K-1 Fiance(e) Visa Process & ProceduresAffidavit for Support

Hope you don't mind if I add a question, we seem in a similar situation.
I am a mom of 3 as well with an English fiance. I also am about to graduate medical school (in May). I will be matched to a residency program in February (start date of July 1), and this is a binding contract, but will not receive pay until my residency begins. Does anyone know if I can use this future income for my Affidavit for Support. Being in medical school for the past 4 years, I have not had income but obviously will have substantial future income, just wondering if this will count or if I need a cosponsor. Thanks and good luck to us all. :)

Short answer: No

I-134 is concerned with your current income not your past or future income. You need pay stubs and employment verification letter which you can only get from a present employer

K-1 Fiance(e) Visa Process & ProceduresInterview on 27th March, last minute panic - HELP!
QUOTE (KimandRuss @ Mar 7 2009, 01:18 AM) <{POST_SNAPBACK}>
He makes plenty.. not to worry.

I don't know why his tax forms are so many. Normally people just get a transcript from the IRS to send.

They dont need to see anything about your finances. The I134 is filled out by the petitioner (USC) to help ensure you will not become a public charge once you are in the US.

You can alert DOS of the address change or simply tell the Embassy once you are there. If he just filled out the affidavit they will have the current address anyway.

good luck at your interview.

Wow, thank you so much. Yeah, I don't know why he has so many bit of paper for tax return either but he assured me it was right. Man, are they gonna laugh at me when I rock up with all these stupid bits of paper?!! He filled out the affidavit before he moved but I hope it won't be a problem to change address. Thanks for the advice. XX

K-1 Fiance(e) Visa Process & ProceduresInterview on 27th March, last minute panic - HELP!
Hi there folks.
Today has been super exciting as I finally recieved an interview date. It's on the 27 th March but I'm praying you well informed folk will help me with a few things I've been worrying about.
Here goes...so my personal finances simply aren't great but my fiance has filled out the I-134 and signed that bit of paper to say he'll be responsible for me as he makes a fair bit of cash. He has sent me his tax returns (is 68 pages normal by the way?) for last year as he made $70,000. Is this enough? I have no idea about the poverty line and the 125% thing. I switch off when it comes to money talk. If this isn't enough then we're screwed coz I have no idea who'll be a sponsor for us now at such short notice. Panic panic.
Also, since handing in all our millions of forms, he has moved to our new place. At what stage do I tell the embassy he has a new address bearing in mind the interview is in 3 weeks. Will they go nuts if I leave it til then? He's only been there 2 weeks anyway, reckon I could just pretend it's been less on the 27th?
Oh and do I need to take a bank statement of my own (embarrassing) finances?

Thank you guys, you really are life-savers in a crisis.

K-1 Fiance(e) Visa Process & ProceduresChange of Name Before Marriage
Hi All,

I have been planning to legally change my name but was not able to come through with it for some reason. I have petitioned my girlfriend on 01/03/09 and if everything goes well she should be here by mid-year. I still plan to go through with my name change but am quite worried that it might affect our petition. But I'm also thinking that there should not be any problem since it's just a matter of removing 2 letters from my old name to the new one. I just want my name to sound more American and it would be nice to have my "new" name on the marriage certificate. I filed the petition using my legal name.
Do you guys see any problem that I may run into by pursuing to legally change my name in the middle of the petition process? Again, I'm not totally changing my name to a different one. I simply want to legally use my nickname which is a 2 letter difference from the legal one.

To add to this conversation, I was able to go to the local Wat and a monk translated a document for me. It had the official stamp and all. Gave them a $20 donation.

Thank you all for your responses. I have the document regarding my partner's name change scanned on my computer. There are 3 Wats located nearby, so I plan to go and see if I can get this documented translated by a local Thai person (monk, etc..). I will ask about getting the document stamped to show the translation is legitimate, correct? Wow I did not even consider this option...thank you!

K-1 Fiance(e) Visa Process & ProceduresQuestions regarding K-1 packet and legal name change
Hello all,

My partner and I are finishing up our K-1 visa packet to do list and I wanted to make sure we have everything. One more somewhat obscure question. My partner legally changed her first name and has the legal document in Thai. Do we need to send this in with the I-129F packet and if so, I assume we need to have the document translated into English, correct? Any input regarding this would be greatly appreciated.

Now I would like to go over our packet to make sure it is 100%.

She will be sending me via FedEx (I am having her send me one extra original copy of everything just in case):
5 orginals of G-325A form with original signatures/dates.
2 original letters of intent to marry with original sig/date
2 passport photos
translated document regarding legal name change (if necessary)

I will send in
• Payment in the amount of $455
• I-129F
• 4 copies G-325A and passport style photo (Michael)
• 4 copies G-325A and passport style photo (Atitaya)
• Birth Certificate/US passport (Michael)
• Letter of Intent to Marry (Michael & Atitaya)
• Proof of having met in the past two years
• Proof of ongoing relationship
* Translated document regarding legal name change (if necessary)

In regards to G-325A form I told her to write in "I was a fulltime student and was not employed prior to May, 2007" so that the past 5 years of work experience (or lack thereof) are documented. We both put an X in the other (specify) box regarding nature of application and wrote in "I-129F". Her signature is basically her printing her name...I hope that is OK because it will look the same when she prints and signs her name.

On the I-129F form and G-325A form where it asks for "other names used" does she write in only her changed first name or should we write in her changed first name with surname?

Thank you all for any input and thanks to everyone who created this site. This is such a great resource and I will be updating out timeline once we get the 1st step in the mail. Hopefully I can help people too in the future.

Kind regards,
Mike

Thank you Terrie and Eric for this advice as this worked great!!

K-1 Fiance(e) Visa Process & ProceduresHow to print Skype history
My fiance and I use Skype almost everyday and it must be 75-80% of how we communicate. I have been unable print our history and do not know how to proceed. I searched all the options and could not find anyway to print. I've tried highlighting the whole history so I can copy and paste into a word document. Finally I've tried navigating Skype's website to send an email to tech support but I keep getting routed back to the "support page" that isn't helping at all.

Any help would be greatly appreciated! Our Skype history is a huge part of our proof of continuing evidence of our relationship.

Thanks and Happy Holidays!!

When was this form updated? My fiance and I were waiting for the new version before we mailed the packet. Will they accept the old form as of July 6, 2009 receipt date? Or is it likely that we will be receiving RFE for it?

Yes they will accept the one you sent because even with the new version they put for 3 days, it still showed that older versions would be accepted

mistake?

Oh no. My fiancee just signed and mailed out the new form to me. She made 4 versions. What should i do? Can i use those or have her send the old version. Wow, I'm off to a weak start here.

thanks

I called the USCIS and the operator didn't know why the new form was replaced by the old one, but did say there was/is some maintenance happening with the website. She said i can still use the new form. So i guess i'm cool. Geez, i barely started the process and I'm already freaking out.

Please report back whether you have the same font problem with the year fields in the residence and employment history sections that I and the Adobe tech support people had. You can always write the years by hand but there's apparently a font problem with the form as currently produced.

I had the same font problem with the year fields. I was using Adobe Acrobat Pro on Mac OSX. I spent quite awhile trying to change the font. I ended up writing that part by hand. BTW, I went with 4 copies of the new document.

Yeah, I don't think pen/pencil is much of an issue.

But you are right, maybe the sharpie caused some smudging. I'll be the first to admit that my penmanship is terrible. A third grader with ADD most likely writes better than i do. I'll send everything again and be *extra* *extra* careful. Like have somebody else write it for me... blush.gif

Thanks all!

Perhaps the names smudged during delivery? I tried using a sharpie marker on the back of the passport photos I submitted but it smeared on the glossy finish of the photo paper, and was illegible. I took a ballpoint pen and lightly wrote the names to not make any imprints on the photos.

If you had the bag marked with your names and the paper the bag was stapled to marked with your names I would think the adjudicator would be able to figure it out. But then again if the names were not legible on the photos themselves maybe it was enough to issue a RFE.

I would just send everything they ask for again. I've seen this before on VJ where someone was confused because the USCIS asked for docs that were already submitted.

Keep us posted.

K-1 Fiance(e) Visa Process & ProceduresPlease help me understand my "non-descript" RFE.
Page one is irrelevant. It is the generic blue form that asks me to comply with the items listed on page 2. I'm not posting it. It is pretty clear that my RFE is due to issues with my passport photos. This is how i submitted them.

2x2 from a studio
Names printed on the back.
enclosed in a plastic bag (thin baseball card style)
Name printed on bag.
Bag stapled to white 8.5x11 piece of paper.
Name printed on paper.
Paper placed behind the corresponding G-325a

One possible issue may be that i printed my name on the back in fine tip Sharpie and my financée wrote in pencil. Last night she was saying that i should have done mine in pencil. Does that make a difference? The Photo Guide doesn't say one way or the other. I'm leaning towards pen.

I think i did this part pretty much to the letter. Is it a pen/pencil thing? What do you recommend?

thanks again everyone.

Yes, i sent a photo of the both of us. Really, i think the CA center is sandbagging. I'm a professional photographer by trade and i understood what was required for a photo submission. When i was first notified about about my RFE ,i contacted another member with a similar timeline to see if he had any action. At the time he didn't, but soon received an RFE about a document that was included in his original submission. A relatively simple one at that...

I believe this is the correct answer. Your photos didn't come up to snuff with the criteria for valid passport photos.

The 3 paragraphs with the asterisks were just general guidelines/instructions for the petitioner to reply to an RFE requiring submission of document(s).

The request for photos below the line just means they want valid passport photos & that is all.

I didn't get any RFEs, but that's how I would interpret this one.

I received my RFE today. I don't understand what information I am missing. Is it really asking for passport photos? 2x2 passport photos where submitted. It also mentions translating foreign documents, which i did as well.

I'm most confused by the first item. Does this mean i must submit a complete copy of my original submission along with what is missing in this rfe? What am i missing? This all just seems like protocol for how to submit missing items, but i don't see anything specific here.

Thanks!

anything you have translated for the uscis just needs an accompanying document "certifying that the information is true and correct and that they are familiar with both languages. so for the visa process you won't need the stamp. as a tip make sure you get multiple copies of any documents you get translated for the aos process after the marriage.

How many wedding dates do you intend to have?! There is no reason to rush to a court house to get married, because 90 days is plenty of time to plan and get married, especially if you've already done some ground work, like finding a wedding planner, or someone like that.
Robert

Well in my case, the rush is saving 1000s of dollars if we have the wedding by December 31. The difference in income taxes between filing "single" and "married filing jointly" is pretty big. I know it's not romantic, but we discussed it and she thought it was a good idea... and after all, we had the unofficial Buddhist ceremony in Thailand back in August.

So we are doing the same thing. Courthouse wedding in December... family wedding later.

Well that's one good reason for getting married by Dec 31st!

Yeah, in our case, not sure it would have made up the difference for the more expensive flight though! Oh well.

Does anyone know a good Website (free or otherwise) to download contemporary Isan music? I kind of like it (in small doses) and was hoping to surprise my SO by having some MP3s for her to make her feel at home.

Thanks!

What a GREAT IDEA!
My Tilac said she didn't want to talk to any Thai people here once she comes because she "heard" (geez, they put SO MUCH WEIGHT on gossip and what they "hear") that the women are catty and think they're richer than so and so and the catty competition is just as bad here as it is there (I do know it's ruthless and nasty there).

I think it would be great to find some Thais locally but she told me yesterday "everybody say not do...everybody say lady not nice once they move to farang country". I tried to tell her everyone's different but that's what I get for finding a small town girl. They rely heavily on what they hear and gossip.

I guess all I can do is try and show her there are plenty of others just like her over here.

That's interesting. My fiancee and I had the exact same conversation -- me trying to hook her up with the local Thai community and she saying she's not interested. I wonder if that will change though.

That's too funny. I have been trying to get mine to meet Thai people locally since she's been here (she got here in September). She said she doesn't really care if she does or not, although she has met a friend at school who is Thai and is from Issan as well and has been here for two years. That girl can never hang out though because she's always working.
I myself haven't met any Thai people at my college, but I think even if I did she wouldn't be too interested in hanging out with them haha.

It's been since the 18th of december when the NVC said they sent it out to Bangkok, but the embassy keeps telling me that they have not received any documents for our case. Should I be worried? Maybe it's just the holidays...

it took us about 3 weeks for the docs to be recorded at the embassy so don't panic yet. they don't necessarily process the pouch the same day it arrives don't panic unless say about 4 weeks. it will move pretty quickly once they record it so if you haven't already to save some time, order your fiancee's police certificiate and get the medical done (we did that and sent our checklist back before the one they mail to you, saved some time in getting the interview scheduled).

I'd like to be able to scan her Thai BC, and upload to a translation service who will email back the translated document for AOS.

shawn, we were in a similar situation. 2 suggestions i recommend contacting a court reporter very inexpensive relative to "translation services" since they only need to certify that they are fluent in both languages. or go to your local thai temple, since you are in socal you might want to make a trip to a wat, loads of people there could do it for you. Kang Lang,

How's the AOS process coming alone?
Any updates for us?
Hope all is well. smile.gif

hilton,

that sounds like you have finally gotten some good news i'll keep my fingers crossed until you say she's received her visa in hand!

thaitousa,

your fiancee must get a certificate of being single, it is required of all. it's a document to prove that one has never been married or is officially divorced if previously married. the aumphur is where it is obtained my husband said it was easy to get.

GOOD LUCK!!!!

sounds like the attorney is totally trying to scam you max, the packet 3 papers are the easiest don't pay one baht to that guy. follow the guides and ask here you can get very sound advice. UNLESS your case is somehow complicated there is no need for an attorney. if only i had known about vj before i filed for the k-1 i totally could have done it alone with these guides since our case was not complicated. told our attorney to ####### off and doing the aos solo (so far so good). best of luck to you!

update for you on our aos devpaik

hubby had his biometrics today, it only took about 15 minutes, they even let him preview his photo in case he didn't like it good.gif.
