My fiance came in the USA with a K1 visa, when he entered he was given his visa but the packet was not returned. We do not have any of those documents and in our AOS we need some of those documents to continue with the process, can someone please advise me what to do...


I think it's normal they kept the packet as they will transfer it to your local USCIS office.

You'll need to submit some of the form again for AOS and even if you already submitted some documents you'll need to re-submit some of them accordingly to the instructions of each AOS form.

Yes the DS-160 is the new form but NOT for K-1 visas. If they asked you on P3 that they want a DS-156, they really want a DS-156 and NOT a DS-160.
FYI, when I had to fill my forms last July, the DS-160 was already out, but the embassy in Paris asked for the DS-156 so I gave them the DS-156 and it was all good.

So my advise is, if they ask for DS-156 on the the P3 instruction then give them DS-156.

Also there is here on VJ some timelines that you can sort by country. Here is what I found when I set the country to Moldova. It looks like most of the people there went through Bucharest, Romania. Though, some still put Moldova so I don't know if it's a mistake from them or what. It certainly seems you'll have to go through Romania embassy. Maybe you can contact one of the people on VJ that is from Moldova to confirm.

No they ask for the LAST address. So wherever you live now if ti has been for more than 1 year or the place before that....

It states on the US embassy in Moldova that they DO NOT process immigrant visas. Technically the K-1 visa is a NON-immigrant visa BUT a lot of embassies process it as an immigrant visa. For that reason it is possible that they don't process K-1 visas in Moldova. I would try to contact the embassy in Moldova to get a clear answer on the matter.

I'm the beneficiary of K1 visa application. We applied a month ago, we received NOA1 and now we are waiting for NOA2. But just now i realized that in all our forms and letters to USCIS i mixed up my middle with my first name. In my country (Romania) we don't have such things as middle and first name, so i got them backwards. What should we do in this case?

Thanks in advance for your advice! I'm new to this process, and my fiance and I have been gathering all the necessary evidence, and I've also been reading a ton on this site. I noticed from some earlier posts references to the beneficiary needing to submit a copy of his/her birth certificate IN ADDITION to me submitting a copy of my birth certificate. Is this true?? I haven't read anything about that in the step-by-step guides, but definitely saw it mentioned a few times in various postings. Any clarification would be really appreciated!


The first step is for the petitioner to send the I-129F and to justify id of petitioner a birth certificate or passport
Then, at the interview stage, the beneficiary will be asked several documents among them the BC of the beneficiary.

I need some help with G 325A. Do I need to fill out G325A for me (US citizen) and one for my wife (who is not in US)? If yes, can i use a faxed copy? I was thinking of faxing the form to her and have her sign and fax it back to me. Is that acceptable? Or does she have to mail it back to me? Thank you in advance for your response and help.

you need to fill 2 forms (1 for you, 1 for your fiancé) but unfortunately, your fiancé will have to mail it because this form requires to be signed and USCIS needs to be able to verify the signature is real.

I almost made the same mistake because I thought it was a box reserved for USCIS.

Because the information is redundant with the top of the form, I don't think it's that important to forget this part. personally, I think you'll be fine but you never know with the immigration process. Anyway, it's too late know to do anything about it but wait.

Hopefully you won't get a RFE for that.

we received our notification that california service centre has received our application! very excited! seeing as it's moving again.... so now i need to know how to make my timeline come up at the end of my posts and how to make it all pretty :) please tell me! i'm computer illiterate :P


I'm not an expert either but the way I did it is to go into my profile and write it letter by letter in "my signature". To make it look nice you can add spaces and/or punctuation. Maybe there is a better to do it and I'm just an ignorant.

My fiancée crossed her SSN on the tax forms and it wasn't even mentionned at the embassy in Paris. She did it because she feared that if it got lost them people might use it.

I'll suggest a coupla things, maybe (maybe...) help you to decide whether you need an attorney or not.

a. read the VJ guides. map the steps out on paper and pencil. See if anything doesn't make sense to you.
b. Read the USCIS web portal about the forms. Map out the steps on paper and pencil. See if anything doesn't make sense to you.
c. Practice filling out the forms, at least 5 times. See if anything still doesn't make sense to you.
d. Have any red flags? Practice writing up attestation letters about each red flag.

Now, after doing (with major emphasis on DOING ) all of the above, if you do NOT understand the forms and the process and potential red flags for your petition,

then I'd suggest getting a good IMMIGRATION lawyer.

This link is in the page that you attached to your post and talks about sending your DS-230 to NVC.


The thing that they use this letter for immigrant visas usually.
Now, you may have heard that technically the K1 visa in NON-immigrant but because it offers the possibility to quickly adjust status and effectively immigrate the embassies sometimes process it as an immigrant visa. Though it should say you only have to send Part I and not part II of the DS-230 form.

Did the form you show the one you received from the embassy or a sample you found? I ask because when I got my P3 they barred some sentences on the form and replaced words here and there. Unfortunately I didn't keep that specific letter so I'm not sure but it's possible they barred NVC and replaced it with the embassy address. Anyway I never send anything to the NVC when I completed my application so unless they changed the rules you don't have to send it to NVC.

Maybe someone who went throught the process more recently can confirm.

the $350 visa application fee is the 263€ (conversion rate 1€ for $1.33) that was called interview fee on the other post
the medical fee can be 150€ depending on the doctor if you have already the X-ray done.

I would wait until you receive your Packet 4 from the embassy to be sure of the amount and the account number.

When you have that you just go to a post office that does financial operations (most of them do) and ask to put moneyon the "mandat compte" number xxxxx (the number was 2006L at the time of my interview)

I guess you can bring cash. I was a client of the "banque postale" so they could transfer the money directly from my account.

I think I would wait because it is possible the amount is gonna decrease. They are currently using a conversion rate of 1.33 but the real conversion rate is 1.43 and it already went down from 287€ when I went there to 263€ recently.

Actually it seems now the visa fee went down to 263€ (because of the $ / € conversion rate) for a K-1. This fee is to be paid via "mandat-compte" at "un bureau de poste" (post office)

Yes the doctor is 170€ and is a separate fee payable directly to the doctor.

Hang in there...5 months is normal for the NOA2...be prepared for up to 3 months for an interview appointment since Bogota is getting backed up more every month.

I just joined today. I came accross this site when I decided to google about experiences other people have had for the K-1 visa. For the past few days I have read many interesting stories and I have learned a lot as well. And to confess I am one of many who is waiting waiting waiting to hear news about my case. The mantra seems to be "PATIENCE" and since I have read many of your stories I do feel more relaxed. My NOA is dated August 13th, 2010 with only 1 touch on August 20th, 2010. For almost three months there has not been any touches on our case, and this is what prompted me to seek other peoples' experience because it seems like a long time without any activity. My fiance is getting anxious!! :) And of course I am too. My service center is California, Laguna Niguel to be exact and from reading some of your posts this seems to be one of the busiest service centers, which might be the cause. What do you think?? Hi everyone :)

The embassy finally has our case/documents and we are ready to proceed with packet 3. I want to go to Colombia and be with my fiance for the interview and hopefully we can return together. My question is: after filing the forms for packet 3 how is the interview scheduled? Do they pretty much give you a date and that's it, or do we have a choice from availabale dates? My teaching contract doesn't end until mid March and I'm thinking if we file packet 3 now we might be given a interview date before my contract expires. I am specifically talking about the Colombian embassy as I'm not sure if the scheduling process is the same with all embassies.

Excellent post Kathryn, some calm perspective on this whole process. If you haven't learned this by now, it's going to be a long road...patience. We are all people, American by birth, or by paperwork makes no difference, the same. I am somewhat surprised at "discriminatory" remarks or comments made about certain types of people, aren't we all trying to help our "foreign" family here? This is not a right, it's a privilege asking permission to bring our family members here. I understand the need to fight for getting your family member/fiance here soon, but this wait we knew before we started could be longer than anticipated. Family visas are low priority for obvious reasons, it's a high priority for me, but not for our Government. :thumbs:

Same boat here more or less.... I've been traveling to Brazil see my fiance for over 18 months, there about every 2 or 3 months for about 3-4 weeks. We tried the tourist visa route also, denied...so we are now waiting for the K1 approval. I suggest being patient, get the K1, then get married after. Remember, it's not guaranteed to get this visa, so have a plan B. You will be hard pressed finding a job in Brasil, it's very competitive even for the local skilled workers, and the pay does not compare to U.S. If you need to work, don't go there thinking you will find something. This waiting is tough, but good will come of it for both of you.

I read several reviews and it depends on the location you will receive the visa. Closer to Rio, faster arrives, 2 or 3 days seems to average, with more distant locations 4-7 days. It's delivered by courier only, so it should be trackable with an estimated arrival date. You can pay extra at the embassy for expedited delivery.

I think you will be ok just to have it translated and include both in your I129 package. The letter of intent you will update and bring to the interview at the US consulate in Rio. Documents in Rio can be english or portuguese,(birth certificates, police reports, medical, etc.) try to do everything in english when possible. Boa sorte! :D

We are going thru the process also, going to the interview in a couple weeks. Make copies of your entire package. Reading other people's experience, this can be crucial if you need it. Better to have it and not need it, than need it and not have it. Send her a copy also, with and all the documents you need after you receive the NOA 2 for the interview.
Brasil consulate is not crazy about proof of relationship, just have proof with pics, phone records, and passport stamps when you visit Brasil. If you show up and attend the interview with her, obvious it's a valid relationship, but rarely necessary. Otherwise relax and endure the waiting, it's going to be long and with it's challenges, but in the end it will all be worth it. :thumbs:

Definately email them with the Case number, if they say they don't have it yet, try again a few days later.
I got the interview date and info about 2 weeks after it was sent from NVC. My fiance did not receive any info, as in mail confirmation for another month! Email is certainly the best way to contact them.

We waited in Rio for the passport and visa, it took 2 days with expedited shipping. It depends on your location, more distant from Rio, more time, but I think 5 days to a week is reasonable to Sao Paulo.

Good luck to both of you! We went through Miami POE last month, it went great. We stayed together and entered the "US Citizens" line, (figure I'm a U.S. citizen, and she is my fiance) when we got to an agent I explained we were both coming from Brazil and my fiance is here for the first time on a K1 visa. I gave him the package, we were walked to another room, waited 15 minutes, done! He just said be sure to get married within 90 days, that's it. :thumbs:
