EDIT: Oh yes, and I realise you have to take your passport to the embassy with you. My main worry is that my new passport wont match up with the passport details on the DS-160 at the interview if I fill it in before I get my new passport.


I would definitely call the passport agency and find out exactly what will happen with your passport. (If it will get a new no etc) because like I said, it would be different than your I-129f too. Which may or may not be a problem. Don't submit your DS-160 until you call and get this information. You can fill it all in, leave that bit blank and safe it to go back to later. You can do that. Also, do t forget to print the confirmation page off when you do complete it because you need to take that with you to the interview.

Personally, I would cut the trip short. Otherwise you're probably going to need to call/email/write to the consulate in Sydney and request an extension.. I'm not too sure how that would look, but I do know they give them out under reasonable circumstances (for example, my interview was Sept 24th, and my petition was set to expire 6 days later on Sept 30th - they said I'd be fine but in the end they had to extend it by 2 days). Remember when you send pkt 3 you are signing off that you are ready to be interviewed. Don't send it all through if you're still in the states and thus can't attend. It just wastes theirs and your time.

You guys are fine, as you have met within two years of knowing each other. That's all that is required. You could have only known each other ONE MONTH, and you can still file so long as you have met FACE-TO-FACE and have proof of doing so BEFORE filing.

I think that is a very reasonable time frame! I am in AUS, and we applied Sept 24th 2012, and my interview was approved Sept 24 2013. That was a much longer process than normal because I was unlucky enough to catch the service center at its slowest point.. It has picked up again since then.

 

You need to make above the poverty line (see pic dutdutout posted) to be the sole supporter. If you DON'T make this much, don't panic. The US Consulate in Australia DOES accept co-sponsors! I had one, and was accepted without issue.

 

Point of entry is wherever he lands first in the US. So you would write either San Francisco or Los Angeles.

as long as the aussies can produce the background check you are good, that is all the US wants

the US will give you a brand new eye and fingerprint scan upon your successful arrival so they don't care what the aussies use LOL

Just to add to this...I've sent off for my UK police certificate.

 

When I called a police station in Sydney to confirm they did fingerprinting there, the guy asked me if I wanted ink or digital. I'm assuming that digital is the way to go but can anyone confirm this? I told him probably digital and he said I need to call the consulate to confirm as different visa's require different types of fingerprints.

 

Can anyone who needed fingerprints for a K1 interview please confirm which ones they were told to get. I'm still leaning towards digital ones. Each time I pass through the USA customs I never have a problem with the digital reader picking up my fingerprints so I'd say it will be fine.

Hi everyone.

 

I'm posting this one because I've been reading the conflicting information between here and the embassy website and it's all very confusing. I apologise if I've missed something obvious in one of the guides and this becomes a re-post etc. I fired off an e-mail to the Sydney consulate office with some questions and received the response at the bottom of this post today.

 

The embassy site, http://canberra.usem...e_niv_appl.html, is clearly incorrect and says I need a police certificate for each state or country that I've lived in for more than 6 months. For me this would be VIC, NSW, QLD and my time in the UK. Do they really want 3 certificates for Australia?! After browsing the VJ site for a while I've seen people saying I only need one national certificate to cover Australia. It's always hard to put complete faith in forum posts on the net when it conflicts against information you are reading from the official embassy website.

 

There's also a bit of a discrepancy around which form to use, P799 or P800 and also whether to get just the name cert or pay extra and get the fingerprint certificate. From what I understand...you only need a fingerprint check IF you don't supply all aliases that you've previously used. Does that sound right to anyone else? The P799 form covers visa applications etc. and that is what they tell me to use in the e-mail, the P800 form I believe is used for people who are wanting to join the police force or work as a teacher etc. 

 

So based on this. I've never had another name or alias etc so I'm going to apply for the standard NSW name police certificate that covers name and date of birth for $52. I will also be printing the e-mail I received from the embassy to put in my file.

 

I'm hoping somebody else might find this information useful and not get a head full of noise like I've had over the last couple of weeks. If I've made an incorrect statement here can somebody please correct me.

 

I'm now sitting and waiting for the NVC to send our information to Sydney...

We didn't have a case number issued until just now. It took about 53 days for NVC to issue our case number and send it on to the embassy in Sydney.

 

As your NOA2 was only a couple of days ago I'd say you still have some time to wait.

 

You can call the Department of State on 202 485 7600 and apparently you get straight through. If you call the standard NVC number you have to wait for a while and usually get messed around by frontline staff who don't know what is going on.

 

I hope I'm wrong about the timing for you but based on comments from other people I'd give it at least a few weeks before calling. The processing times were recently updated from 4 weeks to 8 weeks so they seem to be incredibly busy. Once my visa is approved I'm going to apply for a job at the NVC, clearly they need more staff :)

We didn't receive a tracking ID, but if you have the date your petition left the NVC, you can track yours too. Just go to DHL.com and select "express" then "tracking" then "track by shipper's reference". The shipper's reference is keyed in, for example, like this: EXP 21 OCT 2013A. The date should be a day *before* the day NVC says they shipped it off. Put in the date range of the date before NVC sent it off to the day or two after. Leave account number blank and select your country. Only one shipment left the NVC with destination Singapore during the date range I selected so I knew it was mine. smile.png

Just to add, if you have your case number from NVC, you can key it in here (select Immigrant Visa) to see your case status. Typically it will say "At NVC", then "In transit" while it's being DHL-ed to the consulate, then "Ready" once they receive the actual file. You can also track your case status throughout the interview process.

Just wondering if you happen to know the price of such legal assistance? Because a lot of people state that lawyer is not that much needed unless the case is very particular with issues that may make application process difficult....

The legal fees, which takes us right up to the K1 visa being issued and me entering the USA is USD $1000, this DOES NOT include visa fees, medical, police checks etc. I think the cost of legal fees for the second part was USD $1500, which takes me up to the issuance of my green card. Trust me when I say that we will be doing the second part ourselves.
 
There's enough material and support on here that you can get by doing it yourself.

 

 

 

 

Go to uscis.gov and you can check your case status. You can also sign up to receive updates if you make an account which is basically just putting your info in so that you can sign in.

 

Thanks! Would I still need to do this once it's gone from NVC to the embassy? Once I'm issued my K-1 am I right to assume that this is no longer valid or does it stay active right through until I'm issued the green card?

 

 

 

 

If you submit an G-1145 with your application, you will get an email and text when your paperwork is received.  Most likely your attorney did not attach that form or they entered their contact info not yours.

 

The whole idea of using an attorney is to take you out of the process.  Some attorneys are good with follow up, some are not.  If you trusted this individual enough to put your cased in their hands, then you can only sit back and hope they do the job you paid them for.

 

As mentioned previously you can track your application to an extent, but the USCIS site is rarely accurate, We had our approved 129 in hand and USCIS still said it was in the initial phase.

 

I understand the 'taking us out of the process' part but I specifically asked her to keep us updated the whole time. She also confirmed that she has all the 'backdoor' contacts that normal users who apply without legal assistance don't have so get can get status updates before other people etc. Case in point...I have our case number and we still haven't heard from her. She never sent us a checklist of things to do in the meantime etc. If it wasn't for this site, my own organisation and a fair amount of OCD, I would still be sitting here not having completed anything. Instead I have everything ready as soon a packet 3 hits my inbox!
 
There's been other instances but I'm not going to turn this thread into an attorney bash, and I certainly won't name the firm, I guess she's just really bad at follow up...and organisation...and customer service smile.png

We used an immigration lawyer in the USA to help compile documents and forms and submit our application. I would have preferred to have done it myself but It helped my fiance to get everything organised.

 

Unfortunately, this lawyer is a bit useless in terms of keeping us updated.

 

We had our case number assigned to us from NVC sometime over the last few days as we called this morning and the gave us our number and the status is "In Transit". So it's on it's way to Sydney. Yay!

 

How is everyone else getting their updates? I'm seeing people receiving text messages or e-mails with status updates. Was this information that you gave when you originally completed the I-129F or was there another form? We've had absolutely zero contact from anybody about anything, all we received was our NOA2 in the post. I'm beginning to wonder if the immigration lawyer added herself as a contact instead of us?

 

I'm calling the embassy in Sydney and making sure they have my contact details so I at least start getting updates!!

 

Our NOA2 was August 30 and we've since been assigned our case number. If you are before or around our date then call the Department of State on 202 485 7600 and start chasing your case number. My fiance said they answer the phone straight away and are really friendly.

question: he has only held that position since last year has never done a tax return.

 

is the following evidence enough, or if not, what else should be included:

 

- three most recent pay stubs

- letter of his XO or CSO stating his job title, position, salary, and full-time status

so my fiance got his b.a. and m.sc. and is now an officer in the us navy. he has not held a paying job position before, ergo never filed for a tax return. 

 

he is making good money now, obviously, well above the poverty limits. for the i-134 he is able to provide three most recent pay stubs and letter from the captain stating salery, position and the likes.

 

question: will this be enough for the i-134. if not, what are other options. not to make things harder: parents do not approve of our relationship. joint sponsor might not be a possibility. thanks guys

I just left London and returned to Brasil to do my interview and medical exam here, but before leaving I went to my GP and asked for a report. So the doctor printed all my history since I started on that GP, all visits with comments, exams taken...I don`t know if it will help but I got it anyway. The doctor was very helpful printing for me without even ask. My medical exam will be on 3rd of december.

just wait for the letter in the mailbox. give it 2 weeks to arrive. after a week of waiting for ours, we called uscis only to have them tell us wait another week. then our immigration attorney called us to say he received the letter. and the rfe was for just a better copy of my fiancé's birth certificate. we got approved within 2 weeks after replying.

 

so, don't worry. an rfe is a good sign that someone's looking at your file. and they most of the time make a decision very shortly upon receiving your reply. good luck.

Here is the situation we are in. My gf is a citizen of Hong Kong but she was in Singapore on a student visa. She finished school and applied for another student visa 3 months ago (which would last for 1 year). The visa still did not come, but in the mean time she is getting temporary visas.

 

I was waiting for her to get the student visa before I send in the K1 application because on the application I must choose the consulate when I mail it in. I do not know if I can choose the consulate in Singapore until she gets a visa for 1 year.

 

Am I correct? Can I choose the Singapore consulate, and if she moves to Hong Kong, can she use the Hong Kong consulate for interviews etc?

 

I don't know why the student visa is taking so long and they will not say anything except "we will notify you by mail"

 

How long can we wait? Should she just move to hong kong and I apply using the Hong Kong consulate?

 

I will appreciate any suggestions or thoughts.

Have had a RFE for a Divorce Decree but in this country (New Zealand) our divorce papers are not called this, they are an Order of Dissolution of Marriage, which I supplied a copy of with our application. I contacted our Ministry of Justice, and they said it is simply a difference in country's legal terminology! But this leaves me with a situation where I a being requested to supply a document I cannot obtain. The Ministry of Justice suggested I go to the Court House, and do an affidavit to accompany my Divorce papers, stating this is what this country has in the place of a decree. Does anyone else have experience with this kind of situation???

It seems (and correct me if I am wrong) that schools will accept children whilst on their K2 visa, and awaiting adjustment of status. And that documentation (legal) is required of fathers consent to leave the country at departure but not at the US Consulate.

 

Only question that remains is regarding the medical/vaccination requirements for the child.

Does he come with me to the Embassy Interview, does he also have the Immigration Medical/Immunisations? Does he need to travel with me to the States (once I have approval obviously!) at the same time, because my thought was to settle in and then bring him over in several months. I am divorced, does his dad need to provide a letter as to his consent to allow him to leave this country? And in terms of being in the States, when is he able to attend State funded schooling??

My boyfriend (US citizen) and I (Australian) have been together for almost three years now and are planning on getting engaged when I visit him for three months in January. I know it's a little unromantic to have to plan when we get engaged haha but I guess it's all about planning in long distance relationships! The reason we have planned it like this is so that I can get one last trip to the US before we apply. Im concerned that I won't be allowed to enter the US once we start the K-1 process so I thought this way we can limit the time apart a little bit. 

 

My question is, what should I take over with me so that I can start the process over there? Birth certificate? Do I need a police check at this point? I want to be organised in advance so that we can apply soon after I arrive there. This is all very, very overwhelming! I feel stressed already! I have been reading so many posts on here, everyone is so helpful and supportive!

It will be so much easier doing the paperwork together!!! My fiance is in the States and I am in New Zealand!!

 

Just work through the K1 checklist on here and the letter templates, thats exactly what we did and we are at the K1 pre-inteview stage now.

The co-sponsor doesn't have to work for the government. as long as it's a US citizen and meets the income requirements you should be good!

 

I'd rather prefer to get a co-sponsor than cancel everything (spent so much money) and wait for my faincée to find a job cause getting a job can take a while and then you need several pay stubs, tax returns etc for prove.

 

Just check again for the co-sponsor. I think that's the easiest way to go about it.

Yes. It sucks that 6 months were wasted because of a failure to read the directions.

Anyboby can help me !!! My CASE isnot received letter or mail say THEY denial decision notice for this case I-129F But MY CASE STATUS say that 

  • At this time USCIS cannot provide you with information for your case. Please contact the NCSC 1 (800) 375-5283 for additional information.
Please help me. I filled noa1 on JANUARY 15 From  may 24 we transfer VERMONT  to TEXAS

It means you will get an NOA2 or RFE within the next few days.
