The case number will be written on the 1st NOA you'll get from USCIS. I never heard of it being on the check.

For my information : how can you look at the check you sent after it was cashed ? Do you work at the bank where USCIS cashes their checks ? I'm confused about that but maybe I didn't get it right.

Well then you count yourself has a dependent of your sister among all the other dependents.

Even if you didn't fill a tax return you MUST fill an affidavit of support (when the time comes) on Your name as YOU will be the primary sponsor in the eyes of USCIS.

Here is a link on the poverty guidelines (please use caution because those are the 2009 guideline and they could change any time)

so according to that and taking 125% of the number it looks like $46,000 is enough for 7 people. So if you add yourself and all your dependents your fiancé and all his dependents and your sister and all her dependents and it's less than 7 person you're fine. If it's more than 7 people then you'll have to see if the assets of your sister can help.

Also I wanted to add your fiancé CAN NOT go to the interview with only your sister AOS. He'll need one filled by you as well, even if you put $0 on every line of the form you are and will remain the primary sponsor.

Not a problem in France. In this case "they" refers to Consular officers in Manila where the OP will be interviewing.


Just for my information, do you know why "they" sometimes don't consider a cosponsor in Manila. This seems pretty unfair.

They consider everything except sometimes don't consider a cosponsor. However, current income is the most important, so make sure your current income is well documented with pay stubs, etc.

what do you mean exactly by "sometimes don't consider a cosponsor". We were planning to get a cosponsor for my case because my fiancée is currently at the university and will be next year too and isn't working right now.

Hi,

50k to 60k a year is well above the 125% of the poverty guidelines that they require.

From what i read before (I hope someone will correct me if I'm wrong) they just consider your current income and if it's likely to last after the fiancé(e) arrives. So based on that I'd say your OK.

In addition, if you haven't send your I-129F package yet, you don't need to shown your income yet. That part is only needed when the fiancé(e) goes to the interview. It's good to start thinking about it now though.

I just received the NOA2 approval notice from USCIS (YYAAAYYYY :dance:) and I saw in the "beneficiary" box there is a number like "A 123 456 789" (those aren't the actual numbers, it's just an example).

I'm wondering if that's the number that I'll need to give in the future if they ask for an Alien number or A#.

My I-129F petition has been touched three times in the past four days but it still hasn't been approved. Did anyone else have this problem and then it ended up with getting an NOA2 shortly after? I am so worried about it and I am getting literally sick from thinking we might get an RFE. :(

Any ideas?


We got "touched"on June 15th and 16th but no approval on the online USCIS website. Thought it came in the mail about 4 days later so there is always hope.

Hi all,

We received an email update from USCIS stating our I-129F had been approved...YAY! However it said that it was sent out on June 18th. My fiance still hasn't received the hard copy, so we were just wondering if anyone waited this long for their hard copy?? I mean I know post can take it's sweet time but California to Idaho isn't a million miles away.

The email says that we/he needs to follow the instructions, well, apart from what we know happens next ie: packet 3, gathering documents, police report, medical etc etc, we were also wondering if these "instructions" were anything other than that?

I'm sure we are being very impatient but still, any info would be most welcome.

Well the 18th was a friday so if they didn't actually sent it on friday but just said they had on the online site, it could be it really was sent on monday. I would wait a few more days, It should be there soon.

My fiancee and I sent our i-129f packet to NVC on 3/31/10 and received NOA1 on 4/6/10, dated 4/2/10. Since then, there has been no movement or "touches" on our case. I called and was told it was within the USCIS timeline and that we should wait onger. My fiancee is very impatient and told me to call and get a number from the USCIS customer service agent? What number could they give me and what difference would a number make? I have no idea what she is talking about. I have my EAC number off the NOA1 notice and use it to check updates on the USCIS website. The website still says 'initial review' and is dated 4/2/10.

Anyway, I have checked the Visa Journey forum and have seen people on here who have sent in their i-129f packet to NVC after us and have received NOA2 in as little as 43 days! One case i saw sent in forms on 4/2/10 (around the same time as us) and received their NOA2 on 6/22/10.

If there is a problem or an RFE, wouldn't we have heard something about it by now? Today is 90 days since we sent in our forms. Two weeks ago, the Visa journey timeline said that applications with an NOA1 date of 4/2/10 were being processed. Today, it says 4/26/10. Is this accurate or an estimation? How can I accurately find out what dates are being processed? Our forms were accurate and we checked them about 10 times. I have no red flags as far as criminal record, etc and either does she. Just wondering what could be taking so long while others are zipping right along. All the poeple who i checked got their NOA2 quickly were from NVC and fiancee from China province, like my fiancee. When i called, the lady was very vague, reading off a script and really didnt give me much information. If anyone has had a similiar experience please let me know.

The official timeline for USCIS to process I-129F petitions is 6 month. So despite the fact that a lot of petitions are approved faster there is nothing you can do until those 6 month are expired. Calling them every day won't change a thing.
It is unfortunate but some people have to wait longer than others, so just be patient and it will come one day.

you need to call one of the 3 doctors on a list in P4.

As for the change of the date of the interview, it is possible especially if it is for a trip to see your fiancée.

Hi Everyone, I have noticed when I am looking at the I-129f form in Adobe reader there is a bar code at the bottom of every page of the form, but when I print it out the bar code is gone. Is this a specific issue with my software or does the bar code just go away? would you mail it without a bar code if it should be there?

Hi, there is only a bar-code at the bottom of the 1st page on the form my fiancée sent. It is on the printed page but is not readable by a scanner because of the quality of the printing. We didn't have a problem with this. I didn't even really paid attention to this matter until now so I would have sent it with or without bar-code.

That said, maybe someone here knows more specifically what this bar-code is for and if it is really important that it is printed.

NO. Only fill the forms with official names that appear on passport, birth certificate and any other official document. You can add a sheet on the I-129F package explaining you used an alias for the mails. It's what we did and we didn't have any problem.
I have an alias because my name is hard to pronounce for lot of people.

I am a little confused regarding the completion of the DS-156.. In the Appointment package it says 2 copies for each family member including children..

We intend to have the child follow within 1 year of her mom.. Do I need to simply submit additional copies of the same form I completed for my fiancee or fill out a completely new DS-156 for her child? Her child is 8 years old..

Also, I hope you guys don't think this is extemely stupid, but does the child need a passport?
will there be a seperate visa in the childs passport?

Since we are submiting the DS-156K indicating the child will follow....,

Does she need to have her DS156 submitted at the same time as her mom?
Does the Visa Fee need to be paid at the same time or at a later time? when?


Just need a little clarification on how this actually works for her child..

The mom should fill 1 DS-156 and pay the associated fee and then print it 2 times
For the chld, it will say on the packet 4 the names of applicants that need to fill the form but my guess is he need to fill a form too.

How is the child supposed to travel at a different time from the mom without his/her own passport ? so my guess is he/she need one and ASAP because they ask for the passport # on form DS-156

Well i would try to be as precise as possible. If she doesn't remember the exact time, she can put only the year or the season (exemple : from fall 2005 to summer 2007)

I don't know if they check it but I guess questions are possible if it looks strange to them

I also put my fiancé as contact. For the lenghts of stays I put things like 15 days, 3 weeks, 2 months ... sometimes rounded it a little because i didn't remember all of it exactly (for instance for 19 days i put 3 weeks)

Hi everyone, having problems downloading the poverty guideline form from the USCIS website and wondered if anyone else is having a similar problem?
When I try to download it a tab comes up which says "a later version of PDF reader is required, visit adobe...etc"
I definitely have the latest version so I'm confused!

Am unsure of current 2010 125% levels as my fiance doesn't have a particularly well-paid job at the mo...He's a chef, enough said really!!

Be careful though as those are only 100%, you need to multiply the number by 1.25 to get 125%.

Hi there,

I am a New Zealander looking to marry my fiancee in the United States,
We have been working to prepare the K1 application and I will post my g325-a, letter of intent, photos and various other documents to her in the next few days.

Looking ahead several months to my interview at the American Embassy in Auckland, New Zealand I am worried that the affidavit of support will be a problem:

-My American fiancee works in an industry where the majority of her income is tips, meaning it will not show up on a tax return.
-She is planning on taking two months off in Jan-December to visit me (while the application is presumably still being processed) and had planned to leave her job for this visit.

The I-134 Affidavit requires:
-a bank statement showing deposits for the previous year (which would be suspiciously low due to the fact that cash tips are not usually banked)
-a statement from (her) employer outlining date employment commenced and salary paid. Although future income could be recorded, previous income would now be impossible to calculate..

My question is this:

Will the nature of her income cause us problems?
(What if she took steps to declare her tips as income and paid tax on them?)
and, Will the I-134 cause us problems if she has left her job to come and live with me? What if it is just a holiday and she intended to return?

Also, if it is approved and we are married then we must file an I-864 Affidavit of support which requires her federal income tax return, including w2s (whatever they are). If she started paying tax now and could demonstrate her ability to make more than the %125 poverty level (around $18,000 per year) would it matter that she has not made more than $18,000 in the previous 12 month period? Or should we just report the (low) taxable income and try to find a co-sponsor?

I would appreciate any help, this process can be very intimidating and we would be crushed if the visa application would be denied. Everybody must have had difficulty with some area of the application and for us it unfortunately is the accounting side of things!!!

In case of doubt a co-sponsor is advised. I'm not familiar with embassy in NZ to know if they accept co-sponsor or not. If your fiance is not working at the time you submit the form or if working but with income too low or barely sufficient, I would recommend a co-sponsor. And you are right to start thinking about that now as finding a co-sponsor might be harder than it looks and collecting all the paper needed takes some time.

Yes, the P3 was a letter for me too with 4 or 5 pages in it and on 1 of them there was info about what to fill. Maybe someone with recent experience in Manila will confirm but it should be the DS-156 as it seems everyone is using this form.

Hi guys. I'm a little confuse what forms to use for the US Embassy Interview. The travel.state.gov FAQ website states that:

"When I apply for a nonimmigrant visa using the online DS-160, are additional forms required?
No, with two exceptions. When applying at a U.S. Embassy or Consulate that is using the new DS-160, Online Nonimmigrant Visa Application, you will use only one (1) form. For Embassies and Consulates that have converted to this new process, the DS-160 has replaced all of the following forms: DS-156, DS-157, DS-158, and DS-3032, which are no longer necessary.
NOTE: The exceptions are Fiancé(e) Visas (K-1/2) which still require use of the forms DS-156 and DS-156K, and the Treaty Trader/Treaty Investor visa "

I called the Visa Information number of the US Embassy, Manila and the person who answered said that the forms that are needed for K1/2 visa are DS 157, DS 156 and DS 156K and NOT the DS160. She also said that these forms (DS157 and DS156) are also the forms needed to be filled up for K3/4 visa. She even gave me the link where i could check the requirements for interview for K1/2 and K3/4. I checked the link and it is new edition (july 2010) cause it reflects the new visa fee which is $350.

Does this mean that for K1/2 visa the forms needed are DS 160, DS 156 and DS 156K? As stated in the travel.state.gov FAQ website
or use the old forms DS157, DS156 and DS156K? As told by the US Embassy visa information representative?

Adding to my confusion is that a friend said that she went to the US Embassy for her K3 visa interview and she used just the DS160 and no other additional form. This is conflicting with the link for K3/4 interview preparation in the US Embassy website and with what the US Embassy information representative said to me.

I don't know what forms to fill out for K1/2. Is it DS160 only, or DS160 with DS156 and DS156k, or DS157 DS156 and DS156K?

Help.



As you didn't set a timeline I don't know where you are exactly in the process. But to share my experience, I had the same question and I just waited the P3 of the embassy where they stated that I should fill a DS-156 and NOT the DS-160. So I would suggest you wait your P3 or P4 and read what they want.

So on the I-129F what would I put for question #20, "Your fiance will apply for a visa abroad at the American embassy or consulate at:" Should I put Port Louis or Kenya? I am assuming she can still get all her paperwork through the embassy in Port Louis, even if she has the interview in Kenya. Maybe?


I don't know where she has to apply for the visa. It might be all in Kenya since Mauritius say they DON"T PROCESS immigrant visa.

If I were you, I would contact both US embassy in Mauritius and Kenya to have this point cleared out. It might delay your process if you put on the form Mauritius and it really has to go to Kenya or the contrary. Your paper could take time to travel from one embassy to another and even get lost in the process.

ok, so after looking on the US embassy website in Mauritius (http://mauritius.use....gov/visas.html) I found this :

So now, technically the K1 visa IS a non-immigrant visa BUT is processed as an immigrant visa by the consulates around the world.

It seems they would process K1's in Nairobi but I would call or e-mail them to be sure. The weird part is that it looks like they are able to process the K1 visas for French citizens who live in La Réunion island but not for Mauritius or Seychelles citizens.

Hi, I have no direct experience but on the website of the US embassy in France it says that for those living in the Réunion island (which is close to Mauritius) they should go to the Mauritius embassy :

"Overseas French Territories

Residents in La Reunion must submit their applications at the U.S. Embassy in Port Louis, Mauritius. Instructions for making an application in Mauritius are available at http://mauritius.use...w_to_apply.html. Applicants physically present in France may file their applications with the Consular Section in Paris. "


That is true for Non-immigant AND mmigrant visas.

So I don't see why people from outside Mauritius could go there and not the Mauritius citizens.

Now, if your fiancée is not currently living in Mauritius but another country, she may have her interview in the country where she is currently living.

Here is our plan. I(USC) want to go to jamaica and stay with my Fiance until his visa is approved and we come back to US together. It should be approved November or December. I'm leaving the second week of September to go to Jamaica. So I should be staying with him for 3 or 4 months. I would like to buy a round trip ticket and just change the date on the ticket once I get through airport because i don't know exactly when I will be returning. How hard is it to change the date on a return flight? Option B would be to just buy a one way ticket. What proof do I need to show that I will be returning to the US? I know I can not stay for longer than 5 months, but I don't know when exactly he will get approved and we will be headed to US. I hope this is not to confusing and this is just based on our plan. I know there may be possible delays or denial for his K-1 visa. If that happens i will just go back to US without him and try to sort things out in another way. Thanks for your help.


Hi,

buying a "flexible" ticket is usually doable. Those tickets allow you to change the dates with no additional charge. Though they are more expensive than the regular tickets (sometimes twice the price).
I don't know how it goes exactly for the one way tickets from US to Jamaica but it is usually a lot more expensive (and you'd had to buy 2 times a one way!!) and it may give you a hard time (or even be impossible) at security point since it can be hard to prove your intent to return. That said I don't know how hard they look into that for people going OUT of the US.

It seems to me buying a "flexible" ticket is the cheapest for low risk solution. It is what I did 1st time I came to the US because I booked it so much in advance, I couldn't get the return date yet.

BUT NOW, on the NEW BC my fiances year of birth says 1985,and the orig. said 1986,,..so they missed-wrote it!

now my mother in law has to go and get that fixed again with the NSO...

On my fiances birth certificate, his name was spelled ROBBIE...but he actually uses ROBBY. His school records and i.d's were all spelled with ROBBY not ROBBIE. on the I-129F, i used ROBBY...the thing is, his mom already spoke with a lawyer/attorney and had the ROBBIE changed to ROBBY...im not exactly sure what the NSO plays in this...cuz i know he has to get a B/C from NSO to be submitted when he gets interviewed.

AND!!! on his Birth certificate, it says his year of birth was 1985! but his real birth year was 1986..and again when i filled the petition i put 1986..his mom tells me they'll have to fix this with the lawyer/attorney again...

I was informed about this AFTER i filled the petition!...even after getting a lawyer and fixing the problem on his birth certificate, im still so worried..i know he would have to submit a birth certificate and a NBI clearance when he goes to the interview...

any suggestions or advice??!! SOMETHING??? i dont know where to start!!
WILL THIS BE A BIG PROBLEM WHEN HE GOES TO THE INTERVIEW AND THEY SEE IT!!!!!!??

hey guys, hows everyones cases? those RFEs? i just got one yesterday, so i guess i'll have to wait to c wat they want..i think its for more proof of citizenship..i was naturalized and i only sent in a copy of my US passport,...so im thinking they want more evidence. i cant think of anything else since i made sure sooo many times all the evidence n proof of our relationship and required documents are all there...

well i guess we wait now..

ive looked at some timelines and some i've seen they wer approved 5 DAYS AFTER the service center received it!!!!
OMG! I HOPE IT WE'LL GET NEWS (the good one) A LOT SOONER!!

they asked more proof of my citizenship n proof of meeting in person..i sent those all in the packet.. sad.gif

i forgot to put this .. hehe..
..wen i called today i was informed that they have a "back lot" with the applications they receive. so it will take "3-4 weeks" for them to update the system and send my case to the officer who's reviewing my case. i was also informed that they are only updating cases and RFEs that was received on Feb.20! Mine wasn't received til march 14th!!!

hey guys, here's the deal..

i received the RFEs in the mail on march 10th, and i sent it out on the 11th. CSC received it on the 14th. How long is the wait from the point when they receive it until i get news. I am not saying we will get an approval after the RFEs, but of course we are hoping for the best..i just to know how long! i filled sept.19 and its been 6 months. others who filled at the same time as me are already done with their med exams and are going to their interviews next week..its just soooo depressing its taking sooo long...

any suggestions guys!? hehe..thanks in advance and have a blessed day biggrin.gif

you seem to have everything.... we sent my passport stamps, tickets and photos. You also need to sent proof of your on going relationship outside of these visits, such as emails, phone bills, online chats and letter stamps. Choose a wide range of dates.

I was looking into that, too, as my sister liked the idea that there may be a possibility she could come out with me... but no, there is only an option for you to bring your children, no other relatives. Like the others said, he will have to wait until you are a citizen.

We had so much paperwork that it had to be organised in some way....

what I did, was buy clear plastic sleeves (that you put in a folder), and a small clear faced report binder to put it all in. I didnt use a sleeve for each sheet of paper, just for each section. For instance, all the photos went in one sleeve, and all the emails went in one sleeve. These sleeves were all tabbed down the side, with a Contents page at the beginning. I highlighted all important dates on tickets and stamps, and relevant records on phone bills, etc. Also put post-its where necessary.... yes, very #######! haha! But the better it looks, the easier it is for them to understand...

Another tip, make sure the petitioner signs EVERYTHING..... extra sheets to forms, photos, cover letter and contents.

When I went for a J1 interview at the London embassy once, a girl there with me had US sized pictures that she made herself... she just followed the guides and standards that she found online, and they seemed to accept it... I am in the US now, so will get them done here, thanks for the reminder!
