the US. (there are some cases like that).

Basically, my take is, you have to exhaust all avenues of (not)meeting the requirement before they will allow it.

Do you think in the case where the petitioner became disabled - if he would have submitted a letter from a hospital or a doctor restricting travel due to medical condition, that would have helped?

So my fiance's interview is set for 27th July.

I am super confused as to whether I should go from atlanta to support her during the interview in London or not?
I believe our case is very simple, we have all the required documents and in all honesty she should be pretty okay without me but then there is the other stupid half of my brain telling me if I go, our case would be more stronger. For e.g. lets say God forbid but if shes denied I would end up making a trip anyway to marry her in the UK and file as CR-1.

So do you think it is worth it to go to the UK at a cost of $2000(flight + hotel) for 3 days ? My instinct is saying yes...but like a loser I need some reaffirmation (or good reasons as to why I should not go )

so i have sent off my petition and it was recieved on the 15th of july!
i know its still very early on, and it will most likely be a while until i recieve the 1st approval.
i wasnt able to send a personal check, so i cant check it that way. i had to send a money order.
but i have heard stories of people not even recieving anything in the mail (a 1st approval)......only recieving there 2nd approval like 3-4 months down the road....
any advice?
also, how many days after they have recieved it can i contact the Cal. Serv. center?


You can call the Customer service number on the back of your money order receipt, enter your money order number and they will tell you if it has been cashed or not.

You do not need to contact the Cal Service Center, you can check your status at https://egov.uscis.g...is/Dashboard.do by entering the case number you receive on NOA1.

Hi,
I don't know anything about the Philippines. But maybe I can help understanding what you need for the K1 process. Pictures together, especially any with family or friends, are nice to supplement a record of having met in person in the last 2 years (I submitted copies of passports but since the stamps aren't super clear also itinerary confirmations). In my opinion, these pictures are nice to show you have a real relationship--although this may not matter to get through the first steps, it will in the end. Additionally, if I worked processing visas some pictures of happy couples doing fun things together would make me a little more dedicated to reviewing the forms. In addition to having met in person, they will want you to show an ongoing relationship. I think it is good to have both pictures with different dates and in different settings, as well as some sort of a "communication record". We also don't use the phone very much, so I did a search of my email inbox (which includes chats and emails) of his name and printed out the pages of conversation records- several each day, every day, since we met. I can't say if this was the best thing, but that's the evidence I submitted and it's worked for us.
Regarding finances/working: we are both students with low income but a lot of potential. They don't care about potential, only what is tangible, in the US, right now. You will need to save to pay all the fees. If getting married to this person is your priority, you have to sacrifice and put that first. Once you get to the final steps of the visa and have to file the affidavit of support, you will have to prove that you make enough to keep yourself, your new spouse, and any other dependents from collecting any public support. If you don't currently make enough to do that (right now, and in a stable and sustainable way that you can prove), you can still do the visa but you will need a cosponsor who makes enough to support all of you and is willing to provide documentation to that effect.

Do you know if they are applying this to everyone who ever had a felony conviction? Or just those that are abuse or drug related? On the application I did not marked when it asked if I was ever in trouble, because those conditions do not apply to me.

I got one count in my case from the feds back in 1994 for some white collar mischief. Hope this is not going to put my case into a indefinite black hole! What I did back then hopefully does not screw up my chance for marrying my fiancee.

Since my I129F NOA1 was Oct 2009, it would make sense for me to be in the same position as the other unlucky folks .. Let's get some more facts to get rid of this cloud of uncertainty and doubt.
