have been reading here for more than a year, and finally decided to move forward with our lives, so the k1 process is starting hoping to have all done and sent by this next week,
but i do have a few questions

1. i have seen her more than 8 times since 2009 but we do not have pictures together but we do have pics of each of us in same room so u see every thing is same in back ground,
but do have phone records, many plane stubs and copy of passport will that be enough as she is from the Philippines.

2. also packet is almost ready to go fingers crossed but very confused on where do i send it do i send it to the drop box location in tx as i am in seattle washington

Before I filed I had a problem similar to yours. We had plenty of picture together, but in them we were not wearing any clothing whatsoever. I spent many hours carefully drawing shirts and pants on each of us. And the beach pictures were another issue. I was able to get the Bikini looking nice on her, but I tried and tried to get that Speedo to look good on me. I just could not pull it off. So I had to settle for trunks. Darn those extra chili dawgs.

It is entirely up to you which advice you take about sending in that petition without pictures of you two together. I just wanted to add that I have spoken to many on this site and read many different embassy reviews. At the interview, people have reported that they have taken many different types of evidence to prove that they have a relationship; chat logs, phone records, email, photos, etc. Many have said that most of the evidence is never looked at, but they always look and ask questions about the pictures. If it were me I would plan on going there and coming back with at least 100 different pictures of you two together that way you are covered.

What sort of work do you do and is keeping your job making $200/wk + commission and finding another W2 part time job an option? I assume they would count income from a 2nd job assuming it is W2. Perhaps others will answer that. You look like a fit kind of guy. Anything... doorman at a bar to behind the cashier at McDonalds to a helper at Home Depot.... those aren't glamorous options but for 2-3 months perhaps it is worth it.

Tell us what sort of work you do though and people might have some ideas.

Our petition was denied, we were sent a letter and given a chance to appeal, which we did, it was approved and now we're married. Denials aren't the end, we're proof of that.


I was just looking at your timeline. Your appeal only took like 11 days. I thought when someone said appeal that it took several months. If you do not mind me asking what did they deny you for and how did you appeal?

I agree with what Tim is saying. If you are going to spend money for someone to help you might as well spend the extra and get an attorney. That way they are there to help if there are any problems. If you go the attorney route I would also suggest finding one that has an office in your fiance country that way they are there to help your fiance with the paperwork that she will need.

Hello all, I became a member here months back. I've been researching quite a bit, but now that we are in the process of gathering documents and completing forms I have many questions I need to ask.

First and foremost, I just went to Walgreens to see about getting my photo taken, and they told me they cannot give me a digital copy. I realize I don't need one for the forms, but I wanted to send it to my fiance so she could be sure to get her photo taken to the same size/dimensions. Also, the lady working at Walgreens told me that the Visa pictures are a different size than the 2" by 2" passport photos. She said she thought they were 2" by 3". So obviously with all of this confusion I did not get my pictures taken. I wanted to go to a place like walgreens who does this type of thing on a regular basis, but now I'm wondering if there's somewhere else I should go....or if we should just take our own pictures and print them. And why won't Walgreens sell me a digital copy? Any advice on this would be much appreciated.


Secondly, looking ahead we are trying to make some general plans/ideas for our wedding. We really want to be married in her church in Colombia with all her family. Is it okay for us to get married in her country when the K-1 is approved, or do we have to get married in the USA?

I'm going to have a lot more questions in the coming weeks, so I hope I don't get on your nerves! Thanks for your time.


I think you need to go to a different WalGreens. I got mine done there no problem. Walgreens are like pop cans they are all over the place. I think CVS photo will do it also.

I have a question about starting a new job in the middle of the K1 process. The company I work for is not so good. I have been wanting to find a position with another company for quite some time. I have not actively pursued it though because of this K1 visa process. I was afraid if I found another job and had not been on it for long it would be a red flag and hurt the chances for getting the visa approved. We are at the stage where we have submitted packet 3 to the embassy and are waiting to hear back from them. Do you think taking another position would hurt at this point?

We had a similar situation.

A friend of hers started the Visa process a month after her and received the visa a few weeks ago. However this was a visa to Germany. Her friend also used a lawyer. (We are not)

Naturally this brought out all of the "expert" advice and gossip yap yap. :secret:

The bottom line is things are moving along at a modest pace and optimistically on schedule with our plans. Of course this still difficult to wait. It seems like the wait from NOA2 to interview is the hardest.Especially after sending in packet 3 and waiting over 2 months.

We just try to stay positive and not pay too much attention the naysayers.

It does sound like a similar situation. Yes it seems like everyone is an expert. These country side people are an interesting bunch.

It does seem like the wait after the NOA2 is the worst. From what I assumed before the wait for the NOA2 would be the longest part. But it looks like this process with the state department will take longer.

I had hoped to have her here in September. The state fair is in September. I wanted to take her to that. My birthday is in September. I had hoped she would have been here for that. Last year on my birthday we bought some little cakes at the Paragon mall in BKK and ate them in our room. Just the two of us. Best birthday party I ever had. I told myself then that I wanted to make her a huge chocolate cake next year. I think we will be eating that cake sometime in October. I hope she is here by Halloween. October is pumpkin season. We both like to cook with pumpkins.

I heard all of this from the locals as well. These people simply dont know what they are talking about nor the damage they are doing. People tried to tell me my husband could pay corruption money to get my visa quickly for example. Everyone driving a tuk tuk seems to be an immigration expert. Some are refering to immigrating to countries other than the USA. I know a few that went to England which really was faster. Or Australia.


Yes i agree the locals all like to talk and believe they all know more than they do but they are doing more harm than good. The wait is hard enough as it is, but then everytime she sees them they say "Why is it taking so long, I thought you would be gone by now" it brings my fiance down.

Germany is the country that some of them are referring to. There was some girls that went to Germany from her village and it only took them a couple of months. These people from the countryside that our her neighbors and family have a hard time understanding that different countries do things differently I think.

My fiance has seemed more depressed over the last few days about this whole process taking so long. We are getting close to the end. We are waiting for the embassy to give us an interview date now. It really does hurt worse the closer you get to the end.

She seemed really depressed this morning. She says people in the village ask her why it takes so long. They know other women with farang husbands and it did not take this long. I am so tired of hearing and saying things like, "Just hang in there, it will be over before you know it" and "Good things come to those who wait. What do I say to her when she wonders why it has to take so long?

As long as you did not file that marriage with the Amphur’s office then just file for the K1. The embassy in BKK understands this. People actually use pictures of their Thai wedding ceremonies as proof at the embassy interview. The important thing is to not have that wedding registered at the Amphur’s office. The U.S. will recognize it as a legal marriage if you do.

I think a lot of these companies use numbers from a few years ago when things seemed to go a lot faster and I also think they confuse people who are not familiar with the process and just give the times that it will take just for the USCIS approval. The USCIS approval can take up to six months, but the entire process from start to getting your loved one here in the states takes about 6 - 9 months.

HI ALL,

I sent in the I-129F last Monday morning and tracked it to know that it arrived the next day by noon. Now I come to VJ just to see what is going on, read posts, and to keep up on everything.

When I was clickiing around on links, I went to the Bangkok Emabassy site and cliked on the notice that fees were changing as of April 13, 2012. I read on and looked to see what the fee was and will be for the K-1. It says the old fee was $350 and the new fee will be $240. When I got my things together I went to the USCIS web site to see how much I should make the check out for and it says under "Forms and Fees" -scroll down - Petition for Alien Fiancee: that the amount is #340, which is what I sent, but is not the old or new amount posted on the Bangkok site?

So what it it? Thanks for your help.

As L+T said, that is the fee your fiance will have to pay when she has the interview at the embassy. She will also have to pay about 4000 baht when she has the medical exam done.

I have a quick question about how to spell my fiancee's name on the K1 papers. She's Russian so on her birth records everything is Cyrillic. When using the Roman alphabet she always uses a direct translation of her name, Alyona. She lives in Moldova and just got her passport which is in Romanian. They spelled her name Aliona. They also chnged the spelling of her last name, also by one letter. Should I change all the k1 paper so they match her name on her passport or should I countinue to use the translation that she has always gone by?


Use the name that is on the passport. I have spoken to someone who did not do this and it caused him problems.

I was in the same situation that you are in and I had to wait until the six month period was over. Read your divorce petition. If it says that you are not able to marry another person for six months, then you are not legally free to marry at this point and you are not able to file the petition until you are legally free to marry. So you have to wait until February to mail it in.

As some of the others have stated you will need the birth certificate translated into English for the Adjustment of Status here in the United States. It would be wise to have a couple of extra copies translated there before you come. However, there are translations services here in the United States that you can use. That is what I did and we had no problem. I think it cost $30.00.

There is NO SUCH RULE. Free to Marry and Legally Divorced is what the requirement is for applying for a NEW 129-F. But, caution: The 3rd attempt is not so simple.

2 year rule as it pertains to petitioners filing I-129F:

IMBRA regs state that you cannot file more than 2 I-129Fs in a 2 year period.
If you are filing #3 within that 2 year period, you must ask for a waiver, via written letter attached to the I-129F submittal.

Usually the best idea is the simplest and to me the simplest way would be to take care of the arrears and get your passport back. That is what I would be focusing my efforts on. Not taking care of the child support issue might come back and bite you later on in the Visa Process, so I think it would be best to get that straightened out first.

You have to show proof that you two actually met in person. One of the best proofs is your passport with stamps from her home country in it. My wife came here on a K1 and the only proof I gave was pictures of us together and my copies of my passport with the stamps of her home country in it.

My Fiancee was curious about what she might expect during her interview when it shall come and I really could only give her a guess as to what may come her way during the interview. Such things as "How did you meet your Fiance?" "When did you meet him and when did you meet him in person?" and perhaps "He is divorced, do you know his children's names and his ex-wife's name?" But I really couldn't think of anything else, but surely there are many more questions than that. If you are a Filipina and have gone through this interview, we would greatly appreciate your input on this matter. Thank you in advance for your replies.

that's ridiculous. Not everyone has a digital camera, (me), and if you are including pictures from the past, you weren't necessarily thinking then ... hey, I'd better put dates on these when I print them, in case I ever lose my mind enough to go through the K-1 process.


That is just what I was thinking! Some of our photos were taken with my old camera which printed the date. Our more recent photos were taken with my new digital camera--but I hadn't read the booklet when the pictures were taken, so the date didn't get printed on the photos. Besides, like you said, at the time we were not thinking about requirements for K-1.


Our photos were taken on a very old 35mm camera. By the time I got back from my visit to see my Fiancee, I had no clue on what date did I take this picture on or that picture on. #######, I should've logged everyday I was there in some sort of jounal.

My Beloved Joynelyn and I thought that she might have become pregnant during my stay in Cebu City, because she had missed her period in the middle of my visit. Thankfully a week after my visit she began her period again and so we figured it was just nerves that caused the change in her period. Why did I say thankfully? Because it was the last thing she needed was to be alone, waiting on the Visa process and expecting a baby. It is hard enough being alone and waiting.
