CanadaPolice Certificate Questions
Hi,

I have another questions in regards to the needed police certificates for the CR-1 visa. For the RCMP we noticed that they only ask for a name based check but mention that a fingerprint check can be requested at the examining officer's request. For those that have gone through this step already, which did you get? The name based check or the fingerprint one just to be on the safe side?

Secondly, I am petitioning for my wife who has PR status in Canada but her citizenship is Chinese. Is she required to get police clearances from China since she was living there up until the age of 20? Or do we simply only need the RCMP ones?

Thanks for your advice!

CanadaStarting to get worried....
Hi,

My wife is freaking out and I'm getting concern as well. She had her interview on the 9th of December and got approved. When she got home there was a letter from the embassy stating that her physical was incomplete and that she needed to call the dr. and get the missing paperwork in before her Visa could continue getting processed. Apparently the Dr. misplaced the papers or lost them (Who knows) anyways, she took the requested papers to the Dr. the next day and was told the embassy would get them the following day. It is going on two week and she still hasn't received the Visa.

We emailed the embassy but haven't received a response, she tried calling but apparently an answering machine came on saying there is no more phone support for IV??? and needs to send an email instead? Is there a number I could call to try to find out what is going on?

We don't even know if they did in fact received the papers since we can't get a hold of anyone. We were planning on moving ending of next month. Do you think she'll get it before then? Just wondering if anyone has had a similar experience and how long it took you or what you did.

Thanks, everyone~

Merry Christmas too~

Waivers (I-601 and I-212) and Administrative Processes (221g)K-1 interview ends in administrative review

Sorry to hear about your situation.

It would be nice to hear a bit more detail into the interview. What questions were asked, that sort of thing.

Oh, I am sorry...I know this is what everyone wants to know...but I will say that she did not ask any of the questions we had prepared for ie. age difference, my last marriage, religious difference.

They asked:

if he smokes hashish repeatedly (he is a reggae singer)
my mother and father's names, careers and if he had talked with them and what was said.
how we met
a lot about his music career, his band, his favorite band, his favorite song
about how I afforded four trips to Morocco in a year and a half
my ex-husband's name and then she proceeded to do background check on my ex and question Didi about all she found

He was there thirty minutes.

Then she said, "We will be in touch."

That is ALL.

Sorry for not including this earlier.

Allison and Didi

Sorry to hear about this can you share some information on what was asked at the interview and maybe because they gave him the passport he will have another interview at casa

I responded to the person before you with more detail about the questions they asked....

Oh, I forgot...

also they asked my address and phone number.

Thanks for your response,
Didi and Allison

Hello,
The same thing happened to me and my husband in 2010. I was there in Morocco when he went for his interview. He got a paper with "OTHER" checked as the reason. Tried contactig the conluate while I was there and was told I had to wait until the case got back to the states. I contacted my congressman and got nothing. When our case got back to the states I got a letter saying our case had been closed because the dates had expired....... This whole process will drive you to the brink of insanity...... We were married last year in Morocco and are now waiting to hear when his interview will be for the CR-1...

I wish I had advice to give...

I can only surrender to God, of course.
But
also
I PRAY that your situation does not become our situation.
We are just on our knees hoping for approval, even if another interview must happen.

Our best wishes to you both.

Allison and Didi.

And as for contacting the consulate....
should I begin now?

I already contacted my congresswoman.

I am eager to hurry this process up.

But I don't want to jeopardize our chances by harassing them.

Waivers (I-601 and I-212) and Administrative Processes (221g)K-1 interview ends in administrative review

Did they hand him any other paper that says 221g?

He was NOT given the 221g. What is the 221g?!?!

We are so lost and confused. He was ONLY given his passport and a receipt of payment.

And told they would be in contact.

period.

Help!

Any information would be so helpful1

Didi and Allison

So don't you think no 221g is a good sign? They still have his case and it wasn't sent back to USCIS.

I am hopeful. NO 221g (whatever that is...I must investigate)
and no word of sending our papers back to USCIS.

She said very little, actually..

Thanks for the help and positivity

Waivers (I-601 and I-212) and Administrative Processes (221g)K-1 interview ends in administrative review
Hello VJ..

Well, we had the interview only to have my man turned away with NO ANSWER!!!! The Moroccan U.S. Consulate in Casablanca spent 30 minutes with him and then handed him his passport and said he would be contacted. That is it. I know the outcome is unpredictable. But the endless wait is torturous. Does anyone have any positive stories to share after this scenario? I have contacted my congresswoman and will also contact the Consulate itself after a week or so. There was no indication of flaws in my fiance's performance. I just do not understand!

Any feedback would be appreciated.

Blessings to all in wait.

Allison and Didi

Waivers (I-601 and I-212) and Administrative Processes (221g)do i need a waiver?
hello all! my wife was denied a laser visa due to some questionable proof of employment papers she filed. the immigration officer was pretty cool but penalized her 6 months. 8 months have passed since then and we find ourselves ready to file the k3 visa papers, hence my question. do we need to file a waiver due to the laser visa denial? I was told since it was a non immigrant visa for which she was penalized it would not affect the k3 filing due to the fact it is an immigrant visa app. please advise.

You shouldn't need a lawyer for any of this. Just like Janice said, make sure you complete the paperwork properly, fill in all the blanks truthfully and you should be ok. A previous denial for a tourist visa is not a reason to deny a K3 or CR1 visa, nor is it reason to need a waiver.

Generally true but it does depend on there reason for the rejection. If they've noted a material misrepresentation, there would be an issue. It's not clear to me what might be noted on her record. With more details, the experts in the waivers forum could assist more effectively.

Just fill in the paperwork properly, as your soon to be wife lied on the last paperwork you did they will take a special interest in your case, make sure all your ducks are in a row, fill out everything to the best of your knowledge and for heavens sake do not lie on the application, have evidence in abundence and you should be ok, I do not think you need a pardon for this one, just be honest that is all they require.

Janice

thats just it she didn't lie, the officer just wouldn't take no for an answer. it doesnt matter anyways she no longer works at the same place. i was told it wasn't too big of a deal because she only got penalized 6 months.
thanks for your input, i definitely am a stickler for the rules as it is, with this red flag, rest assured i will be extra carefull.

K-3 Spouse Visa Process & ProceduresDO I NEED TO FILE A PARDON?
Hello all, Thank you ahead of time for your advice on this matter. I will be filing for a k3 visa in january. my wife is from hermosillo mexico. she had her laser visa taken away for 6months due to some paperwork issues during her last filing. she filed for a new laser visa when her daughter turned 15 years old. supposedly, she filed false employment verification for her job in mexico. the immigration officer promptly rejected her application and penalized her 6 months until reapplication.8 months have passed since then, we will be getting married jan 17th and will be filing for the k3 the 18th, will the rejection for the lazer visa be a problem? if so, do I need to request a pardon or? please help me get over this minor bump in the visa journey.

Hello everyone,

i have a question for all the all seeing all knowing out there. As it turns out my step daughter is contemplating coming to the us getting her visa and green card but returning to live in mexico. Is this even legal? Does one have to prove she is in the country to receive the aos? if so doesn't she have to be enrolled in a us school to prove her residency? jeeze as i'm writing this it seems all too clear. can anyone out there reinforce my take on the situation? am I right or just full of it?

If both the I-129F and the I-130 are approved, just ignore the package 3 for the K3, and take your time responding to the paperwork for the CR1. The I-130 approval is good for one year, so you can stall at least that long.

Thank you kindly for your sincere and clear advice. i wish everything could be perfect between my wife and i, alas, it is not so! when were together, everything is better than perfect. is when she leaves that the prolem begins. idk. i do know i love her though so i will persevere. thanks for your insightfull advice!

I am the beneficiary and I am feeling the same way as your wife right now as my visa is getting nearer LOL. Sometimes it is stressful for me to think about leaving everything i have grown with and live to a new world with my husband. But I think it is part of the challenges of marriage. I always put this in my mind that "the greatest regrets in our lives are the risk we didn't take" Just give her some security that everything will be fine when she gets there...and there are cars, planes, boats, buses and trains to hop on when she wants to see her family back home.

Yep i agree with Reba. To give her some time to spend with her family, wait for her CR-1 interview instead of K3.

Goodluck to both of you. May God give you the courage and guidance to do what is right...and what is good. star_smile.gif

God bless you for your insight during these troublesome times for my family! it is a relief to know there are people out there that have gone through similar things. it is especially helpfull to hear from someone with my wifes perspective. thank you again and hope all is well

As Reba said, your I-130 will expire in a year from approval date. So you still have like 8 months (save time) before continuing the NVC process. To delay the process, you just need to do... nothing hehehe sounds rear but is true. From now on everything is almost on you. The embassy will send your hubby the package 3 with instruction so you just ignore it, also NVC (National Visa Center) will send you a letter asking you to pay the Affidavit of Support bill again just ignore it but remmeber to keep everything in a safe place for the future.

many thanks for your sincere advice.
