sounds like the attorney is totally trying to scam you max, the packet 3 papers are the easiest don't pay one baht to that guy. follow the guides and ask here you can get very sound advice. UNLESS your case is somehow complicated there is no need for an attorney. if only i had known about vj before i filed for the k-1 i totally could have done it alone with these guides since our case was not complicated. told our attorney to ####### off and doing the aos solo (so far so good). best of luck to you!

update for you on our aos devpaik

hubby had his biometrics today, it only took about 15 minutes, they even let him preview his photo in case he didn't like it good.gif.

Hi Everyone,
I wanted to let you all know my fiancee and I got our noa2 oct23! Now it is on to the next step of waiting. I feel we are ahead we just got medical and police report done and now waiting on nvc case number. How long approx will it take to get interview date. I have thai attorney to help us. good luck to everyone in there
journey.

congrats on your noa2! there is no hard and fast rule to get your interview date in our case our petition arrived in bangkok a little over a week later and it was about 2 months later that the interview was scheduled. a couple of things you can do is pre-emptively get all your packet 3 info ready, and send it in before you receive the request (we waited until our case had been in the embassy about a week to send it by ems to make sure it was in the system) then the packet 4 (interview letter is generated).

also check the timelines here it will give you some comparison to other cases similar to yours. GOOD LUCK!

Thai Mom...glad to hear you'll be in the U.S together shortly that's wonderful news enjoy!

Hi all,

It's been a long time since I have written here, but I do stop by daily to read the new posts. My "visa journey" has come to an ignominious end. My ex-fiancee has made it known to me that for a long time she has known she will not marry me. It is rough finding out so late in the game, but it is best to find out now than when she moved here.

I envy you guys who this works out for! Good luck on your continued journey...

Alvin

btw: What do I need to do about the visa? She was issued the visa a few months ago.

alvin,

sorry to hear things didn't work out for you, best of luck to you.

Thanks roi aggie and Kang Lang.
So kang lang, you guys waited one year before applying for aos and ead? And you had no problems?

no we have had no problems our check was cashed on this past friday (we mailed our package on monday 29 sept. it arrived on wednesday, 1 october our anniversary), as roi aggie said it isn't recommended but it is not an automatic problem to do it later if you did indeed marry in the 90 day time frame. you do NOT have to have the aos started in the 90 day window. i spoke to a two immigration attorneys (we terminated our own) you can wait but of course during that time you are in limbo. also there a quite a few others on the K-1 visa who waited and have been approved no trouble here on vj you can maybe look them up and read their stories as well. i will definitely keep you posted on our progress since we filed so late. GOOD LUCK!!

Hey quick question guys...

So my fiance arrived in the US on the 15th of September, but just wondering HOW long do we have to do everything? Like, getting married is the first step right?

I know a fair amt. about the "getting the visa" process, but now that we're in the AOS stage, I'm LOST.

I tried to check the guides but wasn't able to find anything besides a guide on how to assemble the papers, etc.

Thanks!

Also, another quick question about the expiration date of the K1. Does this only pertain to GETTING married before the date of expiration, or does it pertain to getting married and applying for AOS (all this needs to be done before the expiration)?

Thanks again

Devkpaik,

The K-1 visa is a one time use, so it is finished. The only thing showing your fiancée is "In Status" is her I-94 card that she filled out on the plane, and the bottom portion stapled into her passport. You have 90 days from the date on the I-94 to FILE for AOS, which means you need to get married within that period of time. DO NOT procrastinate, yet don't worry about rushing either. 90 days is a lot of time to work with, as long as you plan wisely.

You will need a copy of the I-94, K-1 Visa, Passport page, Copy of your NOA2, Marriage certificate, translated birth certificate, passport style photos, and Immunization record.

Too many times people seem to "misplace" their I-94 and NOA2. Don't loose them, as they are still important, and costly to replace!!!

Getting a SSN at this time also allows you to fill in an extra blank on the I-485 and on the Biographic History form, but if you don't have it, it won't cause any problems.

So take your time, plan a nice wedding, but try to do it in a timely fashion. The immigration process doesn't stop until you get sworn in a naturalized citizen!!! Even after AOS you can't completely rest, though you do get a rather lengthy reprieve until its time to remove conditions.

If you have any other questions, let me know!

Robert

hi there,

actually you are incorrect on the 90 days to file AOS there are loads of threads about people who have waited and were approved with no trouble if you want to get other opinions. you can file at any time some have waited several years (although you cannot travel abroad or work) and we waited a year to the day the main thing is that you MUST be married in the 90 days. it's a good idea to file sooner rather than later it is the uscis and who knows how long it will take to get approved. good luck!

I have an interview question. My fiancee tried twice for a 'B' visa (and failed) before we applied for the K. I was there for one of the B interviews, but not the other. We didn't realize at the time that tourist visas have such a low approval rate in Noi's situation (poor, rural, etc.).

Her English is pretty good, but she's not fluent. At the time, I thought it would reflect well on her application if she opted for an interview in English. However, she felt that conducting the interview in English made her a bit nervous and that there may have been some misunderstanding. (for the record, I even had trouble hearing the CO through that little bank-teller thingy!).

Anyway, she's saying now that maybe the K-1 interview should be conducted in Thai instead of English.

My question is: how will that affect her chances of approval? Is she more likely to be approved if the interview is in English, which would be seen as evidence of our "common" language?

hi there, my husband also was denied for 2 b visas AFTER having been approved for 2 in the past (he came to the u.s. twice) so no bearing on your k visa at all. they will likely ask a couple of questions about them (my husband chose not to mention his girlfriend here when he applied. the interviewer did question me about them when he had his k interview) at any rate my husband started his k interview in english and wound up finishing in thai no problem. our interview was under 15 minutes and successful.

good luck!

hi rolln, welcome!

it is alot easier to conduct business if your fiancee has an ssn. alot of banks require it to add or open new accounts in both names and also needed to get an identification card in most states. although some just waited until after the marriage and aos to do it so as not to deal with names on the documents (maiden name vs. married name) it's really a preference.

also please fill in your timeline! it helps others alot!

good luck to you!!

another pesky question. my SIL is in the pacific northwest as an au pair and would like to "change" her visa to a student visa. of course she wants me to sponsor her and i said i would consider it but have to really think about it givent he i-864 requirements (nothing against her just nervous signing that document i take it very seriously) my question is can the visa type actually be changed? if so how would we go about it? would she need an attorney)

How are you guys doing?

a jet lag trick is swimming! i don't know why it helps but it does, my husband thought i was crazy but when I made him do it last year when he returned cut his jet lag down to about 2 days.

we are doing pretty good, think we finally got his medical sorted out, he's going today to get his tb skin test result and find out if his mmr anti-body test result is back hopefully, then we can just finally file for AOS fingers crossed.

hi all!

i posted a question a couple of days ago asking what to do if you like my husband didn't get a copy of the medical report and could not get a copy from bumrungrad...well i found the answer!!!!! (hopefully no one needs it but just in case)

the civil surgeon in our case happens to a be a doctor i've known for years and his nurse told me to just have my husband go to a lab and get a blood test for the mmr antibody (meaning definitive proof of immunization). it takes about a week to get the result. once you have that it can get the civil surgeon to proceed with the remainder of the i-693a form for aos.

good luck all!

Read the interview review, Roi Aggie. Good review. I'll send it to her to read. She has had experience with the embassy before and was not very
happy with them so I am hoping she will keep her cool and just answer the questions and get the visa and we can get out of there.

2 quick questions...
1) How did you guys get the SS card? I filled out that I wanted them to assign a SS# to her on the visa forms, but do we have to go to the SS office to get the card or do they just send it to her in the mail eventually?

2) Can she get a state ID while we are waiting to get married or does she need her green card first?

Thanks all!

Steve & Bualai

hey there steve & bualai,

it turns out that regardless of checking that box for an ssn you are very unlikely to have one assigned. just wait about 10-14 days after arrival and go to your local ssa office. my husband's ssn arrived 7 days after we applied. once you have the ssn you can get a state id in some states. we were able to in california it also arrived 7 days after we applied.

good luck!

Must be one of the "perks" of living in California (along with the inflated salaries, right?)

When I called the CS office nearest to my home, they told me to come in between 9 am and 4 pm and let them know it was for immigration physical. Any day, no appointment necessary. The only glitch was that the admin that made sure all the paperwork was completed ended up getting ill (hospitalized) and was out for the week following Rin's visit. No one else in the office (not a small office as four of them are listed as CS) had a clue as to how to do this admin's paperwork. So we had to wait until she returned. I actually felt sorry for her as her boss was taking work to her in the hospital. She got out on a Friday and called me at my house Saturday morning to let me know I could come by and get Rin's paperwork.

BTW - the immunization transcribing onto the I-693 was included in Rin's $117.50 (it was $30/child as they did not have an exam). Does your CS actual charge additional for that when you are also having a medical with them? What a crock....

hmm inflated salaries...sure doesn't seem like it! wow that's a pretty crazy story poor administrator compiling work from her hospital bed. thankfully it all worked out for your family at a bargain price if i do say so myself.

btw thanks so much for the link to the other thread i think i may have found a less expensive alternative.
