K-1 Fiance(e) Visa Process & ProceduresNVC lost my case

I will, thank you very much for your time.

I have teh same problem... I am just a little ahead of you..

This is what you should do.

1) send an email to CSC-NCSC-FollowUp@uscis.dhs.gov
2) contact the congressman in your area, and ask for help.

Today I received an answer from the NVC research unit, and they told me that my case was actually forwarded to the NRC (National Records Center). They will review my case again, and then send it to the NVC.

Remember to be practive... DO not wait on them... I have sewen cases that have take over six months... so use all your resources.

K-1 Fiance(e) Visa Process & Procedures1 month after receiving NOA2

Dear VJ'ers:

We received our NOA2 on May 14. We patiently waited for 15 days before calling the NVC but they haven't receive our case. I sent an email to NVC inquiring our case and received their response after 5 days. They asked me to attached a copy of our I-797 and I did it right a way. My fiance sent a message to NVC as well but they did not reply to him even after 7days even he included a copy of I-797. After a week, we called again but still, have no record of our case that's why we waited again for another week before calling (our 4th week), very unfortunately the NVC still has no records of it. According to them, the NVC will investigate what's going on.

When we called the USCIS on the same day to ask whether they really send it to NVC, the CSR did not even check our receipt no. to their system and just said that they send it already.

Aside from what we are doing and waiting, what else can we do to get a positive response from both departments.

I really pray that our case was not sent to NRC.

Thank you very much and God bless us all in our journey.

I hope your case did not go to the NRC, but that was the case with my petition... I am currently waiting for the USCIS to get my petition back from the NRC.

Good luck

K-1 Fiance(e) Visa Process & ProceduresWhat do you do if they lose your paperwork after approval?

Keyvmanual, thanks and I will be contacting my congressman. I was hoping that since USCIS confirmed they sent it over a week ago that they might find it since I contacted NVC two weeks ago and they are supposedly looking into it. (F)

Yes, check with your congressman, because I was always told by USCIS that my file had been sent. Good luck

K-1 Fiance(e) Visa Process & ProceduresWhat do you do if they lose your paperwork after approval?

I wasn't sure if this was covered, but I need to vent (or cry) and need some help from veterans of this process if anyone has had this happen to them. I got my NOA2 saying my I-129 F was approved, dated May 11, 2012. So, I am trying to be patient and working on critical work deadlines and trusting the process but finally I cannot take the suspense of waiting any longer so I sent an email to the NVC and they have no record of my file. So, I am hoping that perhaps they just mailed it on to Amsterdam for review so I contact them, and they have not received it either. It has been over a month and now I am concerned that the files may have been lost and I cannot tell you how depressed that makes me other than to say I just feel like curling up in a ball and crying. :crying: :(

Has anyone had this experience? I sent my I-134 and everything to support the I-129 F to my fiance' in anticipation of his receiving packet 3 - so we could proceed as fast a possible. My last visit was at Christmas and New Year and we aren't wealthy so we were waiting to move forward since that made better economical sense and the price of airfare has skyrocketed so a visit didn't seem a good idea if we are going to need the funds for moving expenses.

Now, I don't know what to do other than wait for a response from the NVC who stated they would follow up by contacting USCIS. I hate being stymied though. Waiting is hard enough as it is, without the added emotional burden of this. :cry2:

Hello,

my petition was approved on April 30th, I waited and waited and the NVC never got my file. After sending an email to NVCresearch@state.gov I contacted my congressman and asked for help; two weeks later my congressman informed me that my file was sent to the NRC (National Record Center) instead of the NVC (National Visa Center); later that week I got the same information from the NVC research unit.

After waiting a 57 days, today my file was finally sent to the NVC.

My advise at this point is:

1) Call your congressman.
2) Send an email to the NVC research unit (if you haven't done so)
3) Call USCIS, ask for a tier 2 Customer service agent and ask for a service request, On this request ask them to send your case to NVC. they will respond to you in couple of weeks if they were able to send it, or if they need to locate your file.
4) Call USCIS every week, and request an update on your case... this is a tough one, because most agents will not take a deeper/closer look at your file, so you really need to pressure them.

I hope this helps, and good luck!

K-1 Fiance(e) Visa Process & ProceduresInterview document question
Hi Yall,

Happy 4th of July!

I have a question, the I-134 has to be an original? or can I scan it and send it to my fiancee?

Thank you

Me and my fiance are on the same situation although we don't if our case was sent to NRC. it's been a month since we got our NOA2 but until now, the NVC cannot find our I-29f package.

God bless us all.

If it has been over a month I recommend you call the congressman in your area and ask for help...

I did and I was informed that an inquiry will be sent to NVC and USCIS a day before I received NVC email. It is very hard to be patient when people that file after you are moving along with the process and we are stagnant in one place. We need God intervention in this situation. I will keep you posted with new update as it arise.

I just hope this set back doesn't take more than one month... My fiancee and I had so many plans for the summer, and it seems like she won't be here before summers ends.

K-1 Fiance(e) Visa Process & ProceduresUSCIS did not send my case to NVC, instead...

Oh my... I thought everything will move faster once we receive the NOA2.. I have never heard of that NRC thing.. Does everybody have to go though this review? Or they just pick some unlucky ones? We are still waiting for our NOA2 right now and its upsetting to know that we still have a long wait to go through... Do you guys know why have your case gone this "REVIEW" at the NRC?

Vic2Seyi and I have the same NOA2 approval date, and we were both sent to the NRC... I think somebody made a mistake and sent a bunch of cases to the NRC instead of the NVC...

If you went through the California Service Center and it has been over 30 days, I would advised you to ask your congressman for help as you may be in the same situation as us.

K-1 Fiance(e) Visa Process & ProceduresUSCIS did not send my case to NVC, instead...

This is the copy of the email you referenced that I also received this morning:

Dear Sir/Madam:

Please be advised that the National Visa Center (NVC) contacted U.S.
Citizenship Immigration Service (USCIS) in regards to your approved
petition. USCIS has informed us that your petition is currently located
at the (NATIONAL RECORDS CENTER - NRC). USCIS (CALIFORNIA SERVICE
CENTER - CSC) have requested this file; they will review this file and
inform NVC with location/status of your petition. Please allow ample
time for USCIS to process their review.

If you have an updated address for the petitioner, please provide USCIS
with that information at your earliest convenience so they may update
their records.

Our petitions was approved at the same month and day and was sent to the same place, NRC instead of NVC. I cannot fathom how government agency of that magnitude cannot differentiate between NVC and NRC. I understand that mistake does happen but how many people had have their petition lost due to this dumb mistake. Anyway, I hope they retrieve the case from their inactive case storage and send it to the right place. I wish both of us good luck.

I received the same email... I sopke to someone in Customer service, and he told me that even though our case was approved, the USCIS will have to review it again to ensure everything is ok... he told me that sometimes this make take up to 90 days...

Let's keep in touch and help each other... it seems like we are in the same exact situation.

Have you contacted your congressman?

K-1 Fiance(e) Visa Process & ProceduresUSCIS did not send my case to NVC, instead...
I recevied my NOA2 on April 30th. Since then I have been calling the NVC but they calimed not have recieved my case; I scaned a copy of my NOA2 and sent it to the NVC research unit. I also contacted my congressman's office and asked for assistance.

Today I received an email from the NVC stating that USCIS found my case, and that it was at the NRC (National Records Center). The letter says that they are going to review my case, before sending it to the NVC..

Now, i am kinda relief because at least my case was found, and I know where it is. however, I am scared because I dont know how long this "Review" tipically takes. I mean they approved my case, shouldn't they just send my case to the NVC?

well, the NVC's email says to allow "AMPLE TIME" so this review gets done...

Has anyone heard about this??? is there a time frame I should wait???

Please Help I am truly going insane...

thank you

they won't ask for signature for that service right? how many days is that? the california service center ONLY 50 miles away from where i am...when they send me my rfe it takes few days (3days...i assumed they use regular service..lol) and i want to send my rfe just for 1 day service..lol sorry for acting damn lol thanks

I also live about 50 miles away from the CSC... When I sent my RFE response they got it the next day, and I used regular USPS. All extra I paid for was the confirmation delivery...

If you live so close, this should not be a concern. Good luck!

K-1 Fiance(e) Visa Process & ProceduresRFE circumstances of meeting

Thank you again everyone for even more replies :) :)

The more I read it, I think I may have interpreted question 18 incorrectly. It asks "have you been together in person within the last two years' and then asks 'describe the circumstances under which you met'. I just assumed they meant describe when/how etc you were together in person since it was under one umbrella. Also, the RFE heading does say "Met in person" but I think as they are asking on the petition two separate questions they are doing the same here. I feel the petition is slightly unclear in this aspect because it isn't initially obvious if they were asking "How did you meet initially" or "How did you meet in person within the last two years". In hindsite I guess they are asking both.

Regardless, lesson learned. I sent back the RFE today with a nice paragraph describing how we first met (online) and how we kept in touch and fell in love as well as how I traveled to Lebanon to see him within the last two years. For good measure I included all the pages of my passport (with the new stamps of my other two visits since I submitted the petition), all the pages of his passport (I put sticky-notes in places to point out his entry/exit stamps to Lebanon to prove we were both in his country at the same time), the same 6 pictures I sent originally plus 3 more from our December visit, copies of my boarding passes, and finally the copies of the pre-engagement blood tests. So I feel like I covered all bases no matter which question they are asking and also provided documents that they may have lost which caused the RFE in the first place.

Please please please let them not leave our petition to collect dust on the shelf. Hopefully things will start to move soon. I have so much sympathy for those who have waited much longer than us. Good luck to everyone!

Yes, that should be more than than enough!

Good luck!

K-1 Fiance(e) Visa Process & ProceduresRFE circumstances of meeting

Hello all,

Thank you in advance for your help, please read all of my post before replying...

I need some advice, help, or similar sucessful experiences please. I received an RFE today regarding my K1 fiance visa petition :( All that waiting for this... As a forward I will note that although I know anyone is subject to a mistake, I am an EXTREMELY thorough person. I read every word of the guides here and went through my petition at least 5 times before sending it in. I was shocked to have received this RFE and thought for sure I must have missed something stupid but from what I can tell they are asking for something I have already provided...

Here is verbatim what the RFE says in its entirety:

REQUEST FOR EVIDENCE

REQUIREMENT THAT PETITIONER AND BENEFICIARY HAVE MET IN PERSON: It must be established that the petitioner and beneficiary have met and the circumstances of their meeting.

  • Circumstances of Meeting- Submit information regarding the circumstances under which the petitioner and beneficiary met to establish the relationship.

That's ALL. Here is what I submitted with my petition:

  • Paragraph in question 18 explaining that I was in Lebanon in December to visit my fiance and his family.
  • Every copied page of my passport showing my entry/exit stamps into his country at said times. (It is important to note that these were the ONLY stamps in my passport at the time and my fiance has never been to the US before so our pictures together could have ONLY been taken at this time as opposed to any time earlier)
  • Copies of all of my boarding passes to Lebanon from above mentioned trip.
  • Separate, signed letters from both my fiance and I stating that we were together in person at this time.
  • Copies of blood test results (very common in his country for a couple to get these prior to a formal engagement to eliminate incompatability for children, disease etc) with our full names, date, and address of facility showing we were in the same doctor's office at the same time.
  • Six photos of us together including one with us and his mother and one with me and his mother and sister (names of people, dates, and location written on the back of each).

I called my fiance immediately and discussed with him whether they were asking for proof we were together in person within the last two years OR a statement regarding how we met (because both are kind of mentioned in the RFE but as far as I knew, the later was not a requirement of the petition itself, I've always read they just want to make sure you have been in each other's presence within 2 years prior to filing the petition). Since we couldn't make a definite determiniation I called the USCIS customer service number. The first customer service rep. said he had no idea and transferred me to an officer. 45 minutes on hold later I explained calmly and clearly what I received and what was my question. The officer insisted I was not telling her everything the RFE said because it was too vague and said that usually they list exactly what they are requestion. I replied that I agreed the statement was vague which is why I was calling. She continued to insist I was leaving something out and her final word was to make an info pass appointment so someone could see my RFE to know what was being requested (because again she insisted I was leaving something out). Her last words were "Ma'am, I can not help you".... Thanks a lot..

Okay, sorry it was so long. I just wanted to answer any questions up front. Should I just resubmit everything I submitted already with a kind letter explaining how we met initially, when we were last together, please see the attached etc etc.. I am just unclear whether they are asking for evidence proving we have been together within the last two years or requesting an explanation of how we met for the first time.

As I know everyone else here would agree, I miss my fiance SO MUCH and just want this process over with so we can be together again...

Thank you again everyone.

Hello,

this is my opinion, but based on what the RFE letter says, and what your answer for questions 18 was, I think they want you to better elaborate what the "circustances" of your meeting was.

When I sent my paper work I sent two pages explaining the "circustances" of how we met, and how we began our relationship. To be honest, your answer for question #18 does not really answer the "CIRCUSTANCES" of your meeting.

Keep up the faith! I did get an RFE and believe me there are worst things that can happen! TRUST ME!!!!!

Good luck.

K-1 Fiance(e) Visa Process & ProceduresFiancee made an error may need to delay interview
Hello Ya'll,

My Fiancee made an error, and legalized an old and outdated birth certicate. Her interview is schedule for Aug. 22nd, and the whole process of "legalizing" a Birth certificate may take three weeks or a little more.

My questions is, how soon should I call to reschedule her interview, if she is not able to get her Birth Certificate on time?

Thank you.

K-1 Fiance(e) Visa Process & ProceduresNeed Help form DS-230
Hello guys,

I am a little confused about whether we should put my Fiancee's "A#" on question 25 (VJ DS-230 example form) or question 35 (DS-230 from Department of State), or not...

We already filled out the form and I told her to write "NONE" on the "A#", because I think the question refers to the "A#" from the privious visas she was given. However, I know that on the NOA2 she was given an "A#".

My question is, does question 25 refers to her current A# or does it refers to the A# on our NOA2. Please please help us.

When in doubt, READ THE INSTRUCTIONS !!!! If it doesn't say to affix the photos to the forms....there is your answer. Another good source of information about assembling forms is in the GUIDES section, located at the top of the forum page.

Good luck on your visa journey.

The instructions on the form say to Glue or staple the picture... but I know that somewhere aloing the line I read about not doing that.... I just trying to double check...

Emails?

Send more Skype stuff

Draft a letter describing the evolution of your relationship. Refer to the different evidences as proof of each step of the relationship.

We had the same thing and I sent in more plus the Relationship Evolution letter and were approved the next business day.

Be very specific.
Reference dates and places and to the evidence that depicts that.
Include all the lovey dovey stuff (two people that are intending to marry should be lovey dovey; leave out the X-rated stuff but include all the other stuff.)

My letter was about 3-4 pages long. Be verbose and describe the relationship, show how is came to begin, what you talked about, how your feelings grew, blah blah.

Drafting a personal letter describing our evolution as a couple is brilliant! We really don't email each other often. Most of our communication is done through Skype since I can get it on my phone and we can essentially text message each other throughout the day, and video call too. I can definitely pull more Skype and Facebook conversations, which include lovey dovey stuff ;) I will also include letters from family and friends, but your idea of a Relationship Evolution Letter that ties with the other evidence is just wonderful and exactly what I was looking for. Thanks a million!

I hope the Embassy feels the same way

I'm not sure it would help, but evidence for having met could be relevant here too, the RFE for that has included affidavits from friends and relatives of your relationship, that could be good? both your relatives and his?

I honestly feel like we provided more than enough proof of having physically met, but based on your comment and other, affidavits definitely seem like they will help a ton! Thanks

Not familiar with your consulate for the country so I am taking a stab from my experience in our situation.
Is there a significant age difference or something that might have caused a red flag?
Exactly how many times have you visited your SO?
And how long have you two known each other?

If it just more evidence...find more evidence.

Has your families ever met? Spoken? Maybe one or more of the members can write a letter acknowledging you know each other?
Also you mention the interview went fine...drill your SO and ask specific questions of what was spoken of.

I wish you good luck (F) ...it is not a fun time, I know

Thank you so much for your response. In my opinion, there is not a significant age gap between us. My Fiance is 26 and I am 29. I met my SO in September of 2011 while traveling through Greece, and then stayed in constant communication. I visited him is his home country of Albania in January 2012 then again in April/May 2012. I haven't been back since because we were hoping he would be with me after only a few months apart. The CO did ask him if I take a lot of vacation from work which I thought was interesting.

I will definitely pull more evidence together, and get letters from friends and family. Our families have never met, however they have communicated over Skype and are more than aware and supportive of our relationship. Thanks for your input!

Recommend that you get some affadavits from friends and relatives that have met your fiancee that state proof of your on going relationship and submitt them. That is usually very helpful.

I was thinking the same thing :) I'll pull additional Skype and Facebook conversations that have not been submitted, send additional pictures, and letters from our family and friends. Thank you :)

K-1 Fiance(e) Visa Process & ProceduresInterview Result: 221(g)
Hello VJ Friends,

First and foremost, thank you to all of the VJ members for sharing your valuable insight and depth of knowledge. I have successfully managed to get my Fiance (beneficiary) all the way through his interview simply by reading the guides and stalking the forums for months and months. With that being said, I am unfamiliar with how to post in the country specific portal, so MOD's please move at your discretion.

My Fiance had his K-1 Visa interview a few hours ago at the Tirana, Albania Embassy. Per the Packet 3 instructions, everything (forms, birth cert, police certs, tax transcripts, proof of relationship, pictures, boarding passes, passport stamps, Facebook and Skype chats, Letter of Intent, etc.) was sent and checked by the Embassy before an interview was scheduled. We both felt fairly confident that we would not be issued a 221(g) for missing documents since the Embassy already acknowledged that they were completed and scheduled our interview (this is an Albania specific procedure).

My Fiance said the interview went well and was quick. His English is very good so the interview was conducted in English. The CO mentioned that we had already submitted plenty of proof of an ongoing relationship and asked if he had any additional evidence to share. My Fiance provided a couple of hand-written letters/anniversary cards with a few more pictures. The CO kept the letters and pictures and issued a 221(g) with the following reason stated:

"More evidence of relationship to sponsor, such as photographs, correspondence, or other evidence of relationship over time."

What else should we submit to them that we haven't already provided?? :help:

Here is what the Embassy has received thus far in regards to proof of our ongoing relationship:

- About 25 pictures of us together w/ his family and friends (all dated, with names and locations)
- Facebook messages spanning our entire relationship (I picked about 2 days per month)
- Skype Conversations & Calls (I picked about 2 days per month)
- Letters of Intent to Marry for each of us (signed)
- Original boarding passes showing travel to Greece and Albania several times
- Passport stamps correlating with boarding passes mentioned above
- Engagement ring receipt
- Expedia travel itineraries for the above mentioned trips
- Hand-written cards and Anniversary letters (with envelopes showing when they were sent by Post office)

Any help and/or input is greatly appreciated! Thank you in advance :)

K-1 Fiance(e) Visa Process & Procedurescant skip K-1 with V.W.P. right?
I met a couple where the man is a US citizen and S. Korean citizen and his wife is only a S. Korean citizen.

She came here legally without any kind of visa (thanks to the visa waiver program) and married her husband in the USA.

From everything I read about it, this wont work right? Even if your country is part of the Visa Waiver Program you still need to have an adjustable type of visa (i.e. K-1 or possibly student/work or something of the sort) to become a legal resident.

I really wish the best to the couple but if you can get permanent residency this easily then I just wasted a year of my life doing a K-1.

Can someone please clarify?

Thank you

K-1 Fiance(e) Visa Process & ProceduresApproved expedite request for K-1, now what?

I have just received a letter from the VSC stating that my expedite request due to military deployment has been approved. K-1 Fiance(e) Visa Process & ProceduresCase undergoing "additional processes"(?) at NVC

I phoned the NVC to try to discover the date they might be forwarding the case onto the foreign embassy. The agent on the phone said that my case is undergoing "additional processes" at NVC. I imagine someone here has also been told this before and I'm wondering what type of delay I might expect as a result. Thanks!

My case went also through "additional processing" at the NVC. They even told me that I should give them 3-4 weeks to process my case, but that they couldn't tell me for sure. I freaked out. I started to read the post here in VJ. So, of course, I didn't listen...I called the next day to find out that they already process it and that is was already on its way to the embassy. After reading many posts from VJ, I found out that some case are processed in 2-5 days and others are processed in 3-4 weeks. Although, a few cases last a lot longer than that. I can not tell you the reason why, I simply don't know. I determine that "addtional processing" meant that they are just working on it.

K-1 Fiance(e) Visa Process & ProceduresExpedite no response

So I submitted an expedite request for medical reasons and it has been over a month and no response. Is there a way to expedite the expedite? :bonk:

Is there a way to check on the expedite? I called USCIS and got nothing but scripted answers and was told not to call back. VSC is the one actually processing it but there is no customer service for them?

I mailed the documents requested to:

ATTN: XXXXXX
75 Lower Welden Street
Saint Albans VT 05479-0001

I have a referral ID but the status check on the USCIS website doesn't take it.

Here is my experience and timeline with my expedite:

4 Feb: I called USCIS and submitted my expedite request (due to upcoming military deployment)
4 Feb: Received and email from VSC asking me to fax them supporting documentation for my request.
7 Feb: I faxed all supporting documentation to VSC.

K-1 Fiance(e) Visa Process & ProceduresK1 Submitted

Well, its done. Finally submitted the I129F package today with the all accompanying paperwork. Kind of nervous even though I quadruple checked everything. Started the "Timeline" as well. Also read through the Flow Chart as well as what documents I will need for the next phase. A bit overwhelming at this point but I think we will be OK. I still don't understand why this takes so long. I still don't understand why I know many, many girls who came here on different types of visas and just used the system, where I have a legitimate situation and its going to take half a year. I just hope there are no issues with my submission or anything else going forward.... Have a great day =))

Congratulations. Starting is half the battle. :) We are here to support your journey. I found this site to be very helpful throughout our process so far. I noticed you mention that this will take half a year; well, based on recent timeline, especially from Vermont Service Center, you may want to plan for 8-9 month process for a K-1, but you may get lucky. Good luck!

K-1 Fiance(e) Visa Process & Proceduresgetting married on the US embassy on k1

hello..do you ever heard the possibility to get married at the US embassy on K1 visa? is it possible to do that? anyone knows the procedures and how it works??

thank you

With a K-1 you can not marry until after you activate your visa at the POE upon arrival to the US. If you marry before, your K-1 visa is no longer valid. You would have to start all over again petition and apply for a CR-1 (married visa).

K-1 Fiance(e) Visa Process & ProceduresK1-Fiance Visa Immigration Timeline

As my K1 visa application is over its timeline period and after checking that cases submitted in Oct/Nov are getting approved, called USCIS and got confirmation from CSR that VSC is processing September 11, 2010 cases today. So, Immigration timeline mentioned on VJ are wrong. Just an FYI.
I'm surprised how cases submitted after mine got approval? Isn't there any guidelines or procedures followed? Shouldn't September be finished first before starting with case from Oct/Nov or Dec 2010?

Some cases are expedited if they met certain guidelines. That could explain the majority of the cases that got approved before yours.

K-1 Fiance(e) Visa Process & Proceduresfollow up query on expedite

Hi, last week i posted a thread on expedite criteria, and felt emboldened by the encouragement with most of the replies. He called military helpline last Friday and was given a number for his expedite request, and was told that our case will be reviewed and forwarded to VSC, and should USCIS need papers, he will be contacted. With that glimmer of hope, I logged in to USCIS site to check our case..whether there had been any updates since the last "touch"...sadly, there was none. :crying:
I then clicked "add a case to your portfolio" thinking that since he was given a different number, for a new request to be enclosed with our I-129F application; this was what i got:

"This form was not submitted because of the following error(s).
Please correct these error(s) and re-submit.
___________________________________________________

* The Application Receipt Number must start with three alphabetic characters."

May I ask anyone what we should do next? Shall we call custormer service or sign to infopass? Can we depend on the phone request he made? I really do not want to rely on what military helpline told my fiance, because the i-129F packet he requested months before never even reached his mailbox. We had to download and print the form from USCIS instead. I am not sure whether this is due to a faulty mail personnel or system in their installation or a simple lapse in military helpline for requests. 2 of his mails never arrived :(

i just heard from him today that they were not given any written orders for the training nor would be given any since he isn't an official, and would be busy these coming days in preparation for it. No advice whether there would be any means of communication nor any info on their training duration, but they will definitely not be given any week-end passes. They were told they will be sent to these trainings because the unit he belongs to is CONUS deployable.

My apologies for a lengthy post; I'll be out of the country for a short vacation and would only be back days before fiance departs for the exercises. Not sure whether we'll have time to talk decently for him to follow up our expedite request.

thanks very much for the help :)

In my case, it took 2 weeks to received my expedite approval letter.

K-1 Fiance(e) Visa Process & Proceduresdeployment

so i have a question we sent our l-129f form on january but theres a chance my fiance gets deployed again in may would they aproved it before he leaves or untill he comes back?

I am in the Navy. i just applied for an expedite due to upcomming military deployment last month and got approved. I got my NOA2 2 week later. He has to call the USCIS military hotline and request an expedite. They will ask him a few questions and they will submit the expedite request over the phone. Soon after that, he will receive and email asking him to fax a copy of his orders and a letter from him explaining his situation. If he is in the Navy and assigned to a ship, the Navy does not issue orders; However, USCIS is aware of this and they will accept a letter from his Commanding Officer. After he faxes the orders and the letter, he is going to have to wait for a letter from the service center with either an approval or a disapproval. In my case, it took 2 weeks to hear back from them.Good luck!

K-1 Fiance(e) Visa Process & Proceduresbeneficiary documents required on I-129F

Right now her birth certificate doesn't have her current name, right?

Yes she should send you a name change document and you need to get a certified translation. I'm not perfectly sure of the rule whether sho could translate it herself and sign that she can translate it. You can find a official certified document translator on the internet, I found one for about $35.

My fiancee is also from Thailand and she also changed her name. When she changed her name, they provided her with a Thai name change certificate and they made ink changes to her birth certificate. We provided both to USCIS and we didn't have any issues. So, her birth certificate should reflect her new name, but you should also provide, with your petition, copies her thai name change certificates. However, all thai documents need to be translated and you cannot do the translations yourself. You have pay for an official certified translator to do it.

K-1 Fiance(e) Visa Process & Proceduresbeneficiary documents required on I-129F

Hello again...

My fiance changed her first (given) name (cultural, social reasons) when she was about 15. Does she need to declare this and send appropriate documentation of this on question 7 of the I-129F Petition? Her passport will have her current name on it. Does she need to send a copy of her passport with the I-129F petition? I guess I am confused by the instructions for the I-129F (#6,C). It says:

"If either you or the person you are filing for is using a name other that that shown on the 'relevant documents,' you must give UCSIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order."

I am confused by the 'relevant documents' part. At this point what are the 'relevant documents?' Again, her current passport and Thailand ID card have her current name on them. Do I still need to send legal proof of name change when I send off the I-129F Petition. This will not be a problem, just wondering?

'relevant documents'???????

Thank you!

Eric

Eric,

My fiance (also from Thailand) changed her name. I know it is common in Thailand for people to change their name; sometimes even more than once throughout their lifetime. We provided copies of her name change certificates with our I-129F petition and we didn't have a RFE. If for some reason she doesn't have her certificates, she would have to go to her home of records (her hometown) government building and they can provide her with a new original certificate. That is what my fiance had to do. I hope this helps.
