I was at first worried about this as well. My fiance and I are going getting married in a court. We have no date, we just plan to get married as soon as we can after he gets his visa and moves here. So I was worried, how will we prove we plan to get married? We still don't have rings! I have been looking at rings since the beginning of this year and I still haven't found the perfect ring. And I do not want to rush and buy something just so we have a receipt to show at the interview. I will be wearing this ring for the rest of my life, I want to make sure I love it. So I was really worried of having no proof of a wedding. But, once I found out here on VJ that all you really need is a updated letter of intent, I feel a lot better. But I guess we'll see what happens, his interview is in less then a week from now... I'm nervous...

Well we chose K1 because K1 is faster to get your visa. Also we would have to prove a lot more things with CR1 that we just wouldn't have right now. With CR1, I know you get your green card right away, but it's not a problem for us that my fiance would have to wait a few months to get that, since he has visited me in the U.S. in the past for months at a time, and of course he couldn't work then. That's not a problem. I also wouldn't really like the idea of being apart from my husband. It already seems weird enough for me to tell people I am engaged to someone who lives in a different country, imagine what they would think if I told them my husband doesn't live with me. (Although I know I shouldn't care what they think) Plus I just liked the idea of getting married in the U.S. For a couple reasons, mainly because my family couldn't afford to go to Finland for a wedding, but my fiance's family does make enough money to come to the U.S. for our wedding.

Touches don't mean anything. Most cases are approved without them. Alla has been here 2 years as of today, never got a touch, never got an update, it still shows "initial review" and we never got the Package 3 or Package 4 either. get the visa and the green card. The rest is just bubblegum to chew on while you wait.


We never got a touch before our NOA2 as well. And we never got a package 4. The embassy just emailed my fiance telling him the interview date and what to bring.

Although I do admit while I was waiting for our NOA2, I was checking almost everyday to see if we got a touch, haha.

My fiance bought a one way flight to Los Angeles, California, and then bought a separate flight from Los Angeles to Medford, Oregon. We are saving hundreds of dollars that way. I don't think it will be a problem for you. I'm not worried about my fiance having two separate bought flights like that.

I just feel it would be better for him to get his SSN soon in case we need him to have SSN to have a joint bank account, things like that that we would need for the AOS.

I am so confused about my fiance applying for a SSN. So many times I read you have to wait 14 days after arrival. I just wonder why people are saying that if Gary and Alla were able to apply for one so soon. Even here on the VJ guidelines, it says to wait 14 days. :huh:

I've been wondering this too. My husband's I-94's expires in 3 days. We sent his AOS package last week. We wanted to go to Hawaii for our honeymoon which we haven't done yet. I was thinking maybe when his advanced parole is approved we could go, but I'm not sure. I guess it depends on the state's DMV, when he can get a driver's license as well. (Since you can fly within the U.S. using a state ID or state driver's license)

I've never heard of such an age difference... I don't like to discriminate relationships because of age, but it's still weird to me. I can't help it. Just the thought that the person you are with is as old as your parents or even grandparents, is just too hard for me to overcome. :blink:

I plan on being completely honest, providing plans for our wedding in Canada, if asked, and probably letters from our pastor explaining the importance of a church wedding, etc.

We did about the same thing with a crazy Vegas "legal" wedding and a real family wedding coming up in the future, and we told them that. The interviewer didn't mind or seem to think that was unusual.

Of course we were having sex for years before marriage. :dance: Sex won't come up in a normal interview, anyway.

So I was in contact with my local USCIS center for many months before I filed my i 129f, and they assured me that I would be safe filing in late September, 8 months before my wedding. However, now VSC is taking forever to approve, and all of the timelines for the UK suggest that it will take 2-3 months to get an interview... which would probably put us at or past our wedding date, where 200+ guests will be expecting the groom to actually be there.... I guess I'm just hoping someone will tell me that the London embassy is quicker than that...

Also, I have a family friend who is a Senator in my state, but i would feel HORRIBLE asking her to call for me, and i would also feel horrible skipping all the other people who are in the same boat as I am. When do I get desperate enough to have her make that call? Will it even make a difference? (My NOA1 is Sept. 28)

Just fake it. The groom's from the UK, a visa waiver country. Have him fly over on the visa waiver program before the wedding, and have the wedding. Have the ceremony, throw a bouquet, eat cake. Just make sure you get an officiant who knows that there won't be a marriage certificate until later - this is just a ceremony. Don't tell the guests. Then, when you get your visa, go to the local courthouse and get married.

That's what I did, though I technically got married before the big family wedding. I couldn't be happier - I have all the time I need to plan this shindig. Meaning between you and your fiance is where YOU place it - not the state. Don't let them rob you of something that was never theirs.

No one is suggesting the OP lie. However, the INA says that overstays and illegal presence do not accumulate until the alien's 18th birthday. So teling the truth here is advisable and won't hinder the application.

My girlfriend turns 18 in November. She is from Mexico and is living in the United States. She entered the US without any type of visa or passport when she was 6 years old. We are looking at getting the K1 Visa. Would she have any problems getting this visa as long as she leaves the US 180 days latest after her 18th birthday?


well I have two questions for you:

(1) What did you put in her address history in G-325A? (Yeah buddy, you need to list her addresses for the last 5 years, so technically her overstay is more then 180 days)

(2) What do you plan to put on "Has your fiance ever visited the US"? (see my point?)

Now if you lie and put fake answers on the above 2 and USCIS discovers this, you will be in more trouble. The fine is upto $10,000 and five years in prison.

Filed my I129F five months ago and we have received nothing but a receipt notice. I called for a formal review yesterday but I want to call my Congressman as I have heard suggested many times on this site.

I looked for a FAQ or guide on this but didn't find much. Any advice on what to say to get results? Do I ask them to "make an inquiry"? Do I say it is "outside of the normal processing time" or something stronger?

Thanks for any help in advance.

Definitely say it is outside of processing time, which will require the operator to initiate an inquiry, they will then have 30 days to respond.

I have been on this site for a while and have noticed more often that if you involve your congressmen/women they do the same thing but you usually get a response much faster then in 30 days.

Are you sure nothing was lost in the mail?

Inferring is not a good idea.... There is another active post where a USC filed an I-130 for her husband who is here in the USA. She was asking about the process of filing the I-485. People inferred and gave her proper advice about how to do it. Then it was asked what her husband's current legal status was. It was learned he "entered without inspection". All of a sudden, all of the good advice given based on the inference was absolutely wrong and potentially devastating (financially and procedurally) to the family.

Secondly, you must realize that other less astute people read these posts. If they read that marriage on a tourist visa is FRAUD. How do you suppose they will react, particularly if they had just done it themselves? If someone posts information that is incorrect or unclear, it needs to be corrected or clarified so others will benefit. Period.


How about this, next time you go into a foreign country where you need a visa, tell the Immigration officer you are here for a "destination wedding" with the citizen of that country. See what response you get :)

Marrying on a tourist visa RANDOMLY is NOT FRAUD - even then if the tourist visa person decided to stay here, its extremely hard to proof it was random. The burden on proof lies on the petitioner. A few years ago, USCIS was quite forgiving, but with all the issues our country is facing right now, they have become more vigilant which means such impulse decision makers will have a hard time proving their case with physical evidence.

Speaking of Impulse, try buying a one way airticket to any international location with cash and at the airport with less then 24 hours and you will find out exactly how does USCIS/TSA/Other agencies view such "random" decisions.

Using a tourist visa to come to US or any other country to get married and then settle down certainly is FRAUD

The whole point of telling someone to do K-1 or get married and then go back while the USC files for CR-1/IR-1 is to avoid all the hassles and possible disappointment.

Its 10X easier to prove ON PAPER you have a substantial relationship if you marry here/go back/file for the visa or just file for the visa while both of the people are in different countries.

Read the OP post again and read your statement. Do you think when OP knows about K-1 and yet he/she invites the SO to come here get married and do AOS, is that not intentional misrepresentation? I dont think playing if USCIS becomes suspicious and you play dumb in front of them, they will not be very kind.

Again, the advice of NOT doing AOS on tourist visa (with the preemptive intention of getting married) is based on WORST CASE SCENARIO. If USCIS becomes suspicious, all the bans and fines are not worth it.

I have a feeling you are taking this personally. You should not. Just to let you know I do believe in love & people DO marry quickly on tourist visas, but that is RANDOM - OUT OF THE MOMENT DECISION not a PRE-EMPTIVE ONE.

I think you took my comment out of the context...I meant if you come to US on a tourist visa to get married and then settle (i.e. do adjustment of status) with your US citizen/resident husband or wife, that is fraud.

The OP showed no intention of having a "destination wedding". Also, I am also not sure how easy will it be to prove to USCIS that a US Citizen and a foreign fiance who came on a tourist visa, did so to have a destination wedding inside the US and then decided to stay and adjust status :)

So my Fiancee (from AUS) and I are getting our K1 visa put together. But I was wondering....Is it possible for him to come here(USA) on a Visitors Visa and for us to marry straight away, then apply for a perm. visa??

Also If he becomes a US Citizen does this mean that he is not allowed to enter AUS without a visa???????? Even if he is an AUS Citizen by birth???


Tourist visa is for "visiting / tourism" ONLY. If your fiances comes to the US with the intention to marry you on a TOURIST visa, that is considered fraud. Period.

Choose the right path, file for K-1, it takes only 4-5 months at most. If during Adjustment of status, they discover your fiance was here on a tourist visa to marry you, he will be deported and denied a greencard. Its not worth the risk!

This is the first I have heard on this and am now terribly worried. We submitted B&W photocopies of passports and all the rest were B&W

I would hate it if, it came back just for everything to be re-done in colour.

I am not a K1 filer but a CR1 but its a similar document.


Anyone shed some light on if they submitted everything in B&W and it was ok or asked to resubmit in colour.

Hi,
You may want to include an explanation note with this first packet, saying she doesn't know her biological parents and lives with another family (name and address).
It might be helpful to be open about it from the start, since for packet 3 (before interview) they will ask for more info about her parents and this way you show you aren't trying to hide anything.

Documents required for the interview in Ecuador can be in Spanish or English (at least that's the way it is in Argentina), but any documents you submit from the US (e.g. for AOS after you are here) DO need to be translated and certified.

You don't need copies, you just will want them to know what is in your file because you will always have the burden of proof and responsibility if everything doesn't go the way you want!

You should maybe ask your wife to "make" a copy by noting down what she sent in before she forgets? Just so you have peace of mind about this?

Congratulations! You should plan your wedding!!! Find out what you will need to do to get a marriage license where you live, get married and file for Adjustment of Status, with Advance Parole and Employment Authorization Documents (the first is to become perm. resident and get green card, the second is to travel while you wait for that and the third is to work while you wait for that) as soon as possible! We got married 3 days after arriving in US (my state has 3-day waiting period on marriage license) and put AOS in mail in the same week, and we are so happy we did.. anything that saves you more waiting, right?

We had to wait more than two weeks to get the SS#, I guess it took a while for him to get in the system, and longer for bank accounts and driver's license and such.. don't worry about that so much but file AOS right away! That's what you will be waiting on the most. Your fiance can legally drive and identify themselves with license from their country, and they can share your bank account for a few weeks.

We also wanted to plan a summer wedding, and had made some plans but working with our vendors explained about the visa and said we wanted to reserve but couldn't commit 100% to the date.. good thing because even though we got the NOA2 according to the timeline, processing at the embassy took much longer than we were expecting. In the end, we chose to have a legal wedding immediately after getting the visa, but because people were traveling and we couldn't confirm the date early enough for them to book flights, we had the big wedding party later in October. This wasn't our ideal plan at first at all, but it worked great in the end because soon after the wedding we could both start working, etc. (because we had filed AOS in August).

Do I wish the visa would have come through in time for our original plans? Maybe.. but it was too much stress cutting it so close and would not have worked out, you just don't have enough power in the process to make it go your way. Do I regret planning it the way we did? No, because it gave me lots of time to work with vendors and figure everything out (I was able to have my dress made for me, think ahead of time about a hairstyle, relax about everything while stuck waiting, and spend more time with my now-husband) which made me enjoy the wedding a lot more because I was so comfortable with it and not rushed!

I hope this helps. Know that you have no way to really predict when the visa will arrive, it could be significantly sooner OR significantly longer than average. Try to do things in a way you can have fun with them instead of stressing all the time.

You are supposed to receive something from them, but it took my embassy almost a month to send it to us, and it was not even real mail, just an email! So depending on the embassy they may be slowww. You could try contacting them to ask if they received it, in our case they weren't responsive to that either so we did the only thing we could do, prepare for the next step. The thing they send is called Packet 3, it's a list of documents to make copies of and mail to them before they will schedule your interview. You should try to find the most accurate list for your embassy that you can on VisaJourney, and assemble everything for that so when you do get it you'll be ready to send it back to them the very next day, so you don't lose any time.

After 30 days past when they should have received it, I would get more aggressive if you still haven't received anything from them.

Do you mean you have already received your NOA2 but want to make the rest of the process go faster? I would think a senator couldn't be much help in the part of the process you're in now--the visa packet going to NVC and to the embassy in your fiance's country, being reviewed there, interview, and visa issuance. After that, when you are in the AOS process, a senator might be able to help hurry things along, but for now it is mostly the embassy you need to talk to.

Filing the 129f right away is a great idea! Don't rush though, make sure you have everything in order and make a copy before you send it in.

I tried to plan my wedding about the time I filed, and I did have to move it from the date we were originally hoping :(.. but I was able to get started by doing things that wouldn't matter the date (choosing invitation vendor, designing wedding dress, thinking about guest list, etc.). I also spoke with the vendors that were important to me (spent time choosing favorite locations and contacting representatives there), each time explaining the situation that we are planning for this date but cannot confirm 100% it will be on that date, and asking them to work with me in making plans with the option to move the date back if necessary. People were surprisingly helpful with this.
