IR-1 / CR-1 Spouse Visa Process & ProceduresRecent I-130 approvals for January!
NOA2 got emailed to me by CRIS. When do I call the NVC and see if my packets get mail to embassy in PHILS... since I got the APPROVED notice, what can I do while waiting for my wife... is there anything here in the stateside I can do to expedite my wife to get here. I mean 7 months without her is long enough... I will go with I-130 eventhough both I-130 and I-129F have been approved.

IR-1 / CR-1 Spouse Visa Process & ProceduresLost Divorce Certificate
QUOTE (tysalanna @ Mar 6 2009, 07:14 PM) <{POST_SNAPBACK}>
My spouse in the US sent request for his divorce certificate from the State of Utah and they replied with that they have no record of it. He said he used to have a copy and remembers signing it. He remarried and divorced after his first marriage and now we are married. (I know, not a good track record, but we are making this one last forever.) So does anyone have any suggestions of what we might do?

Should he file for divorce again even though he knows he was legally divorced before? And if that was the case, then is his second marriage void? What about our current marriage?

IN DIVORCE, BOTH PERSON WILL HAVE COPIES OF THEIR DIVORCE DECREE. TELL HIM TO NICELY ASK HIS EX IF HE CAN LET HIM BORROW OR HAVE CERTIFIED COPY OF THE DIVORCE DECREE. IF HE REMEMBER THE COURT APPROVED THE DIVORCE HE CAN ALSO CALL THAT PERSON BECAUSE THEY HAVE TO TRACK THEIR RECORD TOO. GOODLUCK... !

There is no knowing of how booked they are ONLINE but usually if someonce CANCELLED their appointment whoever next online get that slot, even with that you really don't know. They gave youu date to call back, it wont hurt to call them few days earlier.... Goodluck!

I know there are a number of people who have their cases completed before me, waiting for an interview at the Mumbai consulate, I hope they can squeeze me in for April. Hopefully we all find out early next week.

Q,
I am sure you'll be in april interview batch as well. I dont see why they wont giving you april interview date even though there are many waiting for interview date from last month. For me personally I dont care what april interview date I get since I already have march interview date for k3 which I'll be using to obtain CR1.

Good luck to all who are still waiting for interview date.

@@@ WAIT....

You have March Interviews for your K-3, thats good news, converting to CR1 interviews... okay for you to do that have the NVC forwarded your CR1 packet to your consulate. For them to convert it to CR1 interviews, they need to have your case and for them to review. They will not convert that to CR1 interview if they don't have your case in front of them. So call NVC and ask them nicely if they can FORWARD your CR1 package to your consulate in time for you K3 interview. THEN you can convert your K3 tro CR1 interview..GOODLUCK and we will be hearing from you soon!

@@@ SONIA

Before you jump the gun be advice that every country INTERVIEWS is base upon the space availability. Some countries may have opening next month and some doesn't. Each consulate do work with the NVC as far as making interview appointment. So for those that have it... good for us and for some tyhat doesn't have it... hang in there. If for some reason someone cancelled their appointment, the slot is available for the next case in line but we have no knowing of that... So I hope everyone have interviews by APRIL... as far as I know the PHILIPPINES consulate is already fill up to.

Alrighty...this is great that everyone is getting interviews and everything, but can you be a little more specific as to how you got it?
-Did you call NVC? If not, who did you call?
-How long after your "case completed" did you call?

smile.gif

@@@ Moosker @@@

I read that someone called the NVC and cheked his timeline, it shows there that his NVC Completed a week earlier and got an appointment for the interview. Then I saw MMW, I know their case was completed on 26th and mine was the 25th so I figure it they got a date on April 30, then I should have one. So I called the LIVE OPERATOR in the morning and called again in the evening (27th FEB) and my Interview was scheduled on the 21st of APRIL in the morning. My CASE WAS COMPLETED ON THE 25TH FEB, 27TH FEB I ALREADY HAVE AN INTERVIEWS SET FOR ME. On top of that today I received a letter from Consulate to set an interview for my K3 in which I will disregard as I paid the $ 470.00 already for CR1. The mistake they made, the Consulate, is that the letter suppose to be sending to my wife in Manila then I get a copy. It was dated 12 FEB but I just now received it...oh well! So even they tell you to call 4-6 weeks later, it wont hurt to call the next day, all they can say is "NO". Then try again the next day...

What type of visa did you apply for. For the "K" types NVC forwards the package to the Embassy which will schedule the interview. For the I-130 type visas it is NVC that schedules based off availability info from the Embassy. hope this answers your question.

NVC can be contacted by calling (603) 334-0700

@@@ MMW, did u received letter from the US Embassy in regards to get your K-3 Interview? I am going to bypass that interview and not to worry about it due to the facts thast I have a CR1 Interviews already. this shouldn't hurt our case anyway, AFTER all I already PAID the NVC of $ 470.00. Are you going to not worry about ur K3 interview either.. i think its .99 cents poer mintue calling them for an appointment?

You can get a certified copy of that and have it notorized. The NVC will also returned you the ORIGINAL once interview is completed. Here is an example of my interview letter. It will states there that they have your paperwork or you will need to bring it to the interview.

@@@ You can send both idf you want too make sure is certified to. One thing is make sure there is NO DISCREPENCIES on both forms, ( for example...your middle initial is R and the other one it shows F) that will be request a RFE until you have it fix. Make copis of everything and everything need tobe notorized. NSO BC as long as they can read ur name, dob and place of birth and information is about you I will send that one instead... ONCE again make sure info in civil and nso are per batum... goodluck, ur getting there!

As far as getting PCC, I will get one from every place you stayed even for just the school to cover all corners. My wife live in Cebu... she live in Looc because they have no more room for her in her sister house when her husband went home for a break. Then she lived with her brother before I met her...which is in Kamputhaw Cebu address and now she is staying at Hillside Talamban... all of those are in Cebu within 30 mins drive with traffic... but I still provided the PCC to all 3 due to the facts that I used all 3 of them when we initiated the I-130. CHANGE OF address... pcc ALL 3!

Okay, you may want to try to hurry which the hurry can delay your process if ur midssing something. Send every documents you have certified or true copy. If your missing something, it will only delay your case. If ur divorce, u need the divorce decree, cenomar or cemar ( certified of not married or certified of married ), don't do half job as it will DELAY your case.... also dont forget to include your Coversheet and coverhead as it make it easier for the staff to review, here is an example... goodluck...

death of someone
medical conditions on avail basis
if spouse is a member of the armed forces ready to deploy, need a copy of deployment order....

Well if it's any comfort at all we got the same response about our interview date in Montreal! I don't have any advice but I do feel your pain, you have been waiting 3 weeks longer than I. The embassy may give you some information, at the very least you will feel as though you are doing something. But don't give up. I know that some filers were still receiving interview dates through the last week of February so perhaps we may still hear something next week.

**** For ABA....

I am so sorry to hear that, unfortunetly the NVC operator you talked to is not the same people that make the interviews date, NVC operators check computer for any information pertaining to you... like a customer service in the mall... they can't really tell you much. You need to call the SUPERVISOR that did your case and ask for an explanation...not the NVC Operator...( they are like phone operator, they just there to hook ur lines ). Go ask if you can talk to a SUPERVISOR handling your case.... they may give you more info than the NVC operator... goodluck!

Hello!

We were atlast happy on Dec 18, 2008, that our case got approved after 10 long months of waiting...and we were so enthusiastically prepared for the NVC procedure! But VSC instead of posting the papers to NVC sent them to some National Recording Center (NRC) - by mistake as they say...for 2+ months after approval we were not able to get any response for NVC (obviously) and we were just so confused as to what might have happened...My husband wrote atlast to some congresswoman there in US and she helped us out with this thing by finding out that our case never reached NVC, instead VSC sent it to some NRC!!! Now how can they do this to us?!!! i mean this is no small mistake...our three months were wasted! It has been more than an year now since we filed and do not even have my case reached NVC crying.gif it s soo very painful! Thank god we also had I129...and that also has taken an year now...i think i would get a date for my K3 interview in somewhere around the end of may...

so what should we do? are there any chances of our case I130 getting completed before my K3 interview in end of may and if yes how?!! are there any chance of converting the K3 interview into an Ir1/CR1 interview?!!

Thanks

Usually the CR process can be completed in less than 3 weeks if you overnight everything and pay everything online providing there is no RFE. Then they will make u an appointment once is completed.
You can convert the K3 interviews to CR1 interviews providing the CR case is completed and was sent to your consulate. You can ask the NVC to send your completed CR case to EMBASSY as soon as possible and explain them why. It usually takes about 2-3 days once ur case is completed to forward to the embasy. When you have your K3 interviews just tell them that the NVC sent your CR packet if they can convert that interview to your CR. They will look in their computer and see if your case is in the embassy and will pull ur CR case/file instead of your K3 case/file. I hope this helps....sorry to hear about the MISHAP>>>

IR-1 / CR-1 Spouse Visa Process & Proceduresmy interview experience at USEM
QUOTE (lecy @ Feb 12 2009, 09:45 AM) <{POST_SNAPBACK}>
My interview experience at USEM

I’m sharing my experience for the benefits of those who are going to have their interview… hope it helps…

One month before my schedule date, my husband received my appointment letter… from then on, my stomach was filled with little butterflies, and my heart beat faster every time I think of my interview…

So I had four weeks before my interview;

I spent my first week for my medical.

During my second and third week it “project making”. My project making was preparing for my documents… I used 2 ¼’s cartolina (paste it together to make it hard but still flexible to pass through window) as back cover (with different colors) and “extra plastic slot” (don’t know the term, I brought it at bookshop, with hole on the side of it) and fastened it with round fastener…

Folder 1: yellow folder for my identification documents, BC, MC, CENMAR, NBI, POLICE CLEARANCES anything about me… (Yellow is my favorite color) hehe

Folder2: blue folder for my husband’s identification documents, BC, MC, CENMAR, PASSPORT (copy), NATURALIZATION CERTIFICATE, EMPLOYMENT LETTER…

Folder3: green folder for my husbands tax: ITR, 1040EZ, W-2…

Folder4&5 are proof of ongoing relationship:
Folder4: pink folder: emails, yahoo screen shots, call history, wedding invitations, wedding cards (from guests)

Folder5: bank accounts, account statement (showing his remittances), joint affidavit from witnesses (they are our godparents), copy of airline tickets, passport stamps.

Folder 6&7 are pictures:
Folder 6: red folder: picture of my husband and I together with our friends, family. (Note: I took only one photo per place, ex. Baguio, Ilocos Norte, Biak na Bato)

Folder 7: red folder: our wedding pictures… I scanned our wedding pictures because our original album is too thick (6inches!) but I brought it though for backup…

PLASTIC ENVELOPE no.1 – ATM receipts. (advantage: they can easily see what’s inside, no need to open it, very visible and easily pass through the window slot)

PLASTIC ENVELOPE no.2 – PHONE BILLS

PLASTIC ENVELOPE no. 3 – OLD CARDS

PLASTIC ENVELOPE no.4 – snail mail and postal envelope and receipts.

And my last week before my interview date was:

I spent my week on reviewing, reading forums, reading others experiences and most especially I spent my time, reading bible, attending religious gathering, praying a lot, preparing my mind, my heart and my soul for the coming interview… I ask God to give me presence of mind and help me to focus on my business…. I also prepare myself for any possibilities and ACCEPT it… whatever it is… ACCEPT IT. My husband told me that: Whatever happen its God’s will! Amen.

And its very effective… all the butterflies are gone, heartbeat is normal, God gave me presence of mind and alertness. I never felt nervous during the whole process of interview and that’s because of God.

And while waiting for my number to be flash, I’m assisting senior citizens around me that their numbers are flashing and guiding them to the proper window… hehe. What a great feeling helping our lolas… grandmas

One grandma beside me was holding her chest, she had difficulty on breathing because she’s nervous, I calm her by saying it’s okay, that nothing to worry about, etc. etc… and I feel much better calming her.. lol.

Answered prayer: I also ask God to give me kind and nice pre-screener and CO… and indeed they were sooooo kind… I also ask God to sent me an angel and God sent angel for me… my Filipina pre-screener is very beautiful, angelic face, she’s smiling and she’s impress with my docs… especially when I gave my husbands 2008 ITR, she didn’t expect that (gee, everyday I ask my husband to file for his recent tax. Hehehe) when I gave her tax 2008 she said: “oooohhhhhh, he had his 2008!” She asks me questions about “history” of our relationship… etc. etc.

The very first doc she asks was REMITTANCES! When I gave her my atm receipts she said again: “ooohhhh, atm receipts!” then asks for our pictures… she said, okay these are enough, but she saw my PLDT bill that’s why she asks the telephone bill too…

Before I leave the window, I said: “thank you Madame, have a NICE day!” she laugh and said “oh! Thank you. Same to you! GOOD LUCK!”

After that, I saw my number flashing again for CO interview: very light feeling again, very jolly and calm… Once I enter the room, he greeted me,
CO: MAGANDANG UMAGA POH!
Lecy: Oh! Magandang umaga din po!
CO: Anong gusto mo? Tagalog or English? (smiling)
Lecy: (laugh) tagalog, sir. (smile)
CO: (laugh) itaas ang kanang kamay… etc. etc. na magsasabi ng katotohanan lamang?
Lecy: OPO
CO: OPO! (laugh again)
CO: what’s your name?
CO: your birthday
CO: who’s petitioning you?

IR-1 / CR-1 Spouse Visa Process & ProceduresRFE`s CR1/NVC
My RFE was easy one though... actually I got 2 of them. One is their fault... yes I do blame them as they even admitted it... i sent the papers but they didn't check it very carefully. I asked for a suprvisor to review my case, granted, the paper was there. 2nd one, while they reviewing it, I accidently sent the copy BC from NSO instead of the one from NSO. So I sent it overnight express but the case was closed already, I spent $ 17.50 for nothing. Case was closed and the BC from NSO will be ask when my wifes go to the consulate. The one I sent overnight I never got it back. USEM sent me a letter stating to make sure I got the BC from NSO on her interviews...Original/Certified BC- acquire for an interview.... so NVC and I are even...lol! CR1..

Anyone who's had their petition handled by VCS, please advice how long it took from start to finish.

Thanks

It all depends in your case, most of us went to VSC took about 9-10 months and addtional 2 months from the NVC and 2 more months to wait for the interview. It really all depends in your case, I seen few people here was done in 2 months but most average 8 months... expect the worst and hope for the best... Goodluck!

IR-1 / CR-1 Spouse Visa Process & ProceduresDocuments Required for CR1 Interview
QUOTE (Arthur Roberta @ Mar 23 2009, 04:47 PM) <{POST_SNAPBACK}>
I would be grateful if we could be advised as to exactly what original documents are required for the CR 1 interview?

As we shall send the original birth marriage divorce etc certificates and copies to NVC on approval of our I 130, do we need the same original documents to accompany the beneficiary at the interview? and if so what documents?

There just seems such a plethora of documents to produce and we would like to compile them in plenty of time. By the way an NOA 2 would be kind of useful as well Ha!

Best wishes everyone good.gif

Arthur and Roberta

Most of the originals will be send to the NVC as you already mentioned. Make a copies and have it certified before you send it to the NVC. AN extra copy wont hurt just in case they misplace your files. Originals will be return to you when you do your interview. Goodluck!

QUOTE (Steve_and_Lina @ Mar 29 2009, 03:30 PM) <{POST_SNAPBACK}>
Hello everyone. I am a little unclear on some of the specifics of the CR-1.

Assuming my wife and stepkid's applications are approved, I know they must enter the US within 6 months and that we will also have to file before our 2nd anniversary to remove the conditional status.

What I am unclear on is:
  1. With the K3, she can enter/exit the US at will. Can she do the same with the K3?
  2. If we were to visit a 3rd country, would she have to get a visa through Russia or could she travel as a conditional US resident? I am thinking specifically of visiting Europe. As a Russian, she needs a visa.

K3 visa is beteen the USA and Russia with multi entry, anything other those country you will have to request visitors visa for that country you are visiting. Certain countries you don't need a VISA if staying a short time. Before you visit whatever country you plan to visit, google it and see if you need visa from them because you dont wanna get stuck there!

IR-1 / CR-1 Spouse Visa Process & ProceduresNeed help with NVC and Embassy(Jamaica) process for cancelling:
QUOTE (sweetness @ Apr 1 2009, 09:33 AM) <{POST_SNAPBACK}>
Hello- hope everyone is keeping the faith and going on strong

Our case is near complete from the NVC and soon will be forwarded to the embassy in Jamaica according to the NVC agent. I was advised by the agent from the NVC to contact the embassy and asked their procedure on how to abandon the K3 visa because we decided to wait on the I130visa process, which should be soon. The NVC is just waiting on the computer generated birth certificate, apparently Jamaica change/upgraded their format on bc.

I have emailed KNGSTN ( Jamaica) embassy 3 x's asking them their procedure and they email me back with this response: tell your spouse to come on april 14 at 1pm to pick up his K3 packet and wait for the immigrant visa interview. I don't get it am I not making myself clear to them or what? We shouldn't need the K3 packet if we are going forward with the immigrant visa. Should we take that opportunity to ask in person and present the waiver packet or what, I don't want to delay or confuse the process. Any suggestions?

Our attorney has even emailed them and asked their procedure to present the waiver packet and they responded the same way. What should we do? We been approved since October 2007 and now down to the final process. Once NVC receive the upgraded birth certificate the case will be complete and on with the next step. wacko.gif

JUST IGNORE IT, ITS NOT GOING TO HURT YOUR CR1/IR1 VISA... WHAT YOU CAN DO IS MAKE APPT FOR YOUR K3 AND IF THE IR1/CR1 COMPLETED YOU CAN CONVERTED THE K3 INTERVIEW FOR YOUR CRI/IR1.... ALOT OF US HERE IN VJS COMPLETELY IGNORED OUR K3 PROCEDURES AS YOU HAVE ONE YEAR TO FINISH IT. WE WENT WITH CR1/IR1, NO NEED TO DO ANYTHING TO K3 IF YOU DONT WANT!

IR-1 / CR-1 Spouse Visa Process & ProceduresCR1 Visa approved!!!!

Hello Everyone,

My Wife’s CR1 VISA APPROVED!!!!!! I would like to Thank Visa Journey and everyone who have helped me throughout this visa process. I also like to thank the creator of LingChe’s shortcut and Loto’s guide, without this guides I don’t think it would be possible to finish this journey this quickly. Following is my wife’s visa experience at Mumbai consulate.

On March 30, 2009 my wife’s CR1 visa was approved!!!! She arrived at VFS at 6:15am. The Stars and Stripes Lounge was closed at this time and she waited outside with a large group of people all having their interview that day. Finally at approximately 6:50am Stars & Stripes opened and she went inside to deposit her purse and mobile phone in a locker, because you are not allowed to take such items into the consulate. Then she got on the shuttle bus at 7:20am that took her directly to the Consulate at about 7:35am. She then went through a security checkpoint and then got inside the consulate at 7:50am. My wife went inside and an Indian officer gave her originals back and asked for VFS receipt. The officer returned the VFS receipt back to my wife along with a token. Then within 20mins they took her fingerprints and asked for original interview letter for K3 and CR1. This is where my wife told them to process CR1 visa instead of K3. Then at 9:30am they called her name for the interview with the American officer. The interviewer asked if she wanted a translator...she did but she gave interview in English. My wife took an oath (to tell the truth). Then the (female) American officer asked the following questions:

Who is your petitioner?
What is his name?
How did you meet your husband?
What is your marriage date?
Who filed for your husband?
How long has he been in the US?
What does your husband do in US?
What is his employer name?
Why do you thing your marriage will last?
What did you see in your husband?
Where does your husband stay in US?
Does your husband have any siblings?
Are they married?
Where do they stay in US?

Then American lady officer saw our whole wedding album, honeymoon pictures, other ceremony pictures and asked my wife to identify where is your in-laws in the album.

The interview was over within 10 minutes. The American lady officer didn't ask to see phone call record or any other proof of relationship, nor did she ask for any additional documents. The officer was polite and nice during the interview.

Then the officer said "CONGRATULATIONS. YOUR VISA IS APPROVED. We will courier your visa within few days. Then my wife went back to VFS office to collect her stuff and asked them if she can pick up the visa in the evening.

Then later that day my wife went to the VFS office between 5 PM to 6 PM. They asked for Identification and the VFS receipt to pick up the Visa. VISA received!!!!!!

Once again Thank you to all VJ members for the great information & help provided through out this immigration process.

Best of luck to all of you!

CONGRATS, ONE LESS STEP AWAY !!!

I won't recommend the USPS route because most of these immigration docs have "Return to Sender" stamped on it hence USPS never forwards the mail but in fact sends it back to them with your forwarding address and then they send it to you. It happened to me and it delayed my process for a long time so dun count on that.

The best thing to do is keep calling NVC to check if the case number has been assigned, as soon as they assign the case #, they will verify the address with you and you can change it right away- I applied for I-130 in 2006 but my I-130 was approved on March 20th 2009, NVC recieved it with the address that I applied from, even though I changed it with the USCIS, but good thing I was able to change the address as soon as they assigned the case number!

In short, keep calling NVC and do it on phone right away! :-)

GOOD CALL..I agree....keep calling NVC and after they issue your case # proceed to update your new address...do it with a LIVE rep...

LIVE REP will not change your address while talking to them. You have to have an e-mail or letter forwarded to them. They got my birthdate wrong in my K3 case but on the CR1 case was right and I told her what cant she just change it right there while she was reading it berbantum because she was looking at the same information except for whoever entered my birthdate didnt do it right. So she told me I have to send her a letter, copy of my ID card, birth certificate and passport EVENTHOUGH all the info on my K3 and CR1 are the same yet she cant do 2 seconds of her time to get it right in that comp she is reading in front of her. So much for saving the tree uh?

Hi Everyone,

My husband had his interview for the K3 about 2 weeks ago and we recently contacted the consulate who said that they should be calling him for his passport this coming week. The interview for the CR1 was set for May 14th, we keep going back and forth on wanting to wait for that since it will offer more possibilities once he is here.

How does this work, if he receives the visa for the K3 can he just go interview for the CR1 too? Are they able to change it?

@@@ Go with the CR1 visa, once you in the embassy after your interview you can tell them that you can abandoned the K1 visa regardless that you already have it, they will go to the computer and cancelled your K1 visa and get your CR1 visa. DO NOT CANCEL THE VISA UNTIL THE CR1 WAS APRROVED. The down side is that the $ 131.00 you paid is nonrefundable. You could easily wait 2 weeks because thats most of us did, is THAT WE trash the K3 and went with the CR1. You must have money to burn, put it this way at least you don't have to fly back for your CR1 visa, just wait until you get it there. GOODLUCK!!!

just got home from the embassy. soo freaking tired. i'd been through the same steps like those petitioned for K1 visa.

PRE-SCREENER'S QUESTIONS:
What is your name?
Who is your petitioner?
How old are you?
How old is your petitioner?
What does he do and who he works for?
How many years you teach Taekwondo?

CO QUESTIONS:
What's your name? XXX
Who petitioned you? (my awesome man's name)
What are your ages? I am 24 and he's 30. CO: that is just right! good.gif *and he gave me a big smile*
Where did you meet? XXX
What does he do now he is out of military? (i told him my fiance's job position)
Who does he work for? i said DHS and he said, WOW! good.gif
Do you have any idea what US Department of Homeland Security do? Does your fiance told you? I said yes, it's responsible of protecting the territory of the U.S. from terrorist attacks. And the CO said, That's very good!
What did you do when he was here?
When did he propose? Can i see the engagement ring? CO: What a beautiful ring!
*Showing me of our pics together* Is this the lucky & blessed guy?
Where does he live? What State?

And then he said, there are no problems with your documents. You both are blessed and lucky. Good luck on your journey and say hello to your fiance for me. And tell him he's such a lucky guy. Your visa is approved and you will receive it in a couple of days. Just wait outside for your number to be called. And at that point, i was on cloud 9... i do not know if i will cry & jump at the same time cause of too much happiness LoL. Oh, i kept on saying Thank You to the CO cause he look so very happy for us and we talked like just buddies that did not see each other for a long time. LoL. I really did not feel it was an interview. biggrin.gif

Now, it's time to take nap and I will talk to my wonderful man & soon to be in-laws in a few hours. Thank God this loooong wait is over. Can't wait to hang out with his family and friends. And his friends will throw a party for me. Woot-woot!

Thanks to all who said prayers and showered luck dusts to me.
