Ahh yes... though I knew I needed it, I forgot to include the letter of intent that she needs to sign and date in my post.

Yes, I did go through the K-1 Flowchart and Guide. This is how I knew what forms I needed and other items, etc.

Since my fiancee has never been married and has no kids, there really are no documents in the initial I-129F package that will be in a foreign language. I do not see where it mentions to include a birth certificate of my foreign fiancee. It just says I must send a copy of my birth certificate front and back or alternative paperwork to prove my citezenship.

After wasting a month saving up for the $1500 an attorney said he would need to perform my K-1 Visa petition I come across VisaJurney.com. WOW! Very helpful and informative. So help me feel good...

1. I am making a sane decision to make the petition on my own rather than pay an attorney $1500 to tell me to gather the same paperwork the K-1 Visa Guide tells me to gather, right?

2. I see posts mentioning translated documents for the I-129F petition. Other than evidence of seeing eachother (I have many papers and receipts in English) what else is going to be in the initial petition that is in another language?

3. Other than 2 passport photos and FOUR signed and filled out G-325A Biographic Forms, is there anything else that my colombian fiancee needs to sign and provide for the initial filling of the I-129F?

4. Am I ok with thinking I can fill out all the information on the I-129F and the G-325A forms that pertain to my fiancee and then just mail her the documents to sign and date? She can then return those signed documents and her passport photos and I can complete the entire package and wait for NOA1.

Thank you so much for all of your posts and experience. I hope that after my Visa Journey I will be able to help someone avoid making a mistake like paying $1500 or more for someone else to do exactly what they can do themselves.

Well I meant you can still make out the official seal when you make a dark photocopy. In other words my US BC looks pretty fake as a copy. So the question was has anyone ever gotten held up because of the US BC.

Ok, I have a similar question.

I recently requested a certified copy of my Birth Certificate (BC) and on the BC it has stamped 25 AUG 05. I noticed that on the copy it no longer has an embossed state seal.

I am thinking of including this original in the I-129F packet because the back of the form is blank and being there is no raised seal they may not like just a plain photocopy. I can always request another certified copy later for my own records.

Question is...

Anyone ever get a RFE using a copy of a BC and what was it they REALLY wanted to see? Were they looking for a raised seal?

I don't understand why California will not transfer some of their case load to Vermont. A 4 month backlog in California is ridiculous. Why can't the Service Centers share the load? Instead, they share nothing and those of us stuck in California's Svc Cntr can only wait. I never hear of a case that gets transferred to Vermont! Sorry, I'm just frustrated and needed to vent!


Actually I could have sworn I used to see different dates for each service center prior to IMBRA going into effect in March where they each took care of their own I-129F petitions.

It would make sense to me that due to the new RFE to comply with IMBRA (which I thought the 3 stupid questions was lame for all the comotion it created) they consolidated all the petitions to one service center until they were ready to roll out the RFE.

At this point I think after they receive back the completed IMBRA RFE they would send the petitions back to the originating service center for the actual approval process. This ofcourse would make far too much sense, but I hope someelse besides lil ol' me thought of doing that.

We can confirm this once people with NOA1s after FEB 15th start getting NOA2s and looking to see which service center it came from. California or their original service center. Ofcourse those living in the California service area can't help figure this one out.

I don't see where everyone is getting confused and why they would think that the following email/case status change would mean they are approved (NOA2).

Actually, you've got your facts a bit wrong. The movement of NSC petitions to CSC was unrelated to IMBRA. They had already put into action a plan to make CSC and VSC the two service centers handling K1 petitions in an effort to have centers that are "specialists" in different types of visa applications. I highly doubt that they will continue to process K1s out of NSC since this was a USCIS initiative.

Since CSC handles neighboring states that are much larger than the East Coast states, simply based on sheer population they handle more petitions. But that doesn't explain why they don't have a larger, more competent staff!

And yes, regardless they should have had some forethought and created more positions to handle the already large work load as well as all the new work coming from the other centers.

Ok here is some more information that you guys need to take into account.

All the petitions got moved to CSC BECAUSE of the IMBRA thing. Now I don't know if they will continue to keep all the I-129F petitions going to CSC first, but it is my opinion that after they get past the initial onslaught of petitions after March 6th and prior to June 30th that they will in the future be handled at the respective centers.

As for the petitions being handled faster in Vermont and Nebraska centers... Think about it. It is not just recently that California and Texas take forever... it has always been that way. And why not?

Face it ... Hispanics are the largest group entering the US. howmany hispanics you think are looking to enter the US and live in the Vermont and Nebraska service center areas??? Sorry... Texas and California are top of the list. That is why it is taking longer for those centers.

As for any petitions that were put in after March 6th, but still got approved. USCIS admitted that they let a few sneak by after March 6th without IMBRA and many people here complained about getting their appointment getting revoked and paperwork getting sent back from the Emabssy to the California service center. BUt in your example the petition that made it through was from NSC or VSC so it would make sense that because those center move so much quicker that the interview was completed and VISA approved prior to the USCIS realizing they let a few apps slip by without IMBRA paperwork.

Actually, preliminary processing for cases that arrived at CSC/NSC/TSC in March certainly should mean that adjudication was FINISHED before they sent the RFE - since it took them months to actually develop that ridiculous form with no checkboxes to indicate NO as an answer!!!


I'm glad I am not the only one that thought that IMBRA REF was a freakin' joke. I circled all the checkboxes with one circle and wrote N/A next to it. Can't believe no one thought, "What do people mark if they aren't a 'bad' person?" Wonder how many will not write in anything and send it back...

You don't have a current Timeline created... But if you have started the K-1 process. Why go and get married? Just wait it out and get married once both of your are here in the States. No need to make things harder.

I would not worry about a conviction in itself. As some people in the past have said. It is important to know what the conviction was for. Was it anything to do with physical violence? Sexual in nature? Anything like what is specifically mentioned within the IMBRA lawyer jargon. Then definitely get a lawyer to help with questions for sure.

I myself have a felony conviction from about 8 years ago. It has not impeded anythign that I have done with work which includes entering public and low security sections of a High Explosive and Nuclear Storage Facility for the Department of Energy and Department of Defense. I am also able to enter public schools to turn a wrench with kids around and no supervision. Heh... If it hasn't stopped any of those things I seriously doubt it will impede the Visa process.

By the way the actual deed was a theft that carried a maximum sentence of 12 years. I did 4 months and the opportunity to get the conviction off my record after 2 years. I just got lazy and saw no need.

Yes, I understand that... The adjustment wording is based on she needs to feel she know how to get around the US. Drive a car, speak some English, get a job, know how to do things around the house and around town AND also adjust to living with one another 24/7. This would all be very difficult if her and her 10 y/o son were both in the same boat. So, it is more of a let's get you adjusted to living here before bringing the lil guy here who is going to have all the same difficulties as her, but now she can help him adjust to life her because she has been through it.


k-3 is not a visa that you can request for a minor child of the beneficiary,its a marriage based visa.you can file up to one year after receiving your k-1 for your fiance's step son.

When can I petition for her son's K-2 visa? After she enters? After she get her AOS?

And for the K-2 the process time is the same as her K-1? (6 months)

This would be what I am trying to get in my head because obviously she will want her son to be with her as soon as possible. So, 3 months to get married, 3-6 months to get AOS, then 6 months to get K-2 visa for her son? That would be a total of 1 year from the time she entered the US on a K-1 to the time her son can arrive here in the US on a K-2....more or less?

My situation is the I am doing some pre-planning on bringing my possible new fiancee to the US using a K-1 visa. I have been through the K-1 process successfully once before several years ago, so I do have some experience filing the paperwork and all on my own.

My question deals with timing of the arrival/entry of my finacee and her 10 y/o son. I would like for my finacee and I to spend some time alone during the 90 days of her visa. This is at her suggestion, which I tend to agree with as there will be alot of adjustment going on and having a young boy along for that ride would make things more difficult. The plan is for her to get adjusted to life here and feel comfortable she can be the one her son can look to for questions once he comes.

The problem is once she is here she can not leave the country till after the AOS is completed, correct? Which could be about 6 months after entry at the soonest. What is the process to get her son here?

Should he be included on the K-1 visa?
Will his visa still be good by the time she can travel back to Colombia?
If he can't come on the K-1 at a later date, how much more time after we get married(within the visa 90 days) can we file a K-3? visa for her son by himself?

Any advice or additional questions for me are welcome.

This issue is one of size, not availability of generic wrong sized passport photos.


Ahh did not read the comment as meaning there was a sizing issue... I would have thought the Government of Australia and it's postal service would provide passport photos inline with the US standards. After another 10-15 minutes of research I found that it is.

At first glance one might think these two requirements are not equal, however after reading the instructions for the US passport (which is used by the USCIS for VISA processing) you will see that the important factor is the size of the head not the photo itself. The Australian Passport photo is smaller in size, but the size of the head is within the requirements of the US Passport.

Just FYI... I typed in Google "Where to get Passport photos in Australia?" and found the top 2 results were from Australia's National Postal Service that has 1300 locations across Australia and they all perform passport photo services for $14.95 for 4 photos.

< DISCLAIMER: Strictly my personal opinion and $0.02 follows. >

1. If you file your own taxes to the IRS or own a business and have done your own accounting...

AND

2. You and your foreign fiancee have no extenuating circumstances (i.e. either of you have a criminal record, your are welfare poor, you have had several VISA requests, her children's father is protesting or anything out of the 'norm')

You can do the VISA process yourself by reading the various form's instructions, READ EVERYTHING in the VJ FAQs and Forums and ask alot of questions to those of us who have been though it. Using a lawyer is helpful if you have alot of extra money to burn or you do not qualify in the 2 bullet points above.

I am currently in the process of my second VISA request and the first went smooth as anyone would want (the marriage didn't goes as smooth as the process tho)... Just follow instructions and when in doubt ask several people and search the internet.

My suggestion would be not to purchase a ticket leaving the day after that 10th day. If something should delay that for a day or two you might get stuck with missing the flight.

Better to reserve a flight maybe a week after that 10th day and do it now to save on the reservation in advance 2-3 weeks and yet still give yourself time in case there is any delays in getting the visa.

My mom is a college professor and last night she happened to be at a work party where she met a colleague who immigrated from Colombia. Her response was: "no no, tell her not to do the fiance visa...do the tourist visa, I have an attorney...we'll do lunch this week". Also, a few weeks ago my fiance talked to an attorney in Bogota who also recommended a tourist visa.


(DISCLAIMER: My tongue in cheek style of writing sometimes comes off as being an A-hole. LOL)

1. Yeah... love it when really smart people are sometimes very dumb. Advice thrown off the cuff without knowing all the circumstances should make you very cautious. A tourist VISA is not easy to get when you are coming to the US from a less developed country. Lots of requirements from the foreign tourist and as you mentioned she really isn't a tourist she actually is your girlfriend/fiancee and you guys want to get married already so...

2. Wedding ceremony in Colombia... agree with all those that say don't do it regardless of whether it is ok or not. I'm not a gambler and doubt you are if I tell you the stakes are have your fiancee here in 5-6 months vs 12-14 months. That is what you might go through if you mess up your K1 petition and have to start over again with a K3 because somebody felt your ceremony was legit and you are now spouses not fiancees.

ALSO

3. Good luck in trying to get any kind of official wedding person perform a wannabe wedding in a latin american country ESPECIALLY in a church. If you do somehow find a way to make this happen let everyone know on VJ because it is a common desire and most times it ends with the foreign fiancee and family learning the crazy rules us Gringos have in the US. You have to wait to be 'married married' in the US... THEN come back and it is much easier to have a 'renewing of your vows' ceremony AKA your wedding once you are already husband and wife.

4. Photos... lots of great responses on that one. Ummm send your finacee a PDF, a link to an official website, write it in a book or sing it in a song, but just tell her the required dimensions and if necessary let Google help ya with the metric conversions. Usually in most metropolitan areas photo studios and other paper sales shops that can do the passport photos just need to be told that these photos are for a US VISA. Those who do these kinds of services know the bigger size needed compared to the Colombian Passport Photo Requirements.

5. As others have said... READ VJ GUIDES! They are awesome... and so are all the posters on these forums. They have helped me successfully complete TWO 129F petitions. If you are totally confused and seem very lost in this whole immigration process then maybe an attorney assisted route is the way you should go. For me, I like to say that if you file your own taxes or have done some accounting for you own business, you probably can read these forums, VJ guides and form instructions and do it yourself.

I know that you can give the DOMESA 'office' that is located inside the Embassy any delivery address you wish as long as the person named on the delivery is there with identification to receive it, whether that is in a hotel in Bogota or some other city.

The problem here would be that you are depending on the Embassy getting it to DOMESA in 3-4 days. besides the delivery I don't know how many days the Embassy itself takes to put the VISA in the passport. It used to take till the next afternoon about 5 years ago.

I noticed as well that there seems to be an unusual lag of time from NOA2 to the time that NVC receives some petitions.

Our NOA2 was dated JUN 8th, but NVC did not receive it until 20 days later... Just harsh.

From NVC receive date of JUN 28th the Embassy had not received the petition when I called on JUL 6th.

Now it would seem that we will not have an interview in the month of August. Guess with the current workload, sending in a packet 3 response prior to the 15th of the month will not necessarily mean you will get an interview date the following month. :(

My understanding is the medical is valid for 1 year from exam date (that is what's listed in my fiance's consulate instruction). I am not sure if the same rule applies to the police certificate. To be on the safe side your fiance may ask the US consulate in his/her country so that they can give you guys the correct guidance regarding this situation.


I think the official position of the consulate is that we can't do ANYTHING until we receive the packet. Of course, if you know exactly what the packet is going to contain, then it reasons that you should be able to start early. Then again, governmental agencies don't necessarily operate on reason.

I'm hoping they'll accept the medical results. If not, it won't be the end of the world to get the medical re-done. However, it would be easier for the medical exam to still be good 5 months from now.

My fiance did the police report 5 months in advance, as well. Does anyone know how long the police report is valid? Has anyone successfully done it in advance?



Police reports and Medicals are valid for one year... The Medical may be a problem or at least require another trip to have information transposed onto the forms you are given in Packet 3. (ETA particularly the DS-3025 which is your vaccination record, which you must keep a copy of for AOS)

For the medical, keep an eye on the timeline once in the USA. If it is over a year old when you adjust status you will be required to take another one. What Im NOT clear on, is whether the medical is valid for one year since taken, or one year form the point of entry into the USA when it is handed over.



We downloaded all the proper medical forms from the Internet (minus one which the doctor kindly provided.) I'll keep an eye on the adjustment of status issue - thanks for the tip.

Well, our "wedding" will consist of filling out a form at the courthouse, lol. We had a nice wedding, reception and honeymoon back in April, though ;)

In your interview DON'T lose your passport at the Consulate, especially when your flight to America is 4 days later, lol.

After all the months of forms & delays, we were so estatic to have the Visa granted ... only to get completely deflated when we learned she no longer possessed a passport. And she couldn't immediately go back to the Consulate, as she jumped onto a train back home right after the interview.

Thankfully, the Consulate found the passport and she got it back less than 24 hours before her flight. It was a nerve-wracking few days though. Thank God for small miracles!

Apparently, the 2 minute interview was a breeze. Thankfully, we went over the paperwork a dozen times in advance.

K-1 Fiance(e) Visa Case Filing and Progress ReportsUSCIS website is not updating my case!
I setup an account on the USCIS website and signed up for the email updates. The website shows our petition as having been "touched" on 5/2, 5/15 and 5/16, but no email notice of the "touches" were sent out.

HOWEVER, on 5/19 USCIS generated an RFE, which they mailed on 5/23. For some reason the RFE didn't appear on the USCIS website, nor was an email notification sent out.

We responded to the RFE, and USCIS received our response on 5/29. Once again, our response was not recorded on the USCIS website, nor was an email notification sent out.

5/16 is still the "Last Updated" date for our petition.

I phoned USCIS and all they could do was read the information off of the website to me (big help!)

*QUESTION: Has anyone else had the experience of the USCIS website not updating their case staus properly? If so, were you able to fix it somehow?

It's great hearing words of encouragement because I just received a RFE Boy did I cry I am so scared that they ask for something impossible... it sounds stupid but it's the stress . seeing your timeline it made me feel better that RFE isn't going to stop the process...... Our RFE was for proof of relationship & having met in person. A few days after mailing the initial application, I realized (from reading this site) that the evidence I provided was a little weak.

Up until now, our K1 Visa application has been very slow going through the process. I've constantly monitored the other CSC applications filed around the same time as ours, and each step of the way, it seems like we were in the slowest 10 percentile. It felt like our application was made of lead or something, and it was very disheartening to see people who filed at the same time, several steps ahead of us in the process.

Anyhow, that all changed these past few days .... praise God! We appear to have made up for much lost time (and may have even set a new speed record) as NVC issued the letter on July 16th confirming receipt of our file from CSC, and her interview is scheduled in Sydney for July 31st .... which is only 15 days from NVC receiving the file from CSC, to her interview date in Australia!

I recently received the I-797 (Notice of Action) which lists a 13-digit Receipt Number begininng with "WAC" followed by 10 numerical digits.

Is this our official case or application number? Will this number follow us all the way through the process?

Specifically, is this the same number that will be used to identify our application in Australia?

We were successfully able to get the medical exam done in advance, as my fiance will be spending the three months in the States while our application is pending. However, the doctor needs the "case number" to put on the medical form(s) to complete & release the medical forms.

I believe the medical exam is good for 1 year. I could be wrong, though. The doctor was very helpful, as she only brought 4 of the 5 required medical exam forms, and the doctor provided the missing one. If we have to redo the medical ... no big deal.
