Well after my post last Friday for my wife being recommended for approval by her IO on the 27th, she received a phone call Monday from her IO stating the supervisor denied the petition. He was very kind in calling, she appreciated it, however was a big letdown. Denial for 2 reasons. 1 reason- He indicated the supervisor stated after receipt of her conditional Green card, she traveled outside the States within 40 days after receiving her Green card, so in not completing her first 90 days in the States, she did not establish residency. (That she had to be in the States for 90 days before her residency would be established, and it was a CFR). 2nd reason-She did not have enough days for her physical presence and was short by 38 days.

Well my feelings for the first reason after researching-if one receives an employment Green card one should stay with their employer for 90 days or more, something called the 30/60/90 day rule. However she came on a marriage Green card and i could not find a CFR or in the INA 101(33). CFR 8 316.2 does establish requirements for residency which she meets according to it. The second reason--we sent in both her passports with all the stamps arriving in the U.S. and arriving in other visited countries, so assume they not only could see these but also confirm on their computer. Unless my wife missed a trip which i doubt,she was correct.

In any case we are waiting for a denial letter which can take up to 90 or 120 days. After researching appeals, they are costly, time consuming, basically useless, so people recommend to refile an N-400. However after already in to 700 dollars etc etc, she will just live here on her green card. (Now should I open a discussion about the 12 million illegals who are here illegally at probably 90% attaxpayers expense)

but i have a question about the first reason.

they said you can't travel outside the U.S. within the first 90 days when you receive your green card? the second reason i understand, they added all the days outside and did not accumulate the residency.

congrats on the good interviews,

my interview experience in chula vista,ca today.


my appointment was at 12:45pm i arrived at 12:15pm went through security and on to the waiting room where there is two widows making you think you should stand in line, but there is no line you just show up sit down and wait for your name(they assume that everyone will show up i guess) while you are waiting you are suppose to fill out this oath paper with your A#, phone and any change of address. i got called in around 12:40pm to my surprise it was the IO who did my adjustment interview.(really cool guy).

  • asked for DL,Passport, greencard
  • told me he was the guy who did my adjustment (i already knew)
  • raised my hand to swear to tell the truth
  • asked me all the question from the app. about communism etc.
  • told to read a question: when is columbus day?
  • asked me if knew when columbus day was and i said no(it was not part of the test he just asked)
  • told me to write: columbus day is in october.
  • name a branch of government
  • i'm sorry guys thats the only question i remember i was pretty nervous !
  • asked me to sign the application twice
  • asked me to sign my pictures(not to go over my face)
  • sign a paper that had my info on it
  • i asked if he needed my wife's passport or anything from he said he already had everthing he needed.
  • he said to say hi to my wife and that he recommended me for approval and it my take up to 3 months to receive a letter in the mail, if i was not approved or there were any question he would call me.
  • it took about 25 minutes waiting in the lobby and 45 minutes for interview
  • now wait again!

ok guys my schedule fingerprints were on 12/7/10 since i have a new job and i am in probation for six months and its hard to get time off i decided to do a walk in at the chula vista,ca office today as im off this whole week for thanksgiving, when i showed up i asked the security guard if i could speak to the manager and i explained the situation to the guard he said wait outside i'll get her for you after about 20 minutes of waiting he came back out and told to go ahead and fill out the form and gave me a number it was awesome, it took about 45 minutes it is a very busy office and told me they usually dont allow walk ins

Just got an e-mail from my Fiancee! I was out of town for a few days and in my absence my fiancee called the consulate and asked if she could pick up Packet 3! They told her to send them her passport with CMNN????(which she has already done) I never heard of anyone sending in the passport before getting Packet 3 and I have no idea what CMNN means. She is sleeping right now so thought you good people may have some insight to these questions!

Worst case scenario I can fill them out and e-mail them to her! Are there any Vietnamese instructions that come with Packets 3 and 4? I seen that about getting help to fill out the forms I suppose that is if someone in HCM city does it for her. I meant to ask you what mail service did you use to send all the information and forms etc! I posted it before but no one answered!
It will be going to Ba Tri in the Delta and would hate to lose it as they want my original birth certificate! By the way thanks for the info!

Thanks for your quick reply! I have used all the info. on this site but missed that one regarding the Affidavit of Support lol!
As I said if I was going back to Vietnam it would be no problem but there is no way I can make that trip now. (Job is not one where I can leave), I would feel comfortable with someone there to help her with the packets. What I'm worried about is her understanding the forms! Are they all in English or is there instructions in Viet. on how to fill them out?
I can send her filled out forms from here DS230 etc! The packet three and checklist have no idea what it says. She will have to fill out the DS-156 on line, and I don't really know if she can do that. If you think all this can be done without a lawyer from there then I will do it! Hate to have come this far and have some mistake made there screw it up!

There are lots of folks here who haven't done the process with an attorney and many who have sued a lawyer. Think about your case and if it has some unusual circumstances then you may wnat one. We did it ourselves with guidance from the members here on VJ. You should be able to put it all together for her. Why would she need someone else to do it?

I have several questions concerning the Affidavit of Support Form I-134 on item 11 Maybe it should contain more – like how much a month in spending money or a more encompassing statement. What I said was....Room and board for the duration of our marriage! Below is the question concerning #11

11. I intend do not intend.... to make specific contributions to the support of the person(s) named in item 3.
(If you check "intend," indicate the exact nature and duration of the contributions. For example, if you intend to furnish room and board, state for how long and, if money, state the amount in U.S. dollars and state whether it is to be given in a lumpsum, weekly or monthly, and for how long.


Also I'm considering having her retain a lawyer in HCM city Vietnam! Does anyone have recommendations for a good lawyer and how much it costs? I would have my finance do it but she is not computer literate. The forms are not hard but would feel more comfortable having someone there to walk her through it.

I met my finance through my Dads friend who's wife is my finances Aunt! Should I put this in my timeline of relationship??? I heard that this may raise some red flags during the interview....

I was wondering how long does it take for the packet#3 to be sent to my fiancée! She has called the consulate numerous times and she is being told they don’t have any of the paperwork sent from SDNVC. It was sent on 11-17-08 and they should have it by now. She is in Saigon, now would it be better if she went down there with the letter from NVC? It has a bar code on it and they may be able to track it.

That is what I thought it was (National ID card) but Im perplexed as to why they would want her to send her passport. She lives in the Mekong Delta, and I was always told to never let your passport out of your site!! NVC told me today it just went out yesterday! Unbelievable the woman I talked to was nice but when I told her that I had a confirmation that it had been sent to Vietnam 11-25-08! She had no idea why it was sent to me. After looking at all the timelines here for Vietnam it shows me someone screwed up at NVC. Maybe it is for the best, it may be easier to get a Visa after the New Year. lol!

So much has happened since my fiancee got her white slip and the denial of a Visa! We have gone through the normal process of obtaining a lawyer and contacting are congressman. When I have the time I will give a detailed account about the process. As of right now it doesn't look promising!
I was told by my lawyer in Saigon,... on average 4 out of 40 get there denied Visa turned over! In addition, I was told that the guy who did my fiancees interview (Asian American) is notoriously hard on immigration interviews. To get this process taken care of is not cheap but when you only have a few straws left you grasp at them. When this is all over I will post all my findings and paperwork and what to expect! It is in God's hands now...........

A white slip does not mean a total denial, it's usually a 221G. AR or AP, more investigation, evidence, documentation, proof and ect.

The details have already been provided. The beneficiary already provided additional information and was informed the case will be returned to the USCIS with a recommendation to revoke. Based on the reasons stated, there's no point in even appealing. Please do read through the thread first to avoid offering irrelevant responses.

My fiancee just called me and was crying saying the Consulate told her they would be sending all paperwork back to the U.S. I'm so goddamn angry right now and frustrated these S.O.B's are playing God with are lives. She turned in the paperwork I sent her and made her wait for over four Hr's then made her read a paper saying why she was being rejected. Yes there are red flags but innocent things...my father lent me money to buy tickets to Vietnam, and I paid cash! Are time line was short ...only one visit...her English is not good....Now who in the hell would have thought any of these things would have made any difference???? Once you make these mistakes it is all cast into stone, and they already had made up their minds. I will now have to quit my job or be fired to go to Vietnam..I have no choice I need to be with her! I should have lessened to people who said hell just bring her to Canada and over the border!

I will get her here but just need to know what my options are?? I will send a letter to my Congress and play their silly damn game! Do they send the packet back to the U.S right away???? Should go back to Nam. and Marry? Will it do any good to see Mark Ellis now? Lord I'm so frustrated sad and angry.

Thank You for all the help on this site just wish I had seen it early on!

There most likely won't be a second interview, just a decision. How long for the decision? That can vary a great deal.

Have you known your fiance a long time? Been "in a relationship" for a long time? Been to visit more than once? Short courtship, one trip to VN can trigger extra scrutiny in HCMC.
