US Embassy and Consulate DiscussionWhy is the K1 Referred to as an Immigrant Visa at Some Embassies?
I actually think it makes more sense to call it an immigrant visa... although you are entering the country as a "foreigner" and have to change that status once married, you obviously have no intension of leaving. I guess there are always those that change their minds before the wedding! lol

US Embassy and Consulate DiscussionDOS tells me to wait two more months for interview??
I called and spoke to someone else... all she said was that they opened it on the 10th. I asked when she thought the interview would be scheduled, and she said to wait for packet 4. Which is, of course, what I expected her to say, but she didnt repeat what the first lady said.

US Embassy and Consulate DiscussionDOS tells me to wait two more months for interview??
Hi everyone, please help me here, I am in shock!!

I sent packet 3 to London about 3 weeks ago, and have called the DOS twice since. Today, the lady said that my packet had been opened and "enrolled" yesterday. She said that she "believes they have already scheduled this month's applications for interviews next month, so I will have to wait until they start scheduling in October, for an Interview in November"....!!!

Every UK timeline I have looked at, people have been scheduled interviews within about 5-6 weeks of sending back packet 3. Why has this not happened to them? Do you think she has given me wrong information? Do they really only schedule interviews once a month, and the others have to wait?

I really hope I dont have to wait that long

US Embassy and Consulate DiscussionCan i book medical?
There is a medical questionnaire that you have to wait for... but I think that can be found and printed on the forum, so you can go ahead and book your medical... so long as you already have your case number.

I think it might be somewhere in the UK forum... or if you have an email then I can send you one. Someone on VJ sent me a scan of their's that I have.

Bare in mind that you do not have to have the medical done in order to recieve packet 4... this is what I thought, and so I booked it ASAP and then headed back to the UK from the US. I should have waited until I got packet 4 and then booked it and traveled. They actually send you all the medical details again in packet 4!

US Embassy and Consulate DiscussionGETTING READY FOR THE INTERVIEW
I am sure London is different to Peru, so bare that in mind here, but it sounds to me like you are ok....

From me, they wanted:

- Passport pictures
- I134 plus last year's tax (letter from employer or bank is good extras)
- Police certificate and copy
- Birth certificate and copy
- Passport

And that was it... followed by just a few questions

Although I had EVERYTHING you could imagine with me, they didnt need or ask for it... I even had to ask them at the end if they wanted anything extra, as it seemed too easy!

US Embassy and Consulate DiscussionHas anyone here refused to get vaccinated
Wow, this has been a very entertaining thread! Great reply there, Garfield!

To the OP, would you really let one vaccination prevent you from living with your fiance!? I too, have seen your posts elsewhere, and think you should learn to compromise a little... as someone mentioned earlier, moving to the USA is a privilege, not a right.... cooperate with what is required, and you will get your greencard.

I grew up in India, and would certainly NEVER advice anybody to not get a polio vaccination... I am also originally from a country with a very long life expectancy, because children get all their necessary injections at birth. I have many vaccinations (due to my past), even rabies, and am waiting for my H1N1!

Good luck with the waiver... cause you need it.

US Embassy and Consulate DiscussionLetter from the Embassy

My fiancee just received a letter today which confirmed receipt of the K1 petition on Oct 20. It includes a checklist of docs she needs, notice that the interview will be scheduled 150 days from Oct 20 and that packet 4 will be mailed out a month before the interview date. I wonder if this 150 days is just a standard timeline to cover themselves, where in fact there could be the hope that the interview could occur sooner. I know though that one VJ member predicts that the interview will be sometime in March.

They also stated in the letter we received it's 150 days.....what I observed in August and September NOA2 approvals have the January 2007 interview dates. We're also hoping for a February or March...... We have the same date when we received an approved letter from USCIS. The last we got last Nov. 6 stating that they're going to send the papers in Manila....Twas a loooooooooong wait...... God bless to all of us. :star:

First of all, the petitioner had to send form I-134 (affidavit of support) with his petition. What info did he send with it? I am a retired firefighter on disability pension. I sent a copy of my disabilty report, a copy of what my pension is going to be up to the year 2035, copies of my bank statements showing the monthly fire pension being paid directly into my bank account every month, letter from Social security showing my monthly payment into my bank account, also, a copy of my 1099 from Social Security from 2005, (2006 hasn't been filed yet because I am still over in the Philippines). I didn't need to show my 2006 IRS return, because my fire pension is tax free, so The only income I need to report is the Social security and it isn't enough income to file, but I still file with the IRS every year because you never know when you will need to show it to some one.
If I can be of any further help, please let me know. Also, there is a large age diference between me and my Filipina fiancee, but we never had a problem at the interview about that.

It took me more than a month to compose this heh heh just kidding.

Thanks a bunch to everybody who prayed for the approval of our interview, to all visajourney members and friends who helped us in this journey.....Maraming salamat sa inyong lahat! :)

I had my interview last March 12, 2007....in USE MANILA, PHILIPPINES...

So for those people who's next for the "INTERVIEW", take a glimpse and take note on some of the tips....

1) Please do not bring your cellphones, you are not allowed to enter embassy (effective March 1, 2007).

2) From the gate (gates 1 & 2), just follow the BLUE ARROW stating Immigrant, press the button where there's a wheel chair sign and it will open....

3) You have to submit the DS forms to the ticket booth on your right. Note: PLS. make sure you have completed ALL the forms to avoid delays.... The guy who got my paper's nice so he didn't question me anymore.... NOTE: You have to paste the pictures right away (2 DS-156). If they have no questions on your forms, they will give you the stub #.

4) You wait for your turn TO BE CALLED IN FINGER SCANNING. Be attentive. The NUMBER that they will give you (from the ticket booth) is the number for your interview. Tip: You listen to the instructions, don't take away your left & right index
finger unless you are asked to.

5) After the Finger Scanning, BE ATTENTIVE on the SCREENS with the RED LIGHTS....they DON'T FLASH THE # IN ORDER so anytime they will call you.
(E.G. 7002 -- 25 ) left side is your stub #, right side cubicle #

INTERVIEW WITH THE FILIPINO CONSUL: (She's quite fast)
- Name of your fiance
- How did you know your fiance?
- How long did you stay in abroad?
- What is your fiance's work?
- When was the last time you saw him?

Documents she asked from me:
- AFFIDAVIT OF SUPPORT
- RECENT ITR (2006)
- EMAILS
- GREETING CARDS
- NBI
- BIRTH CERTIFICATE
- POLICE CLEARANCE (RIYADH)
- PICTURES

INTERVIEW WITH THE US CONSUL:
- Name of your fiance?
- How did you establish the relationship?
He told me this: "This is quite complicated. You're in Saudi & he's in the US, how did you establish the relationship?" I answered that he's a high school friend of mine....blah blah
- When was the last time you saw each other?
- On the pictures: He said, "You're always in a group, where's the privacy here?" (I'd like to answer the privacy comes next after the wedding heh heh) but then I answered that it was a HS reunion and we were developed the last week of his stay blah blah....
- Does he have any plans of having a vacation?
- What is his nature of work?
- Do you know that you only have 90 days to know your fiance? I told him that I've known him since we were kids, we've known each other for 15 years....

He said to pay my visa while pulling the pink slip. I was kinda confused that time so I did ask him again.....He said m approved....... I thanked him a lot.....

COMMENTS ON THE INTERVIEW....

- You have to be very honest on the details you stated on your DS forms. In my case, I've been in other place so the Filipino interviewer did ask me about it especially my termination in HK in 2002. Why was I terminated blah blah.... How long did I stay in Saudi? What's my work....

- You have to be organized with your documents (like putting the mails in a plastics so it won't be hard for you to pull it out whenever he/she asks for it. The interview will last for only minutes.

- PRAY A LOT & BE CONFIDENT with your answers. The consul was very nice during that time. I think I did not answer excellently but then PRAYING A LOT did best during my interview. I was not even nervous during the interview. I have IMAGINED MYSELF APPROVED (I've conditioned myself a month before and read more abouT hIS wORDS) so i didn't feel surprised when I heard it. It's really an odd feeling but then it felt soooooooooo amazing.

- The interview took me just minutes but waiting time is overwhelming....We entered the gate at 6:30 a.m. M finished at 9:30 a.m.

TO ALL OF YOU GOD BLESS ON YOUR INTERVIEWS, BE OPTIMISTIC & ADD MORE PRAYERS.......

US Embassy and Consulate DiscussionDisappointed....... but keeping the faith
Hi everyone......... :)

I'm sure you have seen this kind of post many times before but I guess I just need to vent my disappoint. We submitted packet 3 documents by fax on March 7th hoping for a interview sometime in April. We could have submitted starting the 3rd week of January, but I was locked into a teaching contract through the 3rd week of March. The reason we waited was because I want to go to Colombia to be with my fiance for the interview process. We were trying to time it out, and after viewing other timelines for the amount of time between submitting packet 3 and a interview date, I thought it would work out in our favor. Well.... I just checked the newly posted April interview dates on the US embassy website and did not see our case number. Needless to say we are very disappointed. I was poised and ready in my own mind that I would be going to Colombia sometime in April. Especially since my fiance's mother, who is getting married, was waiting to know our interview date so she could schedule her wedding while I was there. The only thing I can think of is that the embassy is busier now and we have to wait longer. Or our documents never arrived by fax, though we have fax confirmation receipts that says the transmission went through. I wrote the emabassy so maybe they will respond.

Ok...... I feel a little better.... Thanks for reading my post, and most of all thanks for all your past advice.

Disaapointed in San Diego........

I agree...when Efrain and I went to Juarez I spent a lot of time waiting around talking to random people...and I was AMAZED at how much I knew...and how little they did. I couldn't believe that people did the whole thing so blind...without researching or without knowing any better... We felt so good just knowing that we had done our homework. Even knowing what forms to bring was a benefit...

One lady I met (who I am SURE was crazy) didn't even know what visa they had applied for, and her husband had been illegal for like years and she kept talking about them driving across the border later that day....he was her ride back to wherever she lived in Texas. And I was trying to break it to her that he would probably not be going with her when he told them that he lived in Texas...illegally...for 6 years! But then Efrain came out of the doctors and saved me....

Good luck you guys...I am sure your guys are going to do great...

Congrats to everyone who is moving along with the process... It seems like it's a long wait, but it's SOOOO worth it once you are finally together....

I am kind of nervous to send out the packet...I have checked and re-checked that I have everything in there.... It's so exciting!

Anyway, just wanted you all to know that we are still out there. I check this forum every couple of days, but we have just been so busy! We are moving into our own place on Saturday, and after that, I think things will calm down...

Good luck everyone!

Thanks for the info Allie. I looked up the doctors on the uscis website and there are tons close by, so I am not worried anymore. B)

Efrain has been going to English classes every day through the local public adult school....LOVES it, and is making improvements to his spoken and written English by leaps and bounds. He tells me that people in his class ask him for help, because he knows more....haha...it's so cute. And I am glad that he has something to do, and that he has the time to improve his English. It's a great program, that you should all look up in your area to see if it's available.

We rented an apartment and will be moving in April 28. We are so excited. We will be legally married by that time, so that's exciting....and this weekend we are going to nail down a date for the wedding/party that we are going to plan here in the US. I have never been really into planning a wedding....more into planning the party!...so we'll see. ;) The best part is that he's already here.... and I almost feel already married since we all make such a commitment just to go through this process...Don't you think?

Anyway, I am at work and should get back to it. It's hard to concentrate on Fridays! Have a great weekend!!!!!

Hi guys....now that Efrain and I area settling in, I am starting to think about the whole AOS and EAD process....the paperwork seems endless sometimes, doesn't it?

ANyway, can anyone who has any insight shed some light on the vaccinations for AOS? Efrain doesn't have any records of vaccinations, so he'll have to get all. Do you use the I-693a supplemental form? ANd do you have to go to a civil surgeon for the shots too? Did anyone do this recently who can tell me about how much they cost? Or point me in the right direction. I read the guides and didn't find my answers....

Thanks guys!

US Embassy and Consulate DiscussionNOA2 approved, interview and docs question?
So for my fiance's K1 interview we need to have documentation for her daughters eligibility for a K2? What exactly do we need? From what I understand we need a document that says she has full custody of her daughter from her ex-husband, and his parental rights are terminated. Is this correct? She has to release him from child support payments (which he doesn't bother to pay anyway). I am not sure exactly what I need to bring. When I look on the Moscow consulate website about K2 visa for her child, and info on the net, it seems fairly nebulous. I can't seem to figure it out. Will my fiance not get approved for her K1 if the documentation for her daughters K2 isn't finished? I am confused.

US Embassy and Consulate DiscussionNOA2 approved, interview and docs question?
I have a question about the interview thing.

Marina and I got our NOA2 about a week ago. My sweetie has a young daughter, whom I listed on the petition. I provided birth certificate copies and information about her daughter. The father of the daughter, my sweetie's ex-husband has been out of the picture for a number of years now since their divorce. He hasn't paid any of the child support he was supposed to. He has been completely absent from her daughters life. Marina and I are under the impression that when the interview comes, we are required to have a document from the ex-husband that allows her daughter to leave the country. The problem is, he's an unreliable drunk and is unlikely to get off his #### and do the document. He has stated he'd do it before, but then went back on it and ended up disappearing for a few months only to turn up 1000km away and drunk. What can we do? Do we even need this document? Please assist.

Thanks,

-Rich

My fiance and I just received word from london after our application was sent on from the NVC to london, and of course, his letter from London got lost in the mail, so the people on the phone gave him a list of forms he had to fill out. One thing the woman said he'd need for the interview was the Affadavit of support, and she mentioned the I864, but everything I read says that it should be the I130??? Does anyone know which one to fill out and send with him? or should I do both? Any advice would be GREAT !

US Embassy and Consulate DiscussionBangkok Interview
One thing that stood out the most and what I felt was unfair was. As per I-134 affadavit of support, they do not need 3 years tax returns because I provided letter from my job and bank statements. Only need 3 years tax returns if you are self employed. But, they told my fiance to return on Monday (Additional Evidence Day) with 3 years of my tax returns. So my advice would be to make sure your fiance have tax returns. As far as interview goes they only ask basic questions:

1. How did you meet?

2. When did I come?

3. How long I stayed?

4. Where did I go when I came?

5. Where did I stay when I came?

Interview lasted 3 minutes...

After submitting your wife's AOS application, you will receive what is called NOA (Notice of Action). With that her status changes from F1 to pending immigrant. As a pending immigrant she doesn't have to be enrolled in school anymore.
Take a look at my signature to get an idea of the AOS timeframe. Good luck!
SilkeFemaleGermany2007-07-07 14:38:00

As far as I know, F1s are not subject to the 2-year home residency requirement (personally I don't know any F1 student that faces the 2-year HRR); this rule only applies to certain J1 visa holders (please correct me if I'm wrong).
SilkeFemaleGermany2007-07-07 14:01:00
K-3 Spouse Visa Process & ProceduresWife on Student VIsa

Another thing someone else may be able to correct me on - if her student visa comes with the condition that she return home for a two year period before coming back to the US, that may affect her ability to file for adjustment of status.

That's a good point. Does your wife have a F1 or J1 visa? And if she is here on a J1 is she subject to the 2-year home residency requirement?
SilkeFemaleGermany2007-07-07 13:37:00
K-3 Spouse Visa Process & ProceduresWife on Student VIsa
Your wife is already in the US, so no, you don't have to apply for a K1 or K3 first (also, K1s are for fiancees/fiances of US citizens not for spouses). You can apply for AOS right away and she can stay here with you while waiting for her greencard...when saying that you can apply for her AOS, I assume that you weren't married at the time she entered the country and your decision to get married was spontaneous in nature...

I entered the country on a F1 student visa myself, met my husband while I was attending college, and now I'm adjusting status...if this sounds like your situation, you can skip the K3 step and apply for AOS.
SilkeFemaleGermany2007-07-07 12:53:00
K-3 Spouse Visa Process & ProceduresWife on Student VIsa
When did you get married? If you weren't married when your wife entered the country and you got married spontaneously, then you can apply for your wife's AOS (adjustment of status). Your wife could then stay in the US while waiting for her AOS approval.
Take a look here to learn what the AOS process involves: http://www.visajourn...page=i130guide2
In short you would have to submit packages I-130 & I-485. If your wife wants to work or travel prior to receiving her greencard, you will also have to file forms I-765 & I-131.
Note that your wife will have to undergo an immigration medical performed by a civil surgeon. Shop around for a civil surgeon in your area as prices vary greatly.

Maybe you should post this question in the AOS forum...and please fill in your timeline!

Good luck!

If you enter the US on a student visa (F1) with the intention to immigrate, that's visa fraud...

As you can see from my signature, I'm adjusting from F1 but when I entered the country I did not have the intention to immigrate...I met my now husband while I was in collge, we fell in love and decided to get married...

If I were you, I would look into other visa options such as the K1 or K3.

Your I130 has to be @ approved status before a AOS can be filed.

Not necessarily true... You can file an I-130 and I-485 concurrently it depends on what your facts and circumstances are....
