i think she needs to use the one on her ID since she already declared that as her dob. She will probably need to go to certification/records office with parents in tow to get some sort of official date of birth document.  They will make one for her since they probably have no record of birth. May take a while before you have an official document she will need for the interview and AOS.

I received an RFE for not submitting the intent to marry from the beneficiary. On the top of the letter it states...

 

*All foreign language documents must be submitted with complete word-for-word English translations. The translator must certify that the translation is complete and accurate, and that he or she is competent to translate. Do not submit the English translation without the foreign language document.

 

 

my question is does he need to do a letter of intent in his native language or can he just do it in English. Last thing we want is for them to send another RFE that it needs to be in his native language.

WHAT? Ok I have seen the memo but lots of VJ members got RFEs for unsigned G-325s, what gives? They do not have to be signed,they can be signed at the consualte interview. Some adjusicators haven't read all the memos, we get hundreds of the things, and maybe they make a mistake. If you want to be sure there is no mistake, sign it. Or send a letter expalining why it is not signed and request it be signed at the interview. Do you have that memo?


It is on the VJ website somewhere You can print a copy of that and send it with the I-129f and G-325a.

Fiancee intent letter? Signed or unsigned? Signed.

What about a faxed or emailed signature? When I was adjudicating, if I could see a signature, I accepted it, but many adjusicators will not. Signed is better.








 

 

 

I can only talk of experience as a fellow k1 petitioner. My fiance is in Nepal. Imagine trying to get something sent from there!  He signed it, his original signature. he scanned it and emailed it to me. i printed and sent it in. I did not get an RFE but as the pinned section says it depends on the adjuctor or whatever their called. What i did get an RFE for though was not including his letter of intent so don't forget to do both those ok? lol

 Ok in anticipation of my fiance going into interview. i sent him my affidavit and my tax forms and w2 but i was re-reading the instructions it does not ask for this type of evidence/proof they want a letter from your employer??

 

My employer does not make this type of request. They give out a generic 800 number to call and if they punch in my info they get verification of employment and pay if i authorize it. They don't do these letters?  What do I do now?

 

Why don't they accept tax forms/w2??  what about paycheck stubs can i use that?  Help has anyone come across this problem before?? Also do i have to provide financial documents like bank statements even though I am not using assets as part of my support?

 

I'm stressing please help me out here.

yea i wouldn't recommend you do it the way your suggesting. Your giving them the benefit of the doubt to put two and two together like jay-kay states they are not going to get it. 

 

You don't need the letter of intents notarized i'd do a separate letter explaining your situation and with both signatures on it stating that your both together in Canada and get that notarized. Although I haven't been here long I haven't heard anyone else try this before though.

i am not an immigration expert just a fellow vjer, but i wouldn't risk combining two different documents. Do the 2 letters of intent from each of you ( does not have to be notarized). Then do another letter stating you are in fact in canada with him, have that notarized both your signatures and hope for the best?? or maybe you guys should take a bus trip or something somewhere together. it proves you were in the same location at the same time.

Well definitely do not get pregnant at least not anytime soon. Remember once he gets here he will not be able to work or possibly even find work once he has permission.  You have to support him for several months. There will be stress from coming here, filling out AOS, waiting for employment permission, and becoming accustomed to living with someone you have not lived with before are all stressful events.  Prepare for k1 process by reading the guidlines and searching forums for previously asked questions and once your ready to send package if you have any doubts post and people will make sure you have it all covered.  Good luck on your journey together.

1. Will the petitioner received a package that he has to submit (our read that somewhere....but then I couldn't find where, so maybe I was just dreaming) or will the petition just go to NVC and then the embassy?
After noa2 it is sent to NVC for processing then to embassy

 

2. How can we follow our petition now and check where we are?? Will updates be posted on USCIS.gov??? 

you have to either call the NVC to see if they have recieved and process your application if they have they will give you a case number which then you can check on status https://ceac.state.g...YzCYubaSQI RA==

choose immigrant visa(IV) then enter that case number otherwise you can just wait to receive their letter in the mail which will have the case number on it.

 

IF it has been sent to the embassy already you may want to track further refer to http://www.visajourn...-to-us-embassy/  to try to find where your packet is although you might have to play around with the EXP date as it may be the day before, of or after it was sent

 

3. Anybody from Germany, after your I129F was approved, how long did it take to get to the embassy? Our I129F took 5 months already...can't wait to move on.

 

4. How do we even know our petition arrived at NVC? Do they send an email or something? We haven't received email when I129F was approved, that was exactly a week ago.

Thanks for looking into that for me! I wasn't able to find information on if Dr. Cheema asks about drugs or not. I guess I didn't look in the right spot. 
 
I will certainly be honest. I'm just scared that something that I did when I was a teenager could affect the process now. I'm praying that it doesn't.







There are many threads that you will find with just the keywords "drug use" and "medical", including those started by Canadians. I suggest reading through them if nobody here ends up helping to your satisfaction.

You can also look up the timelines of the OP's that started those threads to get an idea of whether or not they experienced problems.

That was just a guess.

However, quick research tells me that they often view past drug use as a means of denial. Also research tells me that the nature of the drug use and how recent it was plays a factor. People have made threads telling that they have had to either undergo further tests or psychological testing to clear this red flag or have flat out gotten denied or even a temporary ban. Others go clear without any issues though. It really is consulate specific and, again, specific to the nature and how long ago it was. Additional research tells me that Dr. Cheema doesn't conduct drug testing nor ask about it apparently, so you may be off the hook. But if she does, you will have to be honest.

That's the best I can come up with. But again, those with more experience with the Canadian procedure and/or drug history can chime in here.

Your timeline indicates a NOA1  So, they cashed your Check and took the money,  The approval of the NOA2 is after a backgound check.  So, you are asking a question with a question.  To Answer your question:  Were you ever Convicted of Drug use?  If the answer is yes, then yes.  If no, then No. and not bring it up.  Is that a start... Please be more DIRECT with the topic..  Were you Convicted  you will get better replies..  To answer your question.


This is horrible misinformation and advice. OP please ignore.

First off, the beneficiary is the OP, as he/she is asking about his/her upcoming medical exam that will occur before the interview. The OP is not the petitioner. USCIS only does a background check on the petitioner, not the beneficiary.

Furthermore, the OP should never lie, whether it is in response to questions asked in the medical or on forms. So if they specifically want to know about past drug use, you WILL HAVE TO ANSWER TRUTHFULLY. However, you should explain the nature of the drug use and when it was and offer how long you have been clean.

As far as whether or not this affects your passing the medical, I am not certain, but my guess is that it won't as long as you come clean. But others with more knowledge on the subject can chime in on that.

Today USCIS have look into my application for my lovely fiancee. I have an email stating they need request for evidence which i am was pretty upset. I have thought I have gave everything to them. At the moment I'm worry about the whole thing i sent everything between me and her, like love letter, Pictures me and her family, Phone call and video chat, Supporting her overseas etc.. There was one thing I might have miss which was her parents authorization, my fiancee is 17 years old and I am 22 years old. I have already ask there parents for the permission and they said yes. We have went to get a letter notarize from Dominican Republic. I didn't send that piece of information because it wasn't necessary. I really stressing out about this. Could anyone could give me advice please, I really want my fiancee here with me and I know that USCIS have there hands on my relationship at the moment. :(


You have to wait for the RFE letter they send you to know what they need. They spell it out for you on there. Then send back what ever they ask for, even if it is something you were sure you sent already. Usually the whole process adds one additional month.

There have been cases, when someone scheduled an interview past the USCIS deadline, and the embassy just automatically extends it to accomodate the interview on that day.

I just checked.  When we got approval status on August 6th, 2013 from USCIS for our 129F petition it said that the approval expires December 5th. 
 
Our interview is December 5th.  Does the USCIS expiration mean that if the visa interview cannot be postponed?


Most embassies will extend it if you request it. I'd call them, explain your situation, and cancel the interview for a later date. Remember, too, that she will have 6 months from the visa date to actually have to enter the U.S.

You only need the DS-160. The other forms used to be required when the DS-160 was not. It changed.

You still need to get the NBI clearance, CENOMAR, birth certificate, etc.

iammrsregi, Thanks so much for your thoughtful and caring feedback post.  I am studying the links and have gained some very good information from them.  I am very impressed and happy with the support I see here.
 
Leon & Mylen, First of all, I love your constantly moving ant.  I enjoy the sense of humor.  I understand well you points about red flags.  I have been assessing the red flags evidenced by what the CO asked of my fiancee in her interview.  These questions revolved around the following:

  • The large age difference:  The CO asked about when we first met person in 2009, and then about subsequent times together in 2010, 2011, and 2012, pointing out our ages at those meetings.  I think my fiancee answered these inquiries very well, describing how our relationship grew naturally from friends to eventually falling in love.
  • Separation Date from former wife:  The CO then asked what was the date of my separation from my former wife.  My fiancee correctly answered that my former wife and I separated 19 years before our divorce in 2012.  The CO asked the same question again and my fiancee gave the same answer.  Then the CO looked like she didn't like the answers, so my fiance had a nervous reaction and started to look through the papers she brought with her.  [It turns out that my divorce decree inaccurately says my former wife and I signed a separation and support agreement in 2009 (it was actually the property settlement and support agreement - we have no formal separation agreement, but did not cohabitate after Aug. 1993 until our divorce)]. At that point the CO said something about that isn't right and went through a door behind her interview position for 2-3 minutes.  The CO then returned and simply told my fiancee to go to another window (with not other statement or explanation).  At the other window, my fiancee was handed a form with the box checked saying:  Ineligible under the following section of the Immigration and Nationality Act (INA) as amended:  221 (g) It was not established that the beneficiary and the petitioner have a bonafide relationship."  The Filipino man handing her the form asked if she was given any information from the CO, and my fiancee said no.  The man then said I will need to talk with USCIS to find out what happened and how to proceed.
Now, I am trying to figure out what to do next.  I have checked with some immigration attorneys, and a "visa coach."  I don't know where to turn to try to proceed on the best path to gain a visa.  Clearly, the sticking point is coming up with convincing evidence of a valid relationship that passes review by the Manila Embassy.  Some have suggested to go ahead and marry my love, but that would mean a longer visa gaining process, and I don't see enough evidence that this will really help in gaining a visa.  I know we will have to either talk my former wife into changing the divorce decree, or at least come up with the right explanation to USCIS/DOS.  I don't know if there is/are recommended attorneys or other experts to help us get things right for the next round through the Embassy, but I would surely like to gain good advice in this area.  I really don't know who to trust or turn to at this point, but really appreciate the guidance I see and get here.

Looks like you pretty much figured out why they denied you. Good job of sleuthing.

The Manila embassy doesn't generally deny for a large age gap and doens't generally deny if you were legally divorced right before filing for the K-1 (you cannot file if not legally divorced however), but it was the combination of the fact that you met right before separating (according to the decree), divorced right before filing the K-1, the extra large age gap, and the fact that your fiance essentially lied (in their eyes) about what it says on the divorce decree that, in whole, essentially told them they simply do not have the proof that this is geniune. And the proof is on you, not them.

So looking at it from their perspective, it's understandable they wanted to know the details of your meetups while you were still legally married, but separated from, your ex wife and figure out why you begain these meetups right after separating and why you filed right after divorcing, especially with your age gap. Hence the questions about that. But, while a red flag, but still something normal and can be overcome with the evidence she brought. But then she lied about how long you were separated, and it was game over at that point, and why the evidence was not looked at.

Where to go from here: I agree a lawyer is a good idea, but it's hard to find one that has experience with this exact type of scenario, and with the Manila consulate at that. Like I say, they rarely flat out deny on the lack of evidence, unless it is pretty clear to be a sham.

My best bet would be for you to change the divorce decree, then provide an explanation as to why it was changed, AND evidence backing up that you were separated since 1983 (written affidavits under oath, addresses of residence evidence, tax returns, whatever you can muster up). This would address the issue specifically so that they can move on from it next time. Then you will of course need to address the meetups with more evidence they were genuine and not staged. Plus all the additional evidence of a genuine relationship to combat the age issue.

I also think that marriage there and filing a CR1 might not be a bad idea. It is a bit more time, yes, but that will be changing soon. At least it will prove that your intent to marry is genuine. But either way, you still need to address those red flags above directly.

The Manila consulate is generally not known for this type of thing so I'm guessing that the consular officer found some red flags in your case and used the blanket excuse to deny you. Someone else in this thread mentioned that they make a decision before interviewing you.

I would focus on finding and figuring out what those red flags are and specifically addressing them, rather than just bulking up more on the evidence in a general fashion. It doesn't matter how many times you re-apply, it won't solve the problem unless the reasons for the denial are corrected.

Approach everything that you and she wrote in all the applications and evidence from a skeptical consular official's viewpoint to try and find these red flags. And examine all the questions that were asked in the interviews, seeing if you can remember if any were asked repeatedly or if any area was focused on in the questioning more than others.
