My husband is the USC, we just sent our I130 last month. We only have one joint bank account (new, we each have our own older U.S. bank accounts on the side) and I am added as a non-driver to his policy. The insurance company requested this after they found out he got married.
 
He tried to add me to something work related (I'd say life insurance through work but I am not 100% sure) and they would not do it without a SSN.
 


I would pick a fight with the health/benefits plan.  Marriage is a "qualifying event" and if you do not get her enrolled within the limited number of days from the "qualifying event" you will have to wait until next years enrollment.  I had to pick a major fight and they finally added her pending a SS number.


Can you explain this please?
 
I don't think it makes sense that he adds me to his health insurance since I am not there (it is not free), but I would like to understand more about qualifying events and waiting until next years enrollment.

I had to submit her passport so I could get a tax number for her. We have filed jointly for two years now

I submitted a copy (verified by the US Embassy as identical to the original) since I did not want to send my passport in. I am sorry this happened to you. :(

 

I would not worry about different numbers. Different passports have different numbers. I have not seen a country where two passports will have a same number yet. If the Embassy asked for a new one, bring them the new one and that's it. smile.png

 

She will ge in the US soon, congrats!

I presume she was issued a tourist visa by US Embassy. For CR-1/IR-1 you have to send the papers to USCIS first, then to NVC and then at the end they go to the Embassy again. The fact that she has a tourist visa does not mean anything in the process, neither does the fact that her Embassy already saw her birth certificate.

 

I am sorry this is an inconvenience for you, but it will be needed.

Hi Mike,

Unless I understood incorrectly, "the consular route" or DCF is not an option for you. You stated in your first post that your wife went to the US in January. Is she still there? DCF is for couples that both live abroad, in your case your USC wife should live in the UK with you.

If your wife lives in the US and you are in the UK, you have to do the oldfashioned IR-1 route.

My husband and I got married in 2012. We filed Married filing Jointly for 2012. I filled out w-7 form (i think?) and requested an INIT. My husband could not e-file because I did not have SSN/INIT so we sent it via snail mail. Took over 6 weeks to get an answer, I was assigned an INIT and our tax return was processed as Married filing Jointly. I did not live in the US in 2012 or 2013.

 

For 2013, we plan to file Married filing Jointly again and use my INIT instead of SSN. I am still not living in the US.

No. We did not send any of that. If needed, we will provide an email to and from one another per, say, 3 month period. So that would make it 8 emails per year. Enough to show the communication continues.

We called NVC once a week a week after the documents were shipped. We got information the case was received on April 7th, but it took until May 6th to get the case number assigned and we found that our when we called again on May 7th.

 

So, yeah, with the way NVC is going now, I'd say they should wait. They can call every now and then, but no point in calling every day until 30 days expire I think.

 IVY, you said they saw in the computer you have a pending i-130? and they jsut wanted to know that you would return? usually thats the risk... i mean as long as you are going back to your home country, they dont mind. its if they feel you are a risk and wont leave in time, then they are not so sure and send you to secondary is my understanding.

He asked me why I was not moving to my husband, why I was just visiting for Christmas. I said I am still in school in my home country, but I want to move to the US after I finish school in Fall 2014. I told him I had my a photocopy of my notice of action if he wanted to see it, he said he knows I have everything, so he is not asking me for anything.

 

I do not know if he meant "I see you have submitted I-130 in the computer" or if he meant "I see you always had the documents required of you when other officers interviewed you". In Dec 2011 I told the officer interviewing me for my B1/B2 visa the 6 year plan including: marriage, grad school, CR-1/IR-1 and filing for citizenship. I figure she made a note of it in the system, as this is the second time they refused to look at my documents referencing to whatever was written in the computer.

 

It is quite possible he could also see a pending I-130, but I just do not have enough information to conclude that is the case.

Kudos for the thread, we needed this. Here's my personal experience, with information of my flights since becoming engaged (a fact that was known both to the officer issuing my visa and to the people interviewing me at POE), since the marriage and since submitting I-130.
 
 
Engaged in September 2011, I requested a new B-1/B-2 visa while we were planning a wedding in Croatia. Approved, 10 years.
? US | Feb - Mar 2012 ? 3 weeks 



 

 

Married in July 2012 in Croatia. Note: I-130 not submitted at this point. I get asked why, I say it does not fit our plans yet because of my Graduate school.

? US | Aug - Sept 2012 ? 4 weeks
? US | Feb - Mar 2013 ? 3 weeks

 

I-130 submitted in June 2013.

 

? US | Aug - Sept 2013 ? 5 weeks

 

Purpose of the trip: to visit my husband, will go back to school in Croatia. No questions about I-130, no additional documentation to show ties to my home country. I had to show my return ticket for the first time since 2011.

 

? US | Dec 2013 - Jan 2014 ? 3 weeks

 

This time I was asked why I was not moving here on an immigrant visa, I said we submitted I-130 and that I had my NOA1 if he wanted to see it. He said he knows I have everything, so he is not asking me for anything. I did not have to snow my NOA1 or return ticket or any other documentation (I had none, so good, lol).
 
 
Do keep in mind that my last trip was my 7th trip to the US, I never overstayed, have been getting maximum stay allowance the last 5 trips, am on my third B-1/B-2 visa and the visa itself is valid for 10 years. All of those things go in my favour, so I travel around with my marriage certificate, NOA1 and return ticket, no ties to home except my word that I attend a university in my country.


 

I am not saying you should travel without strong ties to your home country, I am just saying that those were not necessary in my case.

I've been a member for quite some time, but hadn't visited much until I recently sent our I-129f petition in just a little over a week ago. Even though Joynelyn and I have only just begun our journey in this process, I have a long range question.

O.K., let us just say that everything goes well and after she receives her Visa to come to the U.S., I shall go to Cebu City, Philippines to accompany her home. But while I'm there in Cebu we marry there so that family and friends can be a part of our union. Now we are married, but she is entering the U.S. under a Fiancee Visa. Is this a problem? I mean, when does the 90 days start, from the time the Visa is granted or from the time she actually arrives in the U.S.?

Hello All,

O.K., we sent in our petition for my Beloved Joynelyn's visa, but something took place the other night at her boarding house that has us wanting for her to change her address. You see, where she lives is actually a business, but they have two rooms that they rent out to boarders (4 to a room and only women and girls). At night there is no one there for security. Last night a boarder there discovered some men building a human ladder to reach the second floor where the rooms are and my Beloved's room is the room that has the window. Now this is in the Philippines, Cebu City to be exact, and the window isn't really a window. I mean, it has no glass or lock, but only a screen. I stayed with her on the phone to comfort her until her cell phone battery ran out. Today when I finally got in contact with her again, we discussed how she should move to a better secured place. So here is my question. What problems could this cause with our petition for her visa? We don't even have a case number yet, as we haven't received our NOA1 at this time. Actually, while writing this I realize that all I probably just have to do is inform immigration to the change of address, but will this cause any delays?

Well, at this time she is shopping for a t-ball aluminum bat as I asked her to do, so that she may greet any possible intruder at her window.

I believe the CSC was stuck on Nov. much longer then they have been on Dec. 31. I suppose it all depends on how many petitions they receive at any given time when it come to how fast they can process them. If you check your timeline, there is an estimate down below of when your case may be adjudicated.

God, I was so sorry to read this post. My tendency would probably have been to first try to salvage the relationship by competing for her heart against any other suitors. Perhaps this was what she wanted. But who really knows what is in her heart now. From what I can tell, you were willing to do your all to prove your love for the one you believed in and that shows a great deal about your character and you deserve to find your true love. I wish you better times ahead.

Have her get a picture taken with a digital camera and send you the .jpg file. Print the picture out at a drug store. I did this and it works fine.



I would be worried about that suggestion. There are requirements for the picture and if you dont get it right they are going to give you another rfe or deny your petition. i would go somewhere where they know how to take passport style photos.
Hey if it worked for you than thats great but i woudn't chance it. i'd be worried the whole time if it were me.


The picture was taken at a kiosk in Thailand where they make passport photos. They did it with a digital camara. My picture was taken at a kinkos, again with a digital camera. All you need to do is take the jpeg file to a Walgreens or other digital photo print kiosk and you have an official picture on real photo paper that is 2" x 2". Nobody uses film anymore.
