K-1 Fiance(e) Visa Process & Procedures	Traditional Wedding	Traditional or not; registered or not; make believe or not: or for whatever reason/purpose you run the risk of getting your petitioned denied or disapproved. The whole point of K-1 petition is for you to be able to enter the U.S. (unmarried) then get married within 90 days prior to the K-1 visa expiration. So many of these get denied, because come final interview with the American Consul - either through carelessness of having pictures or slip of the tongue when asked when were you married - it shows up. IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports	NVC Filers - June 2014	The IV invoice is triggered by the DS261 submit date. If you submitted on May 27th, you should hear something hopefully by Monday. Whatever you do, DON't go back into the DS261 or it will resubmit the date and you will have to continue your 30 days from there....I did that and lost 19 days!!! IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports	NVC Filers - June 2014	I am so confused. I paid for my AOS fee and sent in my DS-261on May 27th. I sent in my AOS package on JUne 11th.   I see some people can see when their AOS packages have been scanned into the computer. I have been wait until June 27th to see if my IV bill opens up, but it still hasnt. I havent herd anything from NVC I plan to call on Monday, but is this timing normal and how do I know when my package has been scanned. I am getting a little worried. I have called my tax lady and i tried speaking nice with her and then she got an attitude. Ughh i lost it on her and I shouldnt have. Well she does my mothers taxes and she called my mom. She told my mom there is no way to file me married unless i have a federal tax number for my husband. Did anyone else have a federal tax number for their spouse? She said to get one my husband should go to the consulate with our marriage certificate and ask for one. Honeslty i dont believe or trust what she is saying. Help please can anyone confirm or deny any of this info. She also said since my parents claimed me for the year that if i filed an admendment they would also need to file an admentment. I really hope her mistake doesnt cost me a month or longer in this process   **********************   Any tax preparer that uses a standard tax preparation software program is probably going to try this switcheroo.  The standard programs will NOT let you file "Married" - either jointly or separately - without an ITIN or SSN in the line for the foreign national.  And the tax preparer does not want to have to fill out the return manually.   I've seen this happen many times since I've been on VJ - and I wish there was something we could add about this to all folks who are going through the IR-1/CR-1 process.   It really is that the tax preparer is clueless or lazy.   If you are married, and you know your spouse does NOT have an ITIN or a SSN, do NOT let your tax preparer file your return electronically.   I do not know every tax return software program out there, but I know MY tax guy, who works for one of the Global Big 4 Accounting firms, taught me about this.  Even his company's software program does not allow for a "married" return to be filed electronically without an ITIN or SSN for both spouses.   It is also a wake-up call for all people.  We are all ultimately responsible for all the details and numbers on our tax returns.  Even if you don't understand taxes at all (and who could understand US taxes!!!!!?????) look over your return every year before you give the OK to submit.  Make sure your personal details are correct!   If you can file an amended return before your send in your AOS packet, you should not have a delay.  Just don't let your tax preparer charge you for preparing the amendment!   Sukie   Thank you! On top of that I was with her when she filed everything out and she marked married filing separately. Thats what makes me so angry, because she had to have changed it when I left! I am just trying to calm down before I go to her offices tomorrow. Contact your tax preparer again and get her to file a 1040X asap. Don't let her tell you that you cannot file MFS. Afterwards, you can submit your AOS packet including your complete 2013 tax return with W-2's, 1099's (if applicable) AND your form 1040X showing you amended your filing status.   Good luck!   Thank you! So my mom talked to her tax lady about it and she said it was no problem. So I made an appointment with her and explained everything to her. She said yep that is no problem. So I sat down with her as she filled out my taxes, and I saw her mark married filling separately. Now that I need to send AOS package I am making copies of my 1040 and I see it says SINGLE!! THE ANGER I HAVE RIGHT NOW. Trying to calm down and hoping this doesnt make a problem for me. My mom is saying I might be ok, because we were married after June. I am filing out my cosponsors(mom) I864 and I am hoping for some help.    On part 6: Where is ask for my moms income does it want her income off of her W2 and for people in her household(my dad) do we put his income from his W2. Because when placing what they each made and after when adding it and putting it in line 10, it was a different number than i put on 13a. under total income. I called yesterday and this afternoon got the emails. I did get a check list     I will have to redo some papers I sent, but I have another question. I got a check list to complete the DS261 again. You should call and ask to speak with a supervisor, that's what my husband did when it was 30business days for us.   Will the supervisor have an answer as to why I have had to wait so long, or will they have my case finally looked at?    Will they give me a hard time to speak with the supervisor? But I am deffinatly losing hope, because I have been hoping for an entire month. OMG have you called them and asked them about it ? like how long is it going to take ? i am scared now i hope i don't have to wait this long cause my AOS packet is still not been scanned yet they told me it will appear  on 27th along with IV invoice but its weekend so i am hoping that it's going to happen on monday. Yes I have! I called three weeks ago. The lady on the phone told me to wait two more weeks. I asked her and what if nothing happens by then, when I call back then will you be able to do something. She then told me again wait two weeks and call back. I am nervous to call because I do have a bit of a temper and I am fed up with this wait. I tried calling on friday when I was off work and during my breaks, but I never got threw. I know Mondays are buy too, but I will try. Any suggestions on if I should ask for someone higher up? And will they actually be able to do anything or are they just going to tell me another two weeks. Thats why I havent called because I really dont want to be on the phone for more than an hour and get told just to wait two weeks. If they do something I would be amazed, but i doubt it. IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports	NVC Filers - July 2014	You don't have to yell at NVC when you call them, it just seems like maybe they have forgotten about a week of us.  It's been over 30 business days, so you have the right to call them and request that someone looks into the situation.  A few of us have had to do that so far, and apparently they had to push through our DS-261s (whatever that means) and they say we should get the invoice next week.  I also sent them an email, you could try that.  You're right, it doesn't make sense why it's taking so long. It is definitely anxiety filling waiting for a response. I would call the NVC and just ask about the document status and if anything else is required. If everything is in order just stay positive and patient. It will come through in due time. I am trying to guess when my husbands interview will be. I was hoping for an end of August interview and now I am not sure. Anyone have any estimates on when my husbands interview will be?   I ask because I was hoping to be there with my husband during his interview, so we can fly back together. However, I start school again the end of September and I must be back in the states for school. I remember reading somewhere that the paperwork that the beneficiary sends to the petitioner who then sends it to NVC cannot be older than two months. IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports	October 2013 I-130 Filers	Ok so I am so confused. I recieved an email on March 7 and then on March 10. Both emails stated that my case had been transfered to another location and it gave the dates in both of those updates on USCIS. They said...." On march 7th you case blah blah blah" and then.... " on march 10th your case blahblah". Then today I recieved another update but it didnt say the date on it. This is what it said... The I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was transferred and is now being processed at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283. IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports	NVC Filers - October 2014	Just when I thought it couldnt get worse    I got an RFE for 1864 at the same time I was able to pay for my IV package. I sent them at the same time in August and the 19th of this month is my 60 days. I just got an email today and I was so excited I thought it was going to be a case complete, but no it was another RFE for the 1864 again! Another one   Which means another 60 days  I was at work when I got it, and thank God my mom is my boss! I went and cried for maybe an hour! It means my husband will not be with me for the holidays! I am a complete mess and when I called them they told me its, because on a section there should have been a 1 to count myself for my household! BUT THE COMPUTER PUT IT THERE AUTOMATICALLY! Apparently it didnt print that way and she even told me my total number was correct    I am so depressed! I was counting on an arrival in early december and now it looks like February!   I wish they could use my original and attach it to my new one, between the two of them they are correct     Did this happen to anyone and it take less than 60 days for the RFE to go through?
