Initially you have two issues that I can see just from reading your post.

1. It seems that you still have questions of whether you want to marry your boyfriend. To qualify for a K-1 (fiance visa) you have to be engaged. In other words, you already agreed that the both of you want to marry.

2. You are only separated. To qualify for the K-1 visa, you have to be free to marry (divorced in your case).

However, I will say that once you get engaged and divorced, you met those two requirements. But keep in mind that there are other requirements (i.e. have met in person within the last 2 years, etc...) Below is the link the USCIS website where it talks about the K-1 visa requirements and the process. I hope this helps.

Yes, but only with an employment authorization document (AED) from USCIS.

Hi gandachic,

Ung BC ng son ko nakuha ko sya in less than 3 weeks dapat 2 weeks lang kaso nagka prob ung computer ng NSO Main kaya delay ung releasing nila.
What I did was, after ko mangank process ko agad bc sa local civil registry dito sa makati, san pala u located? tapos nag request me ng green copy with number after 3 days ung releasing, after nun nag request ako sa local nso ng advance endorsement ..ginawan me ng letter tapos dinala nmin sa NSO Main sa east ave...sabay request na rin ako ng copies..ayun after 2 weeks ung release.

CRBA appointment din ng baby ko sa September 3..sayang kung alam ko lang na pwede walk in dapat pala habang andito pa ung fiance ko.

Hi fellow vj'ers. I'm a little confused on how I should go about my son's birth certificate. I was told by the officer at the local civil registrar that I no longer need to send it to my husband for him to sign the back part (AFFIDAVIT OF ACKNOWLEDGEMENT/PATERNITY) since we're already MARRIED. But I was also told by other fellow VJ'ers that i'd need to have my husband sign the acknowledgement.

Thanks to all who helped me all throughout my and my son's journey. smile.gif
We had our interview this morning. Surprisingly, we didn't wait too long for my son's name to be called.

We had a roadblock the moment we went inside GATE 2 of the USEM. My bag was scanned. My mom's was scanned as well. We left our phones in the car. She totally forgot that she had another phone in her bag (to have it repaired anytime she gets the chance to go to the mall). The guard was insisting that there's a phone in her bag. She was on the other hand insisting that there's no phone inside. "Hindi naman po magsisinungaling yung xray machine", the lady guard said. So we had to bring out all the stuff and voila! There really is a phone. haha we asked the guard if we could just leave it there (they issue numbers for other gadgets) at first she was hesitant but the other guard said that its ok. phew!

So off we went to the American Citizen Services. Our interview sched was 730am. After 15mins of waiting, my son's name was called to Window F. I was then asked to pay at C-1 ($150.00). After waiting another 30mins, our name was called at window A for the main event hehe

The male CO was very warm and accommodating. and he is good-looking too. The interview lasted for only 3mins (apart from our chit-chat...yes, we had a small talk. that's how nice he was.)

We will be leaving on the 26th of Dec via PAL PR-102.

Stewardess will ask to you if you need, just tell her that you have visa and you need that form I-94 form for non-immigrants and a customs declaration form. Be sure to bring pen, so that You dont need to borrow.


I figured. Thanks. The flight attendant gave us two forms. One for my husband (Customs Declaration Form) and the I-94 for me. smile.gif Overall, the flight was great. 12 hours straight via PAL but we were 30mins ahead of time. We arrived early at LAX.
The immigration officer just asked for the packet and she went on to get my fingerprints and photo and thats it. no questions or whatever. It took less than 5mins for us to get out of the immigration line. Then off we went to the baggage area, got our stuff and our dog (picked him up at theoversized baggage counter) then we headed for the exit line. I thought we'd pass through the agriculture since we have a live dog. but the customs and border officer told us to head straight to exit coz were good to go. kicking.gif

Will take note of your post. So far, my pup's vaccine is updated so I don't have to worry about it. No need for a dog passport? Will I be able to get the permit right away or do I need to wait for days or weeks?

it only takes a few minutes to get the export permit. no need for a dog passport. i had my chihuahua microchipped coz thats one of the requirements in CA. and thats it. smile.gif good luck...

some COs don't have any sense of urgency. they'd really get into your asses so as to jeopardize things.
i'm just so happy you and your fiance stood up for your rights. i feel sorry for your little kid. that CO acted so rude infront of an innocent child?! losing her job as an excuse was SOOOOOOOO LAME!!!! couldn't she think of a better excuse that she woke up on the wrong side of the bed or she never experienced having true love?! i would have understood it more as to why she's acting that way. maybe she's jealous of us being petitioned since we have significant others. laughing.gif oh well, my angst is at its highest level!

the famous CO at window 32 (fat or should i say chubby with curly hair) was the one who interviewed me. i didn't go through a hard time. thank God.
though she was a little rude for not even looking at me the whole time we were talking. tongue.gif

my itinerary will be Manila to Guam....Guam to Houston with a stop over at Honolulu....Houston to Washington.

It state there that Guam is a Class A POE (class A is for all aliens) so my guess is that Guam is going to be your POE.
