K-1 Fiance(e) Visa Process & ProceduresCalifornia/Texas NOa2
The USCIS says that the I-129f Visa usually takes about 90 days to be processed.
The VJ estimate date for our petition to be adjudicated was about ten days later then
the actual date that it was approved, but they can only go by the numbers that people
place in their timelines and some choose not to do so. In our case it took 82 days
from NOA1 to NOA2. In our timeline, VJ says our case took 91 days to be approved,
but their counting of the days begins on the day the petition was sent to the
service center and not when we received our NOA1.

Hope that helps. Good luck on your journey!

IR-1 / CR-1 Spouse Visa Process & ProceduresPls help me...Im a father of 2

so ill marry her when i get back there then petition her right? then i can always update my petition once i become citizen right?

Correct,

You will petition her as a spouse of an LPR (F2)

Family Second Preference (F2): Spouses, minor children, and unmarried sons and daughters (over age 20) of lawful permanent residents. (114,200) At least seventy-seven percent of all visas available for this category will go to the spouses and children; the remainder will be allocated to unmarried sons and daughters.

Once you Naturalize you can have the petition changed to an IR-1

Immediate Relatives of U.S. Citizens (IR): The spouse, widow(er) and unmarried children under 21 of a U.S. citizen, and the parent of a U.S. citizen who is 21 or older.

hi im youngdaddy from texas... i am soooo sad!

i feel envy with people here announcing their petitions getting approved left and right as someone said that line... u guys are so lucky.

im a permanent resident here. i arrived here 4 months ago.. and ive been missing my girlfriend and kids so bad. we are not married and i cant figure out how to petition them.. pls help me.

i am visiting philippines next year and i wonder if im marrying her then file a petition when i get back here? or is it advisable i wait for me to be US citizen then marry her and petition them which is 5 years from now... i dont know which way to go. which one is faster? im longing for them everyday... i got two boys thats waitin for me to play with them. im like a kid crying all the time.

i didnt marry her because of this visa i needed to stay single. that was my case...im sure someone does too.

im not sure if this is the right room... but i need to let it out.

Once you and your fiance are married, you, as a lawful permanent resident, may petition her using an I-130. Permanent residents may not petition non-related persons. Also, your children may be included in the filing for your spouse.

K-1 Fiance(e) Visa Process & ProceduresLonely Daddy...Unmarried..Clueless!

rosyanne,

For the avoidance of confusion, he has to become a citizen in order to petition for a K visa. He does not need to become a citizen to petition for immigrant visas for his (future) wife and child (although the wait will be shorter if he is a citizen).

Yodrak

The fiance/e visa can only be petitioned by a US citizen. I believe that is also the case for a K3 (spousal visa).

Yup!
You have to become a citizen first and then apply for her and your kid.

RIGHT! SO HERE'S WHATS ON MY MIND... IM GOING BACK THERE NEXT YEAR AND MARRY HER. ONCE I GET BACK USA, APPLY THE PETITION AS SHE IS MY SPOUSE ALREADY TOGETHER WITH THE KIDS. THEN IF I BECOME US CITIZEN, UPGRADE THE PETITION! CORRECT????

She is 22 and I'm 21. We meet the poverty guidline. I make like $14000 a year tax free with my disability alone. And the Living Expense Pension (VA gives for college)...or my GI Bill is more than enough. Or I could work making just an extra $4000 a year....which isn't hard. Especially in the summer.

I met the guidline for 2008.

I will for 2009.

i need to know if I'm doing things correctly.

I'm alittle worried about these first forms.

I-130, G-325a (dont want lawyer...I'm just a college student)

I had a sorta screwed up a COLOR SET of G-325a. Went online instead to print off and complete...but did hear rumors that the USCIS is ####### about that.
So I cut out the little strips that show the NUMBER and RED LETTERING of where to send it...the different colors. And stapled the matching colors with the matching white forms (from the internet). yeah i know its wierd.

Also my I-130 is double sided. Both pages are the same sheet. Sending them 2 original filled out forms and also 1 for me and 1 for the wife...(records)

USCIS, Me, and Wife are keeping (1 original filled out/signed G-325a set thats 5 pages) So she has mine...and I have hers.

REGARDS to the G-325a

1. We are dating the SIGN date the same
2. making sure out PHOTOS attached are dated the same
3. The photos show our whole face, and ears, as appears on the passport we have.
4. Its that 1 inch chin to head rule...maybe like 1 1/4 inch
5. Her g-325a where needed...is matching with mine.
6. We filled out the part OTHER (I-130, CR1)
7. Didn't abbreviate ANYTHING...attached a separate sheet typed...if not enough room (signed and dated each one same as me) each G-325a

My G-325a is alittle odd.

1. I'm adopted (Naturalized and had different legal name)
2. Have had to attach another sheet for both RESIDENCE and WORK Listings.
3. I retired from the USAF Medically July 2 2007 at a very young age...family couldn't help and I didn't have college yet.
4. So I was hoping around from job to job and place to place...whereever the better money was. Some places I don't have a lease aggreement.
5. I stayed with friends. Moved closest to my job at that point. Was leaving jobs cause I went into high demand positions with no education or experience in them.

Went to see fiance June 30-August 15. Married July 31st.

Thing is I didn't wana get stuck with a huge lease and no where job....when college started after my marriage.

But now I'm stable.

Signed 6 month lease at apartment 1 mile from college.
Have VA Disability and Adjustment Living Pension coming ($17000 yearly/tax free)
College is Paid for 100%.
Going to 17 college credit hours. (Nursing)

also not mentioning my $6500 made this year after taxes from work.

1. How do i get around the RESIDENCE and WORK issue?
2. Will they accept my VA Disability...cause I'm not allowed to work right now.
3. Tax Return won't reflect the INCOME NEEDED TO SUPPORT. I recieve a huge majority from the VA. Not taxable.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 approved, What documents should I start on??
i sent everything off 10-9-08.

I think I overdid the application with supporting evidence. Also included an original marriage certificate.

4 different G-325a forms filled out. My wife and me both did a set.
Included the 2 photos for each (printed name, signed name, and date on back) 2*2 passport style.
Includes cover letters and continued listing of employment, residences past 5 years....

I've moved around alot cause i was recently in the military and recently also discharged medically...so trying to spend a year adjusting.

Filled out the I-130 with a check ($355) and original marriage certificate notarized philippine government NSO.

Have several folders with HUGE LABEL on what it is. Lots of supporting documents in each.

Proof of Marriage
Proof of Flight/Trip
Proof of Identity (wife)
Proof of Identity (husband)
Proof of Citizenships (our passports)
Proof of parental awareness and acknowledgement of marriage (both our parents) Legal Afidavits
Proof of my Resident Address and Mailing Address
Proof of my military service, medical discharge, retirement pay, va disability compensaton, va fully paid education, current college enrollment, went as far as to include my copy of the UNUSED GI BILL and High School Diploma.

We're both 21-22 so we don't have the financial abilities some of you have. But I make $14000 a year alone just on my VA Disability. The rest $4500 needed comes easy to achieve in the year.

If i did everything correct the first time...and included more than enough evidence they want...shouldn't my case go fast?

Your VA comp works, your chapter 31 voc rehab is just a tempory payment, based on your going to school. Unless you take summer classes you wont receive it in the summer. Unless you can swing it with the VA Chapter 31 is only good for 2 years unless you can get a waiver. GI bill...doesnt count. I sugest if you cant work and are 100% service connected with the military you should be getting $3000 a month from the VA. Get with the DAV and fight for your benifits.

VA Disability Pension, VA Vocah Rehab Living Expense....they all give me extra stiffen for being married.

So essentially its a form of financial support.

My VA Disability is $15,000/year no taxes.
Voc Rehab is $5000/year no taxes.
GI Bill is going to do the same thing Fall 2009....financial support for Living/married couples.

I'm still getting paid regardless and for being married too. It meets the poverty guidelines.

IR-1 / CR-1 Spouse Visa Process & ProceduresCR-1 questions
My wife is Japanese and I'm American military. We got married in Japan a couple of months ago, but now I'm stuck back in the states.

I submitted the I-130 package a few days ago through mail.

I read a lot of the information on this site but I was hoping someone could explain the options a little bit better so I don't screw it up.

What's the next step? I know they'll send me a form to acknowledge receipt of the I-130, but then do I submit paperwork for the K3? I've been reading that it's slower than the CR-1, but I don't know.

What exactly is the CR-1? What paperwork do I need to do to get that started? I clicked on the FAQs for that process and it just described the stuff that I did for the I-130 and then the follow up with my spouse for interview and paperwork in Japan. Is that it? The CR-1 visa is basically just submitting the I-130 and then kicking back until they get to the point of working with my spouse at the Japanese embassy?

I just want to make sure that I"m not just kicking back when I should be doing something proactive. Perhaps it would be beneficial to submit the K3 anyways right after I receive confirmation for the I-130...that's what I was reading a lot on this site, but I'd appreciate any insight people might have.

I'd really like to try and get my wife here by April...might be a stretch, but I have to be optimistic. I've left her for 8 months before when I went to Afghanistan, but at least I knew when I could see her again as long as I didn't get killed; now I'm at the mercy of the system, and it's frustrating

Take care

V/R

Thanks for the reply

So the birth certificate and marriage certificate have to be originals? what good are the two copies of the package then; if they lose it, I don't have originals in the two copies.

Also, I was told I can't open the police certificate envelope, so I can't make copies.

I've paid the IV fee so now I have to send out the package. I filled out the DS-230, but I want to make sure I include the right forms and documents.

What documents are needed and which ones need to be originals?

After the NVC receives this package, do they send it to the embassy for the interview?

Does my wife need similar documents or should they all arrive in the package when she goes to the embassy?

I don't know how she can have a duplicate package if they want originals sent in...not too comfortable with that either.

Please let me know what I need to include in the package apart from the DS-230 form and the paid cover sheet. I've been searching the forum, but haven't found anything to completely clarify this for me

A little more information:

The cover page listed from VisaJourney specifies the following documents:
Please find enclosed the following documents:

1. Bar-coded cover sheet
2. 2 Passport-sized photographs of the beneficiary
3. Completed and signed form DS-230, Part 1, by the beneficiary
4. Completed and unsigned form DS-230, Part 2
5. Photocopy of the biographic data page of the beneficiary's passport
6. Certified birth certificate of the beneficiary
7. Certified marriage certificate of the beneficiary and the petitioner
8. Original police certificate(s) of the beneficiary

Also enclosed are photocopies of the following documents:

1. Photocopy of the biographic data page of the beneficiary's passport
2. Certified birth certificate of the beneficiary
3. Certified marriage certificate of the beneficiary and the petitioner
4. Original police certificate(s) of the beneficiary

It lists birth certificate and marriage certificate under documents and then under photocopies, so do they need originals and photocopies?

Also, it lists police certificate and photocopy, but my wife said that the certificate she sent me in an envelope cannot be opened by me. So, I guess I have to just send them the envelope with the package and it will make its way to the interview?

Ehhh...no wonder people come to America illegally; the legal immigration process is insane..hehe

The police record I got for my wife from Japan says that it can only be opened by the US authorities (it's in a sealed envelope). Is this common for other countries too? Everyone says to make copies of the package and send them to my spouse for the interview, but I can't make copies of the certificate if I can't open it. Anyone else done the Japan embassy immigration?

IR-1 / CR-1 Spouse Visa Process & ProceduresFinally got a visa

With a CR1 or IR1 visa, there's not status to adjust to. She'll enter with permanent residents status and be mailed a green card good for 2 or 10 years depending on whether you've been married more or less than two years upon entry. Green card and SS card usually arrive automatically within a month. She'll need to provide both with her I-9 form when she becomes employed.

Cool, thanks for the info. Can she use her visa stamped as temporary green card for working; I heard something like that once. Just wondering

IR-1 / CR-1 Spouse Visa Process & ProceduresDoes the US recognize Muslim marriages?

There comes the catch! The muslim marriage was and is a marriage all the same and the immigration forms want the status of all prior prior marriages. Since the marriage under Sharia Law was then and is still valid and since the other marriage is now dissolved does that not leave a valid marriage that occurred in 2006.

IR-1 / CR-1 Spouse Visa Process & ProceduresDoes the US recognize Muslim marriages?

I am a US citizen, my wife is Philippine national. We met in Kuwait and were married under Muslim law in 2007, The marriage was not registered as a civil marriage with either the Philippine or US embassies as I had a civil wife in the US and she passed away in October 2012. My Philippine wife and I have two daughters the first born in Kuwait in 2009 and the second born in Uganda in 2010. Both daughters have their US citizenship and Social Security cards. We were married again in a civil ceremony in the Philippines in November 2012. Will the US recognize the earlier of the two marriages? We are here seeking the best approach to get my wife permission to live in the US. We would greatly appreciate any advice. Given the circumstances there may be more than one approach.

K-1 Fiance(e) Visa Case Filing and Progress ReportsFinally, Tears of Joy... 129F Approved!!

Congrats!

I have one question though, your profile says you filed for K-1, but you said you called your "hubby"? Is he your fiancee or husband? I saw here that people had problems on K-1 visas if they called each other husband/wife and that petitions were declined because CO at the Embassy thought the couple was married and filed incorrectly. :/

Congrats!

However, you might want to remove this image or blur the visa details at least? I can read your last name, visa number, etc.

hello to everyone, I am a new member and I'm looking for some advise as to what would be the fastest way to get my fiancee in the USA?
Hi.

I know this is a late reply and I'm a new member so you might prefer advice from someone more experienced, but nobody replied so far, so maybe it will still be helpful.

From what I've read (and I have been reading for days now) the fastest way to do it would be K1 (Fiancee visa). You can check the guides here for K1 and K3 (Spouse visa) and decide for yourself what you'd prefer doing.

Either way, good luck to you and congratulations!

Middle East and North AfricaWhat was it like to see him for the first time?

Hi again everyone. I know I spend a lot of time caught up in the practical things that need to be done in this process. But I also often find myself daydreaming about getting off the plane and seeing him for the first time. And I really wonder what that will be like. So I am asking - what was it like to walk off the plane and see him (or her) for the very first time?

I am not in the MENA section, but this question seemed quite universal. I flew to the US first to meet him not knowing if we would end up being friends in RL (no "chemistry"?) or boyfriend/girlfriend. I saw him first, leaning on the wall and using his phone. He was texting me, asking where i was (my plane was late).

I came to him and we hugged without saying anything except Hi. The hug took a while. I kissed him on the cheek instinctively, without any plans to do so and then I had a short freak-out moment about that and if it was okay and what he would think. I decided to play it cool and act as if that was a normal thing to do. Within 10 minutes, after our second real kiss, it totally was. :D

I was thinking of doing this as well. I'm very interested in what replies you will get and if you decide to do this, tell me if it was successful.

Good luck on your journey. :star:
