So, on the part where it asks who the petitioner is for me, if it's my fiancé, I assume I put spouse?! There isn't an option for fiancé so it seems like the most logical, but as he's not my spouse yet so I don't want to put it, then it be wrong!!!

That is a good question as I haven't even been schedule an interview date and was thinking about that also.  I haven't had any personal experience with changing flight date.  I've always chosen EVA airline every year for the last 6 years.  I've never had to change my flight date.  According to EVA website they charge 100 dollars to change the flight date.  I am planning on attending my wife's interview at the embassy and coming back with her 2 weeks after her interview date.  I will be purchasing a roundtrip ticket for myself and a one-way for my wife about 2 weeks after her interview date.  I am willing to assume the risk.  I am getting ahead of myself, but you got to look ahead.  Most people here on VJ in the cambodia portal show no later than 1 weeks in getting their visa and their passport back.  I believe in the website they say it takes about 3- 7 business days.  I am very positive that my wife will get her visa approval because we have a son together which I just came back from filing a CRBA report and US passport for him.  I've visited my wife every year for the last 6 years.  We've been married for almost 3 years now.  Lots of evidence including phone logs, pictures, stamps of date visited, western union receipts, etc.  I see that you just got your NOA 2 in just a month.  That is really fast congratulations.  You're planning on being there for your fiance interview?  Let me know what else you thinking of doing?  Good luck on your journey.

 

Yes I would love to be there for my fiance interview to show my committment and support. I want US to be a part of all these major events but it might be tough this time because of my work schedule. It takes 2 days (due to time zone) to travel from US to Cambodia and since my last trip to Cambodia I haven't accure much time off at work yet. Will see how soon my fiance get the interview appointment.

 

As for the plane ticket, I had the same idea as you. RT for myself and OW for my fiance. From my experience, I've travel with EVA airline before and bought a RT ticket for 30 days stay but I was only able to handle Cambodia for 10 days and so I changed my flight without any fees. I was lucky then? This was 2006.  Then in 2011 I travel with China Airlines and got a RT ticket for 30 days stay again but I kept extending my day and making changes every single week and yet they didn't charge me. I was told as long as their are seats available I can switch. I think I changed like 3x and end up staying in Cambodia almost 2 months.

 

Another experience was with a friend's flight. He bought a RT ticket from Phnom Penh to SFO for about 2 weeks stay but due to unforeseen cases, he had to change his flight about 2-3x with Asiana and they didn't charge him either.

 

Again, there is no guarantees and I fully understand that Airlines are able to charge the fee, per contract agreement but like you I will probably take on the risk and purchase a OW ticket for my fiance to come to the US with methe same day I come back.

 

I hope all goes well with your journey too.. Never know, we might end up having the same interview appointment? eheheh

As far as plane ticket I've always purchased them from EVA air directly from their website, sometimes they have deals and discounts.  You can always try to search on those travel website for deals also.  I guess September will be the cheapest during the low tourist season.

 

I have a question about plane ticket. I might be ahead of myself and I know that the embassy does state that you should not make travel arrangement ahead of the interview but I like to be prepare :)

 

So how do you go about buying the ticket for the beneficiary? Do you know which airline is flexible when it comes to date change?

OK this is what I notice as I was going through this thread and following the link about Packet 3.

 

Since all the requested docs are available online wouldn't it be more convenient and efficient to fill out the form electronically and send all the neccessary supporting documents (form I-134) via email? Then have the beneficiary in Cambodia print it out and signed the DS-230-I and return it to the Embassy in Cambodia?

 

Or does the supporting document for I-134 needs to be original, then it make sense to send it via postal instead of email. Technically if they will accept a copy then the original can be presented at the time of the interview just like all the others items on the packet 3 checklist. 

 

This will really speed everything up instead of waiting for the postal service to deliver them.

That's what I'm leaning towards of doing. It would a best idea. How will you send to your fiancee? Last time I sent paper to Cambodia, I sent via USPS and I had no problem. It was relatively cheap comparing to other mail carriers. 

 

From what I know mail services in Cambodia is not as efficient as those in the states. Not everybody get their daily mail like here (USA). For that reason I hesitate to mail anything there.

 

But since you have experience, I would like to know:

 

-did you write the TO: address in Khmer or in English?

-did they actually take it to the actual address, like home delivery or did they call the addressee to come and pick up at the postal office?

-how long did it take for the document to get there when you sent via USPS (Priority International ??)

I ask them before and they say it's a good thing if you are present with your significant other for the interview, and the embassy allow the petitioner to be there the last time I talk to them.  So try to be there if you can.

 

Thanks for mentioning this because I just raised the question last week about the Petitioner attending the interview. On the country Portals it says NO (not allowing petitioner to attend the interview) but like you just mentioned, in recent cases it helps determine the outcome.  I love my fiance and we wish to be together soon so I will try to make it to the interview when the time comes. I want to be there to share the moments and support him through the way.

I doubt you would see those again as this type of info becomes part of the case file. There is no reason to submit them because you can use the transcripts or copies of the other tax info.

 

I agree. For the transcript I did submit the original with my Packet 3 just because I can easily request another original copy from IRS to present at the interview.

 

However, 1040 and/or W2 is not easy to get the originals. Maybe it depends on the embassy too, some might requires originals? Do check with them.

Looking at your timeline it appears that you just started the process. With that said, I suggest you take a look at this link http://cambodia.usem...v/packet_3.html which will give you an idea of what things is needed for the next step as well as what is needed at the actual interview.  There is a checklist.

 

Tax transcript of 1040 or W2 can be used as financial proof during the Packet 3 stage. You will submit it along with the I134 affidavit of support.  It's good to make an extra copy and take it with you to the interview.

I would make every attempt to meet in person prior to sending your application.  There is no purpose in sending an application and fees to find out you are going to be denied.  My fiance and I have been together for 5 years, traveling back and forth every 2-3 months for the entire relationship.  His country is not a high risk country and we provided lots  of evidence and still got a RFE. It's a stressful process and long periods of time waiting, by not meeting you will only make the process more expensive, stressful on yourself, and longer.  Good luck in your journey...

It'll be about 3 months after you marry assuming you file the AOS and EAD documents immediately after the marriage.

The trouble with the marriage visa is that I would have to make another trip there befoee we could file. I just came from there tuesday so it would be a big financial burden suddenly so it would be about 8 months before I could go there again.
I wonder if cost wise it levels out to about the same as another trip there and back versus what we would pay for the k1

 

 

Well, quickest way to answer that is - does another flight/trip cost you less than the AOS cost (which is $1070)?  That's the big ticket money differentiator of the K1 vs CR-1.

Also, +1 to marriage visa. It's cheaper and more efficient end to end. You can married in Brazil then too if you prefer (on anywhere). You'd be filing the i-130 then applying for cr-1 visa. It's still done with him abroad. The i-130 may take longer yo be approved than i-129f, but the gap has closed a lot lately.

Not as bad as I imagined! That gives us time to prepare, anyway. I was reading about the interview process, which doesnt seem terribly hard. I guess what we will do now is begin the process.

I am trying as best I can to find all the fee information for separate documents. 

Is there a roundabout number for document processing fees, etc?

Or somewhere I can find each fee , so that we are prepared for the costs?

 

Found this example of costs.  Incidental costs are for a different country, but the fee costs will be the same for the petition and visa. The medical fee cost varies country to country, but it'll be the same ballpark figure as theirs:

Ok then we are safe! The medical was the only thing I was worried about. We wont request any benefits for him. Besides that, it wont be awfully long before I am done with school and he wont even need medical assistance. I appreciate you all so much and have a much better picture of what this process is like.

Oh blimey, the million dollar question. Brace yourself. 

 

It takes 5 - 9 months for the petition (I-129f) to get approved, then another 3 - 5 months on the local consulate side to apply for and issue the actual visa. You're looking at at least 8 months, but possibly longer.  Once in a blue moon someone does some sort of magic incantation and gets through faster, but you'd do best mentally to set yourself up for 8 months min.

Does the joint sponsor have to go to meetings etc, or is most of it paperwork? His friend is a legal US citizen and permanent resident, he was born here. He is willing to do it and does meet the income requirement including my bf in his household number. 125% of the povery guideline

 

It's all paperwork! smile.png  He'll need to provide his tax returns, ideally.

You definitely need to sort out your financial support plan *before* your fiance K1 interview as the I-134 must be presented and satisfactory supporting documentation included.

 

Yes, you may have a joint sponsor. They can live in another State.  They must be a USC or LPR and at least 18 years old, and make above the poverty threshold for your fiance PLUS any dependants (so your fiance becomes counted as one of their household).

Yes, you need an affidavit of support - you just use it to show your savings, rather than income.

 

The Oz income will count for nothing, as you won't have that when you're in the USA.  It's basically a form to explain how you will be supporting your fiance when you ARE in the USA, so anything before doesn't count.  You should have his tax returns though (I updated my above post with a couple more links, so go back and check in case you haven't seen them).

 

Also, this post is a couple years out of date, but should give you an impression of how much money you need. Bare in mind that your income in the USA will be 0, so use that as base number. http://www.visajourn...oney-is-enough/

You need an affidavit of support no matter what/how the money comes about.

I believe the financial sponsor must be resident in the USA (have domicile) there, though, so if you're both abroad and currently have no US ties, you may still need a joint sponsor, but I'm a little fuzzy on that requirement against the I-134.  I'd suggest you search the forum for folks with cases like yours.

Don't worry about it. The main purpose of the copy is if the original, or something in it, goes missing you have spares to hand. After approval your original package will be sent to your local embassy via the NVC.

Ive been reading up on that CR-1 Visa. One of the minus on the compare chart is it says he will probably not be allowed access into the US.  I dont see much detail on this anywhere.  Is that only at a certain part of the process? Can I still visit him?
Right now K-1 is our default plan, CR-1 sounds like it might be a little fast but if I wont be allowed to see him will have to consider that.

No, it's not a certain. He can still travel as a tourist, but he may get more hassle at the border about it. He can do so, but he should travel with evidence of good ties back home, return travel info etc. to show he's not planning to stay illegally.

You can still visit him, but the same can apply (they make think you're planning to stay in Canada).

It's more of a warning than an absolute no-no.

The same advice is good even on K1 path. Border agents are often more likely to hassle anyone visiting their bf/gf/fiance/spouse.

1. The most advice you're gonna get is "DON'T".  At least, don't book anything you can't change or move with minimal cost. There's often surprise delays to this stuff, so always plan in some extra time. Remember you've got a whole 90 days from entry into the US to get married, so you don't need to have it for the first weekend or anything. smile.png  If you want to plan something, maybe you could focus on the things that aren't time sensitive - your dress, his suit, what flowers you'd like, scoping out venues... that sort of thing.  Your instinct is very correct in that time for processing and then the actual visa application does vary a lot person to person.  If you complete your timeline (if you've already filed, naturally), you'll get an estimate on when you may get your petition approved (then add 3 - 5 months on the Canadian side for the actual visa application processing time):

2. Your fiance won't be able to work until after you're married and you've filed AOS (adjustment of status) and his EAD (basically, his employment authorisation permit until his GC comes through).  It'll take him about 3 or 4 months from filing the EAD to get it.  This is the guide you'll follow once you're married that should explain this part a bit to you:

If having your fiance work ASAP is a priority for you, the spousal visa may be a better bet for you. That involves you marrying now in the US or Canada (or anywhere) and filing the I-130 for CR-1 visa (still while he continues to live in Canada).  The bonus to this is as soon as he has the visa and enters the US, he has a greencard and can work.

You book your own medical (you phone the doctor surgery).

You need your LND number from the NVC or you can wait for it to come from the embassy in Packet 3 (a letter with your LND number and a link to this website with instructions on how you apply for your visa, the medical and forms: http://london.usembassy.gov/iv_15.html) to book your medical, and your police certificate. Click "medical examination" in the left menu on that website, then the PDF on the right hand side tells you everything about booking and what happens.

You should make sure your medical is booked at a time when London will definitely have your case, as your medical results will be sent to the embassy about 4 days after and they may be confused if they don't have your file yet and lose your results.

If you want to wait til London has your file, keep calling them until they tell you they have your case. They can give you your LND over the phone if they have your file already.

It's gonna take a couple weeks for your file to pass through the NVC to London, at least. You probably won't get packet 3 in the mail for about 4 weeks.

Yes send documents. My medical is july 2nd to! The letter from the embassy is a little confusing. I would have sent my documents sooner but the letter says not to send anything until requested to do so. Good luck!

Yeah, it's very confusing. Would it kill them to make the steps clearer?

As soon as you know London has received your case...
1. Compete the 4 forms and return them.
2. Book medical.
3. Collect supporting docs (incl. affidavit of support) then return ds-2001 and include a cover letter with medical date, wedding date & email. You can do this step before or after attending the medical.
4. Attend medical.
5. Await interview invitation.
Don't mail any supporting documentation (certificates etc.), only forms. All supporting docs go to the interview in person (less likely they'll get lost).

Is that so hard, London?
