was wondering if i could ask some advice...have already received our approval from the dept. of homeland security on the 27th of march and been advised that our petition was sent off to the nvc but they haven't received it yet, most of the timelines i read here were fairly short anyone have any ideas as to what makes some faster than others? is it just random? does one truly need an i-864? i filed the i-134 when i filed my original petition.

sorry to ramble, it's been over a year since i have seen my boyfriend and i just want to get on with our lives.

i also lost boarding passes but called united and gave them the travel dates and flight numbers and they sent me a letter back indicating all the boarding pass information on their letterhead it took about 2 weeks to get back from them.

Yes you can absolutely turn in Thai documents to the embassy however, at the AOS stage you will need them translated and it is significantly less expensive to have the translation done in Thailand if you do not have a friend or family member fluent in both languages(more convenient as well).

The reason I haven't filled in a timeline is because I actually haven't started the process yet! My fiance and I have been together for over four years and he has been wanting to move to the U.S. since we got together, and we didn't start researching the information on how he can move here with a fiance visa until recently. We didn't research it earlier because he had to finish his military service he was required to do because he couldn't move away from Finland until his finished that. And now that he is done, we started researching what we needed to do to apply for his fiance visa. I wish we did research this long ago though. I don't really save anything, but now I will. (Although I'm not sure what good it will do know since I want to start this soon) We're lucky we can still print out our old flight reservations. My fiance saves most of our chat logs so I will tell him to save what he can. I threw away old used up calling cards, so that doesn't help me. I feel kind of frustrated, I didn't realize I would need things like that. But I guess it's my fault for not researching it in the past. I am planning to file for the fiance visa soon, but I am making sure we have everything and be careful not to make any mistakes. So I'm researching as much as I can before we start this process. But gosh I miss him and love him so much, I do want to start this process soon so he can get here sooner, and finally be together.

Oh man, do you really have to send chat logs and emails as part of proof on your ongoing relationship? My fiance and I do talk everyday, mostly online. But I don't save the chat logs. We call each other too, but I use a calling card to call him. I could ask my mom for the phone bill to show when he called me, but he hasn't called in a while since we can just voice chat online for free. I was just going to send our emails that show our flight reservations, photocopies of our stamps in our passport and pictures. Do having chat logs really help your case that much? My fiance does save some chat logs, and I could ask him for it, but I don't really like the idea of people reading our chats. I would have to edit out a lot things, like smiles, stupid jokes, and private things we wouldn't really want others to read. unsure.gif

Oh wow, I've just checked the Embassy section for Finland and it says that the fiance(e)/spouse can't attend the interview. I was thinking I was going to. (I'm the U.S. Citizen) How many of you still went even though you knew you couldn't attend the interview? I don't want to waste over $1000 if I can't even be there during the interview... Of course I want to be there for my fiance, but if I am no help during the interview, that money I would of spent flying there can be used towards buying his plane ticket when he gets his visa... I don't know what to do... If I went to Finland and gave him my passport to take with him during the interview, would that help? Now I just feel confused and not sure what to do when it comes time for his interview...

Hi all. It's been quite a while since I researched about the fiance visa. I was researching and posting here last summer, but I didn't start the visa process for my fiance back then because I didn't have a job last summer and I wanted to wait until I got a job before starting the process. But I got a job last September, and now my fiance, who is from Finland, is actually in the U.S. with me right now. He is only visiting and he will go back to Finland in March. But I thought the best thing to do was to start the process while he is here in the U.S. (And by that I mean getting the fiance visa petition ready and mailing it) That way he can fill out forms here and sign them, and we can go to get passport photos together. I just thought it would be better to be able to work on getting the package ready while being together in person, since we can help each other and I just thought that would be easier then trying to do it while being separated. There's nothing wrong with that right?

Plus my main question is, if I start the process now, will our poverty guideline be the 2009 guidelines? The 2010 guidelines aren't in affect yet right? I feel a little confused about this whole process, but I want to start it soon if we are allowed to use the 2009 guidelines. (Plus I want to start it soon anyways, the separation is very hard)

I know that there is up to a year wait when filing for the K1. My question is, if I can send in the proofs asked for; gifts recipets, letters with stamps, package reciepts with date and address, photos of us together, description of how we met in person, etc. He is in India, I am from the USA. Is it possible to go ahead and file for the K-1 while I am on my visit to his country? I will be there roughly 6mos. and it would really eat up some of the time we would need to be seperated. Does anyone know if this is possible?

Yes, you can file your I-129F from anywhere in the world. We filed ours while we were both in the US, so I could make the boy sign things. :thumbs:

The initial I-129f petition can only be submitted stateside to a USC service center... the consulate interview can only happen after the petition has been approved... so whether it is UAE or PI really does not matter much but is more an issue of logistics and convienience


Just to clarify - the initial I-129f petition petition indeed needs to be submitted to your USC service center (either California or Vermont, depending on the residence of the petitioner), but it can be mailed from any country.

You could stay in America for the duration of your Visa Waiver, which is 6 months, and then return to Canada and file a K3 marriage visa. You could not work in the US during that time, and this process would not be faster than getting a fiance visa. If you just stayed in the US, you would be there illegally and thus would have trouble finding work or returning to the US if you ever left.

You can't move to the US until you have a visa, and there's a long process to get one. You can visit your boyfriend in the US under the Visa Waiver Programme, but you must return to Canada within 6 months and you must not have an intention to get married in the US or to move there on that trip.

What you should do now is file a I-129F to get your process started. You can read more about this in the K1 Process Flowchart.

I recommend not trying to get a work visa before getting a fiance visa.

Getting a US visa through marriage is much easier than trying to get one for employment. The visa you'd need to work is called an H-1B, but they are hard to come by. The recruiter at my company said they cost a company $15,000 in total - it requires the company, among other things, to argue that you have skills so specific that an American could not fulfill the job requirements. Especially in this economy, they're very difficult to get.

If you're sure you want to be married, I recommend working in Canada and visiting your boyfriend while you apply for the K1 Fiance visa. With the visa waiver programme, you can visit him for six months at a time. It takes about six months to go through the process of obtaining the K1 visa prior to marriage, and at the end you'll be able to apply for work authorization easily.

My situation is a bit complex ( I am sure you guys hear this all the time) but however here is my story:

I fell in love with a very dear friend of mine who now lives in UK. We have known each other for almost 7-8 years, 2 years back I proposed to her and she accepted. We have been keeping in constant touch with each other (infact its quite crazy, although she is away in a different country unless I talk to ehr everyday in the morning and in the night and sometime during the day me or her cannot do anything effectively, and btw this is not an infatuation as this has been going on for more then 5 years now). I visit her often whenever I get time off from work / school. Finally its about time that I graduate but she still has 1 more year before she finishes her bachelors. We have decided that we will get married in the states after she graduate however our parents also want us to do a traditional wedding in Pakistan, now here are my major dilemmas:

1) What would be the best way to bring her to the states, she is British citizen and I would be getting my American passport soon, I know K-1 / K-3 are the two possible options but which one is better considering the following

a) If I get a K-1 visa for her, she would have to come to states before our traditional marriage ceremony in Pakistan so we can get married in Atlanta legally and then all her paperwork can continue to process while she gets I-131 "travel document" to leave for Pakistan where we would have the traditional marriage OR

cool.gif We can have a traditional marriage first in Pakistan (not legal mind you, just religious only) after getting her K-1 visa and then I can come from Pakistan with her to America, but will this be a cause of trouble at POE? will the IO be intrusive about as why we wnt to Pakistan together? or will this cause any problems?

c) I can get her a K-3 visa, but then there are 2 big problems with it, we have been already apart for 3 years(apart from 4-5 visits each year during my holidays and yes i saved every single boarding pass hotel reservations and train tickets) and this will cause us to wait atleast for 1-1.5 years more. Secondly her interview will then take place in Pakistan since the benificiary has to interview in the country of marriage? correcT? also it is a pain to deal with departments in Pakistan, they are corrupt and I do not want to spend money feeding them getting my fiances medical and police certifcates.

so my queestion to all of you is what should i do?

Just a note:

Make sure any evidence you show for the "2 year met in person" requirement falls within the 2 years of the submission date for the petition.

So if you submit now (jan 21,2010), you can only use evidence from January 21, 2008 onwards.

(stuff from 2006, 2007, jan 1-26, 2008 will not count)

I generally advise that signatures on those two items are dated after, not before the in person meeting. If I read your post correctly both dates precede your August meeting. If that was the first meeting, I would redo the forms. The dates need not be similar as long as they fall after the first in person meeting.


No Actually that was like the 6th or 7th time we met, she actually mailed me the paperwork before I went to visit her in August. It was definitely after the first time in person meeting which dates back to early 2006.

In the section on the G 325A that asks you to write the residence for the last 5 years, does it mean "official" residence or just a list of places (apartments/houses) that you have lived in.

Specifically, my fiance is Italian and her official residence is for her hometown in Sicily, and has been since she was born, however she has lived in Rome for the past 10 years, where we met each other. She never decided to change her official residence to Rome.

Should we write her only official residence in Sicily, or all the places she has lived for the past 5 years? (basically just 2 different apartments in Rome).

Hey guys........a bit of a dilemma here......my fiance (the UKC) is having his K-1 interview next week, which is awesome! :dance: The not so awesome part: I just got laid off today............ :crying:

So my questions are: Would my co-sponsor have to provide pay stubs in addition to the usual documents for the I-134?? I made enough on my own to support my fiance, but now with this layoff, obviously now I have to show otherwise.......... :wacko:

Not only your co sponsor would have to provide pay stubs but also you have to be sure his/her is above the poverty guidelines.

I already know the answer to this but to make my fiancee feel a little more at easy she would like me to ask: "If there is an English speaking requirment for K1 approvals?"

I tell her on no document that her and I filled out does it say anything about having to know the English language or that it is a must to be approved/submit applications.

Also not everyone in the world speaks the English language and visas are given all the time so that would be the same case here. When she is here I will assist her in learning the language of course.

So I would like your assistance in telling her since her interview is next month Feb 2010...Would the Colombian Embassy deny her, her visa because she only knows a few English words and doesnt understand it? But it is sooooooooooo sexy and adorable hearing her speak it...like I'm sure she thinks the same when she hears me speaking Spanish.

Hello All,

New to this forum but so far find it very, very helpful. A big thanks to all of you who respond, especially those who continue to give advice even after their "visa journey" has completed.

My particular scenario is that I need to bring my fiancee from Peru here to the States so we can marry. I'm at the very beginning level, just now filling out the I-129F. I've been contacting some lawyers but from what I've been reading on this forum is it's probably not all that necessary. Waste of time and money? So if you all could help me out with my questions it would be much appreciated!

1) Do I include anything with this form? Or does the primary evidence, birth certificates etc come later on?
The cover letter in the guide has an excellent check list - follow that

2) I've been seeing some topics of the G-325A (biographical info) form. When do I include this?

3) I send the check for $455 with the K1, correct?

So, we are still waiting to begin the K1 process (need final divorce decree, but otherwise have most things ready to go, at the moment it's looking like we'll be able to file anywhere between late May and June) and so we probably (unless we're very, very lucky and things speed up a lot by then at VSC as well as Montreal :P) won't be getting the visa until early 2011.

We're very fortunate and have flexible schedules that will allow for a lot of visits during this time, which helps the waiting time. We were hoping for some shorter visits early in the year (he'll come up for a week in March and May and I'll come for maybe four weeks or so in June, then he'll be up here for a few weeks in the summertime). What we were hoping though was that I could spend the last bit of the year in the States for the holidays. It would be a longer stay, maybe eight weeks or so, maybe a little more, maybe less. I guess my main question is how likely would I be denied at US customs with a long stay like that (~8-12 weeks)? I do not have very strong ties to Canada between having a very basic job and living with my mom (I recently finished post-secondary school) but I was wondering if the fact that we will be going through the K1 process would help me out a little bit in that it would be indicate that yes, I would like to immigrate, we are doing it the legal way.

Answer only what the CBP officer asks you - there is no need to volunteer additional information. For e.g.

Why are you visiting the U.S? to spend my vacation from work - technically you are on vacation to visit u r boyfriend
Have you been to the US before? Yes, mention the dates and say that was also on vacation and that you like to spend your vacation in US

Again you are not doing something illegal - if you are asked explicitly, do you have a bf in US? you have to say YES, you might incur some additional questioning but I dont think you will be denied entry unless you have tons of
(1) money (2) luggage with you and it is obvious that you are moving here.

To guarantee a 100% entry, carry a letter from your employer, I always do that which states you have been employed since xxxx and you earn xxxx and you will be on a vacation from xx/xx to xx/xx. This is not really necessary but is a very solid proof especially if its on the company letter head along with a business card :)

Ok so let me make sure I understand this correctly. You plan to show unemployment funds as "evidence of financial support" for your fiance? Do you see something wrong with that picture?

You will need a Co-Sponsor buddy and the co sponsor should be earning enough to support his own dependents plus your fiance.

Hope you don't mind if I add a question, we seem in a similar situation.
I am a mom of 3 as well with an English fiance. I also am about to graduate medical school (in May). I will be matched to a residency program in February (start date of July 1), and this is a binding contract, but will not receive pay until my residency begins. Does anyone know if I can use this future income for my Affidavit for Support. Being in medical school for the past 4 years, I have not had income but obviously will have substantial future income, just wondering if this will count or if I need a cosponsor. Short answer: No

I-134 is concerned with your current income not your past or future income. You need pay stubs and employment verification letter which you can only get from a present employer
