Hi this is my first post and I would like to try and get something cleared up, as I keep hearing different answers.

My wife is a US citizen, I am a UK citizen. We have known each other for around two years. We married in January in the US on which I travelled to the US with my family on the VWP.
I have a return flight booked for april. So not to over stay my VWP

I am spending the 90 days of my VWP with my wife so we can be sure I would like to reside in the US and to be sure we can live together (its all going great!)

So... I have no intentions to change my status from the VWP. I will be on the flight back to the UK in April, and she is visiting me in May. We will be filling for a CR1 visa and hope to reside in the US California.


My question is...

Can we file the I-130 now while I am still in the US or should we wait till I fly back. Obviously we want to minimise the time apart from each other and if I can file it now we can gain some time, and still be together.
There is a question on the I-130 asking if your spouse is currently in the US if so how.

I had a basic meeting with immigration yesterday. The kind you can juts book through the website and then wait to be called to a desk.
I stated my case and even asked the lady twice to be 100% clear if its ok to post the I-130 now while I am in the US. She said yes and just attach a copy of my return flight info.

I was surprised at her answer, and I feel like I need more confirmation that this is OK to do. I felt she was just a form filer/advisor and I knew more about my visa possibilities than she did.
(sorry if that sounds like I am undermining someones job, I'm just trying to explain my concerns)


I really don't want to jeopardise my case in anyway, and don't want to seem like I am cheating the system by claiming immigration on VWP.
I have full intentions to complete the visa processing from the UK, I just wanted to gain an extra month really.



Anyone done this before? advice would be greatly appreciated.

I'm glad you brought this up coz I was gonna ask too. Yeah, prices of one way tickets are ridiculous and therefore I would obviously only buy a return and not use the return. I don't think it's possible to book a return ticket with a date over 3 months. Maybe if you get a refundable/changeable ticket then it's possible but they are stupidly expensive also. I hope I get one of the KLM deals and only pay like £350 to San Francisco!! I sure as hell ain't paying £1900.

Hi there.
Quick query...last time I went to the USA was in April but this was prior to K1 application. I know that the tourist visa has changed since (or I think it has) and that we now have to fill out a visa online like 3 days before travel. Am I making this up...did I dream this?
If not, how do I go about doing this or will I get an automatic email or something after purchasing a flight ticket?
Also, I hear a lot about peole getting refused entry while in K1 process depending on factors like what country you are visiting from etc. Coming from the UK, what are the chances of being refused entry to the USA for a holiday? That would suck and really makes me feel sick that they could do that to people. I keep telling my fiance that I can't come and visit in case this happens. We just spoke to a friend who is an attorney that deals with immigration and she thinks I shouldn't have any problems.

Any fellow Brits who have been in this situation with any advice would be a great help.

Wow, thank you so much to everyone. Myself and Naphtali had a meeting the other day and we managed to get everything sorted. He called the USCIS and they said that it will not have made any difference that these forms are late. I have now sent him my G-325A, my letter of intent, my phone bills, photos, passport photos. I also put in a copy of my birth certificate and my passport...maybe I didn't need to but we decided to get as much stuff as possible anyway.
I think it was Kim who said that all I needed to send him was my G-325A coz that's all that matters at this stage but I reckon he'll panic and send everything he can.

Should we send it all in asap or should we actually wait for them to send the (very definite!) RFE?

I am no longer telling people anything regarding when I may be going coz I don't wanna think about it. He has talked about coming over in October to visit but I don't know how the UK immigration people work and will he get in alright? I can't imagine doing it the other way with me going to the States and possibly getting refused entry, that would kill me.

While I'm on the subject of asking you guys questions...when I finally get the all clear to go, should I fly into JFK just to get a work permit? I don't know if that's a certainty or is it way more complex. I'd like to be working straight away but I often hear that the only thing to do is get married asap after arrival to allow a quick work permit or fly into JFK. I just wanna know what the chances are of getting one that way.

It IS four pages of the same information but once you fill out the first page Acrobat will automatically fill out the other three pages. Any change you make to any page will appear on the other three. If you have this free software you're able to save the forms.


I didn't realize that the other pages get filled out automatically by Acrobat. Nice. I tried that Foxit software but it only saves data entered within Foxit, and it doesn't automatically fill out the other pages. I think I'll stick with Acrobat! :)

My letter was similar to the one you described. (And the situation was similar too!) :)


And it worked well? I noticed that you received a RFE (from you signature). I'm assuming that it had something to do with your lack of proper evidence?

I still don't know if the description in #2 is acceptable, but I think I'm clearer about the documentary proof of meeting bit. What I'm planning to do is within the supplementary letter that describes how we met (#2), I'll also say something like "I have also included copies of receipts and other documents as evidence of our ongoing relationship including: photos, grocery receipts, Munich ATM receipts, Shared bank account, Munich Lease, etc."

Please let me know if you think this will be acceptable as proof of meeting and documentary evidence that we've met. Thanks!

And, as I mention in all posts related to these concerns - NEVER FLY INTO SAN FRANCISCO INTERNATIONAL AIRPORT. They're just really, really good at finding reasons to bounce would-be visitors.


Bummer! That's most likely where she would flying into.

Oh - important questions - does she have ANYTHING in her background that would cause them to pause? Arrests? Ever overstayed anything before? Has she been in and out of the US in the past (showing she can follow the rules is as important as evidence that she's broken them).


Her record is clean, BUT two years ago we had a very bad experience at JFK airport and she got into a bit of trouble. Her son's passport wasn't machine readable even though all passports had to be machine readable several months earlier. That, along with the power trip the border office went on, didn't go down so well with my German I-say-exactly-what-I-think girlfriend. She was fined and apparently her 8-year-old son was put on some sort of probation - as if he was an international criminal! However, since then, she entered and left once without a hitch (without her son).

I'm still a little concerned about timing of any visits. I wouldn't want her to plan to visit for a few months only to screw up the K-1 process because she wasn't in her home country...

I'm currently living in Zürich, Switzerland and am in the process of completing my I-129F. However, I plan to find a new job in the States soon and will likely be moving by May 2007. In the meantime, my fiance would like to visit me in the States. A few questions spring to mind:

1. Can she even do this while my I-129F is processing?
2. I know she needs to be in Munich to process the K-1 visa, but is it possible to time things so that she can spend several months in the U.S. and then return to process her visa? Or is timing too important not to be in Munich for an extended period of time?
3. If she does visit, what should she tell the border police?

Have you tried going to a Western Union location there and purchase some US Money Orders from there?


I asked at Western Union and they said they "only send money from person to person."


We sent ours from overseas also. We used a money order drawn on a bank here in Grenada. Most banks (if not all) will draw the draft in US dollars if you request it. They may charge you a small fee (we paid about $4us extra).


And USCIS will accept that? Also, I don't have a bank here in Zurich. I wonder if a bank will give me a money order even though I have no account. I'll find out...

The I-129F requires a payment, and I've already read the many suggestions for using a personal check. However, I'll be sending the I-129F petition from Germany and I don't have any personal checks for my U.S. account with me. If I don't use a personal check, what other forms of payment can I use? So I'm just about to send off my I-129F Petition for a fiancee visa and was wondering... if my fiancee could (I realize it's difficult but possible) get a job in the States, how would this compare to the K-1 fiancee visa? For example, if she was working in the States could we get married and then could she remain there? Does that make it much more complicated? Hi, I'm back. :blush: I'm a bit confused. I always thought that I would get the I-129F packet together (which includes copies of certain documents like my passport, birth certificate and other evidence), make two copies of the entire thing and then send the packet (not one of the two copies I just made). But on this guide it says:

IMPORTANT!
Make TWO copies of the entire package before you send it in. This includes checks too. You want to have a perfect replica of the package you are sending in. Retain ALL originals. The USCIS has the right to check them by issuing an RFE (Request For Evidence). If you receive an RFE, follow the direction exactly, and make two copies of what you sent back.


Does "retail ALL originals" refer to original evidence like train tickets, receipts, photos (which I assumed) or does it mean retain original copies of the forms as well (which I didn't expect).

Can someone help? (On a brighter note, my I-129 F is sitting in a neat pile in front of me, just waiting to be copied. How did it take so long? :hehe: )

Yes, that's what everyone says around here. I actually did look (surprise, surprise!). I'm sure the answer is in there somewhere, but it's not on the guide index and it didn't give any clues as to where I should look. As for the search, well the first time around I could barely tell the ads from the search results. I thought I should clarify my question but that didn't seem to help much either.

I'm really thankful that VisaJourney exists because it's a good resource and a majority of its members are helpful. But honestly, I've seen one too many visitors told to read the guides and/or use the search feature. I'm glad that some of you have this all figured out and can navigate this site, but not all of us are that gifted. So please, before you put up your little sign, remember that this site is not the easiest to use, it could be better organized and the search has too many ads in the results. The whole visa process is already stressful enough. Please try not to make it any worse by assuming that we were too thoughtless to look for answers (or say thank you in big obvious letters).

I filed my I-129F to the Vermont Service Center in March and received a NOA1 in early April. Since that time I've moved from PA to CA for work. The address I used in PA is my parents so they will still receive anything that comes.
  • How do I go about changing my address?
  • How will this affect my case? Will it transferred from Vermont to California? (Please no)
  • If it slows everything down a lot, should I even do it immediately? Or should I wait until I get the NOA2?
What does everyone think?

As to your other question, if you read the wording carefully, it does not say "application approved" it says "application pending". You have an application pending because you have yet to receive the visa. So, yes, you need to change your address.


No, it doesn't say "application approved" it says "approval notice sent" which is practically the same thing right? From the way they make it sound, the application or petition refers to the I-129F, which has been approved.

It doesn't matter much, use your current SF one since that's where she's heading first. You can put a more permanent one when you file AOS.

But one thing that just occurred to me: in her instruction packet (aka packet 3) she's asked the address where she'll reside when in the States. I'm currently subletting and planned to get a larger place when she does arrive. So she couldn't even use this address if she wanted to. I guess she'll just have to use my parent's Pennsylvania address after all (which may be for the better)? Hmm.

I filed a I-129F from my parent's address in Pennsylvania because at the time I was still living in Europe and didn't know where I would end up. Since then, I've accepted a job in San Francisco, CA where I now live and work.

After posting to this thread I thought I should change my address immediately, but since I've posted to that thread my mother has confirmed that I've received both the NOA2 and receipt of approval from the NVC at the Pennsylvania address. The case has now been forwarded to the U.S consulate in Frankfurt. Just to make sure, I checked the status of my petition at USCIS and it has indeed been approved.

But after looking closer at the USCIS change of address site I found the following:

U.S. Citizens who do not have an application or petition pending with USCIS are only legally required to notify USCIS of a change of address if they have previously submitted a Form I-864 on behalf of someone who has become a permanent resident. If you have previously submitted a Form I-864 for someone who immigrated to the U.S., you must complete a Form I-865 within ten days of the completion of your move.


And that was it. On that page they don't even recommend that you change your address. So if my petition has been approved and sent off to Germany, is there any point in changing my address? If my fiance puts my new address on the consulate forms, will they care? Would love to hear your thoughts!

Just skip the form? Can you find an official resource that says the same thing? I mean, this isn't just a form we're talking about; the entire petition process would have to be repeated. I emailed the consulate and they explicitly told me that they need the aforementioned letter.

Everything makes sense except for "It is my understanding that pursuant to 9FAM 41.81 N3.1 (Period of validity)" What do I put in place of (Period of validitiy)? helpsmilie.gif Does it really have to be notarized?!

Also, I didn't remember that the petition will expire until less than a week before it actually expires! If they receive the letter AFTER the official expiry date, can they/will they extend it? I'm so worried that it will expire and there's nothing I can do ohmy.gif

Used to be 70 for Biometrics and is 80 now but Biometrics fees don't have anything to do with embassy interview fees.
They come later.


Actually, I just received word from the Frankfurt consulate and they are asking $85 per applicant, including children. My fiance didn't mention this so I hope that she has paid it already!

I have a book that says the fee for fiance applicants due at the interview was $100 and an Affidavit of Support review is $70. However, I realize that there is a new fee schedule in effect now, but I can't find anything about the interview of Affidavit of Support review fees. Can anyone please tell me what the fee is now? Thanks!

I searched for my now-spouse's name in my email and printed out the 20 pages of results (with just date, subject, a snippet of text, and who I was talking to) rather than print the actual emails.. I think that gave them a good sense. Could this work in your case?

My case is ir-1 and i have not applied for k3 too. NVC has assigned case number for me on june 24 but still have not scheduled interview date. I recommend you to not be a planner in this case. just be cool and do your own life until any news from NVC. I know it's hard, specially for couples who used to be with each other for years. It's more than one year that my wife moved to US in order to apply for me but actually i'm not expecting to have my visa in hand earlier than next spring. In this stage, I sent a lot of emails to NVC and each time I received a frustrating reply which stating they are scheluling interview date and no more information is available. please be informed that I'm in Iran and my interview embassy is Abu Dhabi so hopefully your process time is more shorter than me.

Hi,
finally my waiting is finished and i received my visa the day after interview date in Abu Dhabi.
my interview was so simple and fast. A kind lady asked some question about my job and my wife's situation in US. (about her home, job,...). then she asked me to come the day after in order to issue visa.
