We didn't realize he would need a transit visa but in fact he does if he takes any flight other than a direct flight and has a bit of a layover. Our first attempt at getting him here, he was denied because he had no transit visa thru France (even though he was not planning to leave the airport). We have found if he goes thru Qatar and has a less than 8 hour layvover than he needs no transit visa then.


When my husband came in 2010, he flew from Tunis to Paris and did not need a transit visa because we remained in Charles de Gaulle airport. I find it very bizarre that they would ask for a transit visa unless he has to switch airports.

Hi! When I was in Tunisia doing our paperwork, I had to get proof from the US government that I was "free to marry." At the US Embassy in Tunisia you could do a paper called an affidavit of single status which you can get notarized at the embassy in Algiers. Here is the link: http://algiers.usemb.../notarial3.html Make sure to call them to make sure that they do indeed do this document :)

I would recommend that you get this paper at the embassy as soon as you arrive because I do not know what part of Algeria your bride to be is in, and having the paper simplified my life :)

Wow Everyone ! Thank you for your very rapid replies, the advice regarding ignoring the K3, and other tidbits of information.

I am indeed Muslim, so religiously there should be no objection. One thing that was mentioned elsewhere however is that Algerian birth certificates state a person's marital status, American ones do not. Therefore I would need some sort of certificate that I an eligible to marry (e.g. not currently married to anyone else)

My State does not have any such certificate however, aand I'm certain the US federal government does not either. I've tried contacting the US embassy in Algeria, while they have been slightly helpful in directing me to some paperwork, in this one matter they haven't really given me a direct answer - which is weird.

They have directed me everywhere but haven't really said yay or nay if they are able to issue this type of certificate.

Again, thank you everyone for your replies and shedding more light on this.

When I first met my honey he was flying in from San Diego. He had just been in the country a couple of days from his home country. His flight was to have suppose to have been here at 9-10 then we had a 3 hour delay due to maintenance issues or what ever. I had got my self all dolled up wearing some jeans a cute top my a$$ kicker boots. He calls me right before I was about to leave for the airport he's like maybe you might want to take a nap first since it's going to be a whilebefore my flight takes off. (I' thinking are oy kidding I spent all evening getting ready and then to sleep and reck my master piece (so to speak). I"m liek nah I'll stay up other wise I might not wake back up. ;) I'm like what will you be wearing? He's like I will be the "man in black" I chuckled. :) So when he did finally arrive he of course was the last person off. (most of the pics I had of him were either tiny or he had his sun glasses on) So when I did see Him i saw this huge buff guy. I'm like is that him? His photo's did him no justice!! He was so exremely good looking. He of course was wearing his sun glasses. (this is his thing he has to always be wearing) but when he finally walked out the doors I was there waiting for him with the hugest smile ever! :D I pulled up his glasses so that I could look my love's beatiful eyes. :wub: We gave eachother a hug and kiss upon his arrival. This was the beginning of our happily ever after. :yes:

Hi all.
A couple of years ago my fiancee had a relationship with another US citizen, and they applied for a K1 visa and got a NOA2 and the interview at the embassy was scheduled, but the relationship fell apart before the interview date and she did not attend the interview. She sent a letter to the embassy describing the situation and stating that she did not wish to continue with the process. The embassy sent a reply stating that the case was closed. My question is: Is this going to affect our current K1 visa application in any way ? (I just got a NOA-1 a couple of days ago) Does she have to disclose this episode ? There was no place on either G-325A or I -129F for this kind of information. Should she tell about this at the embassy during the interview?

I found this mention on another board, I hope someone can expand a little more on this.

U.S. citizens who travel abroad and marry have the option of proceeding with an IV application or the nonimmigrant K-3 visa. K-3 visa processing is till faster than IV processing, although the time differential has narrowed. Even if the I-130 has been approved at the service center, sent to the NVC, and forwarded to the consulate, the consulate is still authorized to process the applicant for a K-3 visa. Once the applicant has decided to be processed for an immigrant visa (and possibly been denied for public charge), he or she cannot change and request the K-3 processing.

Thanks, that's what I thought.

You'd think that given that the K3 is supposed to allow family's to be together faster, the most timely option would be betermine the determining criteria, and not the fact that the I-130 is already there.

I was reading on a lawyers site how a spouse of a citizen who enters legally on a visa, and overstays is allowed to file for AOS without having to leave the country. For myself, I can see issues there that just aren't worth the risk, wrong, and leave me frustrated that my country would allow someone to "cut in line" and allow their spouse to be legally here before my wife. I also wonder how much of this is common practice, and if any of these cases are prosecuted for visa fraud, deported, or both. Is that why they are so adament about not letting anyone in at a POE because once they are here, if they have the proper connections (i.e., USC spouse), they can AOS without having to leave?

I get the feeling the law says one thing, but what is actually carried out is something else. I guess that goes without saying given the state of immigration laws in this country.

My wife's case was forwarded from NVC to CDJ on 6/22/06. It appears that K3's interviews are being processed faster than for IR-1 / CR-1. Given that our case is now in Juarez, would it be to our advantage to file the I-129 in an attempt to obtain a faster interview?

All the times that I looked at the processing times in the USCIS website, I would see clearly stated that the I129F was for "NOT YET MARRIED," and as such never looked into it. It wasn't until reading more on these forums that I learned it could also be used for a spouse. Had I known this, I would've filed the I129F with the I130 last year.

My best guess is that we are looking at an 8 month wait from this point if we leave things as they are, but if a couple months can be shaved off by utilizing the I129F, then it's worth the $170. I have read though that if your CR1/IR2 case is already at Juarez when the I129F paperwork arrives, they cancel the I129F automatically.

The wait is very frustrating. If I knew then what I know now, life would be so much easier. We are doing it the right way, but we could've done it a better way!

That`s what we`re doing- I took a week`s vacation along with a four day weekend. As long as all goes smoothly we`ll go visit family in Chihuahua after the interview. Yes it will be her first appointment, my wife has never entered the US without inspection or overstayed a visit, so there is no need for a waiver. She's had a border crossing card (laser visa) for 7+ years, and has always surrendered her I-94A's before they expired.

We'll have our 2 year wedding anniversary next month, and since they haven't notified us yet of an interview it looks like by the time she does get it, at least she will get permanent status and not conditional. Gotta look for the positive where you can!

Generally speaking, how much notice is given when the interview packet is mailed? 30 days?

Something like that. I don`t remember when our current one arrived, but the postmark says 01/29 (El Paso) and this time we have our interview on 02/28. Other people are getting them with about the same time frame. Don`t forget to arrive a couple days early for the medical- it usually only takes one day, but sometimes you have to go back a second time and they`re closed for a lot of holidays- all US holidays and all Mexican holidays. Also, if you buy plane tickets, be sure to give yourself plenty of time for the interview because that one frequently runs into another day. Last year my wife had to keep going back again and again for a week (I was already back at work by the time they finally finished with her). I`ve never heard of anyone else getting stretched out that long, but it can happen. Two days is fairly common. I think they have a list of holidays posted on a website somewhere but I don`t know where.

Hi, Raymond. Is the 3032 the "Agent of Choice" form? If so, they should sent you the packet at the address you gave them. As far as I know, they don`t send anything to Mexico. What ever they send to me in the US, I just fax coppies of to my wife. Also, I could be wrong, but it seems to me that most people are currently waiting about a year from the time their cases are transfered to CDJ to their appointments. Good luck.

And yes, seems more like 11-12 month interview dates, seems most are getting their packet on month 11 for interview in month 12. Oh well, more hurry up and wait.

My wife's case was forwarded to CDJ in June 06. Last December I emailed CDJ and they reported interview wait times between 9 and 11 months. We are at month 8!

We filed a DS3032 listing me as her agent with the NVC, it went in right around the time we sent in the Affidavit of Support early last year.

Will CDJ mail me a packet stating when the interview is scheduled or will it ONLY be mailed to my wife in Mexico?

Our case was forwarded to CDJ in June 2006, last week we received our packet stating my wife's interview is set for June 7!

We want to go as prepared as can be, and I believe we have everything in order except for one detail. My wife's birth was not registered in Mexico until 1980 (she was born in 1967). She was raised by her grandmother, and it wasn't until the school that my wife was attending requested a copy of the certificate that her grandmother discovered the birth had not been registered. My wife tells me that while not the norm, it's not uncommon for births not to have been registered at the time of birth (going back to the 60's and possibly 70's).

When my wife applied for her Laser Visa Border Crossing Card, she says she had to also provide a copy of her parents birth certificates and a copy of her older brother's birth certificate. She did receive her Border Crossing Card.

Having said that, should we obtain copies of her parents birth certificates to have present for the interview? Has anyone face a similiar situation? Any advice/tips would be greatly appreciated.

Generally I have found that the first email, such as the one above will get you back a generic response. The response usually doens't make sense, it's like if they hadn't actually read your email. Now, I discovered that if I simply hit reply to the generic email they sent me, and re-asked the question (perhaps wording it a little different), then I would get a more specific response.

The emails you receive from CDJ are not signed per se, but they will have some initials at the bottom. I suspect that when you hit "reply" to the email, it gets forwarded to the person whose initials appear in the email. The 2nd replies always have the same initials as the 1st message from CDJ, and it seems they take a little more time in reading your letter the second time around.

The key thing is to hit reply when you get the generic email response back from CDJ, do not create a new email. Hope this helps you get some information.

You are lucky that you got your packet. Our file has been in Cdj since June of 06' as well and we haven't gotten the packet yet. Maybe soon. when we call they never give us a direct answer about anything.

I want to ask one question for clarification:

How would they know that we have an I-130 in process unless we tell them? It is my understanding that they only ask a few questions since they are so busy. I would under no circumstance advocate lying to an official but if all she says is that she is visiting for holiday why worry?
I will make sure that she has as much information about her permanent residence in Japan as well as a return ticket before she arrives.

It's kind of a Catch 22. You can enter on a tourist Visa if you have no intent of immigrating to the US, i.e., you will return home after your visit. If you are married to a US citizen AND have an I-130 in process, then the intent to immigrate is there. This creates a greater burden of proof for the person entering on a tourist visa, you must have plenty of documentation showing intent to return, and also proof that you don't plan on circumnavigating the immigration process by trying to AOS once in the US. It's really up to the officer at the POE to decide if they believe you will return home after the visit.

It is perfectly legal for a spouse of a US citizen to visit the US, with or without an I-130 on file, if they can prove they will return to their home country within the time limitations granted to them via their tourist visa.

Obviously this won't help you when sending in the I-130, but it does show proof of a legitimate marriage and might come in handy when she goes in for her interview.

My wife's case was approved by the NVC and forwarded to CDJ in June 2006. We understand interviews are running about 12 months from the time the case arrives in CDJ, which means we are very close now.

The company I work for unfortunately is not doing so well, and it is questionable whether they will make it until June. How will this effect my wife's interview given that I may find myself temporarily unemployed on or about her interview date?

The plan was for me to take a week of vacation and go to CDJ with my wife, and we would still like to do that. But, it would be very difficult starting a new job and then immediately asking for 1 week off.

My tax returns put me comfortably above the poverty line, but if for some reason I am unemployed at the time my wife has her interview, and the newest check stub and letter of employment she has to present at the interview is 3-4 weeks old, can this have a negative effect?

I don't own property or my own home, but I do have the means to sit out 1-2 months while I decide which direction my career will go. Normally this would be a non-issue, but it looks like my forthcoming lay-off will be just before my wife's interview. Getting a co-sponsor is no problem, but is it even necessary? Would having an I-864 filled out with co-sponsor info ready to present at the interview make a difference? The I-864 I originally filled out went to NVC, so I'm not sure if CDJ could do anything with it anyway.

Will filing an unemployment insurance claim be seen as a negative?

Any ideas/tips anyone might have would be helpful.

Hello everyone, i am in the waiting time for getting my interwiew appoiment since Sept. 5th 2006, because at the mexican consulate (CDJ) it takes around 12 months, but i was wondering if anyone knows of any case that hasnt had to wait the complete 12 months? and get the interview sooner, also if anyone could tell me if once i get the appoiment my husband ( he is the american citizen) can go inside to the consulate with me or i have to go there by myself ?

Our case was forwarded to CDJ in June 2006. In late April of 2007 we received our appointment letter stating our appointment would be June 7, 2007.

My wife's case was approved and we are now home!

I would say judging by your timeline you will probably be notified in July or early August as to when your appointment will be. Whoever was assigned as your choice of agent (form DS-3032) will get the notification...most likely your husband.

Spouses are not allowed inside the consulate, on rare occassions they may request the presence of the spouse if an issue comes up during the interview that can only be clarified by the spouse.

My wife's interview was scheduled for 7:30AM, we got in line at 6:30AM, I waited with her until the consulate started letting people in at 7:30, then I waited across the street until I saw her physically go into the consulate. I then walked back to our motel and waited. Lots of people choose to wait across the street in front of the consulate, but with our motel only a 5 minute walk away I felt it was not necessary. I told my wife if I was needed to simply call me from the payphone outside the consulate and I would come RUNNING! I showed back up at the consulate at 2:30PM and my wife walked out 15 minutes later. Later at the POE (point of entry) we spoke to some folks who said they didn't get out of the consulate until 5PM.

One important detail about CDJ, where you are in line in the morning does not determine what order you will be called in. You can be the last person to get in line and stand as good a chance to be called first as the person who got in line at 4:30 in the morning. No food or drinks are allowed inside the consulate, but you can buy them inside.

Later in the afternoon, after having a late celabratory lunch at Frida's, we took a taxi to our assigned POE to get her Passport stamped. If you choose to enter the US through El Paso, you must enter through the POE they assign to you (there are 3 in El Paso), otherwise you can enter through any POE along the border.

I don't see where in the I-130 instructions they ask for the spouse's birth certificate. If you look at the instructions, number 7, section A, it provides all the requirements. I-130 Form. They do ask for birth certificates if you are petitioning for a child or parent. If you look at the link provided for the checklist elsewhere on this thread, you will see the item asking for spouses birth certificate is crossed out.

Now, they've recently changed the I-130, so it's a slightly different form than when I filled it out almost 2 years ago, but we didn't have to translate my wife's birth certificate (she's Mexican, I'm the USC). In fact, we didn't have to translate any documents. For CDJ, Mexican documents presented in Spanish do not have to be translated.

Again, double check, but you don't have to translate your spouses birth certificate because they aren't asking for a copy of it in the first place. And when you go to CDJ, the birth certificate is just fine in Spanish.

Hello! Sent our I-751 on 3/20/12 and got our NOA today 3/26/12 from the VSC.... Question is the highlighted portion something you all get? I have no intention of sending more documentation. Sent plenty.


I have that part on my NOA. I think it's just to remind people not to ONLY send the I-751. Please tell me the date marked on your NOA so that I can add it to the list :D

So today I have received another NOA, dated March 22nd. This one is a 2 pages NOA; however,it gives me a case number EAC# that is traceable online. Is that what you guys have received so far?First time an extension letter AND then another 2 pages NOA that has the case number that you can look up online?
I was hoping to get the biometric letter, not another NOA...


Hmmm...Are you sure there is no appointment listed on it? The first NOA is not traceable online, but the second NOA that I received had the traceable number and the appointment for biometrics.
