He applied for the work visa when he was 17, (which was 8 years ago actually, not 5) it was a work program through his university, after the interview they just didnt think he was "mature" and ready enough, but didnt give any other reason such as paperwork, background etc.

It sounds like your fiance is the victim rather than the offender in this case. I think he should be ok, specially if nothing negative will be on his records. If a question ever comes up during the visa process that will make him mention this case, either when you are completing forms or at the interview, then having supporting documentation is always a good idea. From what the judge and lawyer told your fiance, that should be no problem. Good luck!

no he was not formally charged or sued and doesn't have a police record, thats why im thinking it shouldnt affect it but you never know...

hi....I have a question in regards to "criminal records"..My fiance, along with several others, had his identity stolen 3 years ago from a former employer. The employer used several of his employees debit cards to defraud customers. Currently, he is working with a lawyer to clear his name.  It is taking longer than expected because the person who is being convicted does not show up for court appearance. Both the judge and my fiances lawyer indicated that it was okay for him to leave the country, as long as he appears in court during the next scheduled hearing in order to testify. His lawyer said that he can still apply for the visa, however, it might give us a red flag to know hes involved in a trial. The process has been a long one, there hasnt been any court appearances since last year and none are set until next March. Do you think this would affect our case? He has no criminal record or police reports.

I am in the same boat and wondering the same thing!! I was claimed as a dependent (I was an unemployed student) for the past few years and will only have one year of tax returns. I have read in some places that you only need one, but I've read in other places that they may request for up to three years. Fingers crossed.. 

Yeah..I was wondering too..However, on the step-by-step guide on VJ it only indicates the following:

 

(A) Statement from an officer of the bank/financial institution with your deposits, identifying the following: 1. date account opened; 2. total amount deposited for the past year; 3. present balance 
(B) Statement(s) from your employer on business stationary showing: 1. Date and nature of employment; 2. salary paid; 3. whether position is temporary or permanent (also include copies of your last two pay stubs and your previous W-2 for the associated employer if available) 
© If Self Employed: 1. Copy of last income tax return filed (or IRS transcripts); or 2. report of commercial rating concern 
(D) List containing serial numbers and denominations of bonds and name of record owner(s). 


 

If im not self-employed, Do I still need my tax returns?

From what I've seen reading around, it seems like the consulate officers are given a lot of leeway on what they will or won't consider sufficient. It's better to go to the interview with a bunch of documents that you don't need, than to be delayed getting your K1 because you didn't bring the right thing.

 

 

Thanks for the advice, my only concern is that both last year and this upcoming year my parents claimed as dependents so I dont have my own separate tax returns...do you think that matters?

HI, i have a question regarding the affidavit of support...i've read many forums that say you need your last 3 years tax returns, or your last 1 year tax return,..and some say you dont need them at all until you file the I-864...According to USCIS on the I-134 instructions it indicates this:

 

Supporting Evidence

As the sponsor, you must show you have sufficient income or financial resources to assure that the alien you are sponsoring will not become a public charge while in the United States.

Evidence should consist of copies of any of the documents listed below that apply to your situation.

Failure to provide evidence of sufficient income or financial resources may result in the denial of the alien's application for a visa or his or her removal from the United States.

Submit in duplicate evidence of income and resources, as appropriate:

According to this....I dont even need my tax returns at all because I am not self-employed. Did anyone not submit their tax returns with their I-134 form?

No 221g, she was told to pay the delivery courier and she will receive her visa in a week however her interview was on 01/13/2014 she was called back to the embassy to sign her son's application, they took her left hand fingerprints and was told again the visa will be ready by the next week, it's been 20days since.

You need not to worry right now, the medical is valid for a year, if the visa is approved and it's been a year since your fiancé had his medical a new one will be required and requested in order for them to issue the visa. They will not issue the visa if the medical is expired, since your interview was in January 15 you still got 10 months on your medical

Link to processing times. and find out the averages for your particular service center and your embassy. Lots of factors influence how long it will take. Your case goes to the slow processing center tack on three extra months. That's just one example.

I think you are describing "Brass Knuckles", which as you say are a deadly weapon. That means if your husband is caught with them he could go to jail. Also, this could go on his record which might also make it more difficult for him to find work. This gift is an extremely bad idea. Wouldn't you also be breaking the law sending it to him?

I'm pretty sure, everything was originally signed except the G-325a, which was a scanned copy! (we had realised it might be a problem so I sent him a original signed copy a week before we got the rejection notice)

I don't think the cheque was cashed, we just sent it back and I assume once they re assessed the paperwork they cashed it. :)

They received our package on the 17th and It was returned on the 27th, dated the 23rd. So it wasn't much of a wait, which is surprising! I personally didn't see the returned package but I'm pretty sure my fiancé said all the paperwork had barcodes and looked like it had been inputted onto the system, it had case numbers and whatnot on it. We sent it back the next day and it was approved on the 4th. So even if there is a problem, it can be sorted out quickly! :)

My heart absolutely sunk when I was told we were 'rejected', but honestly it's nothing to worry about with regards to this situation!

I had the exact same problem!
I received the whole package back, with a notification saying:

' was not properly filed because the application or petition was not signed. Therefore, we have rejected your case and returned it to you, including all supporting materials. Please review the instructions on the rejection notice you received prior to re-submitting your case'

We sent the package back with everything signed correctly. After we sent it back they accepted it within two days and everything was back on track!

An overview of the general legal requirements for a K-1 Fiancé Visa:

 

A fiancé visa will get the non U.S. citizen into the United States to get married. To be eligible for a fiancé visa, the non U.S. citizen does not have to intent to live permanently in the United States after your marriage.   • intends to marry a U.S. citizen: The U.S. government wants proof that you've made actual plans, such as place, a date, a type of ceremony and proceedings and more. The person that the non U.S. citizen plans to marry must be a U.S. citizen, not a permanent resident.
  • has met your intended spouse in person within the last two years (though this can be waived based on cultural customs or extreme hardship), and
  • is legally able to marry: If you or your fiancé have been previously married, you will not be given a fiancé visa until you prove that that marriage was legally ended.

We applied for a K-1 visa and was already link to the check. Now we are waiting for the documents from USCIS and hopefully will start getting the  requirements needed and submit them. How long will the K-1 visa be approve? We are hoping that I can come with him back to States next month. Or maybe not?

 

Would you think the the sort of time we've known each other will affect the approval?

Of course, there's not been many folks who've made it through the entire process yet as a same-sex couple, as the rules only just changed, so we're light on anecdotes to confirm or deny how officers are dealing with the actual matter of marrying in a country that only allows it in certain states.  The requirements for the I-129f are clear - you must have met in 2 years and be free and legally able to marry. 

 

It sounds to me like you've already thought about and tried to cover your bases in terms of explaining how and where you'll be legally marrying, though, and you can't do much more than that at this stage.

About the child I assume that your fiancee's GPO is 3mos and 1week and your noa2 will arrive April (hopefully, just keep on praying) and I just don't know airline policies about boarding on the pregnant.

36 weeks is the general cut-off for not being allowed to fly when pregnant, although I know of times when very pregnant looking ladies have been turned away without a doctor's note to say they're okay to go.

My husband got hassled at Heathrow on his last visit he did before he got his work visa. It was Christmas 2011 (he was coming in in November sometime until Jan 3rd) and they didn't want to let him in, but they still did and told him he'd be given a coded landing (I.e. keeping an eye on his trips more closely).

They hassled him because he was approaching being in the UK for more than 6 months in one 12 month period (a couple long trips + a week here and there soon add up). So, I'd watch for that - be sure you're not accidentally going to do that like we nearly did.
