Hi John!
Good luck to both of you! We went through Miami POE last month, it went great. We stayed together and entered the "US Citizens" line, (figure I'm a U.S. citizen, and she is my fiance) when we got to an agent I explained we were both coming from Brazil and my fiance is here for the first time on a K1 visa. I gave him the package, we were walked to another room, waited 15 minutes, done! He just said be sure to get married within 90 days, that's it. :thumbs:

Email them (brasil consulate) after another week, they will give you the interview information, email is the best way to contact. After the interview, you should receive the visa/passport back within a day or two, we had ours the next day with expedited in Rio.

Hi! Have your fiance call with case number, they will give him the RDJ number. after a couple weeks, email Rio Consulate with RDJ number and they will give you the date for the interview. It was 6 weeks later the info arrived via mail to my fiance in Brasil, so email is best. Prepare everything now for the interview, the interview will be about 6-8 weeks from now.

This may be a stupid question (as I am obviously new to all of this), but the NOA1 is just the notice of action saying they received the application and they will start processing it, right??? Thanks for the info! It's crazy how much there is to know....and how NO ONE in the system really tells you how to accomplish it!

Yep, SSA is REQUIRED to issue K-1 a SSN within the 90 day period allowed by the I-94, for the reason I indicated "To get a Marriage License" Kind of hard to get hitiched in some states like TN and NC and a few other places that require a SSN.

Wait 2 weeks after entry because it can take USCIS that long to update records SSA uses to confirm immigrations status, and do not wait until 90 days after, SSA will not issue a number if there is less than 10 days or so of legal stay left.

Also later when you do get green-card, revisit SSA to get a replacement card without the restriction notation on it.



Thanks again....we'll wait the 2 weeks, and that should be perfect for the marriage license, etc. as we have 1 month til the wedding once he arrives. It's nice to know there are people out there willing to give us the info! :) Thanks!!!

Many abuses with regard to SSN, K-1 is allowed one for one reason only, to get married. There is a fed law that requires people applying for a "license" to have a SSN, it has to do with dead-beat parents, the law is to track deadbeats when they apply for: (Driver's License, Fishing License, Hunting License, Business License, Marriage License....) Some states are NO SSN, NO License.. Most states do not comply for marriage license however SSA has been instructed to issue to K-1 holders only.

If you get problems with Bank threaten to take business elsewhere. Also this can be the case with med insurance, just call and ask for a supervisor.



I already noticed that on my medical insurance he has to have the SSN, so I am looking into that too, but I can't add him until after we're married anyway. So, the SSA should allow us to apply for the SSN before we're married then? He gets here 1 month before the wedding, so we should have plenty of time then, I suppose. It's crazy how much red tape you have to go through to get things done! The bank just said they can do it with his passport number (Even though it's not a US passport) so that's good news! Thanks again...I feel like there is not a lot of guidance out there...don't know what I'd do without this forum!! :)

Firstly DS-230 part 2 is not used for K-1 visas, and secondly that check box only works for immigrant visas like CR-1 and IR-1 visas.

You need to enter the USA wait about 2 weeks, and then apply for the number at an SSA office.

Your fiancee can simply apply for AOS (adjustment of status) since she is already in the country. If you decide to go that route, you would have to file petition I-130 and I-485 along with all the other requested documents/forms. Your fiancee would also need a medical exam done by a civil surgeon. The guides here on VJ have helped me a lot in putting together my AOS application. Well, you can get married now, and file for AOS and skip getting a K-1 or K-3 visa, if you had no intent to get married when you entered, which it looks like is the case, but only you know that. In addition to the regular AOS, you would file an I-130 and you would need to get a full medical.

You should change your wedding date.
Our application was submitted Feb. 2006 and my husband(then fiance) didn't get his interview until August 2006. We also went through CSC and London. Even after the interview, it takes a few days (almost a week for us because he lived in Scotland) to get the passport and "brown envelope" from the Consulate.

This process is takes far longer than one would expect.

You will not go to an interview--just your fiance. After USCIS approves your case, it will be sent to NVC, then to Brazil. The Embassy in Brazil will contact your fiance (by mail) and give her directions about the medical exam, interview, and paperwork needed. You do n ot need to be present at the interview. Some embassies allow the USC, some don't.

The request for more evidence is called an RFE here. I'm surprised your lawyer didn't do a better job looking over your evidence before you sent it in. There is no "last time" for an RFE. Although the RFE will usually ask for all the missing information/evidence, it is possible to get a second RFE.

that's ridiculous. Not everyone has a digital camera, (me), and if you are including pictures from the past, you weren't necessarily thinking then ... hey, I'd better put dates on these when I print them, in case I ever lose my mind enough to go through the K-1 process.


That is just what I was thinking! Some of our photos were taken with my old camera which printed the date. Our more recent photos were taken with my new digital camera--but I hadn't read the booklet when the pictures were taken, so the date didn't get printed on the photos. Besides, like you said, at the time we were not thinking about requirements for K-1.

Countries have different concept for signature.

For instance, in France, most people have "artistic" signature because the purpose of signatures is to be unique and not easily forgeable.

Actually, I was surprised to see people just write their names in the US because it seems only a graphologist could determine if it's really you who signed a document or not.

So I gave my fiancée G-325A with both kind of signatures (my usual artistic one and just my name handwritten) and she picked the handwritten style because she felt reassured by it.

I think you are fine with the other kind of signature too, I filed a student visa for the US in 2006 and I signed the documents with my artistic signature and had no problem.

Different ways of filling forms are "acceptable" as long as it makes sense and is coherent with other documents. In our form we left it blank (but we haven't been approved yet so I don't know if that could be a problem).

The sentence "Have you obtained a certificate of citizenship in your name?" applies if you checked the "parents" box so if you checked "birth in the US" I think you should leave it blank.

I just recently submitted my I-129F petition on May 15th to be exact. They have not cashed the check and today May 24 I received the USPS green slip that says REC'D USCIS DALLA May 19 2010. Does this mean that my application has been transferred to Texas Servicing Center even though I live in New Jersey? Does anyone know how this will affect the timeline or my application at all? I am a little bit worried. Please help me

You are not expected to have X-rays taken when you are pregnant. The panel physician will advise you when, after you’ve given birth, it will be appropriate to have the X-ray done.

So it seems you don't have to do the x-ray. But you need it when you want to adjust status within 90 days of entering the US and you will likely still be pregnant at that time.

I think you should call the Embassy because it looks like your case is more complex than it appears to be.

By quickly reading it it appeared the doctor would place a protective blanket around the belly to prevent x-raying the baby. So you would have to tell the doctor about it.

Also I read your fiancé may need to sent a letter saying he is aware of the pregnancy and still wants to support you and the baby.

There is probably more info on the link to the other post, like I said I haven't read it completely and maybe people who answered to this post know more about your situation.

An approved K-1 visa petition is valid for a period of four months from the date of Department of Homeland Security (DHS) action and may be revalidated by the consular officer any number of times for additional periods of four months from the date of revalidation, provided the officer concludes that the petitioner and the beneficiary remain legally free to marry and continue to intend to marry each other within 90 days after the beneficiary's admission into the United States. However, the longer the period of time since the filing of the petition, the more the consular officer must be concerned about the intentions of the couple, particularly the intentions of the petitioner in the United States. If the officer is not convinced that the U.S. citizen petitioner continues to intend to marry the beneficiary, the petition should be returned to the approving office of DHS with an explanatory memorandum. (See 9 FAM 41.81 PN7 for revalidation procedure.)

9 FAM 41.81 PN3.6 Visa Fees and Validity

a. There is no additional processing fee for K visas. Applicants will pay only the standard Machine Readable Visa (MRV) fee. There are no separate reciprocity fees.

b. The K-1 and K-2 visas shall be valid for six months for one entry. The K-3 and K-4 visas shall be valid for multiple entries for 24 months, unless constrained by security clearance requirement or waivers, which are valid for a year or less. Unmarried aliens entering the United States as a K-4 shall be admitted for a period of 24 months or until that alien's 21st birthday, whichever is shorter (see 8 CFR 214.2(k)(8) and 214.2(k)(11)(v)).

My fiance's uncle has been living here illegally for about 3-4 years.

We do not know where he is, just that he has not returned to his home and is living in USA.

When my fiance goes for his K-1 Visa interview, are they going to ask him if he has relatives in the USA?

If his parents apply for a visitor visa to come and attend our wedding, will they be asked if they have relatives in the USA?

We do not know where he lives, just general area, like he lives in the southeast.

Please give us your impression of what problems we will run into.

Obviously we cannot lie but wonder if this will even be asked in the K-1 interview?
We have read on Visa Journey that other parents who want to visit the USA were asked if they had other relatives who lived in USA so we need to be sure to know what will be asked (likely, not expecting anyone here to have perfect knowledge, just does this question get asked in K-1 interview?)





Hi,

Before the interview you need to fill the DS-156 form (among other forms). I don't know if you did that already as you don't have a timeline on this site.

On the DS-156 question #37 they ask about relatives in the US. Though they only ask about husband/wife, fiancé(e), Father/mother, son/daughter and brother/sister. They don't mention uncle/aunt. So if they don't ask it on the form I don't think they would ask it on the interview.

On the other hand, if his parents want to come and they need a visa (if the country is not under the VWP) they would have to fill the DS-156 form too. And this can be a problem as your fiancé's uncle is one of his parents' brother (correct me if i got this wrong) and they ask for brother relatives and their status.

The case number will be written on the 1st NOA you'll get from USCIS. I never heard of it being on the check.

For my information : how can you look at the check you sent after it was cashed ? Do you work at the bank where USCIS cashes their checks ? I'm confused about that but maybe I didn't get it right.
