Hello again...

My fiance changed her first (given) name (cultural, social reasons) when she was about 15. Does she need to declare this and send appropriate documentation of this on question 7 of the I-129F Petition? Her passport will have her current name on it. Does she need to send a copy of her passport with the I-129F petition? I guess I am confused by the instructions for the I-129F (#6,C). It says:

"If either you or the person you are filing for is using a name other that that shown on the 'relevant documents,' you must give UCSIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order."

I am confused by the 'relevant documents' part. At this point what are the 'relevant documents?' Again, her current passport and Thailand ID card have her current name on them. Do I still need to send legal proof of name change when I send off the I-129F Petition. This will not be a problem, just wondering?

My fiance (also from Thailand) changed her name. I know it is common in Thailand for people to change their name; sometimes even more than once throughout their lifetime. We provided copies of her name change certificates with our I-129F petition and we didn't have a RFE. If for some reason she doesn't have her certificates, she would have to go to her home of records (her hometown) government building and they can provide her with a new original certificate. That is what my fiance had to do. I hope this helps.

I just wanted to share with you my experience with our K1 Visa. I would just like to start off saying that this site is awesome and very helpful and that too bad i didnt find or know about it until 2 days ago (after my interview aproval). My story to me is really sad and hope no one else is or will go through it. Please bare with me as my wording is not that great.

I was born in Vietnam and have lived in Canada for 25 years now. Iam now a Canadian Citizen. Roughly 3 years ago i took a trip into the states where i met my finace. I have been back and forth via plane and car to visit her over the first year of meeting her. I ended up getting laid off at work over here in Canada and at that time i went to visit her and over stayed my visit. We both came into Canada a number of times and was never hassled coming in or out. On one visit we had our engagement party at my family home and then went back into the states. Last year we found out that she is pregant with our first child. When she was 6 months i had planned a baby shower for her in canada as i had more friends and family over here. We both came into canada mid May 2010 and had our baby shower. When we went back to the states the drive from toronto to windsor/detriot border was 5 hours and we got there at like 3am. I was really tired but anyways the officer ask me where i was going i said that i was driving my FIANCE back to her home and then come back. he ended up making us go into the border office room where we sat there for like 2 hours. They then forced me to give finger prints before even telling me what was going on. After i gave them the finger prints they basically told me that there not letting me into the states as i have no status to be there. they gave me a list of what i needed if i ever wanted to go back into the states. He also clearly said that if i try to enter the states without those things on the list that i can be Barred from coming into the states for a long time. Some of the things on the list was pretty much proof of jobs and house and bills. basically evidence that i live in canada and would want to come back. That day was one of the saddest days of my life. On top of that they didnt even let my fiance come back into canada. so they made her drive home into the states and force me to go back to canada. I had to take a cab to the winsdor bus station and bus it back to toronto.

After many sad days we then looked at our options. We decided to file for a K1 visa. at that time she was almost 7 months pregnant and time was very tight. we didnt even know what the lead time would take, whether 1 month or 1 year or more. she found a lawyer in her town that said he could get me over into the states within 1 month and that our case is easy. he even said he has conections and that he would speed up our case. After we gave him the amount of money he asked for $3000+ and i remember at that time i told my wife to tell him that we would give half and the rest once im over there. The lawyer said thats not the way he works and that he required the full amount before getting started. from our point we had no choice and went ahead a hired him. at first he got the paperwor going filing for us. as it got closer to the time frame that he promised and my fiances due date he said that there is alot of cases ahead of us and that it will take more time. i could sit her and type this all out but i dont want to bore you, basically time went back and the lawyer kept coming up with reasons....and i ended up missing my childs delivery. at first i asked the lawyer if we should claim that we will be having a son and he said he doesn't think that will help our case. i saw it as it wouldnt hurt and if anything it should help. we even requested to expedite our case due to the fact that she was pregnant and that she was living on her own and didnt really have support. that was denied.

So it came to the point where we just waited and did what we needed to do when we were asked on at the letters that were sent to us from the state. every time we sent away documents and hoped it would come back with good news it became weeks and months later so we pretty much gave up on our hopes of being reunited quickly and just waited. The lawyer ended up not even replying to our emails and calls and we had to finsihed the last of the paperwork that was needed to be sent to the consulate oursshelves with the hopes that it was done right and didnt bounce back.

so after a few months of waiting for results of after sending away the last package via dhl to the consulate we recieved a letter to go ahead a book our interview date. OMG i was so happy as this is the only good news we have gotten. that was in jan of this year. we quickly went on the website and paid the fee and it showed the first date alvailible was in june. my heart dropped again as that is 6 months away and i haven't even seen or held my newborn son. My son was born on Sept 29/2010 by the way. i was so sad of the wait time and delay i felt at times just to give up. what i did and i recommend this is keep checking the site for new dates as sometimes better dates come up from people cancelling. I was lucky and got a interview date of March 22. which was good timing because i needed to finalized and finished alot of the required papers they needed me to bring. i also called and booked my medical exam and they gave me that date 2 weeks prior to my interview date.

at this time my fiance came over to to visit me with my newborn son. he is doing well and today is 6 months and 1 day. we went to montreal the night of the 21 of march and stayed at a near by hotel. my appointment was at 930am and i got there at 840. went i got there there was maybe 5 people ahead of me and i thought to myself not bad. some ladies were not aloud in due to their bags or purses being to big. it was pretty much like going through airport security. they told me then to go take the elevator to floor 19 which i did. as soon as the doors open OMG the room was fulled and i was so shocked. we did what they asked and took my number and waited for my turn. they called me roughly every 10 mins for about 3 times i think each time asking for documents and finger printing. after the last time of being called up they told me to go wait again and someone will interview me. that was great news....so i waited and that took a long time. almost 3 hrs i think. i waited like 3 hours and it took 5 mins with the lady who interviewed me who was very nice. i nervous prior to going and thought it would be like a close doors sitting down with someone to talk about my case. it turned out to be standing at a cubicle talk through a glass window like i was a a bank teller.

I passed she said and gave me 3 papers to read one of which says welcome to america. finally this long road has ended and we are about to head back to the states. its been more then a week now and i still havent recieved this dhl tracking number on the website though. im eager to recieve this visa.

well that was my experience. im sure there was more but im just all over the place with this. hope you enjoy and hope this can help someone out there. feel free to ask questions as im happy to help.

I meant to ask whether the approved expedited request extended until the NVC and consulate stages, pls; or is it simply that the wait time for a NOA2 had been cut shorter? What documents shall we prepare for the next step -- proof of income? evidences of ongoing relationship, etc? Shall i gather NBI, police clearances now? Would anyone have an idea what to expect from here? Will I be seeing the sweet K1 visa stamped on my passport soon? :blush:

I just went through the same think. In our case, the process was expedited through NVC (it was received, approved and sent within a couple of days). Right now, we are waiting for our packet 4 from the embassy. I cannot tell you weather your embassy will expedite. Every embassy is different. My embassy in Bangkok asks (in their website) that we contact them if we think we meet the expedite criteria again, which we did. In addition, we sent my military orders. Hopefully, we will receive our packet 4 this week. I would start gathering all of the other documents now (income, evidence of relationship, police report, medical, etc...). Look at my timeline and you judge.

Congratulations on you NOA2. You should receive your email in a couple of days saying that the I-129F was proccessed.:dance:

I'm about to hit 5 months mark soon, just wondering what to do or who to contact relation to military situations? I know that I have to wait at least 5 - 6 months like the others, but since he's been in military I thought it might help a bit, isn't it? We are about to contact senator in Texas within this week, and that is our plan. Have anyone experienced about military situation like this? please help..........thank you


I am a Naval Officer and just recently applied and got approved for a military expedite. Just being in the military does not qualify you for an expedite. Military service members can qualify for an expedite due to an upcomming deployment. You would have to provide a copy of the deployment orders or a letter for the Commanding Officer stating that he or she is going to be deploying.

That is not a correct statement. K-1's ARE eligible for expedites. Mine was expedited and so have many others here in VJ.

Hello,

I have a question, if I may.

Our K1 interview is around the corner, and I have been hearing that emails and/or letters are needed as proof of relationship. The thing is we hardly have any emails or letters. We just communicated daily (almost 2 - 3 times daily) over the phone and by yahoo massenger. We never felt the need to write emails or letters. Will this be a problem? I am kind of worried. The thing is it was just easier and more practical to just call each other up. Besides, she does not know english, and could not write emails/letters in english...and my keyboard does not support writing emails in Arabic. So it was just more practical to just call each other, since we spoke the same language. As proof we have:

-Phone records
-Yahoo massenger logs
-Pictures from 2 visits
-Tickets, passport stamps, Hotel receit

Do you really need to have emails/letters?

Your input is appreciated.


We did not submit any letter nor emails neither. Only skype logs and phone records and we got approved.

Hi all, my fiance and I at the interview stage of the K1 visa process, my fiance is in the Military and we would like to move on base as soon as possilbe, which is 30 days prior to marriage, my question is this - when do we tell the USCIS of a change of address?? As soon as we know our new address, the next time we need to contact them which will be for AOS or would you advise us to stay where we are till we have completed the AOS.

I ask this because on DS-230 Part 1 of the packet 3 forms that is sent to the embassy, question 11 asks where you want your Permanent Resident Card sending, and I've obviously put the address he is currently living at but if we move on base this will be diffrent.

We changed address as well to a military base before filing for AOS. We just went to the USCIS website and changed my wife's address online. The USCIS website indicates that non US citizes are required to notify USCIS of a change of address within 10 days of the actual move. It was easy and painless. Then, we filed for AOS.

Here is the quote from the USCIS website: "In addition to changing your address for a pending application the law requires that all non-U.S. citizens, except for holders of A or G visas, report a change of address within 10 days of moving by completing a USCIS Form AR-11, Change of Address."

Hello all... Looking for a little help.

Now... seeing how the DS-156 was originally intended for traditional Non-Immigrant Visas, I'm wondering how some of you answered a few questions. I mean I know the K-1 is technically a NIV, but its considered by most an IV because of the ability of the beneficiary to remain in the US following their marriage to a USC. With all that said... some of these questions... I need help with. I'm just not sure if the questions should be answered like a NIV applicant or as an IV applicant. ---Hope that makes sense---

Question 26: How long do you intent to stay in the US?
Question 27: What is the purpose of your trip?
Question 32: Do you intend to work in the US?
Question 33: Do you intend to study in the US?
Question 36: Has anyone ever filed an Immigrant Visa Petition on you behalf?

Hi fellow members!

We are so happy, just received the next step of the K1 Visa. I have to collect forms and send few forms to my embassy before the appointment.
My questions are :
Do I have to fill online the DS-156 before the appaointment at the US embassy?
Do I also have to fill the forms DS-157 ans DS-156K ?

On the DS-156, there is an information i have to fill, concerning the date of arrival in the US territory. But how can I know? haven't the visa yet, so, i can't know, when i'm leaving France, does make sense?

As said, you need to fill all forms before you go to the embassy. For the DS-156 for the date of travel, I personnally left it blank and I didn't have any problem at the embassy. An officer there asked me if I had plans and I said "I'll probably fly there in November or December" so maybe they filled it at the embassy but I have no ideas. It's no big deal anyway.

Question 38. Have you ever been refused admission to the US, or....

My fiancee did get refused on a student visa last year. Is that the same as being refused admission or is that just at a port of entry?

I've asked before, but Question 31. Have you ever been refused a U.S. Visa? I think we have to put yes here and put in her student visa...I was told this shouldn't affect the K-1, but it looks like a question they could give us flak about.

for Q.38, I understood it as refused entry at a POE (Port Of Entry) by a CBP officer. So a denied VISA doesn't apply to this question but as you said you have to mention it for Q.31

Take this with caution as it is only my interpretation and I may be wrong. If I am wrong I hope someone will correct me.

Hi...is it acceptable to type P.O box in a letter of intent to marry or must be home address?

As far as I know, it's possible in I-129 F Part A, Q. 2 .

I think it's possible. However I would put a physical address as they don't use the address written on the letter of intent to send any mail. I don't know if it is a convention in the US but in France, on a formal letter it is the physical address that is written (and it doesn't necessarily matches the contact address).
But as said, it doesn't really matter since they don't use this address to send mail so P.O. box should work as well.

I went to a bank to pay fee for K-1 interview... in letter they say to pay 131$, bank say they have no visa for US that costs this much, that is old price... I got letter a week ago and my interview is on Tuesday! need to call them on Monday to check but what if they don't answer the phone??? how to trait this issue...???? to make bank charge me 131 or I will have problems????


New fee for K-1 visa is now $350 as confirmed in the following link. The embassy will probably ask you to go back and pay the right amount and possibly reschedule your interview if you go on your interview and paid only $131. It is strange though that they would send a letter with the wrong fee on it.

Hi everyone, thank you for your well wishes about my fiance's approval. We met while he was studying in the US on a J-1, and he has a 2-year waiver. During his interview the embassy took the original of the waiver. Now he is concerned that he will need to show the original at his POE, and that the embassy will not mail it back to him. I don't think he needs to worry - can someone explain? Has anyone gone through this before? He doesn't have the K-1 itself in hand as they are mailing it to him, but he should have it this week.


When they mail the visa to him he should get an envelope with it. There will be in this envelope the original I-129F package that you submitted along with the documents he gave at the embassy during his interview. So the original of the waiver should be in there BUT DO NOT open the envelope as it is reserved for the CBP officer at the POE.
There is no way to know for sure but CBP officer should find it in the envelope your fiancé will give at POE.

I see what you're talking about. This matter have been discussed a lot on VJ.

I found other posts here that say the rule have changed and even if you have a stamp it no longer authorizes you to work.

I haven't hear about a temp SSN personally

the SSN is NOT ENOUGH to work when adjusting from a K-1 visa as said by canadian_wife, you need to fill for work authorization (form I-765) when you fill for AOS

If you go crazy after 3 weeks I would advise finding some kind of activity (like doing sports, writing...) for when you get there since it will probably be at least 3 months before you get work authorization plus the time to look for and find a job.....

That seems right. You can add the I-131 for advance parole for no additional fee if you want. Of course you also need to send all the supporting documents asked on each form.

Thank you Bruno. I wasn't planning on mentioning anything, I just wanted to know what you guys thought. But you see, we applied for this visa back in february and started planning the wedding for the end of august (since thats when I was going to graduate from college) hoping that the visa would have been approved by then considering the timelines given at the USCIS website. I know that you are not supposed to legally get married before the visa is approved (which we didn't) but are people supposed to just wait for almost a year for this visa to be approved and THEN start planning a wedding? Which wouldn't even make sense considering I would have to enter the US on the K1 within 6 months of it being issued. I just don't understand what people that want to have a wedding at their home country are supposed to do. Get the K1, go the US get married and then after you are a permanent resident and can go back to your country you go back and have a wedding after you have been married for months? You know what I'm saying? What do they expect us to do?


Yes, I know it can be hard to plan since it's impossible to know when things will happen regarding immigration status. That's why we planned only the official wedding and we'll do the "party" part later. For now we only planned a big party in the US, but depending on how many people come from my family we might do another (less big) party in France too. I personally don't care of delaying the party but I understand it can be frustrating and a nightmare for planning.

Hello,

My fiance (USC) filed our case with USCIS back in February. After 5 and a half months, we had heard nothing and hadn't had a touch since a few weeks after the application was filed. Since we had heard nothing and 5 months had passed, we called them and they said we should hear from them within 60 days. A week later we got a RFE, they requested two passport style pictures of the petitioner (he had sent it with the original application, so perhaps they lost it or it got misplaced, we'll never know). We sent in the evidence a couple of weeks ago and we are just waiting to hear their decision.
The thing is, on August 21st we had a wedding back in Brazil, it was just a ceremony with our friends and family. We did NOT legally get married, we had the ceremony and are waiting for the visa so we can legally get married in the US. After the wedding we went to mexico on our honeymoon, and I came back to the US with him on vacation. I am waiting for the petition to be approved so I can go back to Brazil for this interview.
I think we were just unlucky that our process is taking so long. There is no reason for them not to approve it, as our relationship is very solid and we have concrete evidence or our 5 year relationship.
I want to know if you guys think that I should mention the wedding at the interview or not at all? Would that be looked down upon? Keep in mind that it was just a ceremony, it was NOT a civil wedding at all.
And plus, why do you think this could be taking so long? As I said, there is nothing shady about this relationship at all. I have been to the US numerous times and so has my fiance to Brazil. I was an exchange student in the US in high school and college and my fiance has a great job and is able to support a spouse.


If you mention it at all I would NOT call it a wedding but I would refer to it as a party or celebration or any other word but wedding. I've read in other posts on VJ that it is not a good idea to mention a "party" that looks like a wedding ceremony so I would not specifically mention it. However, if the CO asks about it I would tell since you must not lie. I'm not sure how they would know though. As for the length of the process, it can vary a lot regardless of your relationship being shady or not.

Will my fiance need to fill out and sumbit the DS-160 for her visa interview in Ciudad Juarez, Mexico? My research from the Ciudad Juarez website does not mention it being required.


No. It seems for the K-1 it's the DS-156 that needs to be filled on-line. The DS-160 is meant to replace the DS-156 but for some reason they don't use it for K-1 visa.

Maybe someone how went through Ciudad Juarez recently can confirm.

If they are already married and have Green card, he/she does not need AP and can travel with green card,Right?


Yes that's right.

I think you still need your passport with the green card and sometimes the wedding certif to show your name change if needed (passport could have maiden name and green card new name)

If one successfully completes the K-1 process, comes to the US and marries, how quickly can the applicant get papers to come and go from the US?


You can apply for AP (advanced parole) at the same time of AOS (Adjustment of Status) that will allow you to come back to the US if you go someplace else.

I read that lately people were getting those in about 60 days. So about 2 to 3 months after you apply for AOS you should be able to travel.

Here is a link of the VJ members who went through Paris. It seems there is between 1 and 2 months between P3 and interview with more people around 1 month than 2 months.

You can dig more around the different timelines provided on VJ to find specific data than can give you an estimates of timelines. Remember it's only estimates.

My fiance came in the USA with a K1 visa, when he entered he was given his visa but the packet was not returned. We do not have any of those documents and in our AOS we need some of those documents to continue with the process, can someone please advise me what to do...


I think it's normal they kept the packet as they will transfer it to your local USCIS office.

You'll need to submit some of the form again for AOS and even if you already submitted some documents you'll need to re-submit some of them accordingly to the instructions of each AOS form.
