This forum is a good place for people to exchange ideas and experiences. You sometimes get different answers for a particular question/situation. None of us here is an expert because 99% of us only apply for the K1 once in our lifetime (hopefully), therefore a specific situation that applies to me does necessary mean it will work for you.

The Apexvisa service I mentioned provides step-by-step instructions on how to complete the required forms field-by-field as well as what specific proof of relationship evidence to provide. You (the petition) will have to do ALL the work! The instructions provided by Apexvisa services simply layout exactly what you need to do and how to do it - no guess work, no mistake, no time wasted. If you think you can do it alone or obtain "suggestions" from various forum members and try to piece it together, more power to you. I've been thru several USCIS petitions (for other stuff) and know that it is like walking on a mine-field in HELL! For the K-1 VISA petition, I couldn't do it myself and after some research online I found Apexvisa services.

I understand the frustrations of many forum members who are still waiting in line...I wish everyone here will get record time approvals. No one should have to endure the pain of being apart from your love ones. Perhaps some day USCIS will become efficient...well maybe never but hope is a good thing.

I received NOA1 dated 8/7/06. Today I received an email from CSC stating my case has been approved on 9/20/06! That's amazing!!

All I can say about the fast approval is a little bit of luck and a lot of solid no BS information from http://www.apexvisa.us/

Hi everyone!
I'm new to this forum, My girlfriend and I have been together for 2 years, living in Japan. She is Japanese, and I am American. I want her to come to America with me and test it out, whether she likes living there with me, etc. I think we need about a year or so to test this out.
I thought the best way to go about this, is to just get a tourist visa for her, which lasts for 90 days, and after the 90 days leave the country to canada, or mexico, for a few days, and re-enter, and renew her tourist visa for another 90 days. Is this possible? Can you keep doing this pattern, or is there a number of times they limit you?
Are there other options we can take so that we don't have to keep leaving the country?
Any insight at all is greatly appreciated, I am clueless on this matter, and am very frusterated, as I have been searching the forums, and can't really find any definate answers to these questions.

I would say, don't do it. I did the same thing, went to Canada before 90 days was up, stayed two weeks, tried to re-enter but was denied. (The immigration officer told me that $3000 in my account and a return ticket was not enough stay in America for 3 months, he also questioned my motives.) Caused me a lot of trouble with getting back into the country, it's a very bad experience, believe me, and you will be constantly pulled aside for questioning each time you re-enter.) About six months later I got a J1 for a job, then a year later an H1B, I'm now getting married and hoping for a hassle free immigration process.

Perhaps this is splitting hairs but I am curious if anyone has
thoughts or insight into the following issue.

At this site I have been reviewing timelines for I-129F
submittals to the CSC. Interestingly I see a lot of variation
between "Date Application Mailed" and "Date of NOA1" My application
was mailed April 23, 2007 and my NOA1 date, as best I can tell, is
May 17. Another applicant to the CSC has a mailed date of May 9, 2007
and an NOA1 date of May 14. I believe that the difference may result
from the fact that I mailed my package direct to the CSC since I am a
california resident and the other applicant whose case I cite is a
North Carolina resident (meaning that they sent their package to a
different service center and it was transferred to the CSC by that
center, I believe)

Interestingly, Visa Journey seems to be using the mailed date as an
start date for its' estimated adjudication date (NOA2). For example,
Visa Journey is now estimating my adjudication date to be August 31
yet they are stating that the applicant with the May 14 NOA1 date has
an estimated adjudication date of September 16.

Does it make sense to have my adjudication date prior to applicant
with the earlier NOA1 date?

I don't have an answer, as I'm not entirely sure, but I commented on a thread yesterday for someone asking about their partner with a pre-existing condition requiring on-going medical care.  Hopefully, your fiance will be all on the mend by the time your medical and interview happen and the conversation will not be about on-going care, but just in case or if the info I linked to in this thread helps... http://www.visajourn...37087-dialysis/  Mostly, you just might like to see the link to the reasons they *can* deny on medical grounds, of which old conditions *should* not be one.  It may well be that if it's a case of medical care, it ends up falling under a financial requirement.

 

There's no way on Earth your fiance will be the first person to go for a US visa with a previous heart condition, so I'm sure this cannot be a deal breaker.  I assume she's in Australia?  It may be worth researching specifically how medicals go in Australia and what sort of information they need to give a pass mark (try the local area section of the forum).

 

The above post is correct - the I-130 petition asks no questions about health, so don't worry about it at that stage. It has no bearing.

Put France, since they're only going to send you one letter when the petition is approved or not (they may even do this by email). Everything else will go to the beneficiary in France after that. You can notify them of your change of address once you move back.  It's pretty normal for the USC to move back to the US ahead of the spouse, so they shouldn't be surprised.   Good luck.

I don't think they need petitioner birth ceritificate at NVC or at the embassy. I think they refer to the beneficiary.

You can put the interview items in the bag, folder or envelope, they do allow you to bring your bag inside the embassy. I for sure know that the cell phones is not allow and do think that camera as well.


we were only a k-1 and now almost 2 years ago but we used binders for our evidence. i believe people are still using them. absolutely no phones of any sort or cameras inside the embassy they will take them at the security checkpoint and you can retrieve them on the way out. i just used my passport for identification purposes, never provided any birth cert. unless they have changed things that was sufficient although more information is always better since it seems the bkk embassy has become very tough recently.

Shame you didn't adjust while she was here in the U.S. That is what me and my husband did successfully (we married on the spur of the moment on my last visit). However you will be ok (as you mentioned Spain is not a 3rd world country with high fraud rate) and I'm sure it won't take that long for your K3 to be approved.

Unfortunately I have no idea about how the embassy in Spain works. Never been there (I was a UK resident so my situation was different since I was not living in Spain) however, the sooner you guys start with the process the better. Good thing is that she will be able to travel freely in the VWP.

Good luck to you guys and keep on checking this site it is very useful. You can get lots of tips and advice on how to do things.

NVC completed our case in 24 june but still has not sent it to Abu Dhabi. They said that they are scheduling interview date. I'm not sure if Cuba is in "homeless" category like Iran. But if so, NVC schedules interview date and it may takes longer than others.
Also maybe background check in NVC makes it longer.

Finally, I have been checking the status everyday for at least 3 times a day. I just checked my email and it says approved. I had to double check the USCIS website and sure enough :dance:

I then read the email to my sweetheart, even though she was still asleep in the Philippines, but it was worth waking her up. We had to share it together.

Now on to the next step.

Btw, were you able to find a hotel near St. Lukes ? We had stayed at the Manila Pavilion for 3 days. We were very happy with the hotel room, staff, and food there. When I go back this year we may stay there or at another hotel.

Note: we had stayed on the 12th floor which had been newly renovated. Room was very clean and quiet.

I try and call my wife at least everyday if only for a few mins just to tell we love and miss each other deeply, and to hear how our days are going (L)

As every member here who is trying to be reunited with their loved one we all understand. True, some are taking a little longer than others and we can only give support and encouragement.

I'll tell you a few weeks ago I was at this other forum (asawa) and someone had posted a link to a site. I had clicked on it and there were these members posting songs to clips they had made. I clicked on one of the songs and it was the one where I had remembered my wife always singing while I had visited her last October. I lost it. Talk about not expecting something like that. :crying:

Me and my wife didn't sign our attachment pages also, but this is how we handled both the emplyoment and address questions. I had typed and put this in the first lines of 4 pages each for me and my wife:

“Form G-325A, Q: RESIDENCE LAST FIVE YEARS”, your name
“Form G-325A, Q: EMPLOYMENT LAST FIVE YEARS”, your name

Just insert his name in the other attachment pages.
