IR-1 / CR-1 Spouse Visa Process & ProceduresSuing USCIS with WOM for I-130 (19 mo delay)
QUOTE (produke @ Apr 30 2009, 10:13 AM) <{POST_SNAPBACK}>
I am sick of taking ####### from USCIS, and am thinking of suing them with writ or mandamus (WOM). I have approached my incompetent congressman, OMBUDSMAN, local feild office. All are useless and unhelpful.

My application is pending 19 months. I filed during the "rush" fiasco of summer 2007. My application has never left the Vermont center. I received a LUD in january, and then this week on a SUNDAY!!! This makes me to believe that it was just a system update, and no actual breathing USCIS worker really pulled out my application for any solid action. It was either a system backup, or random touch on applications that seems to collecting dust. The USCIS bot touches them so that they can sleep on it for another 3 months.

At first USCIS wouldnt even tell me the reason for delay, untill a couple of months ago. They finally got off their coolaid and donuts and told me that my application is pending name check. It wont move ahead untill a security clearance is provided. For a person who doesnt even have a speeding ticket, its unreasonable to prolong security check.

SO, after taking their ####### for more than year and half, I am suing them. I think i might be able to ask the court to reimburse for lawyer and fed court fee (about $2500).

I have yet to see my lawyer, but want to ask if any one here has filed a law suit against uscis and has gotten anywhere.

K-1 Fiance(e) Visa Process & ProceduresNeed phone numbers
Still waiting like everyone else in the same boat as we are... it seems that due to the #'s quote per country, and due to large filing from the Philippines.. our time is longer than most and I seen others get approved within a 2 months. I called them evry Monday and my wife is getting disappointed... the person answered the phone, she is looking the same information we are looking online, does anyone have direct number to the office? I have not yet receive any NOA 2 but some do and be touched.

Jun 2007- Met my wife to my cousin.
Oct 2007- I proposed to her online.
May 7, 2008- Flew to meet my fiancee in Cebu.
May 29, 2008- Got married @ Cafe Orchidia, Cebu
June 1-3, 2008- Went Honeymoon in Bohol Island
June 5, 2008- Flew back to the states.(USA)
June 14, 2008- Filed her I-130
June 17- 2008- Received NOA1 for I-130
June 28,2008- Check Cash
June 27, 2008- Filed I-129F
July 1, 2008- Received NOA1 for I-129F

NOTHING since then....

But I noticed some have the same time frame as we do and received NOA 2 or have been "TOUCHED", is there a direct phone line I need to call?

K-1 Fiance(e) Visa Process & ProceduresStupid Question
Because there is a regulations that certain countries needs a visa to come to the USA or vice versa. Recently, the South Korean citizens and other 5 countries can fly to USA without visa. If we let just anyone fly to USA just because they have visa, then why even have country borders or POE?

Yes, you are still US citizenship, you can stay in any country for as long as you want as long as they allowed it. Certain countries you have to pay the fine to to extend staying there. Some countries will tell you to pack up and go.

One of the best thing in that areas is that maybe possible to get a newspaper and take of pictures with you together with that paper. I do the same thing when I was in the Philippines eat mostly at home but I used my credit cards to get some type of evidence that I was there and the expences I have showns that I do feed more than one person. No there is no special forms to fill, the same as everyone else and there is no military priority either even I did back to back deployments to Iraq with a total of 30 months, they can't expedite my wife coming to USA unless I get orders again to go to Combat Zone. Heck while even bring my wife here if I won't be here in the states... is that make sense?

Yes you can visit, that will even better to do so. As far as the time frame, each country is different, if you stay longer that allowable time frame that there will be a penalty. As far as financial, right now it wont matter in I-129F but will be a factor later. Goodluck!

Yes, you can file the from K1 then K3. Just more paperworks but one fee for both if your the sponsors. I went to applied for K-1 because I married my wife in hte Philippines but then 2 weeks later I applied for K3. Wish of luck! Its not an upgade by the way you just have to file 2 different forms.

You be better off filing that in California than Vermont, if you see the threads here, Vermont taking almost twice as long as california and some of the files have been transferred to california. Then do a Change of Address later when you are settle in. California is quicker than Vermont... goodluck!

It will be better off to file your paperwork and later on when you settled in then do Change of Address. If you wait 2 more months to start your paperwork, do you know how many people file in the USCIS between now and 2 months later? It will only delay you documnents longer... GOODLUCK!

First thing you need is to make sure that you have your message archives on in your yahoo messenger for that person. Then you go to the dates and conversation, i.e. today... u look for that person you have chatted with, hit the dates of the message archives, then you can print it out or cut and paste. Goodluck! If your ym messages archive is off and everytime you logged off, ur message is not save. GOODLUCK...

Thats alot for 30-60 minutes job that you can do yourself.... then lawyers are always overcharged to pay for their luxury. Not all lawyers are the same of course, when you talked to lawyer, did you tell them to stick with you until the visa is in your hand or just to file the documents? Some lawyers adding additonla fee for different services? Wow, 2,000 give me alot less than that and I file it for you...LOL. Goodluck! I hope you pay him to go to the proces with you and able to ask question without adding additonal fee...

All lawyers charges different fee... so I hope that help a little...

Hi All,

My fiancee and I submitted a K1 back in october but we were so excited etc we filled out the forms only. We didn't realise (stupid I know) that there was other evidence that needed to be included - photo's, birth certs, statements etc.

Will we receive an RFE or will we be rejected outright?

Thanks sad.gif

You will received RFE and send it back overnight, the sooner you get it send back the sooner they will process it, I hope.... I see K! approved as little as 3 months. Anytime you have question just ask anyone here, we have the same information one work or the others.... Goodluck...ASK before sending and follow instruction every steps. If the answer is blank, write down N/A for question that is none.

So what your waiting for, get you stuff together... and you can actually starts getting the other documents you needed while waiting.

So why do they ask for bank statement? and a letter from the bank?

Hey I am in the military too, bank statesment and bank letter to verify that you have an actual account consistent with your income. How much money you need to be in the bank, as long as it shows that you have money to support yourself and 3. What I did is have all my military les for the last 6 months and it also shows there your ETS. Yes all we need is 100% above the poverty line. Show them what you have deposited monthly or bimonthly for your myPay. The rest is spends for the bills and misc stuff. Its weird because they never asked for a bank letter from me but then I used the same bank for 11 years since I have been in the military for 11 years. Godluck...AIR ASSAULT !!!

As far as I-864 EZ, I did that but alot of people here went to the USEM stated that they only take the I-864... to be safe I did I-864 instead of I-864EZ...

K-1 Fiance(e) Visa Process & ProceduresI-129FProcessing Time
QUOTE (phungv @ Apr 5 2009, 08:29 PM) <{POST_SNAPBACK}>
whistling.gif So Me and my fiance are engaged. We both filled out all the required paperwork for the I-129F package. Now for me being in the military, I got the entire package ready to be sent in. But, my fiance needed to get a copy of her passport photo. So before I got deployed, I sent her the I-129F package. She put the color photo copy of her passport in with the I-129F package and sent it off to USCIS in california to be processed. She mailed it off by January 29th, 2009. She tracked the mail and it arrived there somewhere around the 7th or 8th of FEB 2009. My fiance lives in Japan. So my question is that, will there be something wrong if she sent it from japan to california? I put my address on the form so that the NOA1 will arrive in my mailbox in hawaii if everything goes well. It has been 3 months with no word on USCIS. Is their something wrong with my package? Or is it the processing time? I wont get back to hawaii until late this april to find out if i received a NOA1 or not. But my fiance has been reading online that people are receiving their NOA1 and NOA2's after we sent our I-129F package in. So i'm assuming that their is something wrong with our paperwork. It just pains me because I dont know whats going on. crying.gif I'm praying that everything is good with our paperwork. I made 100% sure that our paperwork was ready to go with no errors. good.gif -sigh- Any feedback on this would be greatly appreciated.

Regards,
Confused Sailor unsure.gif

@@@ Confused sailor...

You stated here that you are deployed, call the military liasion in the USCIS to expedite your case so you can be a priority. All you need is an order states that you are deploying downrange. That will make it easier for you and your fiancee to process your paperwork/case.

Hey everyone:) Just a quick question. In the trip I'm planning to the Philippines, me and my fiancee at that time, are planning on "Hooking up", if you know what I mean. Unfortunitly, one of our concerns is her getting pregnant. As this is a risk when we adults play around good.gif What can we expect should this happen? Can it actually speed up the process of fiancee visa? Can it slow the process? Thanks for all your advice and imput blush.gif

@@@ Are we still little missing the high school time? We are adults here so no offense will be taken if you just use the words. LOL... That was our intentions when I went to get married is to get my wife pregnant, unfortunetly she didn't get pregnant but once she get here we have the time in the world. Is this gonna slow the case or speed up, well depends on the waiting time when you actually get your paper and approved. Once she get pregnant you can request expeditions but if you wait to long, she may not be able to fly certain time during her pregancy or post pregnancy. Goodluck!

K-1 Fiance(e) Visa Process & ProceduresWas I scammed
QUOTE (dragonboy69 @ Apr 11 2009, 12:59 PM) <{POST_SNAPBACK}>
When I was researching getting a K1 Visa in Bangkok and went to the Embassy, it was closed, but there was a man standing in front that said he worked for an agency across the street. Long story short, I ended up using this agency that is supposed to assist in getting a visa. It cost me a pretty penny... $1800 to be exact which I put on my credit card..... I thought they were saying $1800 Baht, but they were talking dollars.

In hindsight, I think I could have done everything they are doing, and saved a lot of money. But, it's too late I already paid them, and pretty much what they did so far, was fill out all the paperwork for me, which was 2 different forms, and put it in a package for me to send with a payment to Homeland Secuirty. I thought they would be submitting something in Thailand, but then I realized that the whole process starts here in the USA. I am reading people's timelines, and I see that it takes a good 4-6 months for the whole process, some longer.

I am about to submit the forms on April 13th.... I wish I had known that it was as simple as it was to fill out the forms, as I could have had this paperwork in February when I returned from Thailand to the states. Instead I waited for this agency to put it together for me, but it took a while for my fiancee to get all the appropriate documents, and then when I did get the package I was short on cash so I had to wait until I had $455 to send with the package.

My question is has anyone used one of these agencies? Do you think I was ripped off, knowing that I could do all this myself? I am not sure if having this agency will be useful later on in the process??

MAKE THE STORY SHORT, YOU ARE BEEN SUCKER TO BELIEVING THEY CAN HELP YOU BECAUSE WITH OR WITHOUT AN ATTORNEY, TIME YOU WAIT TO GET APPROVED STILL ON THE USCIS DECISIONS THEN THE NVC. IF YOU CAN READ THIS, THEN YOU MUST AS WELL DID THE FORM YOURSELF... BECAUSE NOW YOUR $ 1800 SHORT AND STILL GONANA WAIT... BE CAREFUL NEXT TIME. THATS A BIG MONEY FOR THAILAND... SOMEONE WILL BE EATING SOME GREAT FOOD FOR AWHILE LIKE A CUISNE. BE CAREFUL NEXT TIME, SEARCH AND ASK AROUND!

I will ask her more about her dad, when I talk to her tomorrow.

He died and he never done anything to get her citizenship, he was married to her mom for 31 years he died 2 years ago and she is going to be 27

@@@ Osidia, what she is trying to say is that you need meet your fiancee at least ONCE in the 2 years time or when you file for her K1.

I never met my wife in person until I married her, we have been talking for ALMOST A YEAR LONG DISTANCES AND CHAT, THEN decided to get married after I spent my time w her for 30 days. I NEVER HAVE REGRETS MARRYING HER the only regrets I have is that waiting time for VISA for her to be here. Soon I hope, soon. I offered her money for expences when we were dating but she never took cents from me because she works. So i SUPRISED her with a;lot of stuff. After I married her she will ask me if she can buy gorcery or personal stuff. I told her, your my wife, use the money for your NEEDS and we will talk what you WANTS.... she just want to be with ME! Here or in the US as long as I am with her. She quits her job for me because I told her. wow.gif

Let me clear a few things up, I didn't' pay her schooling, her dad put her through school up to the time he died an then her aunt paid, she Graduated from nursing school Last year, What I offered to pay is for her to have her final review and Final coaching an her Nursing Test so she could practice in the Phil, I made this offer she never asked anything about it. Then if she make I told her I would offer to pay for her NCLX Examination because I figured it would be easier for her to take there than here.

She has been more than upfront with me sending me Receipts of the payments to the school for her review , sending me copies of her Valid Photo Identification.

Her dad did not speak of any relation back here in the states and she does not know of any, He Was stationed in the Phil where he met her mom and they were married there, She has only been in the usa 1 time, and that was right after her dad died, she came back here and was here for one week to file paperwork and to fix for her mom to get some pension which is not much, Her mom is 68 and her Dad was 72 when he died.

She has a Valid Visa that is still good from that time and said she would like to come to the usa to see me.

I would never send money for a plane ticket, I would only purchase a non refundable ticket to her to come. if she does, but I am thinking more of going there, 1st to meet her an her mom.

Where I also feel since her dad was an American Citizen that , would be the way to approach getting her here in the USA The whole time her dad was Married he never once came back to the usa and he never talked much about it.

But you can tell by her photos and her Id that she is Half American and Half Filipino.

Thanks for your Help Steve

@@@ Since her dad died and didnt petition her then she will have time getting petition by a dead dad. If the main petitioner file for someone, that petitioner happen to die during the process, the petition itself died. She can try tio get a humanitarian process but even with that will be hard to get it too.

K-1 Fiance(e) Visa Process & ProceduresHelp with best way to bring filipina to the usa
QUOTE (osioda @ Apr 13 2009, 10:25 AM) <{POST_SNAPBACK}>
Hi I am very new to this and have a few questions on the best way to bring a girl here to the usa, we are wanting to marry, but here are the things to consider, She has went to school to be a nurse, she is in the process now of passing her boards there to practice in the Phil, she wants to continue and get her license to work here in the usa so it will require taking the NCLEX and she can do it there which I say is better.

Now she already has a visa that will allow her to stay in the usa for 6 months she has been here before , 2 years ago but I did not know her then,
Her dad was american but he died and this is the reason she came to the usa was to do paperwork about his death. (he lived in the Phil with her and her mom)

Which way would be best to marry and the best way of getting her Immigration here in the usa.

Here are the choices.

1. She comes over on her Visa and we marry, but it is good for 6 months?
Better off to get her a fiancee visa then marry in the US, its quickier.

2 We try and get her a work visa here in the usa and then marry why she is here?
If you do that, then she will have to come back to PHILIPPINES and then you can file the I-130

3. We apply for a fiancee Visa I believe is k-1
I go with # 3 beacause its quicker result than CR1, then marry her in the USA.

4. We Marry in the Phil and then try to bring her here?
This will take longer as you are now filing for I-130, stick with the fiancee visa... BUT ITS YOUR CHOICE....

Now the next question is I am a Farmer, I do not make alot of money that shows on my tax forms cause of the way I work and my investment back into the farm. Do they go by gross or the end line on how what you make and will I run into problems. if it is not much?

Its your annual income they goes with, i.e. what you file in your Income Tax the last 3 years.

I make enough to support myself and her with out problem I have my own home only thing would be insurance, but I am hoping that when she comes here she will be able to get a job that will get insurance for both of us.

With K1 visa she can't get a job right away, you will have to file AOS, be ready to shred about 1400, then she can get job/work legally.

I am paying her way through to take her test to get her license now also. to show support for her.

I appreciate any help you can give me and hope you can understand my post ok. Thanks Steve

K-1 Fiance(e) Visa Process & ProceduresRequest for Evidence
QUOTE (A1C Leslie @ Apr 21 2009, 06:46 PM) <{POST_SNAPBACK}>
I apologize. What I meant was, I received an I-797, request for initial evidence. It stated that I had forgotten to awnser a question. The question is not my concern however. At the top of the I-797, Request for Evidence, it states that it was originally mailed on Mar 13, 2009. This was after I had just PCSed (moved to a new base). I had no address to give them, because my new mailing address was not on my orders. Instead, I had to first inprocess with my new base, then get the new mailing address. From there, I called USCIS, and changed my address online at their website. They told me that because the 10 day wait period was not up, I'd have to wait to request the mail again after the 10 day period. After the 10 day period, I called, they told me they'd send the letter again. And so they did. However, they remailed it ON April 15th, 2009. The due date for me to return this letter with the missing evidence was April 15, 2009. It is now, obviously, April 21st 2009. Would they cancel my package over this? I was wondering what the consequences of sending it now would be.

Or hoping that it may just be a mistake and the date wasn't changed.

Thank you.

A1C Leslie.

When you PCSed to another base as I did few times, in your orders you have a forwarding address as you inproccessed. You could have used that address and they will find you in the base as you processed on Day 1. The best way is to call them again, tell them that you are in the armed forces and enroute to your new location. Call the Armed Forces liasion in the USCIS and someone there will help you out. Trying to talk to civilian that doesnt know nothing about military is sometimes difficult. Goodluck "AIR". If you have orders to go downrange or overseas they can expedite your case!

K-1 Fiance(e) Visa Process & ProceduresI'm new to this and need advice!
QUOTE (Nicole526 @ Apr 21 2009, 12:19 PM) <{POST_SNAPBACK}>
Hello Everyone! Thanks you in advance for taking th time to read this and helping out if you can. My boyfriend came here from Guatemala in 1999. He was deported in 2000 and returned illegally in 2001. I don't need immigration lectures so please only helpful advice thanks! Anyway, we have a child together and want to get married. We saw a lawyer and she said get married here and we will apply for the waiver. I was always under the immpression we should marry in Guatemala, but the lawyer said it doesn't really matter. She said she has always been approved, but my big fear is that he will go to Guatemala and not be able to return. I am so terrified of this. I am willing to go to Guatemala for awhile to be with him, but because of my daughter and all I have heard about Guatemala lately I am terrified of this also. Anyone know how long he will have to stay there and if there is a chance he won't be allowed to come back??

We want to do whats right but I am scared of losing him.

@@@ Both of you stay in the states as if he retunrs to Guatamala, he is ban from entering the states for at least 10 years due to the deportation and now here illegally. Get a 2nd opinion from other immigrant lawyers that have experienced on deportation issues. Goodluck!

K-1 Fiance(e) Visa Process & ProceduresReally worried now
QUOTE (Victor&Cory @ Apr 21 2009, 12:29 PM) <{POST_SNAPBACK}>
I sent the I-129F last Thursday by FedEx. According to their site and using the tracking number it was delivered next day at 10:30 AM. Today I wanted to print the receipt where it shows the signature of the one who got my package, somebody called A.Stanley. All ok until that part. By checking the printout I notice that the package was delivered to a place called St. Jebans instead of St. Albans. I wrote the delivery address correctly so I don't know how this happened. And after a search I didn't find a place called St. Jebans in Vermont.

Probably I'm being mighty ignorant here but I sure am worried. Did Fedex probably sent the package to the wrong address or is it maybe a typo on their website? Any help would be greatly appreciated. Thanks

PEACE.....

@@@ Its misprint... STANLEY also signed for my documnets, I am now waiting for wife flight here to US. Shes done!

QUOTE (atouloute @ Jun 24 2009, 08:27 PM) <{POST_SNAPBACK}>
Hello everyone

I know you knowledgeable folks will be able to help me answer this question. My fiance has a c1B visa and a B2 visa; we applied for the K1 visa we wanted to know would he be denied because of the C1b visa also known as a crewmen visa or the B2?

Thank you for your answers

The only thing I can see that might be an issues is that it will raise RED FLAGS in the immigration. Crewman visa is limited within the port per location, also when crewman have what we call a Leisure pass- to go downtown or visit stores to buy some souvenirs, they have to be back in certain times. As far as being denied thats for the immigration to do their invistagations, ie... did he ever extend his visit if he stopped in other countries or did he make the reporting time? There are more factors to these than just denying it... goodluck!

no comments guys?

As far as I know, you can either get another co sponsor to meet the minimun requirements which is alot easier too. Yes you can add your assets as an additonal income as long as it is solid. For example, savings account, if you owned a house, anything pertaining to any type of finascial support. It will RAISE some red flags though but hopefully it will help. If you follow the instruction there are lines there where you can add additional assets to be consider as a finacial evidence. I hope this help a little..., you can always call NVC for quick info and ask them! Goodluck!
