Oh, now I'm nervous! Both of us have husbands with DUI cases in the past. Were you grilled about your husband's DUI? Were you also asked to submit his DUI court records? Are they asking for original court records, or did they say that copies would suffice?

IR-1 / CR-1 Spouse Visa Process & ProceduresNeed to change interview date Manila

That is what I did before i went to bed last night. First I tried to change through the chat option they have, but it didn't seem the operator was familiar with the process. Then I tried the number, they asked for passport number, date of issuance, date of expiration, priority number, case number, and beneficiary's email address. It was really very easy over the phone, just taking about 10 minutes, and we got a date just a few days after the original, which was all I needed. Our new date is February 1.

Good luck to you!

Thank you! Good luck to you, too! :)

IR-1 / CR-1 Spouse Visa Process & ProceduresNeed to change interview date Manila

I tried to change the date before I made this post. I cannot change the date of my trip. So I would still like to know how to go about changing the date of interview.

Hi! Did you try contacting the Visa Information and Appointment Service at (632) 982-5555 or (632) 902-8930? Got the numbers from the Manila embassy website. My husband and I were going to try to reschedule so he could use his free PAL miles to fly here, but we ultimately decided to just pay the high peak season rate and stick with the schedule given by NVC. I did call the hotline once to inquire. The first thing they'll ask for is your wife's passport number, then the expiration date and her name.

IR-1 / CR-1 Spouse Visa Process & ProceduresCSC BACKED UP
My husband and I also filed in March and only got approval last week, after more than a 5-month wait. But then again, most March filers here on VJ got their NOA2s in June and July. If you look at Igor's list, you'll see there are only a few March filers still waiting for approval. Maybe the CSC rep meant that they were still adjudicating the remaining March filers. So what they told you could be (somewhat) true.

IR-1 / CR-1 Spouse Visa Process & ProceduresMedical Exam at SLMEC

congrats too.. how was ur POE experience???

Thanks and hi! It was all right but not as easy-breezy as my interview. The border patrol officer at the Honolulu International Airport asked more questions than the C.O. did at my interview. It took more than a few minutes before I was let through. I had a big file, and she read it thoroughly before signing my papers and stamping my passport with "Admitted." I don't think she was trying to be difficult; just being meticulous, I guess. She was the only female border patrol officer that morning and seemed to be the only thorough one. Lucky me, heh. But all's well, and I'm in San Francisco! :) What about you? When are you flying, and where's your POE? Good luck! :)

What is the difference between.. "NO RECORDS ON FILE" & "NO CRIMINAL RECORDS"..

Got my NBI clearance today, and it says "NO RECORD ON FILE".. However, I got a Hit, that's why I have to go to Quality Control interview and signed a waiver stating that I'm not that person...

Any same experience as mine?

Oh, and to answer your question, "NO RECORD ON FILE" means you're good to go. That means you have neither a criminal case nor a civil case on record. "NO CRIMINAL RECORD" would result in the C.O. from the embassy asking you for a letter of explanation from the NBI.

Is that your first NBI clearance? If not, did you also get a hit when you applied the first time? I went to NBI today and also got a hit. I don't know what caused it. They didn't release my clearance today; I have to go back another day. I'm confused because this isn't my first time to apply for a clearance, but this is the first time I've been "hit!" My name is pretty unique. Nothing about it - first name, maiden name, married name - is common.

K-1 Fiance(e) Visa Process & ProceduresHow long does USCIS take to process i-130 if it says in the immigration timeline that it's started being processed now
Hi! The time interval between the first notice (NOA1) and the decision on your petition (NOA2) is generally 5-6 months, although some have gotten their NOA2s in less than that amount of time. But what you're asking is what happens within that time interval, is that right? You want to know how long it takes from the time the adjudicator starts actually working on your case to the time he makes a final decision on it, and I'm not sure anyone outside of the USCIS can answer that. The processing dates that Visa Journey displays on the Immigration Timelines page are based on members' NOA1s, if I'm not mistaken. (Somebody please correct me if I am.)

K-1 Fiance(e) Visa Process & ProceduresDid you use a lawyer
We didn't get a lawyer, although we have what most here would deem a complicated case. Before we sent the petition in, my husband (the USC) and I argued about it. I wanted to have at least a consultation with a lawyer to determine if we would encounter problems and if so, what could be done about them. My husband said, "Baby, both you and I are very intelligent and well-read, so I'm sure that we're also both as capable of reading and understanding the I-130 instructions as any lawyer." I did eventually agree (grudgingly) that we didn't need a lawyer, and I guess my hubs was right because we got through USCIS without even an RFE.

K-1 Fiance(e) Visa Process & ProceduresOk to visit fiancee in Phillipines

She lives in Taguig City which is close to Makati City, so I will get a hotel in Makati City. I hope to stay 3 weeks this time whereas last time I could only stay 2 weeks. I was last there in August of 2011. For me, the flight is even longer since I fly from Atlanta to Japan which is 13 hours. I'm thinking of going a different route this time just to make the longest flight a bit shorter. Also, I didn't have any sleeping medication last time I flew either. I thought I would have no trouble sleeping, but I was so wrong.

Hotels in makati are expensive, why not just stay somewhere much cheaper? Or stay in taguig? Yeah its a long flight and its hot here/raining a lot so dress accordingly

There are many hotels in Makati that aren't expensive. For example, LPL Suites, BSA Tower and Prince Plaza II right across Greenbelt 5 have very reasonable rates. The first time my husband came here, he stayed at LPL Suites and paid only 2000+ php a night. There are also inexpensive hotels on P. Burgos St., like Oxford Suites and Citadel Inn, if you don't mind staying in the red-light district. There are more choices in Makati than in Taguig. I live here in Taguig, and there are condotels here at The Fort, but they're pretty expensive.

K-1 Fiance(e) Visa Process & ProceduresMedical exam
You may want to go in the afternoon. Before I went to SLEC for my medical exam, a friend who's done with the entire visa process suggested that I go there in the afternoon because there would be fewer people. This suggestion was seconded by another friend who used to be a nurse at SLEC. I did as they suggested, and true enough, I completed all the required tests in less than 2 hours: in at 1:30pm and out at 3pm. I almost went in the morning, but now I'm glad I listened to my friends. Keep in mind, though, that the clinic closes at 4:30pm.

K-1 Fiance(e) Visa Process & ProceduresHow About A $1000 i-129f

There are many things that can be done to speed up this process. I do not make a lot of money but I would rather pay $1000 for the I-129f petition and have it approved in one month. If everybody paid a higher rate they could higher more workers and process faster. Just one idea to help the system. TIME IS MONEY!

I second the motion, although I agree that it wouldn't be fair to everyone for the US government to charge a premium. While we were waiting for NOA2 (waited almost 6 months), my husband and I talked about how we would gladly pay more money just to speed up the process. We don't have a lot of money either, but we would have saved A LOT in expenses had we been allowed to zoom through USCIS and the rest of the visa application process. Heck, we probably would have paid $5000 or more had there been a guarantee that everything would be processed in a month! This long-distance relationship is not only emotionally taxing but also quite expensive. We maintain 2 residences; an apartment in San Francisco and a condo here. We know that we'll have fewer expenses once we're together because we won't have to maintain two residences anymore.

K-1 Fiance(e) Visa Case Filing and Progress ReportsIs an Immigration Lawyer ever needed for a K1 Visa?
No you don't need a lawyer - big mistake that we got one since we thought it would be more efficient, more organized about the paperwork and that they'll be helpful about the process, but wrong!
It caused us delays when we we were preparing our documents for the K-1 application due to back & forth correspondences, and it takes them 2 days turnaround time to reply to our emails & queries, was sadly just a waste of money - was $1,200...we only learned about visajourney after hiring the lawyer and we could have just done it ourselves...took us lot of time to research this law firm and their website was convincing

So, anyway we already got our NOA2 via email notice since we signed up at the USCIS website, however until now we haven't received any calls or emails from the lawyers informing us about it
it should have been their responsibility to track our case, but they've been useless...they even didn't get in touch weeks prior to expected arrival time of NOA2 to advise us about gathering police clearance & doing medicals and other prep...if we were not initiative enough or if we haven't known about VJ, we would have never known yet that we got approved hahaha or the process could have taken longer...

K-1 Fiance(e) Visa Process & ProceduresI 134 - Supporting Documents? [edited title]

Check the regional forum to see if the consulate really needs those bank statements. I seriously doubt it, unless you're self-employed.

The published requirements for the discretionary decisions, like the "public charge" requirement, are often somewhat vague. Attorneys sometimes get into a habit of doing things a certain way because it's what they've always done, and it's always worked for them, but in many cases it may actually be completely unnecessary.

Yup, that's what we think too, thanks!
SnickerzNot TellingAustralia2011-04-20 09:09:00
K-1 Fiance(e) Visa Process & ProceduresI 134 - Supporting Documents? [edited title]

Generally, when income is sufficient, I advise leaving all asset questions blank. However, your attorney SHOULD understand your case more completely than I do. Why not simply ask the attorney this question?

we exactly do not have 100% faith on our immigration lawyer because of some delay with our initial I-129F processing and other few matters i.e. untimely replies, they only learned our Noa2 got approved cuz we told them, no advice yet re. preparation for packet 3 - but we already collated them anyway because from our research and from VJ...so, it's just good to know fellow VJer's opinion :) we're still waiting from NVC anyway, so we're going to do it and will still have time to gather all past 12 bank statements...just wondering if it's really necessary...and yes their reply is it's in the I-134 instructions requiring us to provide info on date account opened, total deposits to the account during the year, and the present balance...and yup i admit they're correct it is stated there and lawyers are by the book... :hehe:

Ok, so our lawyer told us that we will need to submit and prepare the bank statements for the last 12 months...really??? because it would take awhile to gather this info, and the on-line statements would only show the recent bank balance and not the average bank balance for each month.

We are just planning to bring as support the 2010 tax return & W2, recent payslips, employment letter showing more than enough earnings...are these ok?

Thanks.

hi, we also lived together before...like as what you said, since we both lived together we don't have many correspondences during that period of our relationship as we see each other everyday...

and other letters showing proof that we both lived on the same address....also birthday cards and we also included online receipts (since just stored in our emails) of our local trips, concert ticket purchases, etc.

Whats the next step after receiving noa2? just so i can be ahead of the game... ive read other Vj'ers timelines but everyone has different things, its quite confusing!..

once ur approved, do they sent the next packet straight to the foreign fiances address/embassy/consulate?...

Hi, congrats on your NOA2!

Visit the regional discussion forum of VJ, it's very helpful for stages after NOA2 since this sometimes varies for each Consulate...
After the Consulate receives the packet from NVC, they will send packet 3 or instructions to your fiancee, the waiting time between NVC & Consulate varies but is usually w/n 2 weeks. While waiting, your fiancee can start filling up the forms and gather police certificates, schedule for medical exam, and the USC can start with the affidavit of support...

K-1 Fiance(e) Visa Process & Procedurespolice report/records
yup, that depends which countries you used to live in...mine took 3 weeks for local police record, 6 weeks for another country and 2 weeks for another country....

so, it would be really great to organise the police records in advance, but keep in mind that although police certificates are good for up to one year, some Embassy can exercise discretion to ask for an update for any police certificates issued more than 6 mos...

K-1 Fiance(e) Visa Process & ProceduresWhen and who do I call to figure out if the NVC has my case
You can call NVC around 6 business days after NOA2 since when i called them after 5 days they don't have it yet in the system...
Then I emailed them after 8 days, and I received a reply a day after with our case # and stating it was shipped to consulate,
so approximately NVC did mine in 10 business days...

Also, as discussed under NVC forum, you can track the package through DHL from NVC to Consulate, so you would know when the Consulate will receive it.

K-1 Fiance(e) Visa Process & ProceduresCan I apply for a K-1 Visa and a Tourist visa at once?

Hello people,

I'm currently engaged to my American fiancee and I plan to move to the USA in about a year from now. We decided to go for the K-1 visa.

Since she has been the only one visiting me so far I want to visit her the summer and see the sorounding where I will live.

I will apply for a tourist visa somewhere in August so I was wondering if it is possible to apply first for a k-1 visa and then a tourist one? Or can I apply at the same time for both or is it better for me to come back from the USA and then apply for a K-1 visa?

Also I would like to ask: how long does the processing of the K-1 visa lasts?(from the moment you apply till the moment you pick it up)

Thank you for your help people...

Cheers,

Eddyy

You can apply for only one Visa at a time.
Good luck to you
