Expedite Criteria

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met. The criteria are as follows:

* Severe financial loss to company or individual
* Extreme emergent situation
* Humanitarian situation
* Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States
* Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

* USCIS error
* Compelling interest of USCIS

if u can give proof what i've highlighted in bold then maybe maybe mayybeeee the expedite will be valid. but then again i might be wrong hehe.
i filed for expedite due to financial hardship. i've turn in my supporting evidence but still no news :(

No, USCIS neither approves or denies visas. They approve or deny petitions. Approved petitions allow beneficiaries to apply for visas that are either approved or denied by Consular Officers who work for the Dept. of State.

i recently got married in the Philippines and in order for us to get a marriage license, my husband and i had to submit every single document from baptismal papers when we were a baby to our certificate of no marriage. What city/town did you guys get married at. And how come you and your wife didn't talk about this 'issue' prior to getting married? anyway, even if your wife's first husband has already died or they haven't had communication in years, u still need to file a petition for annulment on the grounds of ...psychological incapacity, presumption of death (u have to prove why and how. war zone? battle field, etc), bigamy, etc..

Good luck with everything Sufrank! Like yourself, i also moved to my spouse's country to be with him. i was there for one year and 7 months. i can say it was totally worth it. it was a personal decision i had to do to make things work for him and I. it got too hard on me being away from him. right after nursing school i decided to move to the Philippines. that was back in april 2008. i've been back here in California for one year one and i'm trying to start over. we like to think these are just obstacles for us to test our marriage/relationship. it's not easy but it has to be done...for the future. i like to think that LOVE IS PATIENT and i know when that day comes when my husband and I are together HERE, it will aaallllll be worth it. :D

Use the expected income from the new job. Be sure you get an employment letter from your employer. Check the VJ wiki for the proper format of the employment letter. You should probably file the 2009 taxes just the get the small amount back that they withheld from your pay during those two weeks in December 2009. Otherwise you have to include a letter explaining why you didn't need to file. You may also want to include a letter of explanation as to why the 2009 income was so low(in the Philippines, etc.).

The poverty guidelines are for INCOME (from any source eligible source) before taxes, so that would be GROSS. The instructions for the I-864 goes into quite a bit of detail about what information they want.

You maybe want to consider looking for a co-sponsor in case the consulate doesn't consider you're projected income from your new job to stable/reliable.

ahhh George you are a life saver! :thumbs: that cleared up the confusion on my part.. if i understood correctly, the I-864A is for a co sponsor living in the same house hold right? say i use my brother, would his income and my income COMBINE to meet the poverty guideline or does his income and his income alone have to be above the poverty guideline.. thanks in advance :blush: :)

I have a complicated situation and i need help understanding and clearing things up.

From April 2008 to November 2009 i was in the Philippines. I came back to the US on Nov 25 2009 and started working 2nd week of December. As noted on the IRS website, Publication 501, Table 1. (http://www.irs.gov/p...blink1000220674) “IF your filing status is SINGLE, and at the end of 2009 you were UNDER 65 YEARS OLD, then file a return if your gross income was AT LEAST $9,350.” Since my gross income for 2009 was under $9,350 I did not have to file a tax return for the year 2009. I understand would have to write a written explanation why i didnt file a tax return for 2009.

Now, I only work on call/per diem with my first job. I now have a 2nd job and i have only been with them for one month. when i submit the AOS package i'll probably have received my 3rd or 4th paycheck. My question is this, WHAT DO I USE FOR MY ANNUAL INCOME? last time i received a paycheck for my on call job was about a month ago. Do i use my full time job as my ANNUAL INCOME? since 2010 is about to end should i base my EXPECTED ANNUAL INCOME for the year 2011 or 2010? the dollar amount under the 125% poverty guideline, is the GROSS or NET PAY? it's very unclear to me so if someone can help explain it i'd greatly appreciate it :)

This probably has been asked before. i tried searching it in VJ but i couldn't find the answers.

Currently we are at the NVC stage. just paid the AOS fee and waiting for the status to say PAID. My question is in regards to the MEDICAL EXAM AT ST. LUKE IN THE PHILIPPINES. are we getting a letter/email/document saying my husband can get his medical done? or can he just walk in? This is what i found online. It stated "When you go to SLMCEC for medical examination, you must bring your passport and one photo (size: 2” x 2”)." it doesn't say any other documents to bring.

CAN ANYONE PLEASE CLEAR THIS UP FOR ME. THANK YOU :thumbs:

i email pi sup sue in NVC about the expedite on their part. no news yet. maybe its the weekend. i've paid for the AOS fee yesterday (friday) it probably will not be "PAID" until early next week.

i asked my executive director at work if she can provide an employment letter for me including the necessary information USCIS requires: salary per hour, hours per week, hiring date, expected annual income. she said she has to check first if there are guidelines or protocols in case she cannot provide me one. they need to cover their behinds just in case sometime goes wrong and her signature will be on it. i should find out monday or tuesday. if she doesn't take her sweeeett ####### time :whistle: :whistle:

Congrats...But there no 100% sure that NVC or the consulant will move as fast also
it depends on the US Embassy case load and its their own discression how fast they
will take to finish it. The petetionier case part can move faster but the person your
bringing maybe go as fast but lets hope it does. My friend had and extreme situtiosn
it still took 137 days and much efforts by the congressman and doctor letters.
And still the US Embassy didnt save but maybe 20 days faster.
The next NVC and Interview the longest and take more time than the first part,
just dont get your hopes up that she there in 2 to 6 weeks.
Be prepared to wait still all paper work take time and they still have to checkout
all your wife info from her country still and that takes time. It dont happen it just
takes days. Police reportsd have to be checked out and here data has to be checked out
all take time. But let hope you can be together by March ..it take time and the US
governmment don't spend money to FEDEX over night your paper work any place. Be sure
iof that. You can call and call but it the people doing the Embassy work that will
do what ever time it is to get your case done. Anyway good Luck to you, just be
prepared to still wait some time before her approval also.
like I said all good things come in time.. you will be with her soon enough.

Congrats again on your early approval, just have LOT OF PATIENTS ALSO....

Anyway, i know i don't have to share the reason for my expedite but my situation fell under financial loss (about 25%) AND emergent situation(75%). if my reason for expedite was due to financial loss and financial loss alone, my case probably would not have been expedited..i believe the emergent situation led our case to the speedy approval. i sense some people feel negative about our case being expedited and approved. but to those who are happy for us, Thank u thank u thank u. I hope everyone gets the greats news they have been waiting for.

no problem. they may either smoothly and quickly process the forms you need to send to the nvc, or process the rest of your application directly at the embassy. depending on what stage you are at with the nvc.

we had to apply to expedite as soon as our case number was applied at the nvc, so when it was approved at the consulate, the rest of the forms ie the aos and iv are processed and paid at the consulate.

hope things arent too bad for you and good luck. if you need any advice drop me a pm, although its plain sailing once youve sent the request off. ensure you had the subject line in the email filled out with the above info too.

ok. send an email to the nvc. i think its nvcinquiry@state.gov

in the subject line put ' atttn pi supervisor sue: expedite request, your case number, beneficiary namw and dob and petitioner name and dob'

in the main body of the email, put your reasons and attach supprting documents if necessary. i did that as pdf files..

its not easy when you have to expedite. i hope it goes smoothly for you.

give them a few days and call. the nvc will request an expedite from your consulate, to be approved.

i have an update. i was FINALLY able to get through the USEM and was able to talk to a HUMAN!!! she said that our case has been received electronically on dec.17. she said they are now waiting for the full paper case to be delivered so they can update our case. she also instructed me to call next tuesday or wednesday to schedule an interview appointment. she saw our case was expedited and she told me that they'll give us the soonest interview date in january. i feel so relieved just knowing the consulate has our case even if its just the electronic file.

depending on when mailed it takes about 3 days to reach the embassy via DHL. Mine was mailed off on DEC 14 and got delivered on DEC 17. Hope this helps give you and IDeal from mailed off to signed for by the embassy mail room i guess.

Our case was expedited through NVC. i was able to pay the AOS fee but soon after it was 'paid' i got an email saying they will be sending the case to the consulate since the expedite was approved. it also said any inquiries i have about the case i'll have to contact the consulate. no interview date given by the NVC :(
