At the beginning, the only thing you will need to send is the petition package, then you have months (4 for me) to wait for your approval.

I am not sure how it works if you are living outside the US, but I know that when your fiance gets his/her visa, she/he will have to enter the US and marry you there... so, obviously, you would have be back for that. Maybe the easiest thing to do , in your case, is to get married in Russia, and then apply for your spouse's residence when you plan to move back to America?

I am sure people here will be able to tell you more about that, but to answer your question... there is only one thing to send for months, provided you dont get a RFE.....

I have been to America two times since we first started to application.... and never once did I have problems, or did the petition even show up on their system. (well, they never asked about it, so I assume so). I was coming for 90 day visits each time, but told them I was visiting "friends and family" for only 3 weeks... (I also had backup plans to tell them I was changing my ticket, if they asked to see it, with proof of my reasons to change it).

It shouldnt be any problem at all... the best thing is not to mention fiance, wedding, boyfriend, or anything like that, but just to say that she is on holiday to see her family/friends.

I am assuming Japan is a country on the waiver program?

As said many times before by everyone else.... the petitioner is the only one who should send his birth certificate with the I129F. Both sides need to be copied. The foreign fiance will need one for the interview and stages later on in the US. Get several copies, there is plenty of time until the interview.

I am not sure how long you have been in England, but it should not matter to them whether you are working at the moment... they will be needing your last year's tax records to see how much you make, and also a letter from your employer. It seems that you still have a job to return to, so that shouldn't be a problem. As for a co-sponsor, they have to be a US citizen... could be a relative of yours.

You will be using the I134 at this stage, and (I think) the more complicated one later once you are married and your fiance his adjusting his/her status. I presume you will be back at your job then, so that shouldn't be a problem.

Your fiance will be fine! The best way to deal with culture shock is to take it all in a little at a time. Make sure he/she keeps regular contact with family back home, and maybe find some more people in your area who are from Peru. This may make it easier to merge into another culture. You could also find a store that sells food from Peru, so that wont be a sudden shock!

As far as I remember, they only wanted your I94 number if you were in America AT THE TIME of the petition. You haven't been back 3 times since then, have you? If you were not there at the time, then you should have put N/A like someone said above. They dont need to know all the I94 numbers from the past.... you have no way of knowing them, as they take them from you at the airport...

If you loose an I94 and they dont take it from you at the airport, then they have no record of you leaving, and you are classed as an overstay. You might be lucky to have returned after that, but it may catch up with you in the visa process. My sister didn't turn hers in at the airport once, and she had to send proof of departure to an address n the states. This is the information for London:

Yes, I think you would have to apply for a K1 visa. Apparently immigration is skeptical about people getting married on tourist visas, as they suspect that your fiance came here with the intention of finding someone to marry. How long it takes depends on which service center you use, and that depends on where in America you live. It is said to be about 5 to 8 months, provided it all goes smoothly.

I am sure he could visit you on a tourist visa throughout the process, although I dont know too much about that. It is not worth overstaying the visa he is on, as that would create issues with the K1 application.

I was in the US when my fiance petitioned my visa.... nothing came of it, and there is no reason why it should. I have been living with my fiance (joint tenancy) for about 2 years now, as I have been coming and going on tourist waivers and J1 visas.

She should NOT say anything about you, the house, or the I129F when she enters the US. As said above, she should say she is vacationing and staying with friends. As she will be there for a while, I suggest she also has proof of personal funds to last the trip... I have been asked when I am staying for a long time... they want to see that she will not need to find unauthorized work.

She will, however, have to answer a question on the I129F that is related to whether she is there at the time or not. This is fine and should be answered honestly.

As said above, she should not overstay the visa, and should leave when it expires. Without being on the visa waiver program, it would be risky to renter, once the petition is in place. But this should be pretty close to the interview and medical date anyway.

I don't know if this will be of any help, but thought it might be worth a try. This is what the EMBASSY IN LONDON requires from applicants who were born in India and Pakistan... this may be completely different to what the require at the Indian Embassy, but it sounds like a registration is what you have already? You should check the US embassy website for India, I am sure there are details there.

A person born in India or Pakistan must present the registration certificate if the birth was registered. If it was not registered, either in the locality of, if a Cristian, in church, sworn affidavits may be submitted. Such an affidavit must be executed by the mother before an official authorized to take oaths (ie. a magistrate, commissioner of oaths, justice of the peace or the like). If the mother is deceased the father may swear to the affidavit. The affidavit should indicate 1) that the applicant's birth was not registered; 2) the full maiden name of the mothers applicant; 3) the full name of the father of the applicant; 4) the date of the applicant's birth; 5) the place of the applicant's birth. If neither parent is alive, the next closest relative, who is old enough and of such a relationship as to have personal knowledge of the birth at the time and place it occured, may execute the affidavit. A statement form the Embassy of High Commission concerning your birth is not acceptable.

I entered the US twice during the I129F wait, and had no trouble at all when I entered. I dont think my case was even on teh system,a s they seemed to have no idea of it. I have always said that I was visiting friends and family, and never mentioned my fiance. This could just make them suspicious that you are going to marry early. I have heard many VJ members giving this advise, too.

Taking proof of your ties back home will help though. I am not sure how old you are, but if you are young, then you should also take proof of funds for the trip. This has nothing to do with the K1 process, but purely that they suspect you might find unauthorised work while you are there, especially if you are going for a long time. They always ask me how much money I have with me, and I have a bank statement printed just in case.

Personally, I would not recommend having an attorney, unless you think there is an issue with your application that could be difficult for you to handle yourself.... (eg. problems with previous divorce, problems with US visas in the past, deportation/overstay, etc etc etc). If you think your journey will be standard and straightforward, then I think that the advice and experience from members of this forum should get you through just fine... we didnt have an attorney, and did not once wish we had got one... so long as you are organised and have all the paperwork you will need, then that should be enough.

There are so many things you need to do, and so many tales of bad experiences, that can make this process very daunting... apart from taking a very long time, it really is ok... so long as you give them what they want!

I talked to a customer service rep today, and she told me they were having "technical difficulties", and I am sure that is what they are just saying for the sake of an answer. Make sure you show them as much as you can from your trip there... maybe you got a hotel, or have tickets to somewhere with both your names on? Photos of you on this trip are important, and you should send as many as you can, especially any with other people in them.

This website has all the information you need.... and K1 applications are very straight forward. You just have to be very organised and good with paperwork, and have a lot of patience!

People get attorneys for various reasons, usually when they feel their application is not going to be as smooth as average. For instance, if your foreign fiance ever overstayed a visa, has a medical condition that could affect approval, has a criminal record, etc etc etc.

They are very expensive, and tend to make things more complicated for you half the time! It seems you have already experienced that, though! I did it all myself, and it was really easy. And, as you can see, people are always ready to help others on this site.

Hi...my fiance' lives in Cebu City, and I have sent you several card, always with about 3 pics inside. They have all gotten to her, but half the time there would be a tear like your letter had. I always mail them through the post office. I even did my documents that she needs for our visa interview. The doc's were sent priority mail and had to go through customs, just took about 4 more days than when I send a card.

I f I had to do it over again, I would have sent the docs registered through the post office, because their international carrier is FEDEX, but seems to have a little less rate than actually going to FEDEX.

But as far as cards, with some pics in them, again they always arrived at her home address no problems, because, nothing of value inside.

Just to keep interested people posted, I had to e-mail the U.S. embassy in Kathmandu and let them know that my fiance's address and phone numbers have changed, so I prefer that he pick up Packet 3 from the embassy directly once they receive it. My e-mail looked like this, which I sent at a time I knew the embassy would be open:

Dear Sir or Madam:

Namaskar. I am writing regarding my approved I-129F petition for a K-1 visa for my fiancé ____________. I have just received a letter (dated 11/13/2007, NVC Case# __________) from the U.S. State Department's National Visa Center indicating that the petition is being forwarded to the U.S. Embassy in Kathmandu within the next week. I understand that you will be contacting my fiancé once you have received the petition documents, however, his address and phone number have since changed. His new cell phone number is _______________. He is currently at home with his family in Chitwan for the Nepali holidays, but will be returning to Kathmandu sometime next week. If I may, I would like to please ask that you first try to contact him via his new cell phone so that he can pick up the packet directly from the embassy. I am afraid that if the packet is mailed it will be lost or may be delayed.

I hope that his visa can be processed as quickly as possible because my entire family is expecting him to be in the United States by Christmas or December 25th. My family members and close friends are traveling long distances to meet him at Christmas time. I then proceed to call my fiancé to let him know that I sent an e-mail to them and he tells me, "Yah! They just called me and told me your fianceé has e-mailed us and that I should come to the embassy on Monday". Less than one hour later I get this e-mail reply:

My fiance submitted packet 3 in-person yesterday (Monday) and he was told to come back this Wednesday for his interview at 1:30 PM. I almost fainted from sheer joy! The woman at the counter took the hardcover photobook I made of our story (using mypublisher) and even my baby pictures that I sent citing that these were all strong evidence of our relationship. Imagine that! Baby pictures of me!!! I wanted Rajan to see what his future children would look like. laughing.gif Following the advice of a fellow VJer I e-mailed the consulate letting them know that I would be available to call-in to the interview if need be. They wrote back within hours saying that they would call me if needed. On the home stretch ya'll and I'm feelin' finer than frogs hair biggrin.gif

After a 10-day long, grueling wait, Rajan finally got the go-ahead to pick up his visa and purchased his previously booked ticket today. In one week I'll be crying and screaming for joy at the LAX international arrivals terminal. Pinch me... I still can't believe he's almost here!!!

Hi all,

We are new on VJ and we are preparing our K1 file. I'm the non USC in the couple and I have a question about the 'employment' part of the G-325A. I never worked full time because I was a student and I just finished school this year. I had student/summer jobs but I guess, nothing that can be put in my G-325A. What do you think? Should I still put those jobs to show that I have some work experience?

I would use your option 2.

White-out or correction tape are both fine. My wife's signature was accomplished by cutting an affixing a pre-signed mailing label.

Alternatively, you could redo the form on your PC and type "will sign at Consulate" in the signature block. The key is to get the information in to the package. It's purely biographical.



it will trigger the RFE if it is not signed and for the question above it really doesnt matter if it is blank self explanatory that the blank was unemployed time :thumbs:
