Just as a side note, we tried to get a Social Security number yesterday, four days after entry, only to be told that she is not yet been entered into that system that ICE uses. The lady offered to do the manual check, which could take six weeks +, but we declined and agreed it would be faster to return a couple of weeks later instead. it takes about 10 days to get into the system before you can apply for the ssn on the k-1. i have heard of some offices giving k-1's a hard time about issuing so maybe take a copy of the ssa.gov policy relative to k-1 with you if your local office is in a less metro area. we didnt' have any trouble less than 21 days from poe he had his ss card in hand. good luck!

true of california as well. we applied for my husband's i.d. 3 weeks after he arrived back in the u.s. in fact he applied the day he got his social security card in the mail which we applied for exactly 15 days after he landed back here and his i.d. doesn't expire until 2011. hope that helps some the californians!

an interesting side note on california they stopped offering the dmv study guide in thai at the end of 2006 but still offer the exam in thai.

We received our 2 year Green Card yesterday!!

The biometrics was taken late December and we received a notice in January that our case was transfered to California.
We received AP and EAD in February and Friday April 3 we received the "Welcome to USA" letter and the Green Card showed up Saturday April 4. No interview...My wife is very excited and happy. kicking.gif

Hang in there....sometimes things move very slowly and then you top that hill and coast for a while.

i also hired an immigration attorney for the process in 2007 when i was petitioning for my now husband. the contract read that he would take me through the conditional green card process for a flat fee of $x. i paid a 50% deposit and let the games begin, as mentioned by others here the clerk did the bulk of the work and it was sub par at best. egregious errors including some that were just plain stupid such as giving my husbands phone number as a local san francisco number (that neither of us had heard of) and he was the beneficiary.

i initially hired this attorney on a recommendation from a dear friend who had successfully petitioned his now wife based really on my own fear that i would make these very simple types of mistakes and cost myself time in reuniting with my fiance. i spent sooooo much time correcting and calling and emailing that i wish i had the confidence to just do it myself. the night before the interview my fiance slept like a baby while i stayed up all night reviewing and correcting forms in an internet cafe in bangkok(ugh) i phoned the attorney many times over the night who basically just told me to relax "a few small errors won't make a difference" this was also the time he thought it was a good idea to say, why are you in bangkok? he had originally told me i must be present for the interview or we'd be denied, yet another false statement, although i'm glad since the i.o. was very interested in the denied b2 and the failure to mention a u.s. girlfriend. she actually asked me about it directly as well.

all that said, the 3 things i came away with after the experience were 1) i should have run screaming from his office when during my consultation he suggested (and we did, actually i am glad he was denied at least we didn't have a fraud issue to overcome) apply for another b2 and then just overstay and marry, he could get us through the process to aos. he figured the 2 previous b2 visas would make him a shoe in for a 3rd. REALLY REALLY to suggest fraud ai-yah. 2) if i had just read the forms carefully i absolutely could have done it as our case was straightforward, i ended up a S.M.E afterward. 3) i completely severed ties with the attorney after the morning of the interview including never sharing the results of the interview and not paying the balance 50% of the contract (which i figured he was not entitled to since he did a sub standard 50% of the work (the k-1) and didn't do the aos since i did it all. he sent an email about 6months after the interview asking if my husband was successful and reminded that if he was and had entered, and we did not marry in 90 days he would face a lifetime ban (UM NOT TRUE, problematic and unnecssarily difficult if you don't but does not lead to automatic lifetime ban dumdum)

all said and done, i would not recommend an attorney for straightforward cases, no one would be as careful or care as much as YOU do about being successful in reuniting with your loved ones.

good luck and i hope it works out better, stay on top of your attorney and go over all the forms with a fine toothed comb!!!

Do I really need to send four copies of the completed "Biographic Information" page of G325A? And if so, that means I need four copies of my G325A and my fiance's G325A? (So eight copies all together?) And if so, do that mean they all have to be signed? Well, what I mean is that my fiance and I signed our G325A, but is it ok if the other copies are copied after we already signed the form? I'm confused, this doesn't seem too clear...

Aww, I am very sorry to hear you lost your job. That is incredibly hard...

I'm not sure what advice to give, but reading these posts make me wonder about my situation. Back last May, I wanted to start our visa process, but I didn't have a job... I tried so hard for months to get a job, but I didn't get one until September. I was very depressed at the time because without a job, there was no way I could start this visa process for my fiance, and we missed each other so much. I finally did start our visa process last month. But, I don't make enough money to meet the poverty line. I tried to get a co-sponsor, but my dad is a cheapskate and didn't really want to help, my mom wanted to help but she doesn't work and is on social security disability... But, I went ahead and started the visa process because I have a house in my name, and with that asset, we should be fine, at least I hope so. At least what I read in the book I have, "Fiance and Marriage Visas: A Couple's Guide to U.S. Immigration" I thought with that asset we would be ok. Either way I know I am going to be worried when my fiance goes to his interview, just because of my income issue...

The Webbs, I hope everything goes well for you guys, and that you get a new job soon!

Yeah I'm not really sure why people use the K-1 to use that time to get to know each other. You should visit each other more often before you decide to file for the K-1. Of course, not all people are as lucky to be on the Visa Waver Program like my fiance is. He is free to visit for me in the U.S. for 90 days at a time with no visa, and I am free to do that in Finland as well. We have spent a total of over two years together in person in these 5 years that we have been together. I am totally ready for marriage, hehe. ;)

But I also wonder why people purposely look for a foreign wife... You think you could never fall in love with an American woman? I'm not saying this because I am American woman, but I guess I never really thought about where I want the person I fall in love with to be from. I wasn't looking for a foreign husband, we were just friends for a year and half, and well, we then fell in love. And to me that is the most important thing, is to fall in love with your best friend. Your fiance is supposed to get package 3 from the embassy. I would wait a little while to see if she gets it. But you can always ask the embassy if they got your approved petition, be sure to tell them your case number too.

You may want to go ahead and request the transcripts. Can't hurt, it's free, and you'll need them for the AOS anyway - they are required at that point even if it doesn't qualify you or reflect current income.


Ah ok, I guess I'll go ahead and request them. I know it takes several weeks to get them, but that's ok, we wont be given an interview date until we send the embassy the checklist when we have everything for the interview. Our expiration date on our NOA2 is Sept. 10, so we should be ok to wait a few weeks to get the transcripts.

So, I always assumed you needed copies of your most recent federal tax returns for the K-1 visa interview. But as I look over the I-134 form, it doesn't ask for that. I can still try to get my tax returns in the form of IRS transcripts, but the thing is, it seems pointless in our situation. Right now I do have a job that I had since last October, and with my current income and my assets I think we should be ok. I plan to get a recent bank statement and a letter from my employer, stating my salary. But the thing is when it comes to my tax returns of previous years, I didn't make much because I didn't work a full year ever since I started working in 2005.

I made $3,317 in 2009 (I was in Finland for the first three months of that year and then I couldn't get a job until the end of September because of the bad economy. So I really only worked about three months that year)

I made $5,815 in 2008 (I worked about six months that year. I spent the other half in Finland and also sometime in the U.S. without a job as I wanted to spend as much time with my fiance (boyfriend at the time) before he flew back home)

I made $5,620 in 2007 (I worked about seven months that year. The times I wasn't working I was in college, then I was moving and looking for a new job)

I was living with my parents at the time so I could quit for months at a time like that. So see what I mean? It is really necessary for me to send my tax returns when the amounts I earned for those years was so low anyways? What is important now is to show how much I am currently making now, and I plan to do that with a letter from my employer. Is it really necessary for us to have my tax returns at my fiances interview? Is there anyone out there who didn't bring their tax returns to the interview and that was ok?

Thank you for anyone taking your time to read this and giving me some advice.

My fiance has received Packet 3, and is filling in the forms they requested he fill in. He got all the paperwork he needs - birth certificate, affidavit of support, etc - everything except the police certificate. We're still waiting on that. Can we send in our forms and checklist and be scheduled for an interview? I'm confused reading the forums on if you MUST have the police certificate before you send in the forms, or if it's ok if you get it later.

Also, what is the required percentage above the poverty level an applicant must earn? In addition, what course of action is available to me if I have insufficient income?


Your income must be 125% above the poverty level. If your income is not this much, you can get a co-sponsor on your affidavit of support. his is to assure the petitioned person (beneficiary) does not become a "public charge."

one's K1 visa or K3 visa (marriage visa) or Relative visa, you must have sufficient income to be a financial sponsor for the person receiving the visa. If not able to meet the requirements, a co-sponsor or joint-sponsor is permitted. This is to assure the petitioned person (beneficiary) does not become a "public charge." You can use form I-864 Affidavit of Support for immigrant visas.
