I am excited so is my wife. The hard part is over with. Having submitted the various forms without one RFE. Oh well I don't mind waiting an extra few months for them to schedule an interview.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-260: Medical and health information

Dear VJ community,

I am writing this thread with an interest to see how many people have had any repercussions from answering yes to the question found on the DS-260 form; 'Are you or have you ever been a drug abuser or addict?'.

In my understanding drug abuse is the same as substance misuse which is how it's commonly referred to in the UK.

Right now I am seriously worried about being barred from obtaining my CR1 visa for a police caution that I received when I was 18 for a minuscule quantity of cannabis

I'm not asking people to divulge details of their personal life, past or current. Just whether they answered truthfully knowing that they have a police record that would incriminate them if they didn't.

(I know lying isn't good but who in their right mind would admit to having used drugs, no matter how long ago it was, if there was absolutely no way of anyone knowing?)

:help:

IR-1 / CR-1 Spouse Visa Process & ProceduresQuick need for opinion about how much bona fide evidence is reasonable.

Thank you so much for your opinions!!

Smelserjl, I really like the timeline idea. But I am having hard time trying to underestand how you actually transformed that on word. Did you do it like with chapters on a book? like X pages about this visits, then this other pages about this months, etc?

Ryan what you said was really helpful. I think I will stick to boarding passes + passport stamps of the 20+ visits, and then for each location select maybe a picture of both of us in it, and/or some few receips from hotels, museums, etc, but without going crazy.

Ugh putting all this together between us both, scanning, photocoping and printing is going to take so much time!

Thanks again to all.

I just sent two sworn affidavits from people who know us. That was enough. I don´t know if you are filing for a IR1-CR1 visa or K1

We've got flights booked for 23rd Sept going from Manchester to Dublin then JFK.

Won't be returning til January 13th unless I get my interview date, will they see this as a problem?

Really hoping they won't deny me entry but I don't think they will because my honest real intention is to return for my interview in London.

My wife is really anxious about the whole thing, who will be traveling with me.

I am pretty sure you won't have problems.

Since I started my visa journey back in January 2013, Ive travelled three times to California. The longest stay was for one month on my holidays.

Everything went smoothly the three times.

One of them I went to the US with my husband and no problems at all either. The only small problem was I got my passport control alone through all passport lines and had to wait much time. My husband went through the American passport lines and took only 5 minutes.

I recommend you to be prepared though. Bring documents to show your ties to the UK, just in case....

IR-1 / CR-1 Spouse Visa Process & ProceduresYes you can visit- IR1-CR1 version

Good morning everyone.

My wife and I, who are both living in Canada, are planning to visit the US during "the process" for her parent's 40th anniversay in December 2014.

We have filed the I-130 and have been advised that it has been transfered to the centre in California.

We are both gainfully employed here in Canada. So my two questions are; 1) When are the "travel restrictions" put on me the beneficiary? Is it the I-130 or after the I-130 has been approved and 2) If we are travelling together will it make it easier for us to cross the border?

Thanks

Travelling together doesn´t make it easier necessarily. In my case, Ive traveled twice to the US having my I-130 approval pending. The first time I went alone and the second one I went with my spouse (the US citizen). No issues at the POE occured in both trips. I, as the foreigner, went through all passports line, while my husband went through American passports line. I was very well prepared with documents showing my ties to Spain. In add, I also carried and email from the US Embassy in Madrid, telling me that the American Inmigration Act do not forbid the entry in the US while a immigrant visa request is processing, but the final decision always relies on the CBP officer.

I thought this could be useful (and I still do) in case of any problem. It is an official response to my inquiry although it does not guarantee anything either. Maybe you can write the US Embassy in Canadá too and try to get a written answer to support the rest of documents.

Its not a good idea to travel, my wife of 20 years - married to a US Citizen, was turned back to Spain because she was processing her I130 and was entering with her tourist visa.  The officers (in Boston) acted like they are gods and have the power to revoke your visa "forever" even though she was traveling with children with American Passports. There was a lot of bullying going on at these check points with foreigners so just stay on the safe side and don't travel regardless of what people say here or anywhere (embassy, people at visa processing, etc). It all comes down to the officer you get and whether he is in a "good" mood or "bad" mood.

I am sorry about your wife´s situation. I disagree with you on keeping on the safe side. What people say here can help others to face their visa journey with personal experiences to take into account. Indeed, it helped me a lot. This doesn´t mean everyone has to make personal desitions about travelling to the US that might take risks. My husband filed I-130 for me last January and, since then, I traveled twice to the US without any problem under the VWP as Spaniard. I already knew before travelling there that the final desition of entry is made by the CBP officer at the POE. I also knew the US Immigration Act does not forbid to go to the US while a visa request is in process. I was clearly informed (and even warned), of that by the American Embassy in Madrid and did all the official research. But, thanks to visajourney also, I decided to go there as better prepared as I can and took the risk. Everything went smoothly. According to my experience, I just tell what I lived.

I wouldnt recommend anyone to travel or not to the US. I just share what I saw, lived and felt to help them to make their desitions. That is all.

hi, I could really use your help!

Did anyone here arrived together with their American spouse? Did anyone that arrived together with their American spouse went back to his home country after their vacation but the American spouse stayed?

As I posted before, I flew in/out to/from the US together with my spouse (the US Citizen). I think it is irrelevant whether you arrive separated or not while you are able to show your ties to your origin country.

Regarding to your return back home without your spouse, the immigration authorities will be never concerned when we are talking about you to leave the country. As a matter of fact, your spouse is the American citizen and can remain in the country freely. In your case, just make sure your visa permit as a tourist (90 days) is not exceeded.

altitoMaleSpain2014-05-12 08:41:00
IR-1 / CR-1 Spouse Visa Process & ProceduresYes you can visit- IR1-CR1 version

Last April 14th my spouse (the US citizen) and I went to US for a week to visit friends and family. So far, both of us live in Spain and we have a I-130 case pending. The first issue was what to do at the passport control, especially in my case as a Spaniard using VWP program. Should I have gone through the GCholders / American citizens line as a family member? Finally, we decided to clear passport control separated. I went through all citizens line and my spouse through American citizens line.

I was very well prepared with documents to prove our ties to Spain.

The CBP agent just asked me five questions:

1. How long are you going to be in the US? One week

2. Which is the purpose of your visit? Vacation (I deliberately omited any reference about visiting friends and my family in law in order to avoid further questions)

3. When was the last time you were in the US? May 2013

4. What are you doing in life? I explained to him my current job

5. How many cash money do you have? 300 USD.

I strictly answered the questions he asked. He took my fingerprints, picture and stamped my passport.

That was all.

No mention neither to my current marital status nor my I-130 application.

I am sure they can not see any link to my visa situation when they check the passport number in the PC. There must be different databases. Otherwise, there is no doubt he would have asked me about that.

IR-1 / CR-1 Spouse Visa Process & ProceduresApplication for travel document - Help!!
Thanks Tay,

I appreciate your help with this one and will stay here until all the necessary documents come through before travelling. Its just very frustrating as i want to earn money and support my family equally and all is safe for me to do so, in theory.

I will try through my lawyer and personally through the offices to expidite the AP. Otherwise i will wait (any idea how long in your case?)

My baby and husband are more important than an acting job and a green card is worth the wait.

Thank you.

QUOTE (TayRivers @ Aug 25 2008, 11:44 AM) <{POST_SNAPBACK}>
If you are doing AOS from a VWP then it is not advisable to leave the USA until you have a greencard, you could be denied entry and sent back to the UK on the 1st flight available at your own expense. If you leave the US without the required documents you will not be able to re-enter as you will be deemed to have abandoned your AOS and will have to apply for a K3/CR-1 and remain in the UK until it is approved.

You should have a chat with a good immigration lawyer who has experience of working with people who are doing AOS from a VWP, remember that you have signed a VWP (I-94w) giving up your rights of appeal. As you may be asked to prove that you did not have intent to remain in the US at your last entry when you go for your AOS interview, do you think it is wise to take a job outside the US given that you are pregnant and trying to get your greencard.

Hi Lyn,

Thank you for your help.

All the info I'm finding out proves I need to wait for Ap approval first and foremost.

I want to work and can safely ( checked with midwife, virgin medical assistance, I can fly no later than 36 weeks ) The film wants me pregnant and will take good care of me.

But you are also right about risking leaving the country without all the necessary documents. Its a wonderful opportunity yet not worth the stress on the baby or myself!

Thank you. I will wait and see what happens.

Hi I have been in the states on a visa waiver and it runs out on the 7th Sept.
I married my husband on the 13th August and filed all documents on 22nd and it was recieved i-131 etc.
I need to go to Britain for an acting job (all confirmed) I need to be there( good money etc) My lawyer is trying to expedite the AP. How possible is this? My job starts 14th October! Only 8 weeks away!

Two other issues.
1 Can i leave on a short trip to Mexico or Canada before my visa waiver runs out or do I have to stay indefinately?
2 Can I apply in person at California Immigration office for a travel document to leave and come back?

Oh and a biggy I'm 6 months pregnant and I need to be back in US for November one month before I am due to give birth.

I hope this is clear and someone can help. My lawyer is difficult to communicate with.

Thank you x

Please speak to your lawyer before crossing any border. If you leave the US while your AOS is pending you may invalidate the application and have to start all over again. You cannot travel without advance parole if you want to continue your application.

Also you may need to check if your chosen airline will allow you to travel so late into your pregnancy. Is a short job really worth the risk of having to stay in the UK until your baby has a passport and you have a visa?

Hope you get the right advice.

Lyn

Hi!

1) a "step-out" to Canada or Mexico does not reset your I-94 clock

I see. But I can still travel if I want to for a honeymoon of sorts before my waiver runs out? Its allowed?

2) yes that is a possibility... it is referred to here as emergency AP

I will try this too I have an appointment. Can my husband post or bring the travel doc to the UK if it does not arrive in time? How risky is this. Will my I-94 in my passport be checked on the way out?

Thank you so much!

IR-1 / CR-1 Spouse Visa Process & ProceduresWhere to find information on single sponsors requirements living overseas
Take a look at the I-864 instruction PDF, too. Take careful note of the domicile requirements.

It's not 3 years savings, either. It would be 3 times the difference you lack in income (i.e. on a household size of 2, you'd need 3x the 125% amount if you have $0 US available income - around $60000).

Have you been filing your US tax returns? They'll be needed.

Probably read this: http://travel.state..../info_3183.html

IR-1 / CR-1 Spouse Visa Process & ProceduresMarrying in LA and Filing for I-130

Canadians don't really need a visa to come to US - we have open borders.

So technically yes, Tourist visa.

Should I apply for a Fiancé(e) Visa (K1) prior to traveling to US to marry there?

Regards

Michael

Then your original proposed plan doesn't really work.  The Canadian beneficiary can't wait in the US while the I-130 and CR-1 are processed, they'd have to leave at the end of their allotted stay (usually 90 days).  You can go and marry, and then as long as the beneficiary has left before their time is up, that's fine, but it sounded like you wanted them to stay put? No can do.  Neither can they work (tourist visas don't allow work) and K1s can't work until they have their EAD.

If you mean "can we go get married in the USA as tourists then go home to Canada" then yes. You can do that.

If you want to marry in the USA and then adjust status to legally stay in the USA (for the Canadian beneficiary) then yes, the K1 would be a route to do that.  Note that with that option, you have to marry within 90 days of entry on the K1, then the beneficiary cannot leave the USA until they either have AP (advanced parole) or their green card comes through.  The soonest they'd be able to leave the USA again would be about 3 months if you got married immediately and had paperwork in good order - same for EAD.

There's a comparison sheet here: http://www.visajourn...content/compare

For all of those options, you as the US Citizen would need to show that you have a US domicile (i.e. you have to actually be resident in the USA), although you can obviously travel.

As you are outside the USA you should be following this guide: http://www.visajourn...tent/i130guide1

You can't move until you have your CR-1 visa in hand but you can visit while it processes.

Note that military personnel on active duty often qualify for expedited processing, so make sure to include copies of hub's relevent paperwork to show that.
