K-1 Fiance(e) Visa Process & ProceduresName change question
You don't have to change your last name.
I think it makes life easier if both spouses have the same last name--especially if there will be children later. But there are lots of reasons to keep your own name--professional reputation, cultural/family identity, etc.

K-1 Fiance(e) Visa Process & ProceduresEvidence of ongoing relationship- letters, e-mails, etc.
We printed out a list of the e-mails that we sent one another. I also printed out a few messages that didn't have any personal information included.
I don't think they are interested in reading your personal thoughts/feelings as much as they are looking for proof that communication takes place frequently.

K-1 Fiance(e) Visa Process & Proceduresquestion on processing time
You are waiting to hear something from the Embassy in Manila?
Does that mean you have already received NOA2 and a letter from the NVC?
What were the dates on those documents?

If you fill in your timeline, someone might be able to help you.

I wonder if the NVC would send Sam a notice once they have mailed our petition to my consulate?

We received a letter from NVC stating our petition had been mailed.

K-1 Fiance(e) Visa Process & ProceduresAffidavit of support question
Many banks have stopped notarizing documents that do not originate with them.

I got my Affidavit of Support notarized at the Automobile Club (AAA). Normally they charge $7, but it was crowded and I had to wait about 20 minutes, so the woman did it for free.

K-1 Fiance(e) Visa Process & ProceduresWhat does it take to be touched around here!?!!?
We only had one touch--and it was the day before the approval.
Other people reported lots of touches but were approved after we were.

I know the waiting is frustrating, but I personally don't believe calling will make anything happen faster.

K-1 Fiance(e) Visa Process & ProceduresDoes my job need to be PERMANENT in order to apply for the Affidavit?
Do you already have a job lined up in Washington? A letter from your future employer might help.

If you can not show that you have an income (or substantial assets), then you will need a co-sponsor.
Since your job will end after only three months, you should probably find someone to be a co-sponsor--unless you have another source of income.

K-1 Fiance(e) Visa Process & ProceduresMedical Bills Assistance
You might have some trouble when you fill out the Affidavit of Support.
If your income is below the poverty level you will need to get a co-sponsor.

K-1 Fiance(e) Visa Process & ProceduresFiling alone or have service?
This forum can provide all the help you'll need--as long as you have a fairly simple case.

If there are issues (overstays, previous K-1's etc.), then you might need the expertise of an attorney.
Using an attorney does not make the process any faster, only more expensive.

Good luck!

K-1 Fiance(e) Visa Process & ProceduresMinimum age to be approved for visa
If the foriegn fiance is under 18 years old, I think written permission from the parents is required--although I don't know the minimum age.
In my opinion, I think it would be a huge mistake to marry someone under the age of 18. Not because 18 is a magic age in which children suddenly become adults, but because a person that young still has a lot of maturing/growing to do.

K-1 Fiance(e) Visa Process & ProceduresCover Letter & Package Organization Questions
We listed everything on our cover letter.
I used a heading and then bulleted the details below each heading, kind of like an outline. For example, Evidence of Meeting would be a heading, then I bulleted every piece of evidence with a brief description--travel itinerary for XX's first trip to..., ticket stubs for XX's trip, photo of XX and XY in...., etc.
I also wrote the matching description on every piece of evidence so it would be clear to the reviewer what they were looking at.

K-1 Fiance(e) Visa Process & Proceduresquestion about when my fiance' can come into the usa again
I don't think he has to wait a certain amount of time before returning to the U.S., but he should be sure to bring proof of ties to his home country. That way he can show intent to return home.
pnd629FemaleUnited Kingdom2007-04-09 10:16:00
K-1 Fiance(e) Visa Process & Proceduresi need a little help please
You need to write your own letter of intent to marry. There is an example here on VJ.

About the plane ticket--you can't send what you don't have.

K-1 Fiance(e) Visa Process & Proceduresjob hunting

cool, thanks! I don't intend on quitting without anything lined up and I will have co-sponsors if I need them anyway, so this is good. I guess I was just more worried about when my fiance goes for his interview and they ask him what I do for a living, what if I do something else by then and all the consulate has is something outdated? Guess I'm worrying for nothing :)

Your fiance probably will be asked about your employment--mine was questioned in detail about my job. Just be sure your fiance is able to explain that you changed jobs since the application was sent--and knows what you do at your new job.
Also, you will probably need a letter from your employer for the interview. The letter will state your current job title and salary, which will correspond with the information your fiance tells them.

K-1 Fiance(e) Visa Process & Proceduresjob hunting
As long as you are employed and your income is sufficient, I don't see how changing jobs could cause a problem.

K-1 Fiance(e) Visa Process & ProceduresWaiting on interview -- but fiance got great job in UK
If your fiance is not going to live in the U.S., you might as well withdraw/cancel your I-129F. The visa that your fiance would receive would be good for only 6 months and then you would need to marry in the U.S. within 90 days of his arrival. After the marriage, your husband has to apply for AOS and stay in the U.S. until his AOS is approved (unless you file for AP). It sometimes takes years for AOS to be approved.
So, if he has decided not to move to the U.S., it is pointless to continue with the I-129F.

By looking at your timeline, it seems your fiance should have received packet 3 and sent it back by now.
Is your timeline correct?

K-1 Fiance(e) Visa Process & Proceduresresidence on 325??
Your resident address is where you live. So, if you lived in the U.S., you would need to list your U.S. address.
I don't think you need to worry about Swedish residency law, as Sweden is not processing your application.

K-1 Fiance(e) Visa Process & ProceduresOut of the Blue.....

HE is the foreign fiance.

Oops, didn't know that--let me rephrase.

Do you really want to marry this person?
What makes you think things will be different when he moves here? He will be able to ignore you in person instead of by long distance?
Find someone who wants to talk to you everyday.
pnd629FemaleUnited Kingdom2007-04-13 10:43:00
K-1 Fiance(e) Visa Process & ProceduresOut of the Blue.....

You have to admit there's something wrong with continually ignoring your fiancee, especially when there's 5000 miles in between. He even told me on more than one occasion that he would be perfectly happy not seeing me or hearing from me til we got the visa (at that point about 3 months away.) WHAT?!

He yelled at me and cussed.

That is the way someone treats you who WANTS to you stay with them?

Are you really going to move to a new country to be with someone who treats you so poorly?
What makes you think things will be different when you are in the same city?
I say cut your losses and find someone who does want to see you, talk to you, and pay attention to you every single day.

K-1 Fiance(e) Visa Process & ProceduresG325-Four pages???
I agree with the information above. You will most likely receive an RFE for the forms, so it would be wise to have your fiance fill them out( all four pages this time), sign them and send them to you--you will need to do yours again too. Then when the RFE comes, you will have the forms ready to send and not cause any more delays.

K-1 Fiance(e) Visa Process & ProceduresPutting lot of yellow post-its?
I don't think Post-it notes are a good idea. Many of the documents/copies you send are self-explanatory, the rest you can write directly on the copy--no need for a little yellow note.

We had our AOS interview recently and it seemed like every paper we ever sent them was in the big file on the interviewer's desk--it was 3-4 inches thick. Just imagine if all those papers had yellow sticky notes--what a mess!!!

K-1 Fiance(e) Visa Process & Procedures129-F Questions
I was under the impression that you needed a U.S. address for the I-129F. At some point you will need to prove you have sufficient income(or get a sponsor) to support yourself and your intended. If you are not currently living in the U.S., it will be difficult for you to show an income. Perhaps I-129F is not the route you should use?

Re: Grandmother's information, if you don't know you can write "Unknown".

Nothing needs to be "witnessed by a solicitor". Many people here on VJ complete their own paperwork without the assistance of an attorney. The only paper that needs to be notarized comes later at the interview stage.

Good luck!

K-1 Fiance(e) Visa Process & ProceduresInteresting article
These people obviously did not have VJ!

I don't understand why the woman would leave the U.S. to get a visa. A visa allows you to enter the U.S. Shouldn't she have applied for AOS because is married to a USC?

K-1 Fiance(e) Visa Process & ProceduresEvidence Photos
I don't know if it matters, but why wouldn't you just send real photos? You can print them off yourself or go to Target and have them printed for about 20 cents.

We only sent 3 or 4 photos with our petition.

K-1 Fiance(e) Visa Process & ProceduresVisa cost, medical exam

However sometime this year there is suppose to be a big increase on this fee to over $1000.

I've never heard of this before. Do you have a link with further information?

We had our AOS interview recently and the interviewer joked about the fee increases--he said we "got a bargain" because some fees were going to more than double.

K-1 Fiance(e) Visa Process & ProceduresI-129f special processing?
If your fiance is already here in the U.S., why don't you just get married and Adjust Status?
Perhaps there are details I don't know/understand, but isn't the fiance visa used to get the fiance into the country? Your fiance is already here.
If she goes back to Mexico for an interview, there is a chance that she will be denied or even banned because of her very long undocumented stay.

I think you should get the advice of a really good attorney.

K-1 Fiance(e) Visa Process & ProceduresFiance abroad on F1,need to file K1 in usa
Does he already have the visa to come here in March 2008? If so, then there is no point in applying for the K1 as it will probably take that long (or even longer if you wait until fall) for the K1 visa to be issued. Once he is in the U.S., he doesn't really have a need for the K1 visa.

K-1 Fiance(e) Visa Process & ProceduresShould my South Korean fiancee and I cancel our K-1 visa application to use an F-1 student visa instead?

:D Thank you so much for your recent response Dan (and to everyone else too)! I think we should play it safe and file an AOS quickly since we are here now and she didn't have the intent of marrying when she entered the US. We can go to Korea later. How do you suggests that we deal with USCIS Vermont now to change our plan from K-1 to AOS?Does anyone have experience with such a process that can explain? Also, what role does advance parole play in our plan?

You will need to cancel your K-1 petition since you aren't going to use it. Then you need to file for AOS. Different forms and different mailing address.
Your wife (or soon to be wife) should definitely apply for AP so she can enter the U.S. again after visiting her home country.

K-1 Fiance(e) Visa Process & ProceduresEvidence for I-129F petition
Photos are only one example of evidence--you can also send copies of letters, cards, e-mails, and telephone bills. Also, copies of your ticket stubs or reciepts from restaurants, hotels, cash machines, etc. could also be evidence that you visited the U.S.

Did anyone in his family take any pictures of the two of you together? Not even when you announced/celebrated your engagement? Are you or your fiance going to visit one another soon? If so, be sure to take some photos together during that visit.

Just a correction.....I have been with my fiance 4 times since we filed for the visa and about 12 times over the past 2 years. I am pretty sure you have to meet with your fiance TWICE before you file for the K-1 but I could be wrong on that. Hopefully your lawyer knows what he is doing and is telling you the right info. I only say so because I've heard alot of people have had trouble with lawyers in this process. I don't even think the assistant of a lawyer is needed in this case unless you have had trouble with the US before. Good luck and I hope your journey goes well

I see, thank u for your information.
and yes I hope the lawyer knows her job :P

I will ask lawyer cause I want to be sure about steps , i don't want problems. I don't have trouble with US.
A friend got the visa k1 ( they met once before filling it) she adviced me a lawyer

when you say you were with your fiance 4 times while waiting for the visa, it was as tourist or you/he had another visa? Or may be the embassy gave the permission something like that.
If yes, so it was not a fraud visa. I wondered about that.

No....he just visited me here in Canada the entire time and had no problems. I visited the US twice and was denied twice and just decided to be on the safe side and stay here in Canada until the K-1 process was done. There is no visa needed for him to visit me in Canada.

No.....no problems with our case. I think it just took us so long because there was a backlog with our US Service Center.

No I didn't say we will fill visa K1 without meeting a first time.
we will in february. I don't think we need to meet twice in 2 years, once is enough ( my lawyer would have told me that) The most important ,as you said, is the proof we really met.

When i said no meeting, it was after filling K1 visa and while waiting for the visa.
You waited for 10 months to get it, that meant you didn't see you lover for 10 months.
it was long. I just asked if while these 10 months, u were able to meet your lover again.

I think about that, my gf in usa will fill K1 in 2007 for me (i am from france) , i am scared it takes so many months, without meeting.....
