K-1 Fiance(e) Visa Process & ProceduresSawasdee 4 (Thai K-1s in 2010)
in california my husband was issued a an i.d. card good for 6 years right after he got his ssn. so less than 30 days after arrival he recieved both ssn and i.d. card. he was not even questioned about the application for i-485 which we ended up not filing for another year. nor did he get questioned about his i-94 the biggest concern was whether or not he could fit his name in the signature box.

i wonder is it a newer policy? or is it relative to driving? my husband did not apply for a driving license.

@darryl and jeep, wishing you a safe trip and happy life!

@poajin...

We've got an interview coming up pretty soon, and my fiance is a bit nervous (mostly about the English required). When you get done celebrating, it'd be great to hear some details of your experience.

the interview does not have to be conducted in english it can definitely be done in thai, they may be concerned with how the two of you communicate but she can speak thai. good luck!

such a shame the usc can no longer go inside for the interview. it was nice to be there for moral support for my now husband. ironically we had a lawyer for the k-1 piece who insisted i must go or he would not be approved. the only reason i didn't want to was i had only recently started a new job. turned out well when i approached my boss he was AWESOME and insisted i go and said take what time i needed. that's why 4 years later i'm still here.

/rambling off

good luck all!

my husband was issued two separate b-2 visas and was neither college educated nor wealthy. this was now almost 6 years ago so perhaps it's more difficult now but i know of a few thai men as well who were issued b-2's.

welcome just13...

the k-3 no longer exists, so if you decide to get married in thailand the spousal visa is the cr-1/ir-1. which could take 9-12 months or so the difference is your wife would receive her permanent resident card on arrival. the k-1 is not likely to be completed in 5-6months more like 6-9 but check against timelines for thailand and you get more information.

as for getting married if you get married in thailand, and plan to get married here, you must be careful. married is married. if you register your marriage at the local amphur you will not need to get married in the u.s. if you decide to do the k-1 and just have the ceremony but not register at the amphur you will be fine. check with some of the other members but i think you need to be careful of the photos (secondary evidence)not indicating marriage at the k-1 interview.

good luck!

Thanks for the info Lang and Aaron. One other question...were you in the interview together or separate? Teaw can understand if the guy speaks slowly enough but I am thinking of finding someone to translate for her just to be on the safe side.

you will be together, unless for some reason they don't buy the relationship and separate you. my husband found some of the terminology difficult to understand. i had to ask the io to rephrase using more simple words and it worked fine. good luck!

@aaron, interesting? i could swear i read somewhere on the site that someone had trouble as a result of that, but good on you! you lucked out.

on a side note we did walk in biometrics in san francisco on friday, easy peasy lemon squeezy!

@ tom and teaw if they give you the 10 year gc it would be i mistake, there was someone here who got one in error and still had to remove conditions.

as for the interview it's not bad, ours was 30 minutes or so, i think we were called for interview because of late filing. at any rate if teaw is not comfortable with english you will need to provide a translator, because it's definitely english only and you are not allowed to guide/help her. they will want to see evidence of comingled assest, bank accounts utilities, cell phone bills. photos seemed to be a big hit, our i.o. was interested in the photos of me with my in-laws and him with my family in h.k. and here in the u.s.

was about 30 minutes and then she went to have a superivsor look at our file and recommend for approval. in and out in under 90 minutes including wait time.

good luck!

trying to get yourself in trouble already? :bonk: i bet you could see the steam coming from her ears i have heard from my mil and sils that you don't wanna mess with a thai lady. i will see if i can connect with my friend in chandler and ask about thai grocery, it's been a couple of years since i was there if i get something i will post it for you. do you have a rice dispenser it will help a ton in storing the rice etc. i have not known many non-asians to have one so i always suggest it.

it must be wonderful to have your wife here now! enjoy a wonderful safe holiday...in fact happy holidays to all!

Really? I always thought that you were native American.

ha! my ancestors were not at the first thanksgiving

actually i am a crba baby...my mom is california born and bred but my dad is from hong kong and that's where i'm from, didn't come to the u.s. until i was 12. interestingly enough my mom has some castillian roots so she spoke spanish to me as a kid and my dad and family are cantonese speakers.

my parents spoke english to one another but my mom put forth a concerted effort to learn chinese (she just wasn't good at it beyond understanding the basics) but not to me, they thought i would be better off learning english last.

hiya tom, yeah if the i-94 is expired or close to expiration the magic number seems to be around 14 days left the ssa will not issue the card and you do have to wait until you are approved for permanenet residence. as rare as it is, this time those jokers got it correct in the ssa office.

@anya...your baby boy is adorable!!!!!!
the exchange rate has been in the neighborhood of 30+/- for a few months now. when i went to asia in june it was 32 on the best day but mostly 30-31. have a wonderful/ safe trip.

i asked my husband if he wanted the the thai keyboard and s/w pack that i had my sil bring me in singapore from mbk *ahem* when i went in june but he never used it. he primarily uses english but has the thai "keyboard" for his iphone so uses that if and when he needs it.

his thai is apparently getting terrible. the other day he could not remember the thai word for onion. took him 10 minutes  anyone else's s.o. forgetting thai?

btw thanks to all again for the responses to getting money to my mil. the exchange rate was not the most favorable it was 29.86 with western union when i sent it but it was nice to know she had it in 15 minutes and she could get it right at her bank, bangkok bank whom i also believe is her mortgage holder. so now she can relax and focus on healing.

Well, I would be just above the poverty line by myself, but do I really need a sponsor? Doesn't that mean they are responsible for my financial needs if I get in trouble?

hi niing, you made it over here! if you are above the poverty line, then you are above it and it should present no problem and you will not need a co-sponsor. if you situation changes and you wind up needing a co-sponsor then they are responsible the same way you are, if the immigrant becomes a public charge "you" the sponsor and the co-sponsor could be responsible for those monies paid out to the immigrant. you have also mentioned your age a few times, it will not present a problem as you are both at the age of consent in both countries so you can stop worrying about that part.

best of luck!

hi everybody, thanks for all the responses, turns out western union was only $11.99 and my SIL could pick it up at bangkok bank in ratchaburi. this is the only time we have ever been asked for money so no need for a bank card, unfortunately my MIL was in a motorcycle accident and needed some money this month to pay her mortgage to the bank and hospital bill since she won't work for a bit. main thing is she will be fine!!! unfortunately though she killed a dog, she feels pretty awful about that too.

btw exchange rate is lousy right now!!!

I was impressed by the article because it clearly showed that this dirtbag was getting away with murder,
while it also exposed his partners in crime because in any rotten business, it takes two sides to make a deal.

true...what a shameful dirty rotten business although the cynic in me doesn't see that it will change anything.

glad the citizenship test will help everybody, fingers crossed!

@daboyz i think your wife n my husband are going to be studying at the same time...

@rin and john, how did you finally get rin to study for the driving exam, my husband says he's nervous to drive here and parking in abysmal in san francisco.

@tom and teaw...safe travels!!!

@td4me...unfortunately there has always been a chance to buy your freedom in thailand. i would say the article title is horrid since if he is guilty of even one of those charges then he deserves to ROT, and him gaining freedom is not justice.
story is reminiscent of one from about 3-4 years ago about a san francisco cop who had been traveling back and forth to thailand for like 15 years or something and he was caught with a VERY young child they didn't say exact age or gender but ultimately the justice he got was..."he committed suicide in his jail cell by shooting himself in the head/face TWICE". "suicide eh?

just thinking ahead and in just 13 months my husband will be applying for citizenship, i happened to find a link that lays out all 100 questions in english and thai that is pretty awesome. my husband's english isn't bad at all but i think the civics test will be a challenge so i was quite pleasantly surprised to find it in thai.

i think most of you have pretty english savvy spouses but here you go just in case...

colleges vary state by state with regard to k-1 visa holders attending. my husband attended school long before he adjusted status without any additional fees (not out of state or otherwise). just double check with your local school. not sure if it makes a difference but he is attending a community college.

Rin usually watches American TV, but does watch ThaiTV about an hour a day when I am at work (to catch up on news).

We decided against the the bum gun and instead installed the shower head with separate spray hose in the shower in two of the bathrooms. If you live where the weather is cold and ground water temps in the winter drop to 50 degrees or less, the unheated bum gun would be a bit too "refreshing"!

hahahahah "bum gun" hahahahaha i rarely laugh out loud at things i read but that was hilarious to me, i will be sure to tell my husband about it. we don't have one but he doesn't care at all. he had a western style toilet in thailand so no big deal.

We just finished AOS and my countdown to ROC is almost 21 months; seems like nothing.

The calculation I made was the GC approval date + 2 years minus 3 months to be within
the 90-day window for filing.

I put the countdown on a ticker to remind me. To be sure I'm within the 90 days I pushed
the "OK to apply for ROC" date a few days forward.

it does go very quickly! i can't believe my husband has been back in the u.s. 3 years already (11 july). it's crazy if we hadn't delayed our i-485 we would planning for citizenship right now. but this time next year i will be griping about the final step.

NEWS FLASH!!!!!!!!!!!!!!

Teaw went to the embassy today, Monday, to see why they tried to call her Friday. So she got to the embassy about 1:30, got in by showing them on her phone that they tried to call. He sent her back out while he checked her case, then called her back in and said SHE GOT THE VISA and told her to wait out front until 3pm. So at that time they called her back in and gave her the packet and visa and she went outside and called and woke me to tell me. She said 3 AP cases got visas yesterday.

So now the planning starts as I have to see when I can get off work for two weeks to go over and get her, spend time in Buriram with the family and move some of her stuff back up there.

Now I can finally rest easy and quit worrying when they will get off their butts.

i missed it! congrats, you must be thrilled.
