No, when they say documents, they mean oficial documents, birth certificates, name change certificates, divorce decrees, marriage certificates, custody papers, etc...

Hi Everyone! Has anyone had experience about on the type of divorce records that should be submitted with your I129F?

The state my divorce was in(Colorado) uses Vitalcheck, a thirdparty company, to provide verification/certification(with raised seal) of the divorce and submitted originals with my 129F. I was wondering if this suffices or would actually need copies of the divorce decree, much more difficlut to obtain. But since I now I have time....lots of it...was wondering if I should go ahead and get the actual decrees in case I receive an RFE. Would appreciate any insight you may have!

My divorce was in Virginia. I got a copy of my divorce decree from the courthouse in the mail with a stamp certifying that it was a true copy. My divorce decree didn't have a rised seal. I made copies of it and submitted the copies with my package. They didn't ask for my original.

I was checking out the Tokyo Embassy information page on VJ, and noticed this line: Will not give up a job or business, dispose of property or make non-refundable travel arrangements until visa issuance

All I can find on the Tokyo Embassy site in any close match to this statement is: No advance assurance can be given that you will receive a K-1/2 visa. THE RESPONSIBILITY FOR QUALIFYING FOR A FIANCE(E) VISA AND SATISFYING YOUR TRAVEL AND MARRIAGE PLANS RESTS EXCLUSIVELY WITH THE VISA APPLICANT. PLEASE DO NOT PURCHASE A TICKET BEFORE OBTAINING A VISA.

Why is this so? And does anyone have any information in regards to this rule? Insights? My fiancee plans on leaving her job prior to the interview, to spend time with family, friends, make preparations, etc. Obviously it makes sense because there will be no liability for the Embassy were someone to book and miss a flight, or to leave a job and be denied a visa. But, I'm wondering, why is the job specifically mentioned on VJ, but not on the Embassy site?



Well, not everyone gets the visa approved. Some people get denied. So basically, they are saying, that is you quit your job and the visa gets denied, don't make your job lost on the embassy for denying your visa. Also, some people go on AP after the interview and some people get send back to provide additional evidence, the case could be delayed for a long time, and if your fiance is in his or her country with no job, the embassy jsut want to warn you that if could happen.

They only sent me one message (notice of approval) when I was waiting for the I-129f petition. I still checked the uscis website often when we were getting close to our expected approval time since some have said they signed up for email/text alerts and they never got them even when their case was approved. I noticed that the website was first to update to "approval". About five minutes after I saw the "approval" status on the website we got the email and text. It's useful to be able to update your text message information.



I got several messages...notice of approval, notice for biometrics appointment, notice of interview schedule, notice of green card approval, notice of card in production, notice of cards mailed. I found it very helpful. I highly recommend it.

I have a question on the USCIS website ... specifically the section of the CASE STATUS.
Well, let's go! I'm still waiting for NOA2and to see how my process is, I always get the website > http://www.uscis.gov/portal/site/uscis
And then I go in the part CASE STATUS and put my number and "CHECK STATUS". It's what everybody does, right?!

Well .. but my question is on the left side of the site and have a few options like this:

Yes, it is possible to sign up for an account. but when you sign in, it doesn't provide you with much more information than you already have (perhaps the last time your case was touched). But if you sign up for an account, you can also sign up for alerts via email and text if you wish that way everytime your case status changes, you would receive a text and eamil. That is a lot less time consuming than going to the website everyday and inputing you receipt number to check your case. I found the text and emails to be very accurate and helpfull in my case.

We have been asked to submit documentation for expediting out K1 visa because I will be traveling abroad and we would like to be married before. Can anyone tell me what type of documentation the VSC would like to have - are they just requesting a copy of my travel orders. Will that be enough or is there other documentation that they are seeking for the K-1 Expedite Visa process.

Ok, I just went through this this month. Here is what I did...

On 4 Feb, I call the USCIS military helpline and talked to a person. I explained my situation (upcoming military deployment). She told me that if I would wanted to she could submit an expedite request over the phone. I agreed. She asked a few questions (receipt number, etc...).

The same day, I received an email from VSC asking me to fax them a copy of my orders and a letter signed by me with my official rank stating my reasoning for requesting an expedite.

On 7 Feb, I faxed all the documents to the fax number provided by the email.

On 22 Feb, I received a letter in the mail informing me that my request to expedite due to military deployment was approved and that I will hear fromtheir office soon.

On 23 Feb, I received an email from USCIS stating that my petition had been approved and that they are forwarding the case to the NVC (State Department).

It worked great and very fast. What I gathered from the process is that it can't hurt to ask. The worse they can say is no. Good luck!

So, it looks like we will need FI's SSN to apply for a marriage license in MD. From the VJ SSN guide, it looks like we should wait 2 weeks after his arrival to apply, and then will need to wait at least another 2 weeks to get the card. Is that right, or is there anything we can do to get the number faster? He is arriving nov 15 and we had been aiming to get married dec 11 - I'm wondering whether we should rethink that. We want to get married before the holiday rush, and also to get him on my health insurance ASAP (just in case) and AOS so he can get his EAD...
would appreciate hearing others' experiences. Sorry if this is the wrong forum - I couldn't find an ssn forum



In Virginia there is also a place for SSN, but they told us to leave her blank since she doesn't have one yet.

I just want to let anyone who is about to reach 6 months processing at 6 months or over 6 months that you can ask for expedited processing.

Here is how I did this and how it happened for me

When I reached 5 months I called and inquired about my petition they put in a service request for my case to which 15 days later I get a response which explained what I could do when I reached out of the normal processing times

So here is what happens, they post normal processing times on their web site your NOA1 date is your posted date
When you reach the normal posted processing times based on your NOA1 you have to allow USCIS an additional 30 days for processing

If the USCIS has not processed your petition during this time you can call the USCIS and ask for a expedite request
If the Agent you speak to does not let you file the request ( their system may not let the agent put int he request ) so ask for a tier 2 officer
When talking to the tier 2 officer please be nice and answer their questions and tell them that you want to request and expedite based on ONPT ( Outside Normal Processing times ) This is following their procedures and is not jumping ahead of anyone else as you have already met the requirements

Then the same day or following day you should receive an e-mail from the USCIS which is asking for a letter and evidence for the reasons why you are requesting an expedite and that you have 20 days to respond

I wrote a simple letter following their requirements to include certain information and then explained why was I was requesting the expedite and they provided a fax number and I faxed it back as quickly as I could which was the following Monday the 4th

Today I received a letter stating that I met the requirements for special handling ( this was after I was actually approved but confirms that I was processed because of this request )
List of events
3/1/11 called reached 5 months & a service requested was entered
3/16/11 received response back stating about 30 additional days processing to be allowed etc ( where I got the ONPT information )
3/31/11 called USCIS and asked for expedite with a tier 2 officer
4/1/11 received e-mail for letter to respond
4/4/11 faxed back letter and evidence ( letter, 1st service request, expedite request, and noted processing times on USCIS website )
4/8/11 received text & email notice of Petition Approval ( petition approval was 4/6/11 no notice till 4/8/11 )
4/9/11 received letter from USCIS stating that I met the requirements of special handling

Good luck to anyone who is about to reach 6 months processing times

You can start gathering all of your documents, but I wouldn't send anything until you have confirmed that the Bangkok embassy received your case files from NVC. I recommend you wait until you received the packet 3 from the enbassy before you send anything. But it is a good idea to start getting the police report and the medical exam now (as long as you got your note of action 2).

Yes, submit all of that evidence...plus boarding passes, passport stamps, hotel receipts, credit card transactions and yes lots of pictures doing diferent things, you with her, her friends and family. They also want to see the tax info at the interview. My fiance brought copies of the documents I submitted for the pertition. In addition, she also brougth copies and originals they asked for in the package 3. Good luck!

Based on that, i would think that the US embassy will not look at your case favorately. Be ready to explain the reason why he is out of status in the UK. I can tell you that when we petitioned and applied for my wife's (then fiance) K-1 visa, my fiance had overstayed in another country before. The CO asked why, she explained why and the Co was satisfied with her answer and she issue dher visa. I am not saying that is going to happen in your case, I am simple sharing our experience. Yes, if you can get an original or certified copy of her birth certificate you will be better off. Here in the US they won't take a house book for any proof of birth. You should be able to get one through the Amphur's office where she was born without a problem.

On another note, I took Teaw to get her learners permit so she can learn to drive. She took a long time studying the materials which, of course, don't come in Thai and they give test in almost any language but.....what else?? Thai!!! Cause they said they don't have the money to translate it. Bull hockey!!!! That's down right discrimination!!! They guy asks, English, Chinese, Vietnamese.....and I cut him off and said she's Thai but you guys won't spend the money to do it. So she did it in English...25 questions and I thought she'd NEVER finish!!! LOL!! She did take her time but passed so now I will be looking at driving schools to teach her how to drive.

We just got our packet 4 via email. Our interview day is 26 April. Lately, the Bangkok embassy has had a 2-3 week wait from packet 4 arrival to interview day. however, in our case the wait in between is 4 weeks. One thing to keep in mind during April in Thailand is all the holidays. Perhaps, they are closing for Thai holidays too. Take a look at my time line below. From NOA2 to packet 4 was 1 month. From NOA2 to interview appointment is 2 months. That of course will depend on how fast can you return your packet 3 with all her documents to the embassy.

Hey everyone! We are new to VJ, so I'll start with a little bit of background info. I'm from Arkansas, and I met my Canadian fiancee online in November of 2010. We fell in love almost instantly and knew we wanted to be together forever! We hired RapidVisa to help us with the K1 process. Our packet was received at Vermont Service Center on June 10, and we are still waiting for NOA2. The people at RapidVisa told us from the beginning that this entire process takes 4-6 months. That is from the time the servicing center receives the packet until the interview time. Montreal will be his interview location. We have been reading some accounts on VJ that really vary from that timeline we were given. We would love to hear from all the Canadians who have gone, or are still going through the K1 process. Thanks for all of your help:)

Regardless of country, the USCIS potion is taking about 5-6 months. After that you have to deal with NVC and the embassy. They lied.

I filed the petition myself from Virginia, but I hired Siam Legal to help my then fiance fill out and gather the docs for the visa application. We never found ourselfs waiting for them. The results were great and my wife mentioned that they really made her experience much much easier. The only reason why we hired them was because my wife didn't feel confortable doing it by herself and I was not familiar with Thai documents.

I just received a copy of the beneficiaries Visa.

 

The visa has an expiration date of 25 December which would be 6 months from the interview date. That seems right.

 

There is a note at the bottom of the visa stating. "K-1 petition expires on October 26, 2013"

 

So, she could wait to enter until 25 Dec. But, the petition would be expired?

 

How does the petition expiration date play into this process?

Please keep in mind that there is a difference between the petition expiration and the visa expiration. Once you have a visa, the only expiration you need to worry about is the visa expiration.

A friend of mine has his fiance's interview coming up in a week for a K1 visa.  When they filled out DS-156 the fiance did not have any family in the US.  Last month her sister received a K1 visa and just came to the US this past weekend.  Should they update the DS-156 and any other documents that asks if they have family members in the US and bring the updated documents to the interview and give when they are handing in documents?

I think you can wait a few weeks. There are people that receive the P3 while they are visiting their loved one and can't send anything until they are back.
As for a month to a month and a half, I just checked the VJ timelines and it looks like 4/5 weeks wait with some variation. In my case, for instance, there was 5 weeks between me sending back the P3 and my interview date but that was in July / August 2010.
I think if you send your P3 about 25 days before your arrival in France you should get a date while you are there.


We've received packet 3 in the mail and we are about to begin filling out the forms. However, I was wondering how long we have to send in DS-2001/DS-230? I am allowed to attend the interview with my fiancée and I would really like to be there with her when it happens. It would work out perfectly if I could have it fit during a three week period in March because I have a break from school around that time. I know I can't request a specific date, but I figured maybe I can wait a bit until the beginning of February to have everything returned to the consulate. I know they usually issue a date a month to a month and a half after packet 3 is returned. So the ultimate question is, how long before any of these forms expire or my case in general? Any answers, advice, or suggestions are welcome. Thanks!

Even if you are "just PACSed", you can't marry someone else so you are not legally free to marry and that is one of the condition to be eligible on a K1. Also if you dig this forum a little, you'll find stories of people who did a fake fiancée or wedding celebration and were denied because it looked like they were married even though they were not legally married.

My fiance and I decided to wait out the K1 process while living together in France. I've been here for about a month now and though I had some luck getting job interviews, they are not willing to give me a work visa and getting a student visa is too costly for me (i would have to actually pay for class). So we were thinking of getting a PACS (Pacte Civile de Solidarité) so that I can get a long stay visa and work authorization. For those of you who are not familiar with it: PACS in France is not really marriage, its more similar to the Civil Union that we have in the US. My question is, would getting PACSed count towards a marriage and void our K1 visa or is it okay to do?

To apply for a K-1 visa you must be FREE to marry but if you get PACSed you are not free to marry anymore. For that reason, it would have the same effect as getting married.

Hello, everyone. Today I rec'd notice that our Petition for Visa has been approved, and they're mailing me a letter specifying what's next.
So-- what's next? My fiancée Emma is in the Philippines, and I'm assuming the next thing is for her to fly to Manila for the interview. She is quite nervous about this (I think in part because of her English, although I think her English proficiency is around the 70th percentile).
What kinds of things will they ask? How should I help to prep her?
Also, what will they look for during the medical exam? And do those take place at the same time, the same visit?
She is in Mindanao, and so it will be good to do it all in just one trip.

Regarding the medical exam, I think they encourage you to do it a week or 3 days before the actual interview. If she's ok and has no issues on her medical, then she can go ahead with the interview. If she has medical issues, St. Luke's will call the US embassy to reschedule it and have the medical issues resolved first.

For the questions, there's a bunch of examples you can find here. In my experience, I was asked about our pictures, why we're in a group, about my work abroad. She can always ask to repeat the question if she can't understand it the first time. Good luck with your fiance's interview.

Yes, it is a RFE . You will get a notice in the mail asking for additional evidence. When you know what they are asking for, please send it back to them ASAP. Mark on the envelope in red, " RFE " . Send it express so you can get a tracking number to let you know it was received. It would not hurt to also put your receipt number on the envelope. That's what I did, and they got it with no problems. As far as a longer wait time, others have had their NOA-2 shortly after mailing in the second RFE, but every case is different, as you can see, I'am still waiting. Good Luck and keep praying. (F)

Now here's my case. First RFE was sent to us, it's just a questionnaire about international marriage broker, if my fiance's ever convicted in a court et.al..... My fiance sent back the questionnaire (the question form only) last June.....They sent an email to us they got the RFE reply last 21st of July.

Now they updated our case stating this (email):

On September 5, 2006, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 30 days have passed and you have not received the notice. Please contact the service center where you submitted your application during business hours.


M quite confused.....I don't know what this means. I've seen in the previous posts they are requiring some documents. Am I experiencing the same thing? Is there anybody who have the same case like mine?.....Hope I won't be waiting for months again for the approval.

Your fiancee will not need to bring anything of the 129 to the interview. It is just good for the fiancee to know what data is in the package in case there is a question like what is your mothers name. (CO has access to this as the 129 is sent to CO for the interview stage... which is why they might ask a question from the package)

hello guys,

I have a problem, it seems like someone in my office threw away the copy of my I-129F package :angry:... However, I still have an extra copy of some of the documents, but I dont have all of them.

Do you guys think, this could affect my Fiancee in her interview?

Should I just send her a package with the original documents I have, plus some "new" documents?

Any ideas? Thank you!

its been almost a month since i have gotten my approval and nvc still havent received my case :crying:



I know how you feel, I am going through the same situation.

Did you send a scanned copy of your NOA2 to "nvcresearch@state.gov"???

If you did and they could not find your case, I would suggest contacting your congressman as they can help you get answers for your case...

If you havent sent an email to "nvcresearch@state.gov", just do so and hopefully they will find your case.

My fiancé and I primarily commuicate via Skype (alomost daily) and I take a screenshot almost every. It wasn’t until later I thought about making sure to put date on screen when taking theses shot. I don’t have extensive phone records or e-mail logs but I have dozens of these skype shots that clearly show Wila’s face and mine many with dates. Should this be sufficient as proof ongoing relationship along with plane ticket receipts and photos of are trips together and meetings with family? If so how many should I include?

Before my petition was approved I got a RFE and they specificly asked for dated pictures. In my case, my fiancee and I have been together for alsmot three years and have seen each other multiple times, however, none of our pictures were dated, so I sent a copy of both of our passports, some receipts and airline ticket stubs and they approved my petition.

If you get an RFE it says that pictures are consider secondary evidence.

So bottom line is, Pictures are not THAT necessary.

Hello guys!

First of all, thank you for being such a supportive community!

I received my NOA2 on May 30th, after waiting 15 business days I was told by a NVC representative to send a scanned copy of my NOA2 to nvcresearch@state.gov . On May 25th I received a response from the NVC Research Unit stating that my case was not found at all, because The USCIS did not send my petition.

The same day I called the USCIS and was told by a representative that the USCIS had definitely sent my petition, so the NVC should had entered my case on their system by now.

At that point I felt pretty much stuck in between the USCIS and The NVC, so I decided to call my congressman’s office and asked for help. This morning I received an email from the congressman’s secretary stating that my inquiry was sent out.

My questions are:

Has anybody gone through this same process?

Roughly how long did it take?

Does it really help that my congressman is contacting the NVC and USCIS?

Is there anything else I can do to get through this process quicker?

I have teh same problem... I am just a little ahead of you..

This is what you should do.

1) send an email to CSC-NCSC-FollowUp@uscis.dhs.gov
2) contact the congressman in your area, and ask for help.

Today I received an answer from the NVC research unit, and they told me that my case was actually forwarded to the NRC (National Records Center). They will review my case again, and then send it to the NVC.

Remember to be practive... DO not wait on them... I have sewen cases that have take over six months... so use all your resources.
