Here is what is said in the I-751 instruction sheet .

"If you are still married, the petition should be filed jointly by you and the sponsor through whom you obtained conditional status, (your husband).  However, you may apply for a waiver of this joint filing requirement if:

1.  You entered the marriage in good faith, but your spouse subsequently died.

2.  You entered the marriage in good faith, but the marriage was later terminated due to divorce or annulment.

3.  You entered the marriage in good faith and have remained married, but you have been battered or subjected to extreme cruelty by your U.S. citizen or permanent resident spouse, or

4.  The termination of your status and removal would result in extreme hardship."

That is awful.  I feel for you.  Just read your I-751 application carefully.  You can file jointly or as an idividual.  To file as an individual you have to be divorced or claim abuse.  The question you need to answer first is are you going to stay with your man?  If so, joint app is the way to go.  If not, you will need to get the divorce going.

All my forms are dated August 25 including my check and I also mailed it on that date. I live in California I mailed to P.O. Box 10751 Laguna Niguel, Ca., 92607.

It is 90 days before your green card expires and not three months. Your 90 days will be 08/27/2010. If they received it before this date the package will be returned!

8/25 was a sunday? Did you submit before 8/25?


I mailed it on August 25, 2010 my mistake for not mailing it prior. I believed they received it August 26 as it dated on the note. What should I do? I'm re confused now. They returned the whole packet including the check. Should I re do it and also the date?

"You filed the I-751 prior to the ninety (90) day period before the second anniversary of your date of admission to the United State as a permanent Resident. You may resubmit the petition within 90 days of the expiration date of your Alien Registration Card. Your card registration Card expiration date is 11/25/10.

Hi everyone, Just wondering how to view my status online, I tried to look my case with WAC.......but its says "something like case not found.....". My green card will expire this coming Nov. 25, 2010. I already submitted my I-751 along with my supporting documents and also done my Biometric appointment, after the biometric appointment I have no clue what's going on with my case status. Is there anything I should do? since i don't get any other notice like interview appointment, card production or whatever it may be. However in my I-797C NOA, says that my conditional status is extended for a period of one year. Please enlighten me with this matter since I'm not sure if I'm doing right here.

I have no idea why the system is not taking the WAC number. It might take awhile before it appear in the system I guess. Just to clarify, the WAC number on the NOA and the bio appointment letter is different and you have to chcek with the WAC number on the bio letter.

Nope, all you can do is wait after the bio appointment unless they have an RFE or something.

Before you got your Bio appointment letter, you should have receive the NOA which will extend the green card for another year. It will takes months before your case will be approved or interview. There are many people here who are still waiting for approval after their bio appointment.

By the way, you should be able to check the status of your case on uscis.gov using the WAC number listed on your bio appointment letter.

I spoke with an NVC operator, who told me that NVC received our case on September 12, four days after petition approval. She also told me, though, that it would take 23 days from the date of receipt for them to enter the case into their system and generate a number. Does it really take that long to generate a case number? Based on previous threads, I gathered that around July 2011, it was taking CSC a month to send approved petitions to NVC. But I've always thought that once NVC receives a case, it's entered into their system immediately. So I'm confused about the 23-day wait. Oh, and I'm also majorly disappointed!

You sometimes get a person who either doesn't know or just wants to make your life a little bit harder. You normally will get both at the same time. In our case, the woman told us both before we even had time to ask--that's the norm--you just got a stinker. Call back right now--they are open until midnight eastern time !!!


I was thinking that while talking to her, but I wasn't sure, so I let it go. She did come through in the end, I guess, because we received an email from NVC within 24 hours. But thanks! :)

My husband and I are at the NVC stage of our CR1 visa application process. Got our NOA2 on Sept 9. Case received by NVC on Sept 12. I called NVC today, and we finally have a MNL case number. The girl I spoke with said our case was just entered into their system. After she gave me the MNL number, I asked her for the IIN, and she didn't seem to have any idea what I was talking about. I told her it was the invoice number, and she said, in an amused tone, that it was too soon for us to have that number. She said it would be sent to us via email, in 10-20 days. Now, does that sound right? I've seen on some people's timelines here that they received their NVC# and IIN on the same day. Is that right, or should I really wait for an email? I think the girl from NVC was wrong, but I didn't want to argue with her because I wasn't sure myself. Should I call back and bug them about our IIN? Any input would be appreciated, thanks!

Things seem to be moving smoothly at NVC, but we may have encountered a potential problem. We paid the I-864 bill today, and we can probably send the AOS package soon. We ordered my husband's tax transcripts from the IRS. They should reach him in a week or so. The problem is, we seem to have lost his 1099s, W2s and schedule forms. We're close to panicking! It's possible that we threw them out after filing, thinking they wouldn't be needed anymore. We don't remember. Are those really needed, in addition to the tax transcripts? Aren't tax transcripts enough to show how much he earns? If the 1099s, W2s and schedule forms are needed and we can't find them, what can we do? What can we send in their place? We're planning to submit only the transcripts, his certificate of employment and his recent pay stubs, but we're afraid we're going to get an RFE for the other financial documents. :unsure:

Where does it say that they have to be originals? For our AOS we sent copies of everything and printed my husband's pay stubs online and it was fine. Have your husband get an employment letter from his employer too stating his hourly wage, dates of employment, how many hours a week he works and his position.


Oh, I thought (wrongly, I guess) that everything sent to NVC should be in their original form, and I've been bugging my husband about it. I'm glad to know I can just print his pay stubs!

Oh, the NVC requirements are giving me a headache! I have another question. NVC wants all documents to be original, right? Well, there may be a problem with my husband's pay stubs because he doesn't have pay stubs on paper. Their company's pay stubs are stored in a web site called CompuPay Online, and it does give the options to print them, but that means we'll be printing them on our own typewriting paper. Will NVC accept them? My husband asked their company's CEO for pay stubs, and the CEO directed him to that site. His pay stubs are there, and I'm looking at them and can print them at this very moment, but our question is, will that work for NVC? We don't want to get an RFE at this stage!

No, the AOS package doesn't need to be approved before you can pay the IV bill and send the DS-230 package. My husband and I haven't sent our AOS documents yet, but we've already been billed for the IV fee. We're planning to send the two packages at the same time. (I don't know the answer to your first set of questions, though.)

I just realized that my husband actually qualifies for the I-864EZ, but we used I-864 for our AOS package. Does anyone think that we'll get an RFE for the form? I sure hope not. If we do, I'll be the one to blame because I told my husband to use the I-864.

Okay... so here is the update....and I actually read this in Wiki guide for bringing your spouse here.. but due to timing issues, was too afraid to hope that it would apply to me. Apparently, as told to me by the NVC employee this morning, if NVC reviews your Affidavit of Support documents and they do not at that time have the beneficiary's Visa App and supporting documents, then they send you a letter and the AVR message states, we have reviewed your documents and found missing/incomplete....the missing documents is that they dont have the DS230 yet.... duh... The wiki guide stated that this may happen IF they review your AOS and you have not yet paid your IV bill or sent the DS230... as I had paid the IV bill and the DS230 had been sent and received by NVC the day before the review... I was afraid to hope it could be the reason for the AVR message.. Thank god it was... and ps.. My AOS package was fine.. just waiting for the word on the DS230 package now... Thanks again for your replies.


If they don't find anything missing from your DS-230 package, your case could be completed very soon. We also got the "missing information" message on November 9, after they reviewed our DS-230 but hadn't gotten to our AOS yet. The following day, on November 10, our case was completed. We were very pleasantly surprised at how fast everything was!

Hi! I used the format from this link: http://www.visajourn...il_DS-3032_form. It's from the VJ wiki. You don't need to scan any documents. Just email NVC using the format.

Yes. I emailed my DS-3032 just a few minutes after we paid the AOS fee, and NVC accepted it. It's my understanding that you can do both simultaneously, since they take parallel paths, so to speak. (By they, I mean the processing of the AOS and the processing of the IV application.)

Hi! No, I haven't tried that, but I certainly will now that I know it can be done! I thought all along that we had to wait for NVC to schedule it. How is it done? So I go to manila.usembassy.gov and look for the link to online scheduling, right? After you scheduled online, what did you do with NVC? Did you let them know that you had scheduled the interview yourself? Thanks, OMG, it's good to know it can be done for CR-1 filers!

Edited to add: I'm on the Manila embassy website, but I see no link to online scheduling for immigrant visa applicants. Did you try calling them?

Oh, good for you! Congrats on getting a December date! :) Yeah, ours is different. CR1/IR1 applicants' interviews are scheduled by NVC, not by us. But I'll call NVC again. That was just one operator. Maybe she made a mistake...I'm hoping she made a mistake! ;)

The computer was going to let me. It let me put in my data, click on a date, and click on a time. All I would have had to do was click Continue, which I didn't do because I wasn't (and still am not) ready to take the risk of everything possibly blowing up in my face.

I guess I'll just wait. It's actually not that I don't want to wait for an interview date. What irks me is that NVC is saying that there are no more slots for December, but the website has available December dates. I even called the Manila embassy hotline to ask if December is full, and the CSR pulled up a calendar and said the first two weeks of December are available for CR1 applicants.

I learned that online scheduling has been successfully done by a couple of CR1/IR1 applicants who have had to undergo a sputum culture test. I'm curious to know if anyone who didn't have to undergo additional medical tests was allowed to schedule an appointment online.

Call me impatient or whatever (because yeah, I am), but I'm tempted not to wait for NVC to schedule an interview for me and go ahead and schedule one myself. I went to the portal for appointment scheduling for Manila, checked the calendar, and saw that there are still slots for December. But NVC is telling me December is no longer open. Well, according to the website, there are at least 10 available December dates! What will happen if I schedule my interview myself? Will that cause problems for our case?

Yeah, my interview's on the first week of January. I hope they don't start trying new things at the start of the year. Or if they do, I hope it's to make the process easier. No interview sounds good, making the appearance at the embassy just a formality. But I believe that's highly unlikely.

Hi! The medical should be done first, definitely. Even if you pass the interview, the embassy won't give you a visa without a medical clearance. The results of the medicals should be in by the time you have your interview.
